It's February 16th, 2 2016, at 9 a.m. and the Kerr County Commissioners' Court 3 is in session. We have one item on the agenda this 4 morning. 5 Item 1 consider -- 1.1 consider, discuss and 6 take appropriate action to authorize Nelson Lewis 7 Construction Company to close Quail Valley Road at the 8 intersection of Ranchero Road for installation of a 9 wastewater main, by method of boring and jacking for the 10 Kerrville South Wastewater Project Phase VI from 11 February 17, 2016 through February 26, 2016, that's in 12 Precinct 1 and 2. Anybody want to speak? 13 COMMISSIONER MOSER: Yeah, let me if I may, 14 Judge, kick this off. Gaspar's here from Nelson Lewis, 15 but see if I can set the scene and get this thing 16 through pretty quickly. It's the phase six is not a big 17 project. We're hooking up the apartments in precincts 18 two on the other -- on the west side of 19 Ranchero or north side of Ranchero, south side or 20 whichever it is, and then it has -- we have to bore a 21 line under Ranchero Road. That -- that has been bored, 22 we closed the road on Quail Valley a couple weeks ago. 23 If this bore -- if you were doing it on your 24 ranch, or whatever -- 25 THE COURT: If I had one. 4 1 COMMISSIONER MOSER: If you had one. 2 JUDGE POLLARD: Yeah. 3 COMMISSIONER MOSER: Or Jonathan's or 4 anybody's property outside the city, outside the city, 5 we'd probably accept it. Okay. But there's couple of 6 things TCEQ has specifications which have to be adhered 7 to, the bore is not perfect, it has a little dip in it. 8 Okay, is what it does. The city can't -- they -- if 9 TCEQ would accept it, the City would accept it. But 10 TCEQ is not accepting it for a variance on this thing, 11 so we have to re bore. Nelson Lewis has to re bore the 12 thing to have to meet the specifications for the right 13 soil and the consistent slope. So that's what this is 14 about is going in there and having to close Quail Valley 15 again and re bore the line and install the pipe, and 16 that's it. And where am I going wrong here, Gaspar? 17 MR. CARACHEO: I don't know. Do I need 18 to -- 19 COMMISSIONER MOSER: Sure. 20 MR. CARACHEO: If y'all can hear me from 21 here. TCEQ, actually we never contacted them, just so 22 everybody's on the same page about that. 23 COMMISSIONER MOSER: Okay. 24 MR. CARACHEO: We worked with the City for 25 seven-plus years, and ultimately we feel that it is more 5 1 of a responsibility to keep the city happy than to try 2 to jump through hurdles to get them to accept something 3 they're not comfortable with. We did see the line and 4 there is a small dip outside of the bore. The bore 5 itself is actually all right, but there's a small dip 6 behind it that goes south on Quail Valley, that they're 7 not too pleased with, so after reviewing the internal 8 video camera inspection, we have decided that we will 9 re bore the road in order to gain more of a percentage 10 of a flow on the downstream piece of pipe on Quail 11 Valley. So that's really what we're here to do, we're 12 going to re bore it. I don't really know that there's a 13 whole lot more to say than we're going to re bore the 14 thing and just -- 15 COMMISSIONER MOSER: Close the road. 16 MR. CARACHEO: Yes, yes, Sir. So I'm here 17 asking for permission to have them close the road down 18 from the 17th of up through the -- I'm sorry the 18th, 19 isn't it? 20 COMMISSIONER BALDWIN: No; 17th. 21 MR. CARACHEO: The 17th. 22 COMMISSIONER BALDWIN: Which is tomorrow? 23 MR. CARACHEO: Which is tomorrow. Through 24 the 26th. Now the previous time we had asked for one 25 week. That's a little bit more time consuming to go in 6 1 there and redo something. Rework is a little bit more 2 difficult, a little bit more time consuming, so we're 3 going to back the pipe out, pump flowable fill into the 4 holes and re bore it. So you are adding a few more 5 steps than you had to start with on the project. So I 6 mean that's what we're here for so -- 7 COMMISSIONER BALDWIN: I ran into this 8 gentleman, met him this morning and told him I was going 9 to chew on his butt a little bit, so I'm going to do 10 that. I just wanted to let you know that these guys are 11 dedicated and committed to serving the tax payers of 12 this County, which is our bosses. 