I think we'll call 4 this awards day. We got a whole bunch of these on it 5 today. 6 Please stand and bow your head in prayer. 7 (Prayer and Pledge of Allegiance.) 8 JUDGE POLLARD: This is the part of the 9 agenda for people to come forward and speak on items 10 that are not on the agenda. If you wish to speak then 11 please step forward to the podium, identify yourself and 12 state your address, and address the Court, and limit 13 your comments to three minutes. 14 Is there anyone wishing to speak at this 15 time? There being none, we'll pass on to item 1 -- 16 well, we'll go to the Commissioners' comments first. 17 We'll start with Commissioner 1. 18 COMMISSIONER BALDWIN: Sir, I don't have any 19 comments at all, thank you. 20 COMMISSIONER MOSER: A couple things. 21 Number 1 regarding the redundant telephone service. I 22 think it can be best served -- described by a note, got 23 it from the regional director, says our team along with 24 the Hill Country and Windstream have been working 25 nonstop to get the route set up. These are totally 6 1 redundant routes so that we don't lose telephone system 2 unless they cut two lines. It's a very complicated 3 process, and we're still having weekly calls to 4 coordinate the process. The plan is to have the bulk 5 Hill Country and Windstream routes up and working by 6 August the first, pending no issues. So I think in six 7 months we have six times it was cut so a lot of people 8 without AT&T service. So that's a big poll. 9 The other thing is the County including 10 myself and the Sheriff and the Emergency Management 11 Director coordinator met with representatives from UGRA, 12 what we're doing is looking at the flood warning system 13 in Kerr County to see what we might do if anything to 14 enhance it and improve it. We're not saying we need to. 15 So we're going to do a little systematic approach in 16 that and see what we can do like they did in Comal 17 County. They really have improved their system. So 18 we'll come back to the -- to the County and to UGRA, and 19 hopefully to the City, and they didn't have a 20 representative there, I think they have a new emergency 21 management coordinator, so anyway, that's within 22 probably maybe next month we'll come back to something 23 specific. 24 JUDGE POLLARD: With regard to the 25 redundancy it's supposed to be three backup alternate 7 1 routes ultimately, isn't that correct? 2 COMMISSIONER MOSER: Ultimately you can get 3 to that, yes. We'll get the first -- complete the 4 backup first and then there's another sort of backward 5 route you can get, and get another degree of redundancy, 6 yes. 7 JUDGE POLLARD: The reason that's important 8 we had one cut down towards Comfort and then somebody at 9 the same time cut the redundancy route over towards 10 Bandera, and both, and put us out of service for while, 11 so we gotta have a double backup. 12 COMMISSIONER MOSER: There you go. 13 JUDGE POLLARD: All right, I have nothing 14 further. Go ahead. 15 COMMISSIONER LETZ: I have nothing, Sir. 16 COMMISSIONER REEVES: I just have one thing. 17 I think we all got an e-mail on this the other day, but 18 on May third, from 4 to 8 o'clock in the afternoon 19 across the street in the old post office the Kerr Arts 20 and Cultural Center will be having ragtime music, and 21 it's being sponsored by Diane and Bob Green of the Kerr 22 County abstract, and Judge Barton and his wife Joyce. 23 So anytime the Barton's are involved with music it's 24 going to be real good and they just like to invite 25 everybody over there. 8 1 JUDGE POLLARD: All right, very good. 2 Let's go to item 1.1 on the agenda. 3 Consider, discuss and take appropriate action to honor 4 the members of the Kerr County Child Services Board, 5 Commissioner Baldwin. 6 COMMISSIONER BALDWIN: Thank you, Judge. 