Commissioner Baldwin? 11 COMMISSIONER BALDWIN: Yes, sir. Would you please 12 stand, have a word of prayer with me, and join me in the 13 pledge of allegiance. 14 (Prayer and pledge of allegiance.) 15 JUDGE TINLEY: Thank you. At this time, if there's 16 any member of the audience or the public that wishes to be 17 heard on any matter that is not a listed agenda item, feel 18 free to come forward at this time and tell us what's on your 19 mind. If you wish to be heard on any one of the agenda items, 20 we would ask that you fill out a participation form. They can 21 be found at the back of the room. That will give me a 22 heads-up on the fact that there are folks that wish to be 23 heard on that. I just 8 wanted to -- wanted to say what a great community we have. 9 You know, dealing with my own personal little issue going on 10 right now, old friends that I haven't seen in years have come 11 out of the woodwork, and it's just a neat thing to see, neat 12 thing to experience. We're getting -- I'm getting support 13 statewide now, so I think I'm running for governor out of this 14 deal. (Laughter.) 15 AUDIENCE: You might as well. 16 COMMISSIONER BALDWIN: Might as well. That's about 17 it. I just thought I'd throw -- you know, that's my test 18 balloon. Thank you for having me here today. 19 JUDGE TINLEY: Thank you. Commissioner Williams? 20 COMMISSIONER WILLIAMS: A week ago, the rain broke 21 and we had the Republican golf tournament, and one of the 22 things we gave the golfers was these pad -- padfolios, and 23 there were a few of them left over, and I thought you 24 gentlemen might find one of these useful. 25 COMMISSIONER BALDWIN: Bill, I have to question your 7-9-07 6 1 gift-giving. Is there any public money involved in this? 2 COMMISSIONER WILLIAMS: Not a penny. Parade went -- kicked off fine. 14 Rain parted for that, and then a good barbecue followed, 15 following the parade. Other than that, not much going on, 16 just a lot of rain. Got another inch last night, or night 17 before last, kind of which was -- I thought the forecast said 18 the rain was over, so maybe it's over today. That's it. 19 JUDGE TINLEY: Commissioner Oehler? 20 COMMISSIONER OEHLER: I don't really have much. I 21 was -- I talked to Billy Snow a while ago, and he informed me 22 that on August 11th this year, they're going to have a 4-H 23 Horse Club banquet, and any of us that would like to attend, 24 we are invited to go. So, other than that, that's about it. 25 JUDGE TINLEY: Thank you. Let's get on with our 7-9-07 7 1 agenda and see if we can get through it on a reasonably 2 expeditious basis. First item on the agenda is to consider, 3 discuss, and take appropriate action to approve the 4 appointment of election judges and alternates for the term 5 of one year in accordance with the Texas Election Code, 6 Section 32. 7 MS. PIEPER: Gentlemen, we're starting to gear up 8 for the Constitutional Amendment election in November, and 9 this is just one of the requirements that we're required to 10 do. PIEPER: Yes? 18 COMMISSIONER WILLIAMS: Where you'd identified 19 Precinct 2 on a consolidated basis as the American Legion Hall 20 in Center Point. I don't recall it being -- I thought it was 21 the Union Church. 22 MS. PIEPER: You're correct on that. It was the 23 Union Church. 24 COMMISSIONER WILLIAMS: Okay, thank you. 25 COMMISSIONER LETZ: What were the ones we 7-9-07 9 1 consolidated to last time, if you can -- 2 MS. Consider, 24 discuss, and take appropriate action to direct payment of the 25 salary of the County Auditor and record the actions of the 7-9-07 10 1 District Judges and in accordance with Vernon's Texas Civil 2 Statutes, Texas Local Government Code Section 84.003. This 3 matter shows to be placed on the agenda by the District Clerk, 4 Ms. Uecker. I believe there was also involvement by the 5 County Attorney, and possibly also our County Auditor -- 6 outgoing County Auditor, shall I say, Mr. Tommy Tomlinson. 7 Probably be a good idea to bring somebody forward, 8 Mr. Tomlinson, and let us know who we got here, let everybody 9 take a look at her. 10 MR. TOMLINSON: Well, it's my privilege to introduce 11 to the Court and to the public Jeannie Hargis. I think some 12 of you have already had an opportunity to be -- be involved 13 with her activities at the city, so I think that -- that this 14 lady will do -- will do us an outstanding job, and I think 15 that the District Judges feel the same way. So, I just -- 16 just make her feel at home, and we're trying to put her to 17 work today. 18 COMMISSIONER WILLIAMS: We'll put her to work, 19 Mr. Tomlinson. (Laughter.) I just want to say that my 20 experience on the Airport Board -- and I know Commissioner 21 Letz serves there with me. My experience in working with 22 Ms. Hargis has been just absolutely excellent. Anything we 23 needed done or any information we needed for her to provide, 24 she willingly did it, and did it as quickly as humanly 25 possible to do, and I thank you for that. I look forward to 7-9-07 11 1 your service here to Kerr County. 