II, LOT 15 Mr. Wiedenfeld wishes to do a revision of plat involving subdividing Verde Park Estates, Sec II, Lot 15, the existing well lot within a residential subdivision, into two (2) parts. The lot size is only divisible by 1; therefore, it cannot be subdivided. Mr. Weidenfeld feels that this is a commercial situation; but, our rules give consideration to a; Commercial Development, not a residential development. Kerr Cbunty Subdivision Rules and Regs section 5.01.11. reads as follows: 5.01.H. Commercial Development Subdivision: Commercial development subdivisions shall be subject to the Kerr County Subdivision Rules and Regulations. Certain provisions contained herein may not be applicable and will be reviewed on an individual or case -by -case basis by Kerr County Commissioners Court. Section 5.01.1. and Section 5.01.E may not be applicable for commercial development subdivisions. A water utility and a waste water disposal plan must be submitted and approved and sealed by a engineer licensed in the State of Texas knowledgeable in water utility and waste water utility design. It is my opinion that this proposed revision does not fit a Commercial Development, and that Mr. Weidenfeld is subject to the same rules as any other property owner in this residential subdivision. There is an existing residence on this Lot with a License wastewater system that he rents out. He wants to sell this but he ineeds to retain a small portion, with the well, by fee ownership. Existing right now, Verde Park Blvd is a dead end streei that neither the School Buses or BFI can turn around on without driving on public property. The existing Lot is 2.72iacres, and by county regulations it can only be subdivided into one residential lot and that is what we are proposing, one residential Lot with an additional well site. Along with this Charlie would be willing to dedicate a Kerr County spec. Cul De Sac for the road.
