"BUSTER" BALDWIN, Commissioner Pct. 1 24 WILLIAM "BILL" WILLIAMS, Commissioner Pct. 2 JONATHAN LETZ, Commissioner Pct. 3 25 DAVE NICHOLSON, Commissioner Pct. 4 2 1 On Thursday, February 12, 2004, at 1:00 p.m., an emergency 2 meeting of the Kerr County Commissioners Court was held in the 3 Commissioners' Courtroom, Kerr County Courthouse, Kerrville, 4 Texas, and the following proceedings were had in open court: 5 P R O C E E D I N G S 6 JUDGE TINLEY: Let me call to order the 7 special emergency Commissioners Court meeting that was 8 posted for this date. The item on the agenda is 9 consideration and discussion of authorization of signature 10 on all documents for employee health insurance. The -- I 11 think the immediate thing before us is an application for 12 stop loss insurance that's been presented from Monumental 13 Life Insurance Company. I see that we've got the Treasurer, 14 who's also our employee benefits officer here with us today. 15 Ms. Nemec, are you satisfied that the -- the application 16 that is before the Court at this time conforms to the -- the 17 proposal that was submitted by E.B.A. and Bryan Finley 18 Insurance, and upon which the award was made? 19 MS. NEMEC: Yes, sir. And I think Tommy 20 investigated that a little bit further and gave us a copy of 21 his response to it, also. 22 JUDGE TINLEY: Okay. 23 MS. NEMEC: I have the original application 24 here. 25 JUDGE TINLEY: Okay. But you're satisfied it 2-12-04 3 1 conforms? 2 MS. NEMEC: Yes, sir. 3 JUDGE TINLEY: Okay. 4 COMMISSIONER LETZ: I make a motion that we 5 authorize the County Judge to sign the application. 6 COMMISSIONER WILLIAMS: Second. 7 JUDGE TINLEY: Motion made and seconded that 8 the Judge -- County Judge be authorized to sign the 9 application for excess loss insurance to Monumental Life 10 Insurance Company as presented and confirmed by the 11 Treasurer. Any further question or discussion? 12 COMMISSIONER WILLIAMS: One question. 13 JUDGE TINLEY: Yes, sir? 14 COMMISSIONER WILLIAMS: Is that the only 15 document that remains unsigned? 16 JUDGE TINLEY: As far as I know, it is. I'm 17 not sure. 18 MS. NEMEC: There'll -- this will probably be 19 followed by a -- a contract that would need to be signed. 20 This is just the application. And I believe maybe, once 21 they receive this, then there will be a contract that will 22 need to be signed. 23 COMMISSIONER WILLIAMS: Do we need to amend 24 the motion to include the subsequent contract? 25 COMMISSIONER NICHOLSON: Might as well. 2-12-04 4 1 COMMISSIONER LETZ: Yes. 2 COMMISSIONER WILLIAMS: Let's do so. 3 COMMISSIONER LETZ: I amend my motion 4 accordingly. 5 COMMISSIONER WILLIAMS: I'll accept that 6 amendment. 7 JUDGE TINLEY: All right. Any further 8 question or discussion? 9 COMMISSIONER BALDWIN: Comment, Judge. I've 10 seen a lot of things in here that -- that befuddle my mind, 11 but the one today is why the County Attorney is not raving 12 mad that we haven't signed our insurance and why we're not 13 pursuing our insurance program until today. I mean, where's 14 the anger? Where's the outrage? That's all. 15 COMMISSIONER WILLIAMS: I guess we'll have to 16 ask him. 17 JUDGE TINLEY: Anything further? All in 18 favor of the motion, signify by raising your right hand. 19 (The motion carried by unanimous vote.) 20 JUDGE TINLEY: All opposed, same sign. 21 (No response.) 22 JUDGE TINLEY: Motion does carry. Let me 23 make real sure that what I've got here is -- I don't want 24 half of mine mixed up with this, you know, which is what I'm 25 trying to avoid. These are different pages. There's Cobalt 2-12-04 5 1 and Monumental here. See? That's the same as that one. 2 COMMISSIONER LETZ: Right. 3 JUDGE TINLEY: I think this one goes there. 4 I think that's what goes there. But apparently I'm missing 5 one page. Here's a Cobalt stop loss quote, but -- okay, I 6 think we got it. Anything else to come before the meeting? 7 If not, we'll stand adjourned.