2 MS. HARGIS: Thank you. TOMLINSON: That's correct. 17 COMMISSIONER BALDWIN: This is the first one I've 18 ever seen, but -- I think. 19 MR. TOMLINSON: We -- her bond will be ready this 20 afternoon, so we plan to pick it up and get it to the District 21 Clerk maybe -- maybe today. And so, at that time, she can -- 22 you know, they can -- we can do the oath and she'll be ready. 23 JUDGE TINLEY: Any other questions or comments? Welcome 4 aboard to the team, Ms. Hargis. 5 MS. HARGIS: Thank you. I'm excited and very 6 honored to work with all of you. Thank you. 7 JUDGE TINLEY: We're proud to have you. Thank you. 8 Let's move to Item 4, if we might. Consider, discuss, and 9 take appropriate action concerning use of Road and Bridge 10 surplus funds from items sold on eBay. 11 MR. ODOM: Yes, sir. Enclosed is a copy of the Road 12 and Bridge surplus items we've sold on eBay and the amounts 13 for which they sold. We would like for you to consider using 14 some of the funds for the following two items: Purchase of a 15 FEMA surplus mobile home for the Ingram yard office. There 16 have been numerous times -- nights this year when Road and 17 Bridge crews have been called out to check crossings for high 18 water and/or ice on roads, especially in Precinct 4. Since we 19 do not close the roads until they are impassable, these men 20 may be out all night to keep checking the water levels and ice 21 accumulations. In Ingram yard there is no decent place for 22 them to get out of the rain and/or cold or rest or go to the 23 bathroom or eat. Texas Procurement in San Antonio currently 24 has mobile homes that were purchased for the Katrina disaster, 25 and they are being offered to government entities at very low 7-9-07 13 1 prices. 2 The enclosed photos show the one that we would like 3 to purchase. It is 14 by 64, and is simply outfitted with 4 vinyl floors and an open concept. It is handicap-accessible 5 with 36-inch doors, and can easily be equipped as an office. 6 It has central air and heat, refrigerator, range and 7 microwave, and furniture. By placing this mobile home in the 8 Ingram yard, we can better serve the citizens in western Kerr 9 County and have a clean and safe environment for the Road and 10 Bridge employees. We ask that you allow us to purchase this 11 mobile home with $8,000 from the surplus funds. And I believe 12 that that is an '06 trailer, I think, off the top of my head. 13 Number two that we request is make note on the 14 zipper. We have a three-year note on this piece of equipment. 15 First payment was made in October of '06. We have another 16 payment October of '07. We ask that you allow us to use 17 $28,987.89 of these funds to make a third and final note on 18 this piece of equipment. In other words, if we pay it now -- 19 prepay this with this $28,000, come October, I have sunset 20 that one year ahead of time, and I think that would be 21 appropriate use for this. I believe that also -- I did not 22 say, but I think that this is $47,781.95 cents that we have 23 collected so far on this old equipment, we still have some 24 more that possibly will be sold, so we have -- we will have 25 funds left over to go back in reserves. But I think this is 7-9-07 14 1 the best use of our -- of our money to buy this mobile home 2 that our people can use. It is very cheap, and is an 3 opportunity that'll pass us by if we don't -- it's not going 4 to wait. And the zipper is self-explanatory; that's good 5 business. 6 JUDGE TINLEY: Mr. Odom, what about the 7 transportation/setup of this modular unit? 8 MR. ODOM: I believe that we should be able to take 9 our service truck and be able to pull it down here with that. 10 We feel like we don't have to hire anybody to do it. We can 11 do it ourselves. 12 JUDGE TINLEY: Okay. 13 COMMISSIONER WILLIAMS: Where's it located? San 14 Antonio? 15 MR. ODOM: San Antonio, Ackerman Road. 16 COMMISSIONER LETZ: First, I mean, I compliment 17 y'all for deciding -- or figuring out to use eBay. We did 18 really, really well -- 19 MR. ODOM: Really well. 20 COMMISSIONER LETZ: -- with that surplus. I can't 21 imagine that all that stuff combined would bring more than 22 $5,000, much less $47,000. I might be a little bit leery of 23 having you transport that. It's kind of a specialized -- you 24 know, 64-foot, I'm sure your people are qualified and can do 25 it, but it's not that expensive usually to hire a transport 7-9-07 15 1 company that that's their business, and they have the little 2 trucks that go front and back. You might be able to get part 3 of it. 4 MR. ODOM: Surely. 5 COMMISSIONER LETZ: I just -- that seems like a 6 little bit of a liability issue, transporting a mobile home 7 out of San Antonio, when we're not used to doing that. 8 MR. ODOM: We are used to pulling a low-bed trailer, 9 so -- 10 COMMISSIONER LETZ: Right. But -- 11 MR. ODOM: With equipment on it. However, we can 12 afford to do that. I have contingencies. We -- our fund's 13 still here -- right here to do that, and that's the discretion 14 of the Court. 