ABLES, 216th District Judge 25 2 1 On Thursday, October 28, 2004, at approximately 2:25 2 p.m., an emergency meeting of the Hill Country Juvenile 3 Facility Corporation was held in the District Courtroom Jury 4 Room #1, Kerr County Courthouse, Kerrville, Texas, and the 5 following proceedings were had: 6 P R O C E E D I N G S 7 JUDGE TINLEY: Let me call to order the 8 special emergency meeting of the Hill Country Juvenile 9 Facility Corporation posted for 2 p.m. on this date, 10 October 28, 2004, second floor of the Kerr County 11 Courthouse, Jury Room Number 1. We're a bit late getting 12 started; I apologize. The item on the agenda for today is 13 to consider and discuss a temporary continuation of a lease 14 agreement between the Hill Country Juvenile Facility 15 Corporation and Kerr County. I would represent to the 16 Facility Corporation that we're in the process of trying to 17 acquire the facility, and as part of that overall process, 18 the Kerr County Commissioners Court has agreed to continue 19 the lease agreement with Kerr County, and also the operating 20 agreement that -- that Kerr County has with the Juvenile 21 Board, which will be the subject of another meeting, on a 22 temporary basis, so that the facility can continue to 23 operate essentially on the basis that it has been operating 24 for this -- during this past month. But, in order to go 25 forward with the attempted acquisition, why, the County has 10-28-04 jfc 3 1 entered into an agreement in principle, and I think we've 2 about got the -- the terms of the interim agreement worked 3 out. But, at this time, I would consider a -- a motion by 4 which the facility corporation continue the lease to Kerr 5 County, Texas on a temporary lease arrangement, as has been 6 occurring during this past month, pending the efforts to 7 acquire the -- the lease would be until December 31, unless 8 it were terminated earlier by 30 days prior written notice, 9 and continuing on successive one-month periods thereafter 10 upon 30 days prior written notice on a month-to-month basis. 11 Do I hear a motion to that effect? 12 JUDGE PROHL: I have one question. 13 JUDGE TINLEY: Yes, sir? 14 JUDGE PROHL: And they're agreeing to cover 15 the operating expense for salaries and costs and vendors and 16 so on? 17 JUDGE TINLEY: No, it's as per the previous 18 one. We're -- Kerr County would be responsible for the 19 ongoing operational -- 20 MR. EDWARDS: That's what I meant. 21 JUDGE TINLEY: -- expenses, and to the extent 22 that -- that it's not generated by revenue, Kerr County, 23 Texas, is obligated for those. 24 JUDGE PROHL: Then I move it. 25 JUDGE TINLEY: Okay. I'll second that 10-28-04 jfc 4 1 motion. Any question or discussion on it? All in favor of 2 the motion, signify by raising your right hand. 3 (The motion carried by unanimous vote.) 4 MR.
