The lone bid from Rubio Construction (who built Phases II and III) came in greater than available funds, so must be rejected. The plan is to authorize project engineer to modify plans and specifications to extend the line up Lydick Lane to pick up some additional users who are in the process of being qualified by GrantWorks. The plans modification and rebid makes Southwind MHP as the base bid and Ranchero Road and Quail Valley as alternate bids. Modifications, when completed, will be forwarded to City Engineering for sign - off. The bids will be publicly opened and read aloud at 9:15 AM on Monday, July 26 2010, during Commissioner's Court at 700 Main, Kerrville, Texas 78028. This project is being funded by the Texas Community Develoment Program, Texas Department of Rural Affairs, TxCDBG Contract No. 728065. Bids are invited for several items and quantities of work as follows: Construction of 6 -inch and 8 -inch gravity wastewater collection system, service laterals, septic tank mitigation, manholes, bore under pavement, cutting and replacing asphalt, dewatering, testing and all other items included in construction documents and as necessary to complete the project. Each Bidder should visit the site of the proposed work and fully acquaint himself with the existing conditions there and should fully inform himself as to the facilities involved, the difficulties and restrictions attending the performance of the contract. The Contractor, by the execution of the contract, shall in no way be relieved of any obligation under it due to his failure to receive or examine any form of legal document or to visit the site to acquaint himself with the conditions there existing. The County will be justified in rejecting any claim based on lack of inspection of the site prior to the bid. A bid bond in the amount of 5% of the bid issued by an acceptable surety shall be submitted with each bid. A certified check or bank draft payable to the County of Kerr or negotiable U.S. Government Bonds (as par value) may be submitted in lieu of the Bid Bond. Performance and Payment Bonds — construction contracts in excess of $25,000 will require a payment bond and those in excess of $100,000 will also require a performance bond in the full amount of the contract. The failure of the successful bidder to execute the agreement and supply the required bonds within ten (10) days after the prescribed forms are presented for signature, or within such extended period as the locality may grant, shall constitute a default and the locality may, at its option either award the contract to the next lowest responsible bidder, or re- advertise for bids. In either case, the locality may charge against the bidder the difference between the amount of the bid, and the amount for which a contract subsequently executed irrespective of whether this difference exceeds the amount of the bid bond. If a more favorable bid is received through re- advertisement, the defaulting bidder shall have no claim against the locality for a refund. There will be no pre -bid conference. Attention is called to the fact that not less than the federally determined prevailing (Davis -Bacon and Related Acts) wage rate, as issued by the Texas Department of Rural Affairs and contained in the contract documents, must be paid on this project.
