Voelkel, County Surveyor, to the list of unopposed candidates elected 3 5 1.2 Canvass the General Election results 5 6 --- Adjourned 7 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 3 1 On Thursday, November 16, 2006, at 10:00 a.m., a special 2 meeting of the Kerr County Commissioners Court was held in the 3 Commissioners' Courtroom, Kerr County Courthouse, Kerrville, 4 Texas, and the following proceedings were had in open court: 5 P R O C E E D I N G S 6 JUDGE TINLEY: Let me call to order this special 7 meeting of the Kerr County Commissioners Court posted for this 8 date and time, Thursday, November the 16th, 2006, at 10 a.m. 9 It's a bit past that time now. The first item on the agenda 10 is to consider, discuss, and take appropriate action to amend 11 Court Order Number 29900 to include Lee C. Voelkel, County 12 Surveyor, to the list of unopposed candidates who are deemed 13 elected. I see that we have our long-serving public official 14 here, our County Surveyor. Ms. Pieper, do you want to kind of 15 tell us why we're here on this one? 16 MS. PIEPER: Well, gentlemen, whenever I'm ordering 17 and printing ballots, the County Chairs submit to me a 18 certification of nomination from the primary, and it -- his 19 name was inadvertently left off, and I did not catch it until 20 I was doing post-election reports. So, at that time, I called 21 the Secretary of the State, and due to the fact that y'all had 22 declared all the other unopposed candidates elected, the 23 Secretary of the State said in order to remedy this problem, 24 that we can amend this order to include him on it, and that 25 would take care of the problem. And then I also have a -- a 11-16-06 4 1 correction for a certification nomination that is signed by 2 our County Chair stating that his name was inadvertently left 3 off of the original certification. 4 COMMISSIONER WILLIAMS: How do we know it was 5 inadvertent? 6 COMMISSIONER NICHOLSON: Yeah. 7 MR. VOELKEL: That was my question. 8 COMMISSIONER NICHOLSON: That's a joke, Ms. Clerk. 9 COMMISSIONER WILLIAMS: Yeah, it was a joke. 10 COMMISSIONER NICHOLSON: I move to amend the court 11 order to include Lee Voelkel as elected. 12 COMMISSIONER BALDWIN: I second that emotion. 13 JUDGE TINLEY: Motion made and seconded for approval 14 of the agenda item. Any question or discussion? 15 COMMISSIONER BALDWIN: Judge, it's my understanding 16 that Mr. Voelkel may want a recount for this election. Not 17 sure that he wants -- haven't figured how out how to spend all 18 that money -- salary money. 19 COMMISSIONER WILLIAMS: I thought he was looking for 20 a raise. 21 MR. VOELKEL: All of the above. 22 COMMISSIONER BALDWIN: That's why we love him. 23 JUDGE TINLEY: That's why he had no opponent. 24 COMMISSIONER BALDWIN: Yeah. 25 JUDGE TINLEY: Any further question or discussion on 11-16-06 5 1 the motion? All in favor of the motion, signify by raising 2 your right hand. 3 (The motion carried by unanimous vote.) 4 JUDGE TINLEY: All opposed, same sign. 5 (No response.) 6 JUDGE TINLEY: The motion does carry. We'll move to 7 the next item, to canvass the general election results. 8 Ms. Pieper? 9 MS. PIEPER: Sir, I believe you have the official 10 canvass results in front of you that you can call out the 11 totals, if you'd like. 12 JUDGE TINLEY: Okay. Is it appropriate that I read 13 each and every one of these into the record? 14 MS. PIEPER: No, sir, it's not, because this will 15 become part of the record if one of the other Commissioners 16 will make a motion to just approve it as submitted. 17 JUDGE TINLEY: Okay. I have provided each of the 18 Commissioners here present today with the official cumulative 19 report of the general election results. I would note that 20 there are a couple of spots where there is an X-out or a 21 mark-out. That is done because those are not county 22 functions. The first two deal with the Headwaters results 23 that were on that same ballot, and the last three deal with 24 the city tax freeze issue, which, of course, was a separate 25 ballot, but for which we did the counting and -- and announced 11-16-06 6 1 the results. So, those that are marked out, obviously, do not 2 form the official -- part of the official cumulative report of 3 the Kerr County general election, and are not a part of our 4 canvass. 5 COMMISSIONER WILLIAMS: I note with interest, Judge, 6 that Kerr County voted 66.43 percent of our registered voters. 7 MS. PIEPER: That is incorrect, sir. 8 COMMISSIONER WILLIAMS: That's excellent. 9 MS. PIEPER: Because this is also counting -- 10 COMMISSIONER BALDWIN: She said it's incorrect. 11 COMMISSIONER WILLIAMS: It's incorrect? 12 MS. PIEPER: That is incorrect, because in order to 13 do the programming, it is -- the way the programming -- the 14 way the ballots were set up, that is also counting the 15 individual voters for the city and the Comfort ISD. 16 COMMISSIONER WILLIAMS: So there's some duplicate 17 counts there? 18 MS. PIEPER: Right. 19 COMMISSIONER WILLIAMS: Okay. 20 MS. PIEPER: Our -- our percentage, I believe, was 21 47 percent. 22 COMMISSIONER NICHOLSON: Still a good turnout, 23 though. Better -- 24 COMMISSIONER WILLIAMS: That's still good, and that 25 tracks a lot of other counties. 11-16-06 7 1 MS. PIEPER: It was a little over 15,000 that voted 2 in the county general election. 3 COMMISSIONER WILLIAMS: Okay. 47 is not bad. 4 COMMISSIONER BALDWIN: Judge, I move we accept as 5 presented, please. 6 COMMISSIONER WILLIAMS: Second. 7 JUDGE TINLEY: Motion made and seconded to approve 8 the official cumulative report of the Kerr County, Texas 9 general election as the official canvass of the election 10 results. Any question or discussion on the motion?
