Welcome to the Commissioners Court. This is 9 9 a.m., Monday, December the 23rd, in the Commissioners 10 Courtroom, Kerr County Courthouse. It's my turn, isn't it? 11 If y'all will all stand, and we'll have a word of prayer, and 12 then the pledge of allegiance. 13 (Prayer and pledge of allegiance.) 14 COMMISSIONER BALDWIN: Thank you. You may be 15 seated. If there's any citizens that wish to speak to us 16 about something that is not an agenda item, please come 17 forward. We would like for you -- if you want to speak about 18 an agenda item, we'd like for you to fill out a form in the 19 back. But if not, if you get our attention, we'll be happy 20 to recognize you. There's a gentleman approaching the 21 podium. Yes, sir? 22 MR. REEVES: Good morning, gentlemen. 23 COMMISSIONER BALDWIN: Give us your name and 24 address, please. 25 MR. REEVES: Bob Reeves. I represent the Hill 12-23-13 4 1 Country District Junior Livestock Show Association. I'd just 2 like to take a few minutes -- I know y'all have a busy day, 3 but I'd like to take a few minutes and bring you up to date 4 on the 70th annual edition of our livestock show. We made a 5 lot of changes this year. Many of these changes they're 6 doing are due in part to the partnership that this Court has 7 given us. The expansion of the show facilities has enabled 8 us to expand our show to seven full days this year. We have 9 a record number, 2,964 entries coming in. More importantly, 10 1,211 4-H and F.F.A. members. We will begin the show this 11 year on Sunday, January the 12th. 12 Some other numbers you may be interested in. We're 13 expecting, at the heat of the show on Thursday and Friday, 14 over 3,000 people in attendance each day. We will award 15 $20,000 in scholarships based on achievements in the show 16 ring. This $20,000 in scholarships is over and above the 17 $40,000 which the show awards in scholarships based on 18 academic achievements. We'll give over $30,000 in cash and 19 other prizes to the winners of our various events. This 20 comes from underwriting and donations. Many of you donate to 21 the trophy fund, the award fund; we do appreciate that. 22 Thanks to the completion last year, or actually the first of 23 this year, of Phase 1, a record number, 1,219 market and 24 breeding swine will be shown this year. It's going to take 25 four days to show all of those, and it's just a tribute to 12-23-13 5 1 what y'all have done and helped us with. 2 Another exciting change, I think most of you are 3 aware that the Angora goat show has been a statewide show for 4 well over a decade. This year we've expanded the ag 5 mechanics show to statewide. Sixty-two projects will be 6 exhibited. If you haven't ever come out to look at the ag 7 mechanics show, come out; they're some of the best projects 8 that these people have worked a year or more building. 9 Because of the growth of the ag mechanics show, we'll have to 10 use two venues; the indoor arena for the larger projects, and 11 the old exhibit hall will be utilized for some of the smaller 12 projects that are being built. So, we're excited with the 13 statewide show being expanded, and we're looking at it. 14 To kind of give you a rundown of the week's events, 15 on the 12th, the Angora goats and the breeding swine, 350 16 head of those will be coming in. We'll start judging Sunday 17 afternoon with our county shows. The following Monday, we 18 will start with the statewide Angora goat show and the 19 district breeding swine. While that's going on, the ag 20 mechanics projects will be coming in on Monday, and they will 21 be judged all day Tuesday. It's an all-day event. Tuesday 22 afternoon, Mr. Bauer's registered sheep department arrives. 