15 COMMISSIONER LETZ: What about the septic issue out 16 there? 17 MR. ODOM: The septic -- we already have a septic 18 system. We feel like we could move it to the back side of the 19 old barn right there where the septic system's at, and we 20 should be able to tie into it, so we thought about that. We 21 do have a -- a well that has non-potable water which would 22 furnish the trailer. And -- not drinking water, but for the 23 restroom and all, it would suffice. We think we can make it 24 work on the back side and level it up and have a decent place 25 that we can go. 7-9-07 16 1 COMMISSIONER LETZ: You might get with Environmental 2 Health. 3 MR. ODOM: Well, we will. We'll go through the 4 permit just like everybody else. We'll not -- we won't make 5 an exception out of us. 6 COMMISSIONER BALDWIN: Judge, my question is -- is 7 when there's moneys coming from this eBay issue back into the 8 county, do they go into Road and Bridge general fund, or is 9 there a special surplus fund line item set up somewhere? 10 JUDGE TINLEY: I see the Treasurer nodding her head 11 back there, I think to the latter part of your question, that 12 there's a special surplus fund. 13 MS. WILLIAMS: Yes, sir. 14 JUDGE TINLEY: And it comes back in. So the payment 15 of the authorization for these items, if I'm understanding 16 correctly, will need to come back out of that specialized 17 fund? 18 MS. WILLIAMS: Either that, or we will probably have 19 to do a budget amendment and maybe set up a line item for the 20 purchase and increase the budget on that side, and also 21 increase the revenue side. Because surplus moneys has not 22 been budgeted. 23 MR. ODOM: That's right. 24 JUDGE TINLEY: Okay. Do you think it would be 25 better to bring it back into the Road and Bridge budget? 7-9-07 17 1 MS. WILLIAMS: Yes, sir, I do. 2 JUDGE TINLEY: Okay. 3 COMMISSIONER WILLIAMS: Well, that would work pretty 4 well, given that you've got to get the estimated cost to move 5 it. Just add that onto the total. 6 MR. ODOM: Add it onto the total. 7 COMMISSIONER BALDWIN: So, $28,987.89 for the zipper 8 note? 9 MR. ODOM: That's correct. 10 COMMISSIONER BALDWIN: And $8,000 for the mobile 11 home? 12 MR. Thank you 22 for your good fiscal management, Mr. Odom. 23 MR. ODOM: Well, I thank the Court for being 24 open-minded, and this is a good move. 25 JUDGE TINLEY: Let's move to Item 5; consider and 7-9-07 18 1 discuss conceptual layout of project titled Champee Springs 2 Estates, located in Precinct 3. 3 MR. ODOM: Yes, sir. If you don't mind, I would 4 like to read this letter that was sent to me, and I had met 5 with them previously and discussed the options and their 6 questions that they have. It says, "Dear Mr. Odom, thank you 7 for taking the time out of your busy schedule to discuss our 8 submittal. The information you provided us was a great help 9 in understanding the issues of Kerr County with regards to 10 land development, as well as better understanding of the 11 County's rules and regulations. As a result of that meeting, 12 we have completed the conceptual layout for a project titled 13 Champee Springs Estates. As discussed, the conceptual land 14 plan is intended to be a vehicle to open a dialogue as to a 15 possible alternative land plan in the future for the area 16 north of Privilege Creek Ranch Subdivision. This concept plan 17 does not include are within the Privilege Creek Ranch 18 Subdivision. The attached prints of the conceptual layout of 19 Champee Springs Estates are hereby being submitted to Kerr 20 County for review and comments. The area being presented does 21 not include any of the area known as Privilege Creek Ranch, 22 which is presently under consideration by the County. 23 Furthermore, the conceptual layout is a presentation of a 24 future possibility for the use of the land that might occur a 25 few years" down the road. 7-9-07 19 1 "The concept is for a central water system to 2 provide potable water to the individual lots. Sewage disposal 3 would be provided by an on-site aerobic facility for each lot. 4 A central sewer collection system could also be a possibility. 5 In any case, a septic system with leach fields will not be 6 allowed. Therefore, lots will range in size from 1 to 2 and a 7 half acres with common green space open areas proposed for the 8 remainder of the site. The overall density will not be less 9 than 1 lot per 3 acres." Which is in compliance with the 10 centralized water system. 11 "Since the concept plan has a higher density than 12 one lot per 5 acres, a higher storm water runoff would be 13 expected. Mitigation of the storm water increase would be 14 incorporated in the development plans. These control measures 15 would likely be placed in the greenbelt areas. Since this is 16 on a conceptual plan for a future possible land use, the type 17 of facilities are not sized or shown on the concept layout. 