"BUSTER" BALDWIN, Commissioner Pct. 1 WILLIAM "BILL" WILLIAMS, Commissioner Pct. 2 24 BRUCE OEHLER, Commissioner Pct. 4 25 ABSENT: JONATHAN LETZ, Commissioner Pct. 3 2 1 On Thursday, October 14, 2010, at 1:00 p.m., a special 2 meeting of the Kerr County Commissioners Court was held in 3 the Commissioners' Courtroom, Kerr County Courthouse, 4 Kerrville, Texas, and the following proceedings were had in 5 open court: 6 P R O C E E D I N G S 7 JUDGE TINLEY: Okay, let me call to order this 8 special Commissioners Court meeting posted and scheduled for 9 this date and time, Thursday, October 14, 2010, at 1 p.m. It 10 is that time now. The item on the agenda is to open bids for 11 county employee health benefits insurance, refer to 12 appropriate personnel for review and recommendations. We've 13 got a whole stack of stuff here. 14 COMMISSIONER OEHLER: Whoa. Oh, it's on a cart. 15 JUDGE TINLEY: Yeah, we've got them on a hand truck 16 over there. 17 COMMISSIONER BALDWIN: Do you want me to call Road 18 and Bridge, see if we can get -- 19 COMMISSIONER WILLIAMS: Get a forklift? 20 THE CLERK: There's some scissors; might make it 21 easier. 22 COMMISSIONER OEHLER: Oh. Judge, I hope you know 23 what you're looking at when you look at this. 24 JUDGE TINLEY: Ray's got a knife, I'll bet you. 25 COMMISSIONER WILLIAMS: Got a big stiletto? He's 10-14-10 3 1 got it right there. 2 JUDGE TINLEY: Ray's got it. 3 COMMISSIONER OEHLER: Oh, we got books. All right. 4 JUDGE TINLEY: Okay. Let me just have one of them. 5 Okay, the first proposal is from Mutual Assurance 6 Administrators, Inc. They appear to be out of Addison, 7 Texas. Next one is from Benefit Choices Company. 8 COMMISSIONER WILLIAMS: Who, Judge? 9 JUDGE TINLEY: Benefit Choices -- 10 COMMISSIONER WILLIAMS: Okay. 11 JUDGE TINLEY: -- Company, out of Kerrville. 12 COMMISSIONER BALDWIN: Texas? 13 JUDGE TINLEY: Yes. Ward E. Jones, II. 14 COMMISSIONER WILLIAMS: Oh, Ward Jones. Okay. 15 COMMISSIONER OEHLER: This one says "Humana" on it. 16 JUDGE TINLEY: Apparently the plan is going to 17 be -- is with Humana, but the presenters are shown to be 18 Carey Malek and Ward Jones. 19 COMMISSIONER WILLIAMS: Mm-hmm. 20 JUDGE TINLEY: So, these go together. You can 21 stuff that all in there. I believe he's going to do okay at 22 this job. 23 COMMISSIONER WILLIAMS: He's doing good. 24 COMMISSIONER BALDWIN: Pretty good. 25 COMMISSIONER WILLIAMS: Especially since he got the 10-14-10 4 1 right kind of tool. 2 COMMISSIONER OEHLER: Yeah, Ray gave me his -- the 3 right tool. I'll do it this way. 4 COMMISSIONER BALDWIN: Just think catfish. 5 COMMISSIONER OEHLER: Well, yeah. 6 COMMISSIONER BALDWIN: Or backstrap, maybe. 7 COMMISSIONER OEHLER: Well, it's more like the 8 backstrap. 9 COMMISSIONER BALDWIN: Yeah. Is it axis or 10 whitetail? 11 COMMISSIONER OEHLER: This is just a hog. You 12 wouldn't do axis that way. 13 COMMISSIONER BALDWIN: I was going to say. 14 JUDGE TINLEY: Okay. 15 MS. HYDE: These are from the same person. So 16 that's -- 17 JUDGE TINLEY: Go ahead and open that other one, 18 too. I have one-half of a package from Pharmacy Benefits 19 Management through Script Care. 20 COMMISSIONER OEHLER: How'd you know about that? I 21 thought you worked for U.P.S. 22 MS. HYDE: They used our boxes. 23 COMMISSIONER OEHLER: That must be the other half. 24 JUDGE TINLEY: No, same thing. It may be that 25 they're only bidding on the scrip package. 10-14-10 5 1 MS. HYDE: Prescription. 