23 They'll judge those Wednesday while our county entries are 24 coming in. Thursday and Friday is when it gets real busy 25 with our county show, as well as the district entries 12-23-13 6 1 arriving. Friday will be our market show, along with our 2 heifer show. Then Saturday, the grand finale, and that's our 3 auction. Based on preliminary pledges that are coming in, we 4 anticipate that we will exceed our record sale of last year, 5 which was $960,000 that was awarded to the kids. 6 Other dates I'd like you to remember, January 4th 7 is our annual appreciation dinner. The invitations have gone 8 in the mail, but on behalf of the association, I invite all 9 of y'all to come out, eat supper. We will recognize our 10 buyers, recognize our stock show dedication. This year the 11 show is being dedicated in memory of a major supporter of the 12 show, as well as a great civic citizen of Kerr County, and 13 that was Ms. Hazelle Calcote, and we'll be dedicating it in 14 her memory. The 10th of January is the Cowboy Breakfast 15 right here on the show ground -- or on the courthouse 16 grounds, so we look forward to seeing you then. And another 17 thing, I would like to express my appreciation to those of 18 you on the Court, Mr. Henneke and all of the other elected 19 officials that come out to volunteer as announcers, to help 20 in the show ring. 21 When my kids were showing, we went to shows all 22 over the state of Texas, and you do not see the support at 23 any other show that we see here from the elected officials. 24 Many of you have announced over the years. Mr. Henneke will 25 be up there catching bids. What other show do you go to that 12-23-13 7 1 you have two district judges out there working in the show 2 ring to help us get ready? So, we're just greatly 3 appreciative of all of that. As usual, Commissioner Baldwin, 4 we will have plenty to eat upstairs. I'm not sure what day 5 the gumbo is going to be served, but I'll let you know on 6 that. And I know all of y'all are welcome to come up there. 7 We've had unprecedented help this year from our media in 8 marketing the show; radio, print. The Convention and 9 Visitors Bureau has produced a TV advertisement that will hit 10 the San Antonio markets and down here, not only touting the 11 benefits of our show, but of our county. They've been a 12 great help on it. 13 Another new implementation that we have this year 14 is the old exhibit hall, for the first time, will have 15 commercial exhibits. Every year we get calls, "Can we set up 16 this booth? Can we set up this booth?" Starting Wednesday, 17 our top buyers, our major supporters are going to set up some 18 booths in the old exhibit hall and run through Friday until 19 we have to get ready to set up for the auction. Ms. Weaver 20 and Mr. Dean from the Chamber are helping us with the 21 logistics on that, so we're -- we're very excited. We 22 recently -- as you will recall, last year, with the 23 completion of the new show barn, the association spent 24 $300,000 on new pens. Thanks to a grant from the Community 25 Foundation, as well as some of our reserve funds, we 12-23-13 8 1 purchased another $40,000 of pens, which were delivered last 2 fall, and they've been set up. So, not only do we have a new 3 facility, we have new first-class pens, and we look to keep 4 adding to those. 5 We -- we started setting up for the show on 6 December 9th, and I'd like to take an opportunity to thank 7 some people -- Mr. Bollier and his staff, Mr. Odom and his 8 staff -- with providing the labor and the equipment to get 9 the pens set up. We've never been this far ahead of 10 schedule. Sheriff Hierholzer, Deputy Johnson and the 11 trustees were out there working, and while we've still got a 12 lot of work to do, I can't thank them enough, and I thank you 13 for allowing them to help us. Our judges this year will come 14 from all over Texas and the United States. As you may well 15 know, the judges are some of the foremost in the animal 16 industry. Many of these have judged shows such as San 17 Antonio and Houston. Other judges that are coming in, I know 18 for a fact those major shows send representatives down here 19 to see how they're doing, and they'll be at other shows in 20 the future. Our show believes in giving back. Our 21 exhibitors who no longer show, they're using their vacation 22 time. They're coming from school, and they're going to be 23 working in the show ring, and that's because of what they 24 believe, just like we do, the support of the 4-H and F.F.A. 25 members. 