18 To the north of the concept plan area being submitted, there's 19 approximately 400 acres to 1,000 acres that could be a logical 20 extension of the conceptual plan and could be added into this 21 planned development." And that is more toward the end of the 22 current Lane Valley, is my understanding. It is not up front 23 where our road maintenance ends. 24 "I hope that this letter provides you the 25 information that you desire concerning the submission of the 7-9-07 20 1 conceptual plan for Champee Springs Estates. We are looking 2 forward to our dialogue with Kerr County on the possibilities 3 of developing this property into an aesthetically pleasing 4 subdivision. Should you have any questions or desire any 5 additional information, please feel free to contact our 6 office." I believe that I have Mr. Blume and the engineer for 7 any questions that I might not be able to answer, or I may be 8 able to turn the time over to them to answer that question. I 9 may not do it justice, but I have a concept of it. 10 COMMISSIONER BALDWIN: Just -- you need to put me in 11 the geographical area. Is this -- where is it from -- from 12 the subdivision that's so stormy down there? 13 MR. ODOM: It is -- 14 COMMISSIONER BALDWIN: Are you going to talk during 15 this? Okay. 16 MR. It has nothing to do with what 20 we presented to the Court before. 21 COMMISSIONER BALDWIN: Okay. 22 MR. ODOM: That was Privilege Creek Ranches. 23 COMMISSIONER BALDWIN: Okay. 24 MR. ODOM: This is totally a separate -- behind that 25 subdivision is, I would guess, 1,000 acres or so? Something 7-9-07 21 1 like that? Something like that. But, anyway, there's other 2 land back behind that goes back -- the concept is back to Lane 3 Valley. That's how they would enter, at that point. And in 4 this subdivision -- 5 COMMISSIONER BALDWIN: And Lane Valley goes to this 6 property? 7 MR. ODOM: It goes up adjacent. It stops -- 8 COMMISSIONER BALDWIN: At that property? 9 MR. ODOM: -- at that property line. Or the roadway 10 easement, let's put it that way. Proposed roadway easement. 11 COMMISSIONER WILLIAMS: So, when you say behind the 12 Privilege Creek Subdivision that's currently matriculating 13 through -- 14 MR. ODOM: Yes. 15 COMMISSIONER WILLIAMS: -- the conduit, -- 16 MR. ODOM: Through the conduit. 17 COMMISSIONER WILLIAMS: -- you're talking about the 18 south side or the north side? 19 MR. ODOM: That would be the north side. 20 COMMISSIONER WILLIAMS: North side? 21 MR. ODOM: Yes. 22 COMMISSIONER WILLIAMS: Okay. So, that would mean 23 that you would come to this off of Lane Valley Road first? 24 MR. ODOM: This section would be off Lane Valley. 25 COMMISSIONER WILLIAMS: First, before you got to the 7-9-07 22 1 other one? 2 MR. ODOM: That's correct. 3 COMMISSIONER WILLIAMS: Okay, thank you. The other 4 question -- 5 MR. ODOM: The other side still comes -- 6 COMMISSIONER WILLIAMS: Other question I had, 7 there's a reference in this letter from this gentleman that 8 talks about sewage disposal being on-site, and then it says a 9 central sewer collection system could also be a possibility. 10 Would that -- was that thought incorporated into the letter, 11 keeping in mind the future plans that Kerr County is working 12 on for a sewage collection system for the eastern part of the 13 county? 14 MR. ODOM: That wasn't really discussed. It was a 15 system of their own, sort of like a M.U.D. If I'm correct 16 under that assumption, it would be a M.U.D., municipal utility 17 district, which would be in place for that area right there, 18 and possibly future development that was proposed as an 19 alternative. That they could reduce the size of the lots, 20 still have the 3-acre average, stay up on the ridge lines, is 21 my understanding. But I'll turn that over to Mr. Blume or the 22 engineer on that. But looking at that, that's what was 23 proposed, and more upscale, like Arizona-type thing. 24 COMMISSIONER WILLIAMS: They could also consider a 25 gravity flow line in the subdivision to the interceptor line 7-9-07 23 1 that's going to go down Highway 27 as well. 2 MR. ODOM: Could be, but would you have lift -- I 3 don't get into that aspect. 4 COMMISSIONER WILLIAMS: Just a possibility. 5 MR. ODOM: Possibility. Possibility. 6 JUDGE TINLEY: How far off of 27 is this 7 subdivision? 8 MR. ODOM: Seven miles back there, maybe, something 9 like that; 6, 7 miles. 10 JUDGE TINLEY: Okay. 11 MR. ODOM: To the -- to the end of my maintenance. 12 And then this proposed 100-foot right-of-way goes down through 13 here. 14 JUDGE TINLEY: Okay. 15 MR. ODOM: Along the property line here. 16 JUDGE TINLEY: And then the -- projecting into the 17 future, immediately north of this particular area is the 400 18 to 1,000 acres that might subsequently be developed that was 19 mentioned in the letter? 20 MR. ODOM: That is correct. You probably go in a 21 quarter of a mile and -- well, actually, this 400 acres abuts 22 right up against it, but that was something that was a 23 possibility. But 400 acres is my understanding, and -- and I 24 don't know if the individual would sell more or not. But that 25 was a plan, but it has nothing to do with the south side of 7-9-07 24 1 the project. It's all back up here where our county 2 maintenance essentially ends. 3 JUDGE TINLEY: What I'm getting to, Mr. Odom, is 4 that the projected 400 to 1,000 acres, I believe we projected 5 going closer towards Highway 27. 