2 JUDGE TINLEY: Okay. Script Care, Ltd., out of -- 3 of -- well, I don't see it -- Beaumont. Unless they have 4 something else to pair that up with, they're bidding on the 5 prescription only. 6 COMMISSIONER BALDWIN: Both of those were from 7 Script Care? 8 JUDGE TINLEY: Yes. 9 COMMISSIONER BALDWIN: And one of them was 10 something and the other was something else? 11 JUDGE TINLEY: They were the same. 12 MS. HYDE: They were the same. 13 COMMISSIONER BALDWIN: Oh. 14 MS. HYDE: You asked for three copies. 15 COMMISSIONER BALDWIN: I see. 16 COMMISSIONER OEHLER: Four copies of the same 17 thing. 18 COMMISSIONER BALDWIN: I see. 19 COMMISSIONER OEHLER: That's according to the 20 Judge. I didn't look at them. 21 JUDGE TINLEY: Okay. Next one is from ING, also 22 shown to be out of Addison. 23 COMMISSIONER OEHLER: Goodness, one letter. Same 24 one? 25 MS. HYDE: Hmm-mm. 10-14-10 6 1 COMMISSIONER OEHLER: Different one. 2 JUDGE TINLEY: Here's a declination to bid from 3 Texas Association of Counties. 4 COMMISSIONER OEHLER: If you do this right, you 5 don't have to use a knife. But then it doesn't work and you 6 have to use a knife anyway. (Laughter.) Look out there, 7 Judge, you're in the line of fire. Going to get it yet. 8 Counterfeit box. 9 JUDGE TINLEY: Okay. This one is from Clint Wilson 10 and Cooperative Purchasing Network. 11 COMMISSIONER WILLIAMS: Does have it a corporate 12 title? 13 JUDGE TINLEY: Huh? 14 COMMISSIONER WILLIAMS: Doesn't that say a 15 corporate title in that stationary in there or something? 16 JUDGE TINLEY: Well, apparently Entrust is involved 17 in -- 18 COMMISSIONER WILLIAMS: Oh, Entrust. 19 JUDGE TINLEY: -- in some way, shape, form, or 20 fashion. 21 COMMISSIONER WILLIAMS: Got you. 22 JUDGE TINLEY: It's presented by, according to the 23 cover, Clint Wilson and Cooperative Purchasing Network. 24 COMMISSIONER WILLIAMS: Mm-hmm. 25 COMMISSIONER OEHLER: We'll see if that one works 10-14-10 7 1 better than the last one. According to the 5 brief cover, directing our responses to only services we 6 offer, which are Section 125 plan administration and HRA 7 administration. 8 COMMISSIONER OEHLER: That's the same thing that 9 you got in there? 10 JUDGE TINLEY: I'm sure it probably is. Yes. 11 COMMISSIONER WILLIAMS: Got some homework there for 12 you. 13 COMMISSIONER OEHLER: They probably gave us a bunch 14 of paper. 15 JUDGE TINLEY: Okay, U.M.R. And let's see what it 16 shows them to be out of. I think they're our current plan 17 administrator, T.P.A., aren't they? 18 MS. HYDE: They are. 19 JUDGE TINLEY: Okay. 20 COMMISSIONER BALDWIN: Where are they from? 21 JUDGE TINLEY: Well -- 22 COMMISSIONER WILLIAMS: Arizona, aren't they? 23 MS. HYDE: U.M.R. is a wholly-owned subsidiary of 24 United Health Care. 25 COMMISSIONER WILLIAMS: Okay. 10-14-10 8 1 MS. HYDE: And so it's nationwide. 2 JUDGE TINLEY: I didn't see any -- quickly looking 3 for an address here. 4 COMMISSIONER BALDWIN: Doesn't matter. 5 MS. HYDE: Our people are out of San Antone. Their 6 office that works with us is out of San Antone, okay? So -- 7 JUDGE TINLEY: Is that it? 8 MS. HYDE: That's it. 9 JUDGE TINLEY: Okay. 10 MS. HYDE: We got -- I have the TCPN and the TAC 11 that y'all asked me to make sure that -- the only one that I 12 saw was Entrust. TAC refused -- respectfully refused. 13 JUDGE TINLEY: TAC declined to bid. 14 MS. HYDE: And then there was Entrust. I didn't 15 see one from T.C.G. Did I miss it? T.C.G. is the other TCPN 16 provider. 17 JUDGE TINLEY: No, I don't think so. 18 COMMISSIONER BALDWIN: It was not there. It wasn't 19 read. I have a total of eight. 