12-23-13 9 1 One of the judges that we're most excited about 2 having back this year, he judged about 10 years ago, and then 3 hasn't been back. But it's a homegrown gentleman, grew up in 4 Precinct Number 4 out Highway 39. I watched him grow up out 5 at that show barn, watched him help Ingram Tom Moore High 6 School win a state basketball championship several years ago, 7 and by luck, I was at Reed Arena in College Station about 8 four years ago to watch my son graduate, and I got to see him 9 receive his Ph.D. And I think most of you that have been 10 around here know him, and I still refer to him as Andy, but 11 it's Dr. Andy Laughlin. He's an assistant professor at 12 Lubbock Christian College. And he was excited to come back 13 home and judge this show. He's going to judge the county 14 lambs and the county goats on Thursday. I think a lot of you 15 know him, and good to see him come back. 16 Finally, I just want to thank this Court on behalf 17 of the association for all that they do. Years ago, you said 18 you were our partner, and you've proved it. And we look 19 forward to an exciting show. It's going to bring a lot of 20 people in Kerrville, and we're looking forward to that. So, 21 I know you have a busy agenda. 'Cause that's pretty impressive. 3 MR. REEVES: The major shows like San Antonio, 4 Houston, San Angelo, all have statewide. 5 COMMISSIONER MOSER: Okay. 6 MR. REEVES: So, that -- this is our newest 7 department, and it's growing. 8 COMMISSIONER MOSER: That's great. 9 MR. REEVES: Growing by leaps and bounds. 10 COMMISSIONER MOSER: Super. 11 COMMISSIONER BALDWIN: Any other questions for him? 12 Thank you very much. 13 COMMISSIONER LETZ: Go ahead and update us on the 14 speakers, if you will. 15 MR. REEVES: Oh. We've been working on the sound 16 system. I guess any time you build something new, you seem 17 to need to tweak something. And the show, in addition to the 18 $40,000 in equipment that we've purchased, we've gone in 19 partnership with the County and are paying for $4,500 worth 20 of speaker upgrades to the -- to the sound system out there 21 out of our funds, and we're more than happy to help y'all 22 with that. 23 COMMISSIONER BALDWIN: Thank you. 24 COMMISSIONER MOSER: Good deal. 25 COMMISSIONER BALDWIN: That was needed, I can tell 12-23-13 11 1 you. 2 COMMISSIONER OEHLER: Thank you. 3 MR. We'll have some -- 10 some comments from the Commissioners Court at this time. 11 Commissioner 2? 12 COMMISSIONER MOSER: Nothing right now -- well, I 13 will, yeah. 14 COMMISSIONER BALDWIN: I found that hard to 15 believe. 16 COMMISSIONER MOSER: Yeah, right, right, right. 17 Thank you for reminding me. The -- we had a meeting at the 18 airport the other day, looking at the possible increases in 19 revenue. A couple of us -- the Mayor and myself and some 20 others -- went over to Austin to meet with the governor's 21 economic development department on potential funds for that 22 airport. I think we have found some potential funds that we 23 could pursue. We still haven't negotiated the -- the deal 24 with -- the Airport Board hasn't negotiated the deal with 25 Mooney. That's pending. But this is in preparation for 12-23-13 12 1 that, so the City and County can look at that facility and 2 see what we can contribute to make that a going operation. 3 Mooney has a very aggressive plan to have a bunch of 4 employees out there. I think that's been in the press, so 5 we're -- we're helping them in every way that we can. 6 There's to be a negotiation an agreement on a lease with the 7 Brinkman hangar, which the City/County reacquires that at the 8 end of this calendar year, which is next week, and we hope 9 that that comes to fruition. And, anyway, I think the 10 revenue from the City and the County next year is going to be 11 even further greatly reduced. So, there's a lot of good 12 things happening out there. And they've agreed on a contract 13 -- let a contract to build 12 T-hangars, which will increase 14 revenue. So, lots happening out there, all in the name of 15 economic development and -- and increasing that facility. 