6 MR. ODOM: Yes. 7 JUDGE TINLEY: Which would give further emphasis 8 possibility on the feeder line for wastewater, assuming that 9 we can get this east Kerr County -- Center Point and east Kerr 10 County wastewater system going. 11 MR. ODOM: That is very possible, but I couldn't 12 speak for the developer. I don't wish to do that. But 13 anything's possible. Lift stations could -- I don't know what 14 the fault is, what the drain would be down there. You would 15 assume it's on a hill; there might be enough in there to do 16 it. 17 JUDGE TINLEY: Generally, it's going to be gravity 18 flow, if my understanding of the topography is where I think 19 it is. It's going to be pretty much gravity flow down to 27. 20 MR. ODOM: Maybe. I just -- I just don't have that 21 data. I haven't seen that data. 22 JUDGE TINLEY: Okay. 23 MR. ODOM: Would you like the -- Mr. Blume, would 24 you like to incorporate anything in this discussion, or the 25 engineer? 7-9-07 25 1 MR. BLUME: Well, I think Paul could probably bring 2 you up to speed, and actually, this is a request. My lender 3 on the project is back here, Greg Davis. It's actually a deal 4 between him and the engineer here. I gave him my authority to 5 do it, to look to the future. So, I mean, I'm there. I'm 6 aware of what's going on. You've seen my plan. You've seen 7 what I want to do. But I think it would be appropriate, since 8 they hired him, to visit with him on that, any questions. 9 MR. MORAWSKI: I'm Paul Morawski with Broadbent and 10 Associates. As they said, I was hired sort of by the lender, 11 just to take a look at just a concept of what the possibility 12 you could do with this property other than just dividing it up 13 into large-acre tracts. So, my idea was -- the other thing 14 that I've done is to try to do kind of a cluster-type housing 15 where we go on the top where it's flat and we put the houses 16 there, and then you leave the open space, which are the steep 17 areas that you don't want to really disturb, because you don't 18 want the erosion, and see what kind of density we could come 19 at with regards to following your guidelines as to density. 20 And so I've looked at it from that point of view, and what 21 we're trying to do is bring it to you and say, you know, 22 here's a possibility of what could be done. What is y'all's 23 feeling and what's your input? You know, are you opposed to 24 it? Or, you know, just try to work with you to get a -- you 25 know, a quality development out there. The idea of doing the 7-9-07 26 1 smaller lots, again, is you just -- you just develop those 2 small areas that are flat, and then leave the open spots. 3 And, you know, we understand there's a possibility, 4 because there will be more lots per acre than, say, 1-to-5 or 5 1-to-10, that we'd have additional runoff, and what we'd look 6 at doing is, in the bottom of these draws, you could put small 7 detention ponds if it was necessary. So, it's really just an 8 engineering issue. The same thing with the handling of the 9 San Antonio sewer. You can do on-site aerobic systems, or we 10 could collect it maybe. You'd probably use some lift stations 11 and take to it a central area. It could be a M.U.D. or could 12 just be a private disposal system, or we could tie in, and 13 that's just really engineering issues. So, I think before you 14 work -- those things are always going to be worked out to what 15 the rules and regulations are, and to engineering practices. 16 So, I think the issue of the land plan is to see how you feel 17 about it and what your concerns are, you know, from the 18 County, and so I'm here to answer any questions, whether it be 19 engineering or from a land plan view. 20 COMMISSIONER OEHLER: How does it work with the 21 people that will buy into this concept? Are they going to 22 have an undivided interest in the balance of the property, or 23 what happens to the balance of the property when you have lots 24 that are left basically as green space? 25 MR. MORAWSKI: It would be held in common. There 7-9-07 27 1 would probably be a vehicle, such as a homeowner's 2 association, and so there would be some type of dues that you 3 would pay for maintaining it, especially if you have detention 4 facilities, to pay for the upkeep, if there is any, you know, 5 for the inspections, you know, those type of issues. In this, 6 it's more or less in common. It's like green space for all to 7 enjoy, so there would be access easements that they'll be able 8 to, like, put -- if they like hiking trails, bike trails 9 and -- I don't know, riding. 10 COMMISSIONER OEHLER: It would be under the 11 ownership and control of the homeowner's association? 12 MR. MORAWSKI: Yes. Yes. 13 COMMISSIONER OEHLER: Okay. 14 COMMISSIONER WILLIAMS: How many lots are proposed 15 in this? 16 MR. MORAWSKI: I believe in that one, there's, like, 17 approximately 475. 