20 COMMISSIONER WILLIAMS: Me too. Well, one 21 declination. 22 JUDGE TINLEY: Yeah, including the declination. 23 COMMISSIONER BALDWIN: Yes, that is true. 24 JUDGE TINLEY: Okay. 25 MS. HYDE: So there's seven. 10-14-10 9 1 COMMISSIONER BALDWIN: Seven, yes, that's correct. 2 COMMISSIONER WILLIAMS: Seven proposals. 3 JUDGE TINLEY: Do I hear a motion that the bids be 4 accepted as presented and referred to the H.R. Director and 5 our insurance consultant for review, evaluation, and 6 recommendation? 7 COMMISSIONER WILLIAMS: So moved. 8 COMMISSIONER OEHLER: Second. 9 JUDGE TINLEY: Motion made and seconded as 10 indicated. Question or discussion? 11 COMMISSIONER BALDWIN: Can you tell me when they 12 will come back with a recommendation? 13 JUDGE TINLEY: I really couldn't. Obviously, if 14 there were two proposals, it would come back quicker than if 15 there were 12. But we've got seven presumably viable 16 proposals. I would think within the next three to four 17 weeks, hopefully, we'd be able to have something to start 18 with. 19 COMMISSIONER OEHLER: Think it will be by the first 20 meeting in November? Or will there be -- 21 MS. HYDE: I'm going to say the first meeting in 22 November, if -- Gary and I are going to talk. He's in 23 Brownwood today, and we're going to talk tonight. Wayne's 24 going to be taking them back, copies of them, so we got to go 25 downstairs and separate them. But I'll say that, and then if 10-14-10 10 1 we can do it faster... Now, Commissioner Letz came 2 downstairs this morning; he thought it was at 10 o'clock, and 3 so he agreed that we should look at having a workshop instead 4 of trying to do it with a commissioners -- commissioners 5 court. Yeah, sorry about that, Commissioner Baldwin. 6 COMMISSIONER OEHLER: A workshop, to where we don't 7 have to focus on anything but insurance. 8 MS. HYDE: That way it's not an all-day affair 9 where you have court and this, and then you guys can -- we 10 can try to get you something in advance where you can be 11 thinking of some questions, that kind of thing. So, I told 12 him we would -- we would get back. 13 JUDGE TINLEY: I would agree that a workshop for 14 this particular subject would probably be appropriate so that 15 we can spend whatever time is necessary, 'cause we're talking 16 about a -- a significant decision here. I -- you know, the 17 first meeting in -- in November is not quite a month away. I 18 haven't looked, but -- the 8th. 19 MS. HYDE: The 8th? 20 JUDGE TINLEY: Certainly by that time; hopefully we 21 can get to it sooner, possibly maybe the week before, 'cause 22 we probably need to make a decision on this thing by 23 mid-November because of getting things in place and having an 24 enrollment period. Wouldn't you think, Ms. Hyde? 25 MS. HYDE: I'm hoping, yes, sir. Yes, sir, 'cause 10-14-10 11 1 we want to try to do open enrollment the first week of 2 December. 3 COMMISSIONER WILLIAMS: First week of December? 4 MS. HYDE: We did that last year. We got it to the 5 second week of December. Our goal was to get it to the first 6 week, have make-ups or missed the second week with the 7 retirees. 8 JUDGE TINLEY: Okay. Any other question or 9 discussion on the motion? 10 COMMISSIONER WILLIAMS: No, sir. 11 JUDGE TINLEY: All in favor of the motion, signify 12 by raising your right hand. 13 (The motion carried by unanimous vote.) 14 JUDGE TINLEY: All opposed, same sign. 15 (No response.) 16 JUDGE TINLEY: The motion does carry.