16 That's it. 17 COMMISSIONER BALDWIN: Super. Thank you, sir. 18 COMMISSIONER MOSER: Mm-hmm. 19 COMMISSIONER LETZ: I just want to add one thing 20 about the airport, that -- related to Mooney. I made a 21 comment to the Airport Board, and I think they -- they agree, 22 and I know the Mayor agrees; we talked briefly about it. 23 That Mooney's -- obviously, the Court has not dealt with that 24 directly; they're with the new start-up and the sale. And 25 the City hasn't been either, but I think it was agreed that 12-23-13 13 1 all three parties, Airport Board and City and the County, 2 need to get together on this. It's a very potential big 3 item, and it may -- it's going to -- may involve some of our 4 assets out there in doing one thing or another. So, I think 5 in the future, probably in January sometime, I'm guessing, 6 maybe some sort of joint meeting, or I don't know how we'll 7 handle it. But I think the whole Court needs to get -- you 8 know, be brought up to speed on that. 9 COMMISSIONER MOSER: Sure. 10 COMMISSIONER LETZ: And that's the main thing on 11 that. It is very important, very important to the community 12 and very important to the airport. Other than that, -- 13 COMMISSIONER BALDWIN: Merry Christmas. 14 COMMISSIONER LETZ: -- I don't think I have 15 anything else. 16 COMMISSIONER BALDWIN: Mr. Oehler? 17 COMMISSIONER OEHLER: Well, I went the other 18 evening over to Fredericksburg and saw their lights. And I 19 tell you, I went to Johnson City; that's quite impressive 20 over there, what they have over there, Pedernales Electric 21 and the courthouse and the little park. And went to Marble 22 Falls; they've got one heck of a display over there. 23 Kerrville lights are great. I mean, the courthouse looks as 24 good or better than it ever has, in my opinion. There's one 25 thing I did notice, though, about those other towns, and that 12-23-13 14 1 evidently we've had a little comment here about "Merry 2 Christmas." They got banners across the towns over there 3 saying "Merry Christmas," but we can't have it here. So, 4 that to me is a little surprising. And I know there are 5 people that are offended by that, but just -- it's just not 6 okay in Kerrville, but it is everywhere else. So, anyway, 7 that's enough of that. 8 COMMISSIONER BALDWIN: Thank you, sir. Speaking to 9 that, in all the years I've been here, that was the first 10 time that I've ever had anybody complain about Christ being 11 on the Kerr County Courthouse. 12 COMMISSIONER OEHLER: Mm-hmm. 13 COMMISSIONER BALDWIN: And I don't think that he 14 will complain any more about that, by the way. We have an 15 award to present this morning. Kerr County Clerk receives 16 the Five Star Exemplary Vital Registration Award for the 14th 17 consecutive year. Jannett Pieper, Kerr County Clerk, was 18 honored with a Five Star Exemplary Vital Registration Award 19 by the Texas Department of State Health Services during an 20 award luncheon held during the 59th annual Vital Statistics 21 Conference to recognize the efforts and dedication to vital 22 records. So, she's got this great thing 14 years in a row, 23 and it's not -- there's different categories, and I can't 24 remember what they are. Jannett, what -- yours is 25 "exemplary," but super fantastic and great and honorable and 12-23-13 15 1 all that stuff? 2 MS. PIEPER: Each year they make the criteria a 3 little bit harder for to us meet, so after 14 years, 4 hopefully they're going to run out of criteria one of these 5 days. So -- 6 COMMISSIONER BALDWIN: So, anyway, congratulations. 7 Thank you for your hard work. 8 MS. PIEPER: Thank you. 9 COMMISSIONER BALDWIN: I don't know where you're 10 going to start putting these things. You're going to have to 11 build a new hall. 12 MS. BOLIN: Back in November, you approved my 12 bookkeeper position, and I already had a bookkeeper in my 13 office, so I just moved her over to that position, which left 14 one of my motor vehicle positions open. So, I need to fill 15 that, please. Please, please. 16 COMMISSIONER BALDWIN: Budgeted position? 17 MS. BOLIN: It is a budgeted position. Item 1.3; 5 consider, discuss, take appropriate action on implementation 6 of the burn ban, and allow Commissioner Baldwin to sign the 7 order. This is the burn ban issue. The way I understand it, 8 it's a 90-day deal, and each Commissioner has the authority 9 to put the burn ban on or take it off, either one. 10 COMMISSIONER OEHLER: Move approval. 11 COMMISSIONER LETZ: Second. 