OVERBY, Commissioner Pct. 2 JONATHAN LETZ, Commissioner Pct. 3 25 BRUCE OEHLER, Commissioner Pct. 4 2 1 I N D E X October 29, 2012 2 PAGE 3 1.1 Consider/discuss, take appropriate action to provide funding, in partnership with City of 4 Kerrville, for electrical upgrades to former B.A. Products building, with City and County to 5 each pay one-half actual cost, but not to exceed total sum of $47,000 3 6 2.1 Pay bills 8 7 --- Adjourned 9 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 3 1 On Monday, October 29, 2012, at 11 a.m., a special 2 meeting of the Kerr County Commissioners Court was held in 3 the Commissioners' Courtroom, Kerr County Courthouse, 4 Kerrville, Texas, and the following proceedings were had in 5 open court: 6 P R O C E E D I N G S 7 JUDGE TINLEY: Good morning, ladies and gentlemen. 8 Let me call to order this special meeting of the Kerr County 9 Commissioners Court posted and scheduled for this date and 10 time, Monday, October 29th, 2012, at 11 a.m. It is that time 11 now. The agenda item for this morning is to consider, 12 discuss, take appropriate action to provide funding, in 13 partnership with the City of Kerrville, for electrical 14 upgrades to the former B.A. Products building owned by the 15 City and the County at the airport, with City and County to 16 each pay one-half of the actual cost, but not to exceed a 17 total of $47,000. I was contacted by the folks from Alamo 18 Colleges. As you know, they've got -- the City and the 19 County have given them a lease out there to do training, 20 initially for welding for -- primarily for Fox Tank projects 21 and others. And as a result of using that -- that building, 22 they found that certain improvements were necessary. 23 Unfortunately, the grant which they have in place covers 24 training, supplies, and equipment. Doesn't -- doesn't cover 25 upgrades to the building. But notwithstanding that, they 10-29-12 4 1 have expended a considerable sum of money already on our 2 building, Mayor Pratt, which will become inhabitable and 3 usable, and one that we can hopefully, down the road, charge 4 money for if they're not using it for job training and things 5 like that. 6 I've given each member of the Court a kind of a cut 7 sheet of what's been going on out there, what's been expended 8 and what is in the offing. I apologize for having to call a 9 special meeting, but they need to move forward with that 10 electrical, and the City's in a position to cover their 11 portion without having a meeting, I'm told by the City 12 Manager and the Mayor, and -- and we need to authorize ours, 13 because it was not a specifically budgeted item. You'll note 14 it talks about electrical, 47,000, and you have a bid. 15 Notwithstanding that figure, Ms. Fahrenthold, who is here 16 from Alamo Colleges, has been -- I don't know whether she's 17 been beating up on the electrical contractor or what she's 18 been doing. She tells me she's improved that figure some. 19 The bottom line that -- that I'm asking the Court for 20 approval on is to approve up to a total sum of $47,000, with 21 our exposure to be one-half of that, but not to exceed 22 one-half of the actual cost, whatever that turns out to be, 23 which hopefully will be hopefully 40 or less. I have talked 24 with the Auditor. We have airport funds which have 25 accumulated from various projects out there, which are 10-29-12 5 1 sufficient to cover this expenditure. And that's pretty much 2 it in a nutshell. 3 COMMISSIONER BALDWIN: Judge, are you saying that 4 the 47,000 is our share? 5 JUDGE TINLEY: No, no. 6 COMMISSIONER BALDWIN: That's a total? 7 JUDGE TINLEY: 47 is the total. What I'm asking 8 the Court for authorization for is one-half of the actual 9 cost, with the City paying the other one-half. And like I 10 say, I received commitment from both the City Manager and the 11 Mayor that -- that they will respond for their portion, but 12 for the total cost not to exceed 47,000, our maximum exposure 13 being $23,500. 14 COMMISSIONER BALDWIN: Good. 15 COMMISSIONER LETZ: Judge, this was discussed at 16 the Airport Board meeting, and I think, unless I'm mistaken, 17 the way we really need to do this is to authorize the Airport 18 Board to have a capital expenditure, because they can't -- 19 they can't expend a capital expenditure -- it's coming out of 20 their money. It's not coming out of our money. Which -- and 21 so they can't do it without coming to us. Because of the 22 interlocal agreement, they can't authorize a capital 23 expenditure. Is that not correct, Jeannie? And Mayor? 24 MS. HARGIS: With it -- according to the contract 25 they signed with -- with AACOG is that they would spend no 10-29-12 6 1 money on that building. 2 COMMISSIONER LETZ: But they're willing to -- 3 Mayor, didn't they pretty much -- they agreed this was coming 4 out of their reserves? 5 MR. PRATT: That's correct. 6 MS. HARGIS: No, it's not coming out of their 7 reserves. They're going to come up with the money; we're 8 going to come up with the money. 9 COMMISSIONER LETZ: I thought it was coming out of 10 the airport budget. 11 MS. HARGIS: No. 12 JUDGE TINLEY: The funds that Ms. Hargis has found 13 as airport-related funds which are, in essence, earmarked for 14 airport use, we have in the county coffers. 15 COMMISSIONER LETZ: This is money that -- so the 16 money that was refunded back from the TexDOT grants is -- 17 MS. HARGIS: Yes. We have -- we have three refunds 18 both of us have received this year; they're identical. One 19 was $17,672.97, one was 9,747.15, and the other one 3,944.06. 20 So, we have close to $30,000. And we left the 17,000 in 21 their capital account to be used, but they had to have our 22 permission to use it. And then I put -- the other two 23 refunds were put in our regular account, so -- 24 COMMISSIONER OEHLER: Okay. 25 COMMISSIONER LETZ: Okay. I mean, it's designated 10-29-12 7 1 airport money. I thought it was coming out of the airport 2 budget. It's actually coming out of our part of it. 3 MR. PRATT: And we're -- 4 COMMISSIONER LETZ: Tom's agreeing. 5 MR. MOSER: Nothing out of the airport. 6 MR. PRATT: It's coming from the City to the 7 airport out of city funds allocated for airport, and I think 8 that's the same as you. 9 JUDGE TINLEY: Same here, yeah. 10 COMMISSIONER OEHLER: Same refunds that we all got. 11 MR. PRATT: That's exactly right. 12 COMMISSIONER OEHLER: Okay. 13 COMMISSIONER LETZ: Okay. I'll make a motion to 14 authorize expenditure of up to 50 percent of $47,000, for the 15 funds to come from county funds that are refunded from 16 airport projects. 17 MR. PRATT: Did you mean 47, or 23,5? 18 COMMISSIONER LETZ: Fifty percent -- 50 percent of 19 47. 20 MR. PRATT: Okay, I didn't catch the 50 percent. 21 COMMISSIONER OEHLER: I'll second your motion. 22 JUDGE TINLEY: We have a motion and second as 23 indicated. 24 COMMISSIONER OEHLER: Being as Number 2's quiet 25 there. 10-29-12 8 1 COMMISSIONER OVERBY: Yes. 2 JUDGE TINLEY: Further question or discussion? Just -- it's autopsies, so that 11 we can take them back to last year. They are updated last 12 year, and the auditors will take them back. It's $4,200. 13 COMMISSIONER LETZ: Autopsies? 14 MS. HARGIS: Yeah, two autopsies. 15 COMMISSIONER LETZ: Move approval. 16 COMMISSIONER BALDWIN: Second. 17 JUDGE TINLEY: Motion made and seconded for 18 approval. Question or discussion?