18 COMMISSIONER WILLIAMS: 400-some-odd? 19 MR. MORAWSKI: And it's -- you know, it's just, like 20 I say, a concept. We kept the houses up on the top of the 21 crest of the hills. They could be smaller, could be larger. 22 I didn't really get specific. I think it's going to fit -- to 23 really get down where, if you really did it, it would be 24 fitting the lots to the terrain to give people access, keep 25 the views as open as possible from some of the roads where 7-9-07 28 1 there's some scenic views. 2 COMMISSIONER WILLIAMS: And the green acres would be 3 left sort of in a natural state? 4 MR. MORAWSKI: Yes. Yes. 5 COMMISSIONER BALDWIN: 475 and 339, that's a lot -- 6 there's a big difference in those two numbers. 7 MR. MORAWSKI: Well, I guess the concept being is 8 that the number of lots would not exceed the three -- a unit 9 per 3 acres. So -- and it could be more or less, 'cause it's 10 really -- that's the optimal density. I think what you're 11 going to really look at is, when you put in a lot, that it 12 makes sense. You don't want to -- you don't want to put in a 13 runway lot where, like, 50 foot of frontage and it goes 1,000 14 feet long. Doesn't make sense, so you're trying to really fit 15 the lot to the terrain. 16 COMMISSIONER BALDWIN: Sure, I understand. 17 COMMISSIONER OEHLER: Only thing I can see is it 18 looks like some of those lots are very narrow and very long. 19 MR. MORAWSKI: Right. And it's -- and I agree with 20 you, and that's why I stated I hate runway lots. But, you 21 know, we're keeping it a certain size acreage that people 22 would want to have stuff, and so I think it could still be 23 massaged. I think the idea is a concept to see what your 24 feelings are, and then I think we'll take that -- if it were 25 to occur, then we'd take your input and work with that further 7-9-07 29 1 to bring it back to you again, and see if this is what you'd 2 like. 3 COMMISSIONER OEHLER: Which will, by, of course, 4 making wiser -- using the same configuration, you're going to 5 end up with less number of lots. 6 MR. MORAWSKI: That's true. 7 COMMISSIONER OEHLER: Which would be -- you know -- 8 MR. MORAWSKI: And that's -- and it's whatever the 9 land -- you don't want to rape the land, so you have to work 10 with the land. 11 COMMISSIONER OEHLER: I understand. 12 MR. MORAWSKI: So, you know, I -- like I say, I did 13 -- I put effort into it to come up with a concept, but it's 14 really -- when you start laying it out, that's correct. 15 COMMISSIONER OEHLER: That's the only thing that 16 caught my eye. Some of those appear to be maybe not even 100 17 feet wide, just -- just guessing. They're probably wider than 18 that. 19 MR. MORAWSKI: Well, the concept that I laid out, 20 some of them were 100 foot wide. But they go -- I was trying 21 to make them somewhere between 100 and some get to 150, 22 depending on the acreage. 23 COMMISSIONER OEHLER: And then under that, it 24 appears, just from looking -- 25 MR. MORAWSKI: Uh-huh. 7-9-07 30 1 COMMISSIONER OEHLER: Looks like they may be as much 2 as 400, 500 feet long and only 100 feet wide. 3 MR. MORAWSKI: Correct. Some of them are, yes. 4 And, really, particularly, some of them would fall off into -- 5 would fall off into somewhere on the slopes where they 6 wouldn't be developing, and I think in that case, if they were 7 larger, we would probably put an easement and it would be 8 maybe an open space easement so people wouldn't develop on the 9 hillsides and cause problems. So, I think if something was 10 like that, we would put something in like that. 11 COMMISSIONER OEHLER: I like your concept, and I 12 really like the concept about putting in a M.U.D. If you're 13 going to have those lots like that and don't have to have 14 them -- I really think it's going to be cheaper in the long 15 run. Of course, it is maintenance. You know, there does have 16 to be an operator of that system, but that would really be 17 advantageous, and you could leave more of your green space 18 and -- 19 MR. MORAWSKI: Correct. 20 COMMISSIONER OEHLER: -- and have maybe even more 21 lots to offer that way, if people wanted to do that. I'm not 22 one of them, but -- you know, I like bigger lots. But -- 23 MR. MORAWSKI: I understand. 24 COMMISSIONER OEHLER: -- the concept, I like the 25 concept. 7-9-07 31 1 MR. MORAWSKI: Okay. 2 COMMISSIONER WILLIAMS: Is there some sort of 3 tentative timeline that's been established for this project? 4 MR. MORAWSKI: The lender might be able to -- I 5 don't know if he had an idea, but I think it would be 6 something -- my understanding would be, you know, nothing 7 would be started on it really for a year and a half. Year to 8 year and a half. 9 COMMISSIONER BALDWIN: Well, I like the plan. I 10 don't know that we -- we may be using the word "M.U.D." a 11 little bit loosely here, but some kind of collection system to 12 hook up to our plan would make us all very, very happy. But I 13 really don't like the word "Boerne." (Laughter.) This is 14 Kerrville. 15 MR. MORAWSKI: I understand. 