The only item on the agenda is to 11 consider, discuss, take appropriate action to approve SECO 12 Energy Efficiency and Conservation Block Grant for Kerr 13 County and authorize County Judge to sign same. As the Court 14 knows, we made an application. Ms. Lavender was kind enough 15 to do all the work involved. Kerr County made the 16 application under the energy grant, the SECO grant program, 17 and we were allocated approximately $115,000. It has been 18 approved. The contract was sent to us -- 19 MS. LAVENDER: Last Wednesday. 20 JUDGE TINLEY: -- late last Wednesday, with the 21 proviso that it needed to be signed and returned by day after 22 tomorrow. There was provision for asking for an extension. 23 But to not run the risk of having the extension denied, and 24 further, to make sure we stay on top of the pile, as it were, 25 to get our money, we've called a special Commissioners Court 6-7-10 4 1 meeting. Mr. Henneke, have you reviewed the contract that 2 was proposed for acceptance by the Court and my signature? 3 MR. HENNEKE: I have, Your Honor and Commissioners. 4 This is money that the County's applied for through State of 5 Texas and the Comptroller's office, coming down from the 6 federal government under the TARP money. It's only the 7 federal government that could have a 50-page agreement to 8 provide for buying of a couple air-conditioners, some light 9 bulbs and digital thermostats. I do need to counsel and 10 advise the Court very strenuously that specifically provided 11 for in this agreement is a strict prohibition upon using of 12 these funds to build a zoo or swimming pool, and so we can't 13 do that. 14 COMMISSIONER BALDWIN: Is that in writing? 15 MR. HENNEKE: It is. 16 COMMISSIONER BALDWIN: Dadgumit. 17 COMMISSIONER WILLIAMS: Can we do a swimming pool 18 next to a zoo, just combine the two? 19 MR. HENNEKE: But I've reviewed it. The only -- I 20 know that Ms. Lavender will continue to administer it. 21 There's strict requirements with regard to reporting, which 22 seems to be the main hurdle, but basically at the end of it, 23 it is $115,000, and there's a lot of legalese, but those are 24 the conditions of accepting the money and being able to move 25 forward with the grant. But I don't see anything that would 6-7-10 5 1 cause us to reject those funds. 2 COMMISSIONER WILLIAMS: In other words, we can go 3 ahead, right? 4 MR. HENNEKE: Yes, sir. 5 COMMISSIONER WILLIAMS: As long as you don't build 6 a zoo or a swimming pool. 7 MR. HENNEKE: Correct. 8 JUDGE TINLEY: Well, if I were Commissioner 9 Baldwin, I might say something like, "We can't do anything 10 close to the courthouse, because that would be tantamount to 11 being close to a zoo." (Laughter.) 12 COMMISSIONER WILLIAMS: Yeah. 13 JUDGE TINLEY: But I'm not Commissioner Baldwin, so 14 I'm not going to say that. 15 COMMISSIONER BALDWIN: We didn't say that. 16 COMMISSIONER WILLIAMS: Not even thought of. 17 Didn't even think of it. 18 COMMISSIONER BALDWIN: Judge, I move for approval 19 of the agenda item. 20 COMMISSIONER WILLIAMS: I second the motion. 21 JUDGE TINLEY: Motion made and seconded for 22 approval of the agenda item. Question or discussion on the 23 motion?