12 COMMISSIONER BALDWIN: Motion and second. Is that 16 including me to sign the order? 17 COMMISSIONER MOSER: Yep. 18 COMMISSIONER BALDWIN: Item 1.4; consider, discuss, 19 and take appropriate action on establishing procedure for 20 identifying candidates for the county EMS/First Responder 21 program. Commissioner Moser? 22 COMMISSIONER MOSER: Thank you very much, 23 Commissioner Baldwin. We've been talking about this now for 24 probably six months intensely. We have a number of people in 25 the county that want to be First Responders. We have not 12-23-13 18 1 been able to put them in the program just because of some 2 differences in what we judge to be is -- is candidates and 3 what the City, who coordinates this thing for us, would like 4 to have. To make it very clear, we have a need for 5 additional First Responders, and I'm going to present 6 something which I think gives us a way to get our First 7 Responders, and that is a proposal that the applicants for 8 First Responders in the county, those outside the city, 9 number one, reside within Kerr County or contiguous counties. 10 Number two, that they have a current Texas driver's license 11 in good standing, as well as valid proof of insurance. 12 Number three, that they pass a criminal background check for 13 sex offenses and felonies. Number four, that they pass a 14 motor vehicle records check. Number five, that they pass a 15 drug screening for illegal drugs. Number six, that they pass 16 a medical screening for infectious diseases. Number seven, 17 that they have an EMT Basic certification. 18 The way this would be implemented -- and I've -- 19 we've had several meetings within the -- within the county 20 and within the county staff. I met with H.R. and with the 21 County Attorney, and we think the way to do this is -- is to 22 have H.R. collect all this information, bring that to 23 Commissioners Court and present the information to 24 Commissioners Court for Commissioners Court then to say, 25 "Yea, verily, this person should be a candidate." Then we 12-23-13 19 1 send a letter over to the City saying, "This is who we 2 recommend being incorporated." The letter would delineate 3 all of these seven things that this person would have, or 4 these persons -- people would have. And with that, then, 5 that says it has the County's blessings. They meet all the 6 criteria and requirements and suggested criteria that the 7 City said is good to have. 8 I think it's common sense; the things that I've 9 just delineated should be necessary for a person to be an 10 EMS/First Responder. This is -- this is something that 11 has -- that I think does not have an undue burden on H.R. 12 It's something that Dawn thinks she can accommodate. I think 13 there's no funds or no additional taxes for the county and 14 for its citizens to pay for this. I think we have sufficient 15 budget for this. It will be up to the applicant to get the 16 medical records -- or pass the medical screening test and 17 have the other things, which we would pay for. It will 18 probably be in the neighborhood of about $100 per applicant 19 to get the background check and to have the necessary medical 20 tests performed. So, with that, I'd like to have a 21 discussion on this before I make a motion, see if we can move 22 forward on it. 23 COMMISSIONER BALDWIN: May I make a comment -- 24 COMMISSIONER MOSER: Absolutely. 25 COMMISSIONER BALDWIN: -- right quick? Before you 12-23-13 20 1 do make a motion on it, my guest is not here for Item 1.5. 2 And what I'd like to see happen here -- because I think it 3 goes hand-in-hand, my item and your item. I think they were 4 -- they're going to -- 5 COMMISSIONER MOSER: Mm-hmm. 6 COMMISSIONER BALDWIN: -- help each other along. 7 Let's have the discussion, and then let's hold off on a 8 motion until we hear from both items. 