 1        On Thursday, December 9, 2004, at 4:00 p.m., the

 2   previously recessed meeting of the Kerr County Commissioners

 3   Court was reconvened in the Commissioners' Courtroom, Kerr

 4   County Courthouse, Kerrville, Texas, and the following

 5   proceedings were had in open court:

 6                      P R O C E E D I N G S

 7                  JUDGE TINLEY:  Let me call back to order the

 8   meeting of the Kerr County Commissioners Court which was

 9   recessed Wednesday, December the 8th, at approximately

10   6 p.m.  We stood in recess until 4 p.m. this date,

11   December 9, 2004.  I wish to report that I've been in

12   telephone communication with Mr. Herb Bristow, who is the

13   attorney for the bondholders, and while he was unable

14   yesterday to confirm the agreement of all of the bondholders

15   to the framework of the agreement which was struck

16   yesterday, he advised me telephonically here within the last

17   hour that he has been able to make contact with all of the

18   bondholders, and that he has received the agreement of all

19   of the bondholders to the framework of the agreement which

20   was struck and announced in open court yesterday shortly

21   before 6 p.m.  So, I merely wanted to report that.  There's

22   no action to be taken, but the Court was recessed until

23   today for that purpose, and that's the announcement.