7 Kerr County Child Services Board has been around here 8 forever, and longer than I can remember at least, and 9 they've always been the group that in my mind that does 10 the hard work when you're dealing with the babies that 11 come out of people's home because of abuse and those 12 kinds of things. These are the folks that do that work 13 and they've always flown under the radar, never brought 14 them over here and say thank you to them, but we want to 15 do that today. So we have a little gift for them, and 16 we're -- Judge you and I are going to step out here in 17 the front and I'm going to call their names, and they're 18 going to come 4th or 5th, whichever they are -- that was 19 a joke. 20 MRS. All 11 right, I've been requested to deviate from the normal 12 procedure and skip over to 1.18, 1.19 and 1.20. These 13 are -- I'll just read them. 14 1.18 is consider, discuss and take 15 appropriate action to accept petitions to set Stock Law 16 Election in regard to horses, mules, jacks, jennets, 17 donkeys, hogs, sheep and goats. 18 1.19 is consider, discuss and take 19 appropriate action to accept petitions to set Stock Law 20 Election in regards to cattle. 21 1.20 is consider, discuss and take 22 appropriate action to authorize the County Judge to sign 23 an order for election to be held on November 8th, 2016, 24 with regards to Kerr County Stock Laws. Mrs. Bolin and 25 Diane. 11 1 MS. DIANE BOLIN: The County Clerk has been 2 given these petitions and I approved them through the 3 tax office that these are registered voters to the 4 County. We're all to accept these petitions and set a 5 Stock Law Election for November. 6 JUDGE POLLARD: A little bit of history 7 behind this, and I'll ask the Sheriff to speak a little 8 bit. 9 SHERIFF HIERHOLZER: Well, making it real 10 quick and short. This is kind of that clean-up fact 11 that should have been done years ago. You have either 12 open range or closed range, okay. Open range is where 13 landowners, if you have your flower bed and your 14 neighbor has cattle, then you have to fence the cattle 15 out of your flower bed. That's open range, the owner of 16 the cattle doesn't have to fence them. 17 Closed range is just the opposite. The 18 owner of the cattle or sheep, goats, whatever, have to 19 fence them in, you don't have to fence them out. And 20 under those 1930's and everything else, there are still 21 portions of Kerr County is one of the very few of the 22 States that are actually open range, which makes it 23 very, very difficult when we're dealing with loose 24 livestock or anything else. So this is a clean-up deal 25 to go countywide, to just close countywide so the owners 12 1 of the livestock have to keep them fenced, and people 2 don't have to keep them fenced out. That's what we're 3 asking for. 4 JUDGE POLLARD: Originally Kerr County 5 passed the stock law, I think back there in the teens, 6 1914, '15, along in there. But they did it on a voting 7 precinct, each voting precinct voted for it. And there 8 were a number of voting precincts, I know boundaries 9 have changed a number of times over the years, and 10 there's a lot of confusion about where those lines are 11 and what -- there's several areas in the County that 12 just don't know, and some that are open that is as the 13 Sheriff mentioned. 14 Now, Gillespie County on the contrary passed 15 their original stock law and they did it on a countywide 16 basis, the County boundary. So we're proposing to do 17 the same thing with this here just to clean that up so 18 that the whole County is uniform throughout the County. 19 So this will be an election on the County boundaries as 20 to the stock law. 21 SHERIFF HIERHOLZER: It does have 22 consequences. If the election were to fail, my 23 understanding is the entire County would become open. 24 JUDGE POLLARD: I suspect that's true. And 25 there would be a lot of people with gardens and shrubs 13 1 that would really be unhappy about that. 2 COMMISSIONER MOSER: And a lot of cattle on 3 the highway. 4 JUDGE POLLARD: That's right. That's right. 5 And it reverses that burden when you hit an animal on 6 the highway. 7 COMMISSIONER BALDWIN: Judge, I have a 8 question. I'm assuming that this language came straight 9 out of the law. 10 JUDGE POLLARD: Came right out of the County 11 Attorney's office. 12 MRS. STEBBINS: Yes, Sir. 13 COMMISSIONER BALDWIN: County Attorney's 14 law, which is good enough. Now, why is there one of 15 these items for cattle only and the rest of them are for 16 donkeys and jennets and Jacks and chickens and all that? 17 MRS. STEBBINS: Because that's what the 18 rules say. 19 COMMISSIONER BALDWIN: The cattle are -- 20 MRS. STEBBINS: It has to be separate, yes, 21 Sir. 22 JUDGE POLLARD: There are separate statutes 23 that require separate -- 24 COMMISSIONER BALDWIN: Wouldn't you like to 25 know why? 14 1 JUDGE POLLARD: It goes way back before 2 this, before the memory of living man. 3 COMMISSIONER BALDWIN: Noah's Ark. 4 COMMISSIONER LETZ: I would want to clarify 5 one point for -- probably the County Attorney's the 6 person to ask. We could have County roads that are 7 going through open range. This will not impact that. 8 MRS. STEBBINS: I don't know if I understand 9 the question. 