9 COMMISSIONER MOSER: Okay. 10 COMMISSIONER BALDWIN: Would you -- 11 COMMISSIONER MOSER: Yeah, that's fine. That's 12 fine. 13 COMMISSIONER BALDWIN: Okay. 14 COMMISSIONER MOSER: But I just -- I want to -- the 15 discussion being how we get these six things, okay, 16 identified. And I don't think there's -- we can't see much 17 of an issue there. I've met with -- with the Sheriff and got 18 his opinion on this thing. I've met with -- like I said, 19 with H.R., County Attorney. I think this is a 20 straightforward process. I think the thing that -- that it 21 enables us to do -- I know that there are a number of people 22 that can meet all this criteria, okay? I mean, it's a matter 23 of going down and getting a blood test, okay, for some of 24 them. And with this, by the first of the year, we could 25 probably have people that are in the First Responder program 12-23-13 21 1 that have been sitting around, and that are super frustrated 2 that this Court cannot get off the dime and say "yea, 3 verily," and let them become First Responders. 4 COMMISSIONER LETZ: I'll take exception to that. 5 It's not the Court, it's the City. I've heard the mayor say something, but I don't know 13 what authority he's speaking, other than individually as the 14 mayor. So, to say it's the County is just flat wrong. I 15 won't put up with that, Tom. 16 COMMISSIONER MOSER: Okay. Well, let me withdraw 17 that, then. Okay? Let's just say that we -- we've heard 18 from the mayor, we've heard from the EMS Coordinator. We 19 have common sense. And what I've laid out here are things 20 which I think, okay, that if we, the Court, says, "Here's 21 somebody we nominate to be in that program," they should be 22 accepted. Then I don't think there will be any issue with 23 anybody if we can do that. 24 COMMISSIONER LETZ: I wish the City would tell us 25 that. 12-23-13 22 1 COMMISSIONER MOSER: Well, what we will do is, 2 we'll -- what I'm proposing to do is send a letter, okay, to 3 the City Manager saying, "We recommend Mr. John Doe, and 4 here's the reason -- here's what we've done in doing that." 5 Okay? So, you've got the letter in your packets, got the 6 template. The letter has been drafted with -- with the 7 support of the County Attorney. I think -- I think this will 8 do it, okay? I think it's just a one-way street then. It's 9 just simply us saying, "Here's who we recommend and why, and 10 here's the criteria." And we -- the Commissioners Court 11 recommend that this person be incorporated into the -- into 12 the EMS program, okay. So -- 9 COMMISSIONER LETZ: May I ask a question? 10 COMMISSIONER BALDWIN: Sure. 11 COMMISSIONER MOSER: What's the contract for? What 12 services? 13 COMMISSIONER BALDWIN: Well, I kind of want her to 14 go over that, and basically these services, all the same 15 things that you just laid out. And an addition -- one of the 16 additions would be reading and math assessment test, that 17 kind of thing. And this person can do all those background 18 checks that we're requesting. What's your issue with that? 19 Why are you frowning? 20 COMMISSIONER LETZ: Well, I was just trying to 21 understand. Why do we need to hire somebody to do that when 22 we have the staff to do it? 23 COMMISSIONER BALDWIN: We have the staff to do it? 24 COMMISSIONER MOSER: Yeah. I make a motion that -- 19 that the County set up the process to screen applicants using 20 the current staff the County has to make sure that they are 21 qualified under the purview and under the opinion of this 22 Court, and the applicant will submit evidence as presented to 23 Human Resources, and Human Resources will present it to 24 Commissioners Court that the applicant does, in fact, reside 25 within Kerr County or contiguous counties, have a current 12-23-13 25 1 Texas driver's license in good standing, as well as valid 2 proof of insurance, pass a criminal background check for sex 3 offenses and felonies, pass a motor vehicle records check, 4 pass a drug screening for illegal drugs, pass a medical 5 screening for infectious diseases, have an EMT basic 6 certification, and is in good standing. And with that 7 information presented to the Court, the Court will make a 8 decision on whether or not that person should be nominated to 9 the City of Kerrville, who is the current EMS Coordinator. 10 This is -- this is all within the budget that we currently 11 have. It's within the capability of the staff that we have. 12 And with that, I make that motion. 