I think we were previously 12 dealing with an executive session item, so I think it's 13 appropriate that we go back into executive. So, at this time, 14 at -- at 2:11, we will go out of open or public session to go 15 into closed or executive session. 16 (The open session was closed at 2:11 p.m., and an executive session was held, the transcript of which 17 is contained in a separate document.) 18 - - - - - - - - - - 19 JUDGE TINLEY: Okay. It is 2:31, and we're back 20 into open or public session, and we'll be in recess subject to 21 the call of the chair. 22 (Recess taken from 2:31 p.m. to 2:48 p.m.) 23 - - - - - - - - - - 24 JUDGE TINLEY: Okay, let's come back to order. We 25 were in recess for a bit, so we'll come back to order to our 10-11-06 4 1 Commissioners Court meeting that was underway. At this time, 2 2:48, we will go out of open or public session. 3 MS. THOMPSON: Bye, everybody. 4 COMMISSIONER BALDWIN: Don't go off too far. 5 MS. It's 3:05. Any member of the Court have 11 anything to offer with respect to matters taken up in closed 12 or executive session? 13 COMMISSIONER LETZ: I'll make a motion that we -- I 14 wasn't planning on it; do you have your notes here? -- that we 15 split the functions that are currently under the Maintenance 16 Department to two departments. There'll be a Maintenance and 17 Ag Barn Department which will be headed up by Tim Bollier, and 18 there'll be a Custodial, Grounds, Administration and Booking 19 function which will be headed up by Alyce Davidson. They will 20 both be at a salary level -- they will be exempt employees at 21 27,645 annual salary, and it'll be commencing immediately -- 22 or at the next pay period. Makes it simpler. At our next pay 23 period, they'll be at that level. And I believe that's it. 24 COMMISSIONER WILLIAMS: Second. 25 JUDGE TINLEY: We have a motion and a second. Any 10-11-06 5 1 question or discussion on that motion? All in favor of that 2 motion, signify by raising your right hand. 3 (The motion carried by unanimous vote.) 4 JUDGE TINLEY: All opposed, same sign. 5 (No response.) 6 JUDGE TINLEY: That motion does carry. 7 COMMISSIONER WILLIAMS: Can we assume you accept? 8 MS. DAVIDSON: Yes. 9 MR. BOLLIER: Yes. 10 JUDGE TINLEY: We have formal acceptance of the 11 position by Ms. Davidson? 12 MS. DAVIDSON: Yes. 13 JUDGE TINLEY: By Mr. Bollier? 14 MR. BOLLIER: Yes, sir. 15 COMMISSIONER LETZ: Judge, if I may add another 16 thing, part of that motion was that there will be a 90- and a 17 180-day review period over the individuals and their 18 performance. 19 COMMISSIONER WILLIAMS: Performance review. 20 COMMISSIONER LETZ: Yes. Okay. 21 JUDGE TINLEY: I think we would have the inherent 22 authority to do it every nine days if we wanted to, actually, 23 but -- since they fall under the Commissioners Court umbrella. 24 But I think it's good that they have notice of that. 25 COMMISSIONER LETZ: Right. 10-11-06 6 1 MS.