13 MR. CARACHEO: Yes, Sir. 14 COMMISSIONER BALDWIN: And if we get behind 15 on a project, or if we close the road and make it 16 inconvenient, make it uncomfortable for our citizens 17 that's a no no, and if you -- if we get behind and we 18 start struggling with catching up and doing things and 19 staying on a schedule, and I get my rearend kicked, 20 guess what, you and I are not going to get along real 21 well. And so I just wanted to let you know that, and 22 I -- this is the first time I've met you, but I'm glad 23 I've got to meet you, and I appreciate your -- I think 24 what I heard you say that you didn't really maybe didn't 25 really have to go back and bore, but you're going to 7 1 anyway to correct what some see as an issue. And I 2 appreciate you doing that. 3 MR. CARACHEO: Yes, Sir. 4 COMMISSIONER BALDWIN: So thank you very 5 much for your service, and don't come back in here 6 anymore with this kind of stuff. 7 MR. CARACHEO: No, I definitely don't want 8 to. 9 COMMISSIONER BALDWIN: Okay. 10 MR. CARACHEO: And I do want to make 11 something clear to everyone on this. Originally the 12 plans did not call for us to open cut this road. The 13 way the plans were designed would not work. The plans 14 were designed for us to dig a bore pit on the north side 15 of Ranchero Road which there was not enough room there 16 to do that without getting into the apartment complex, 17 and that was something that we had mentioned to the 18 design engineer, and the only other option was to open 19 cut the road. So certainly if -- it was not our 20 intentions to ever open cut the road. When I bid the 21 project, I bid the project the way it was designed with 22 the idea that it would work. Now, there's some existing 23 gas lines and water lines north of Ranchero Road that 24 are not shown in the plans, which would not allow us to 25 dig the bore pit on that opposite side so, you know, I 8 1 understand that it has cost us time any money, and it 2 has cost y'all a lot of time as well. So you know, I 3 just want everybody to understand that this was brought 4 about also because of some design flaws. 5 COMMISSIONER BALDWIN: Sure, I understand 6 that, thank you. 7 MR. CARACHEO: If we had messed up on the 8 bore on the opposite side, I could re bore it two or 9 three different times on my dime, and not ever have to 10 worry about closing down the road. I mean that was 11 something that I just want everybody to be aware of that 12 that is the reason we're even here to close down the 13 road. 14 COMMISSIONER BALDWIN: Thank you very much 15 for the explanation. 16 COMMISSIONER MOSER: So I move that we allow 17 Nelson Lewis to continue their work on re boring, and 18 with that have to close Quail Valley from February 17th 19 to February 26th, and that's it. 20 COMMISSIONER BALDWIN: Through the 26th? 21 COMMISSIONER MOSER: Yes. 22 COMMISSIONER BALDWIN: Okay, I second that 23 motion. 24 JUDGE POLLARD: It's been moved and seconded 25 that this contractor be authorized to re bore, and that 9 1 to close Quail Valley Road from starting tomorrow and 2 going through -- you said the 26th -- 3 COMMISSIONER MOSER: 26th. 4 JUDGE POLLARD: -- of this month. Any 5 further discussion? 6 COMMISSIONER REEVES: Does road and bridge 7 have any comment? 8 MS. HOFFER: No, Sir. 9 COMMISSIONER REEVES: And who is paying for 10 this, are we having to pay for it? 11 MR. CARACHEO: No, Sir, the contractor is 12 paying for everything. 13 COMMISSIONER MOSER: It's a fixed price 14 contract. 15 COMMISSIONER REEVES: Okay, I have no other 16 questions. 17 JUDGE POLLARD: Any others? 18 COMMISSIONER LETZ: I do have a question. 19 So Ranchero Road be closed completely? 20 COMMISSIONER MOSER: Ranchero's never been 21 closed. 22 COMMISSIONER LETZ: Quail Valley will be 23 closed. 24 COMMISSIONER MOSER: Yes. It's a detour 25 they go through a parking lot. 10 1 COMMISSIONER REEVES: And you contacted Mini 2 Mart again? 3 MR. CARACHEO: I will contact them directly 4 after this meeting. I didn't want to give them any 5 information that was going to be changed at a later 6 date, so that I have the fliers that will be distributed 7 to all the houses today, and I also have a flier that 8 I'll take to Miss Sylvia Fritz and talk to her about 9 using her driveway again like we did in the past, and of 10 course the traffic control will be set up just the same 11 way it was on the previous time that we closed it down. 12 JUDGE POLLARD: Who drafted the design 13 specs? 14 MR. CARACHEO: On the -- on the plans? 15 JUDGE POLLARD: Uh-huh. 16 MR. CARACHEO: Tetra Tech Engineering. 17 COMMISSIONER MOSER: Tetra Tech. 18 JUDGE POLLARD: All right.