10 JUDGE POLLARD: I can answer -- 11 SHERIFF HIERHOLZER: You're talking about 12 479 or something like that that's got cattle guards. 13 It's the same landowner on that same Farm to Market Road 14 and they the can allow it to go across on those County 15 roads. That's not -- that's totally separate than open 16 or closed range. That's the same landowner owning both 17 sides of the county road. That can allow -- 18 COMMISSIONER LETZ: I just want to make it 19 on the record that that's not being changed there, 20 because you know, there are I mean if someone hits a cow 21 on those roads, the rancher or whoever is not 22 responsible or liable, I should say. 23 COMMISSIONER REEVES: And we have a number 24 of County roads -- you talk 479 is a State highway, 25 but -- 15 1 SHERIFF HIERHOLZER: But it's still a farm 2 to market road. 3 COMMISSIONER REEVES: -- there's a number of 4 county roads though, your precinct, mine, maybe y'all's, 5 too, that the county road goes through a ranch, but the 6 landowner owns both sides. He's not going to have to 7 fence the right-of-ways. 8 SHERIFF HIERHOLZER: No. It doesn't affect 9 that; it only affects different landowners. 10 JUDGE POLLARD: Okay. Any further 11 discussion on that? 12 COMMISSIONER LETZ: I guess we need to 13 handle these one at a time? 14 MRS. STEBBINS: Correct. 15 JUDGE POLLARD: As to item 1.18, which is to 16 consider, discuss and take appropriate action to accept 17 petitions to set stock law election in regards to 18 horses, mules, jacks, jennets, donkeys, hogs, sheep and 19 goats. What's your wish? 20 COMMISSIONER BALDWIN: I move for approval. 21 COMMISSIONER MOSER: Second. 22 COMMISSIONER LETZ: Second. 23 JUDGE POLLARD: It's been moved for approval 24 as to item 1.18, which is to set the stock -- set an 25 election on that, on those particular animals named in 16 1 1.18. There's an election going on in the City 20 and she's got involved in the process, which is the 21 reason why we deviated from the normal procedure to cut 22 her loose with that. 23 Item 1.2 public hearing regarding the 24 revision of plat for lots 31 and 32 of The Reserve at 25 Falling Water Subdivision, plat record volume 7, pages 18 1 215 to 217. That's in Precinct 3. Anyone wishing to 2 speak? I'll declare the public hearing open. Is there 3 anyone? There being no one, I declare the public 4 hearing closed. 5 Let's go to item 1.3 consider, discuss and 6 take appropriate action regarding fiscal year 2016, 2017 7 airport budget. Mr. King. 8 MR. KING: Hello, Commissioners and Judge. 9 Stephen King, president of the Kerrville-Kerr County 10 Joint Airport Board. We're presenting today our budget 11 for the 2017 fiscal year, and I hope y'all have a copy 12 of it. 13 As you can see there we're requesting 14 contribution from the County -- first of all the total 15 is $397,165.00, and we're requesting $21,725.00 -- 16 $735.00 contribution from the County and the City. 17 That's a reduction of 27 percent from last year where we 18 asked for $35,000.00. 19 Just the highlights of the budget. We've 20 increased income again this year, which has allowed 21 us -- increased income and reduced our expenses, which 22 allowed us to reduce the contribution. We're hopeful 23 that at some point we'll be able to get it down to zero. 24 I thought we might get it this year, but we run into a 25 situation where we can't cut expenses a whole lot more 19 1 and the revenues haven't increased. So we're sort of -- 2 we're looking -- there's another item on the agenda 3 we're hoping to increase some revenue out there and 4 hopefully be closer next year to the magical number of 5 zero, which will require no contributions from either 6 party to run our airport. Any questions on the budget? 