13 COMMISSIONER BALDWIN: Okay. Thank you, sir. 14 There's a motion. We -- this has no -- this has no impact on the way we 18 function, except that it lets citizens, in the meantime -- in 19 the meantime, we have people that may need this service 20 tomorrow, and we can't get off the dime and do it. 21 COMMISSIONER LETZ: We can't, that's right, 'cause 22 we have to go back to the City Council, and it still has to 23 come back to the Court -- 24 COMMISSIONER MOSER: No, we don't. We send a 25 letter over. And I want to make a comment about Mr. Moser's 14 things. And what I had planned with 1.5, it's really not -- 15 it's -- I'm not expecting her to take over the First 16 Responders. However, that would be my wishes. I would 17 prefer that her take over, obviously. The City does not want 18 to -- it has been proven to me over and over again that the 19 City does not wish to do business with us in any way, so it 20 seems to me that we need to start separating ourselves. And 21 -- but the reason we were bringing in the lady today and 22 listening to her, she could interface; she could do all these 23 same things and interface with the City and their desires, 24 their needs, their wishes and wants. And she's the one that 25 could go in and negotiate, and -- and come up with the right 12-23-13 29 1 verbiage, et cetera, and then bring it back to us and go on. 2 So -- but that's -- I just want to say that. It's not a 3 takeover at this point. However, that would be my desire. 4 So -- 5 COMMISSIONER LETZ: Question. So, to clarify 6 that -- and I visited with the County Attorney, who I guess 7 has met with Ms. Millican as well. She would handle the 8 application process, but the process will still stay with the 9 City. 10 COMMISSIONER BALDWIN: That's exactly right. As 11 well as the -- those background checks. 12 COMMISSIONER LETZ: Right. I mean, that's part of 13 it. To me, that's part of the application process, which to 14 me, you know, would be a good idea. But she's not here, so 15 we can't act on that. 16 COMMISSIONER BALDWIN: That's correct. 17 COMMISSIONER MOSER: For clarification on 1.4, just 18 for the record, we do -- the County has an agreement with the 19 City through the end of fiscal year -- this current fiscal 20 year -- 21 COMMISSIONER BALDWIN: That's correct. 22 COMMISSIONER MOSER: -- to provide EMS 23 coordination, first -- EMS/First Responders coordination. 24 COMMISSIONER BALDWIN: That's correct. 25 COMMISSIONER MOSER: Okay. I just wanted to make 12-23-13 30 1 sure that that was clear. Yeah, okay. 2 COMMISSIONER LETZ: I guess -- 3 COMMISSIONER MOSER: So, what -- well, let me ask 4 it. So, what you're proposing -- or not proposing, but 5 you're suggesting here is another option would be to have 6 Ms. Millican -- I believe that's her name -- provide the 7 services the same as what I was proposing that we have H.R. 8 provide for us. So, that's -- apparently, that's the only 9 difference, is that we have H.R. provide the services rather 10 than Ms. Millican. 11 COMMISSIONER LETZ: Well, there's a little bit of 12 difference. 13 COMMISSIONER MOSER: Okay. 14 COMMISSIONER LETZ: I'm a little -- I have a little 15 slight concern about the H.R. Department doing medical 16 screens. She's not a doctor. 17 COMMISSIONER MOSER: No, we would hire that done. 18 That would be -- 19 COMMISSIONER LETZ: So, we're going to contract 20 with a doctor to do medical screening? 21 COMMISSIONER MOSER: No, no, no. I think I made 22 that clear, but let me make it very clear. 23 COMMISSIONER LETZ: For instance, if Tim wants to 24 become a First Responder, Tim would go in to the doctor and 25 get the proof that he passes those tests. He would bring 12-23-13 31 1 that back to H.R., okay? Same way with the drug screening, 2 the medical, both portions of that. So, that would be Tim's 3 responsibility to do that. We would reimburse Tim for those 4 expenses. He would simply bring that back to H.R. H.R. is 5 going to present to this Court all the information that she 6 gathers, and then the Court can decide. 7 COMMISSIONER OEHLER: She can't share that 8 information, because of HIPAA, with this Court. She can make 9 a recommendation of a person, but not based on anything that 10 she would share with this Court that would be a violation of 11 federal law. 12 COMMISSIONER MOSER: She can bring the results. 