16 COMMISSIONER BALDWIN: Okay. Thank you. 17 MR. MORAWSKI: And to answer your question about the 18 M.U.D., a M.U.D. is really only a vehicle. It could be, you 19 know, a private operation, run by somebody. So -- 20 COMMISSIONER WILLIAMS: Well, I would echo what the 21 Commissioner is saying, and as you move forward with your 22 plans, I would urge you to stay in tune with what we're 23 attempting to do over there with respect to the sewer system 24 and transmission line which is being proposed from Center 25 Point to Comfort. And while you're at it, any numbers you 7-9-07 32 1 might want to examine of what the cost would be to run a 2 feeder line down from your subdivision down to that 3 transmission line. 4 MR. We worked with the 5 seller and buyer, Commissioners Letz and Williams, because 6 it's right at both of the -- if you fall to the right, you're 7 in Jonathan's, and if you fall to the left, you're at Bill 8 Williams' precinct right there, so the line's right there, as 9 well as the County Attorney in an attempt to satisfy all 10 parties. Even though this plat does not meet all of the Kerr 11 County Subdivision Rules and Regulations, it does make a bad 12 situation better. We're talking about a one-lot subdivision. 13 Therefore, at this time, we ask that you approve the plat as 14 presented, and be willing to answer any questions or turn that 15 over to Commissioner Williams or Commissioner Letz. 16 COMMISSIONER WILLIAMS: It's actually a two-lot 17 subdivision. 18 MR. ODOM: It is actually two lots. But we're -- my 19 understanding is that the 13.1 acres up here, this individual 20 doesn't wish to do it. I think that's been turned over to the 21 County Attorney. But this was -- the young man that bought 22 this was wanting to get a septic and to build a home, and this 23 young man didn't do anything. 24 COMMISSIONER WILLIAMS: That's correct. He got 25 caught in the squeeze. 7-9-07 34 1 MR. ODOM: He got caught in the squeeze. And, you 2 know, I'm not legal. I'm just saying we got a bad situation. 3 This young man's trying to resolve this issue. This is a way 4 to resolve the issue. 5 COMMISSIONER LETZ: Well, my recollection is, I 6 mean, the division was done before the individual bought the 7 property. The guy who we're dealing with now had nothing to 8 do with this division; he just bought it. 9 MR. ODOM: Just bought it. 10 COMMISSIONER LETZ: He thought he bought property. 11 Ideally, the 13-acre tract would be Lot 2, but that individual 12 won't -- won't do anything. Won't participate, won't work 13 with the other individual. So, I think Bill and I looked at 14 it. My recommendation was, let's at least get the guy who's 15 trying to do it right -- okay, even though it's a small lot, 16 let him do a one-lot subdivision, and then deal with the other 17 individual that owns the remainder when he tries to sell that 18 property. 19 COMMISSIONER WILLIAMS: That's correct. 20 MR. ODOM: That's right. 21 COMMISSIONER WILLIAMS: And there's also a well on 22 this Lot 1, is there not? 23 MR. ODOM: Yes, there has been a well there. It was 24 allowed to be drilled. 25 COMMISSIONER WILLIAMS: Ample room for a septic, and 7-9-07 35 1 there's already a well. And this does solve, hopefully, a 2 situation that was almost impossible, because the gentleman 3 that bought what is identified as Lot 1 really got caught in a 4 situation where he had no -- had no understanding or idea it 5 was going to take place. 6 MR. ODOM: He had no concept. The young man didn't 7 know. 8 COMMISSIONER WILLIAMS: So, I move approval. 9 COMMISSIONER BALDWIN: Wait just a second. These are colonias-type 2 C.D.B.G. block grant moneys. In this particular case, it's 3 not a huge amount of money, but the Grantworks folks have 4 notified us of the potential for this. And what we'll be 5 looking at would be possible stormwater takeoff issues, 6 flooding issues, housing issues and so forth. And Grantworks, 7 as always the case in the past, conducts the public hearing. 8 They prepare the application for us, and they do a lot of the 9 work. I have a note here from Grantworks. When we originally 10 talked about July 12, they are asking that we change that to 11 13, which will allow them ample time to get a newspaper 12 advertisement in tomorrow. She has a Masters in 9 library -- library science degree from Louisiana State in 10 1994, and she taught home economics in high school and library 11 in elementary and high school. And that Option 1 of the two options that are 12 being proposed would take a transmission line down Highway 27 13 from Center Point to the W.C. & I.D. lines and/or the 14 treatment -- sewer treatment facility in Comfort. I see Keith 15 Marquart, the General Manager, is back here. Thank you, 16 Keith, for coming. The items in the letter of intent are 17 those that we discussed, and what this would be is -- is a 18 letter intending both parties would sit down and negotiate an 19 intergovernmental agreement to discuss all of these items that 20 embody a solution to these questions. The intergovernmental 21 agreement -- we sent a letter to the Board of Directors of 22 W.C. & I.D. and asked them to consider it as well, or we're 23 asking the Court's approval today to do this. This would be 24 step one in a long process to work out the details of a 25 connection between our proposed system and the sewage 7-9-07 62 1 treatment facility in Comfort. So, that's the sense of it. 2 Commissioner Letz, do you have anything you'd like to add to 3 that? 4 COMMISSIONER LETZ: Only thing, I think we should 5 add the word "nonbinding" explicitly in here. I think that 6 this is not intended to be a binding agreement; it's more of a 7 nonbinding agreement to give us a framework to move forward. 