7 COMMISSIONER MOSER: Let me just comment and 8 compliment the Airport Board, and I think everybody's 9 heard this about a hundred times, but anyway from four 10 hundred thousand dollars needed by City and County for 11 the operations to almost zero this year and hopefully 12 next year zero, so the Airport Board is to be 13 congratulated. 14 And I think Kirk Griffin is here from the 15 Airport Board, and Bruce McKenzie, airport manager. So 16 it's been run exceptionally well and two years ago was 17 airport of the year and this year Bruce is airport 18 manager of the year, for the State. So good work, guys. 19 COMMISSIONER BALDWIN: What about Steve, do 20 you have anything nice to say about Steve? 21 COMMISSIONER MOSER: No. He's a neighbor. 22 MR. KING: I'll be leaving the board next 23 year and you can make all the great comments when I do 24 leave. I'll expect some sort of a proclamation. 25 COMMISSIONER MOSER: Your resignation will 20 1 not be accepted. 2 MR. KING: I'm going to work for the library 3 board. 4 COMMISSIONER BALDWIN: Okay. This one's 5 over. 6 MR. KING: I'll try to straighten out that 7 mess. 8 COMMISSIONER BALDWIN: Hey. I've got an 9 airport question. 10 MR. KING: Sure. 11 COMMISSIONER BALDWIN: I know a large part 12 of our income is fuel sales? 13 MR. KING: Correct. 14 COMMISSIONER BALDWIN: Or it used to be. 15 And my home is in the path of Kerrville airport, and I 16 saw about five airplanes come over my house the other 17 day that you could keep this courthouse in just about. 18 And did they -- each one of those airplanes buy fuel? 19 MR. KING: They bought a lot of fuel. 20 JUDGE POLLARD: A lot of fuel? 21 MR. KING: A lot of fuel. And that was one 22 of our local -- 23 COMMISSIONER BALDWIN: There was five of 24 those airplanes. 25 MR. KING: One of my residents had a get 21 1 together, a birthday party, and a lot of aircraft came 2 from New York to visit. So it was quite a -- I think we 3 sold 12 thousand gallons or something, 12 thousand 4 gallons of fuel. 5 COMMISSIONER MOSER: So those aircraft are 6 in the 40, 50 million dollar class and there were about 7 six of them. And people looking at the airport and they 8 say aaaaya(phonetic) you know it's just a bunch of guys 9 out there. That airport does a lot for this community, 10 for the people who have ranches here, because that 11 airport's here so they can do things like this. 12 MR. KING: Unfortunately, a lot of those -- 13 like that particular event which probably moves to the 14 revenue of Kerr County is significant that weekend. 15 Because there was caterers, there was cars from San 16 Antonio up here. I mean they rented 20 cars, rent a 17 cars. Those are not public. They're not publicly as 18 far as you know they're not announced in the paper it's 19 going to happen, but those are type of events, you know, 20 that they didn't drive down here from New York. 21 And those are the kind of events that they 22 do help the County, not just the airport, but the County 23 and they all stayed somewhere. There was like a hundred 24 and 15 of them and they all stayed somewhere. 25 COMMISSIONER MOSER: So I move that we 22 1 accept the budget that is presented by Mr. King. 2 COMMISSIONER LETZ: Second. 3 JUDGE POLLARD: And moved by Commissioner 4 Moser, seconded by Commissioner Letz that we accept the 5 airport budget for fiscal year 2016 and '17. Any 6 further discussion? 7 COMMISSIONER REEVES: I'd like just like to 8 join the rest of the members on such a good job that 9 they're doing with keeping our expenditures from the 10 County down by their hard work and what they're doing, 11 it's showcase, and we thank you. 12 COMMISSIONER LETZ: Same comment, great job. 13 JUDGE POLLARD: I agree, too. Steve King and Mr. McKenzie. 21 MR. KING: Yeah, item 1.4, Judge and 22 Commissioners. That's an -- what we're proposing to do, 23 and obviously the airport for the last couple years, 24 we've been looking for revenue sources to increase the 25 revenue and decrease the amount of money you guys have 23 1 to put into it, and there's a hangar over in -- hangar 2 19, which is the old Mooney paint hangar. It's a ten 3 thousand square foot structure, at least, been sitting 4 there now vacant for -- 5 MR. GRIFFIN: A year and a half. 6 MR. KING: -- a year and a half. But it 7 hasn't been used in a long time. And we -- Mooney 8 doesn't have any interest in it. It's gone back to the 9 airport as far as the lease. We got them to give it 10 back to us so the airport controls it now. It's a ten 11 thousand square foot structure. It was originally used 12 to paint airplanes. 