13 COMMISSIONER OEHLER: Well, this whole thing, I've 14 said from the beginning, is totally ridiculous, that you have 15 people wanting to be First Responders, and it's not this 16 Court's fault that they're not allowed to be. It is the City 17 of Kerrville's fault, that it's never been an issue before, 18 up until recently. And the only documentation we have is 19 that letter that sets out everything from the City of what 20 they're willing to do, and this is all brand-new. That's not 21 part of the contract we have with them to administer the 22 program. That's bull, is what it is. They're keeping people 23 from being First Responders for some unknown reason. And the 24 Mayor doesn't have the authority to come over here and make 25 deals without City Council approval. 12-23-13 32 1 COMMISSIONER MOSER: Well, all we have to do is 2 send them a letter. 3 COMMISSIONER OEHLER: We did that. 4 COMMISSIONER MOSER: No, we didn't send them a 5 letter. 6 COMMISSIONER OEHLER: We sent them a letter saying 7 we want everybody that wants to participate be able to 8 participate. 9 COMMISSIONER MOSER: I don't want somebody to come 10 to my house that doesn't have a medical background. 11 COMMISSIONER OEHLER: Well, do you think that would 12 be the case? That's absolutely foolish. 13 COMMISSIONER LETZ: We told the City to administer 14 the program the way they wanted to, which would be to include 15 background checks if that's what they thought was necessary. 16 They didn't want to do that, and I'm not sure why. But I -- 17 we need to get this -- we've talked about this way too long. 18 COMMISSIONER MOSER: I agree with you 100 percent; 19 we've talked about it way too long. 20 COMMISSIONER LETZ: But it doesn't make sense to me 21 either. I mean, I don't -- if we pass this and send it to 22 the City, we're just back to square one. 23 COMMISSIONER MOSER: We would not. The letter 24 would say, "We recommend this person; put them in the 25 program." 12-23-13 33 1 COMMISSIONER OEHLER: How do you know that they'll 2 accept them? 3 COMMISSIONER LETZ: How do -- what are we sending 4 to the City? If we're going to say this person passes, -- 5 COMMISSIONER MOSER: Right, we're going -- 6 COMMISSIONER LETZ: -- we did that, and they said 7 no. 8 COMMISSIONER MOSER: We're going to send it over 9 and say it passes because of the following, the six things 10 right there. 11 COMMISSIONER LETZ: Okay. To me, it's a one-page checklist. 6 COMMISSIONER BALDWIN: So, you're drawing a line in 7 the sand at if we get another letter. My line's already 8 there. 9 COMMISSIONER OEHLER: Well, mine's been there. 10 COMMISSIONER BALDWIN: Yeah. 11 COMMISSIONER OEHLER: This is -- I mean, we have to 12 try this, because, you know, we are -- we could be affecting 13 people's lives, and we should not be doing that. But it's 14 just -- it's another way to allow somebody to participate in 15 the program that wants to do that. We have some bills here to be paid, 19 and basically that's what this meeting's all about, is to pay 20 the bills at the end of the year. So, I'm excited about those two budget 14 amendments. Those are money coming in, but I do need y'all 15 to accept those. But 21 they -- he had this gigantic box, looked like a big Christmas 22 gift, and opened it -- opened it up, and all the blue 23 balloons came out. That was the announcement. 24 COMMISSIONER MOSER: Oh, neat. 25 COMMISSIONER BALDWIN: So, we got another little 12-23-13 43 1 Buster coming. 2 COMMISSIONER MOSER: Oh gosh. 3 COMMISSIONER OEHLER: Heaven help us. 4 COMMISSIONER BALDWIN: You lucky stiffs. And 5 Christmas lights -- talking about the Christmas lights, San 6 Angelo has the most incredible light show I've ever seen in 7 my entire life. You drive through there, and you take these 8 -- you can take a photograph of the most incredible light 9 show you've ever seen, and it's reflected off of the river at 10 the same time. 11 COMMISSIONER MOSER: Oh wow. 12 COMMISSIONER BALDWIN: It is absolutely beautiful. 13 And I promised them I'd quit drinking so much. 14 COMMISSIONER MOSER: 'Cause you were seeing three? 15 COMMISSIONER BALDWIN: There was three images there 16 on every one of them.
