ABLES, 216th District Judge 2 1 On Thursday, December 2, 2004, at 7:30 p.m., an emergency 2 meeting of the Hill Country Juvenile Facility Corporation was 3 held in the Kerr County Commissioners Courtroom, Kerr County 4 Courthouse, Kerrville, Texas, and the following proceedings 5 were had: 6 P R O C E E D I N G S 7 JUDGE TINLEY: Let me call to order the 8 emergency meeting of the Hill Country Juvenile Facility 9 Corporation scheduled for this date and time, Thursday, 10 December 2nd, at 7:30 p.m. It's approximately that time 11 now. Only item on the agenda is consider and discuss the 12 approval of an amendment to temporary lease and operating 13 agreement at the Juvenile Detention Facility. The 14 Commissioners Court of Kerr County yesterday approved an 15 amendment to the temporary lease and operating agreements by 16 which the County is continuing to operate the Juvenile 17 Detention Facility, which would reduce the notice time for 18 extending from month-to-month the operating agreements and 19 lease agreements on a temporary basis -- would reduce the 20 notice period from 30 days to 15 days, so as to leave 21 everybody in basically the same position they're in, but 22 still give the bondholders an opportunity to respond 23 pursuant to their request. And because those -- those 24 operating agreements -- lease and operating agreements 25 involve both the Juvenile Board and the Facilities 12-1-04 jfc 3 1 Corporation, any amendment to that temporary lease and 2 operating agreement necessarily needs the approval of both 3 of those entities. So, at this time, I would entertain a 4 motion that the Hill Country Juvenile Facility Corporation 5 authorize the president of that corporation to execute an 6 amendment to the existing temporary lease and operating 7 agreements which would reduce the notice period for 8 extending the continuation of that agreement on a 9 month-to-month basis. That notice period will be reduced 10 from 30 days to 15 days. 11 JUDGE PROHL: So moved. 12 JUDGE TINLEY: And I'll second that motion. 13 Any question or discussion?