8 I think that was something that I believe Mr. Bohnert or one 9 of the board members that attended our meeting thought ought 10 to be there. 11 COMMISSIONER WILLIAMS: That's fine. 12 COMMISSIONER LETZ: And the other thing I think we 13 ought to -- well, we might want to more clearly state in here, 14 this is our -- the primary -- you know, our prime -- I guess, 15 like, our primary nonbinding letter of intent. A lot of this, 18 in my mind, is a -- the purpose is for the Water Development 19 Board to know that we have a plan for the sewage. I mean, if 20 they're going to give us money, we're actively negotiating, so 21 they think that this is -- the Kendall County Water District 22 is the way to go, definitely the primary one. But it wouldn't 23 hurt to do another one, possibly, as well. But, anyway, the 24 main comment I want to add, this should be a nonbinding letter 25 of intent at this point, because we're pretty general still. 7-9-07 63 1 COMMISSIONER WILLIAMS: I don't have any problem 2 with "nonbinding." I think in terms of the other potential 3 letter of intent, we're certainly willing to sit down with the 4 City and see if we can work out a letter of intent that way, 5 both of which to be included in our -- supplement our 6 application to the Texas Water Development Board. The reason is, there's a long -- it's 20 nothing related to the future development out in Lane Valley 21 that may or may not happen. There's some changes that -- a 22 long -- I guess Len and I have felt for a long time need to be 23 made in the right-of-way on Lane Valley. Hill Country Co-Op 24 is -- they know where they want to put their line, but they 25 want to put it right off into the private property outside the 7-9-07 79 1 fence line, which is right where we need to require some 2 right-of-way, hopefully. And I met with Lee Voelkel and some 3 of his people; we went out and did a -- got an idea as to what 4 it's going to cost to do a survey of that whole road, as far 5 as it goes right now, and kind of look at it so we can 6 coordinate with Hill Country Co-Op before they start trenching 7 early in the fall as to where that line should go, so the 8 County doesn't have to spend a lot of money to move that line 9 if we do require additional right-of-way on the road. The 10 cost to do this is around $5,000 to $10,000, and this is to 11 GPS the road itself and all the fence lines. These are all 12 prescriptive easements. Len has that amount available in his 13 right-of-way budget or in some projects he may not get to. 14 Won't be a -- but I did want to bring it up, and if -- if it's 15 felt by anyone on the Court that this needs to be an agenda 16 item, this is a fairly large expenditure, though I think it is 17 within Len's prerogative to do it under his right-of-way 18 budget. He does too, but we just wanted to bring that up. 19 So, if anyone has any comments, let me or Len know A.S.A.P. 20 and we'll get it on the next agenda for Court approval. If 21 not, we'll just proceed as we think it's his purview to do 22 this, as I think it is. That's it. 23 JUDGE TINLEY: Commissioner Oehler? 24 COMMISSIONER OEHLER: Ag Barn -- we need to start 25 calling it, I think, the Kerr County Exhibition Center rather 7-9-07 80 1 than the Ag Barn. But the progress out there, most of the 2 stalls have been taken down. Part of them -- I think they 3 took three up to Animal Control to use to hold some animals 4 when they get them, like big animals, you know, horses or 5 donkeys or mules, you know, snakes or whatever that they can 6 put in some of them. Plus there's been a -- all the ones that 7 we wanted to be put back up have been put up. They're ready 8 for use on the southwest corner of the Exhibition Center 9 and/or arena part. Animal Control has also built a shelter 10 and a pen to hold animals so that whenever we're having a 11 stray problem, they, you know, have a proper place to do it 12 there where they don't have to run back and forth and feed and 13 check, that sort of thing, as we get those animals at the Ag 14 Barn. You know, we take them in as strays. Environmental 15 Health, Mr. Shaver has gotten his certification to be a D.R., 16 so he is -- he's been through all the whole job now as far as 17 inspections and that sort of thing. And, let me see, what did 18 I -- Library Board, now we have a new board member, and I'm 19 looking forward to that.