13 We've kind of come up with an idea of 14 possibly using that hangar for aircraft storage. 15 Aircraft storage is at a very, very high demand at the 16 airport even though we did build 12 T-hangars a couple 17 years ago. And we just have people daily come to the 18 airport and want to park an airplane. 19 People forget when people move from Houston 20 or from Dallas or from Michigan, a lot of them are 21 pilots and when they bring their furniture down here 22 they also bring their airplane, if they have an 23 airplane, and so they don't have anyplace to put it. 24 It's not like -- they can't go to an R.V. storage and 25 park it, you have to come to the airport. 24 1 So a lot of them -- it's a huge problem. We 2 have 15, I think, on the waiting list right now that are 3 confirmed waiting. And I know there's a lot more 4 everyday. A gentleman about two weeks ago had about six 5 aircraft wanted to move from another city here. And 6 it's just a problem, he doesn't didn't have any place to 7 put them and so now he's looking for a place to put 8 them. 9 And what our plan is to use this ten 10 thousand square foot hangar to store aircraft in it, and 11 we've had it inspected, we've looked at it, it seems 12 like it's a very sound building, and with not very much 13 input in capital. We can make it into a storage 14 building and rent it out for probably 17 hundred, 18 15 hundred a month, total for the building. But to do that 16 we need a road into it. 17 We need a road, a six hundred foot road 18 coming off of Peterson Farm Road to get to it, and we'll 19 put a gate there. And then we need around the hangar -- 20 actually around the hangar there's an apron that's in 21 pretty bad shape and we'll need to repair that apron 22 and then build a small taxiway to intersect our other 23 taxiway. 24 So what we're asking the City and County to 25 do is -- they've helped us and we're very appreciative 25 1 of it. And currently right now the County is currently 2 in a project with the City to pave some area around the 3 Mooney building, the Mooney complex, so that they can 4 bring their brand new aircraft in and out without 5 getting rock chips all over them. So they're 6 cooperating now with the County building their base, the 7 City is going to lay some hot mix over the top of it. 8 We are paying for all the materials in that project. 9 In this project we're going to pay for the 10 materials. We propose to pay for the materials to build 11 this road and it would be a chip sealed road, which the 12 County also is quite adapt at doing that. They can 13 build the road, we provide the base and everything. 14 They'll build the road and then chip seal it, and then 15 around the hangar we're going to dig that up and then 16 the City -- we're going to ask the City to hot mix that, 17 to put hot mix down because that has to be hot mix so 18 the aircraft don't spin anything up into the propeller. 19 So it's a joint effort, we're going to ask 20 the County to do one part of it. I think it's an equal 21 fifty fifty project as far as labor. We're just asking 22 the City and the County to provide labor, and use 23 y'all's great equipment as you've done in the past to 24 help us get a road in there and get the apron around the 25 airport, where we can park the airplanes when they're 26 1 outside. And then we can increase the revenue to the 2 airport by 17 thousand a year, which you figure on a, 3 you know, two year that's 34 thousand. I think 4 material's around ten thousand, ten thousand dollars in 5 materials is what we're going to put into the thing. 6 And I think it's a very good project, and it has a very 7 good return on investment. 8 COMMISSIONER MOSER: That potential revenue 9 is not reflected in the budget. 10 MR. KING: That 17 thousand is not reflected 11 in the budget. As is we have another hangar out there, 12 the BA Products Hangar, the old BA Products Hangar, 13 that we had leased to Alamo Community College. And 14 they've -- we've decided to terminate that relationship, 15 and have for several years, and we're going to lease 16 that back out and that's not reflected in the budget so 17 we're hoping both those revenues there that's how we can 18 get revenue neutral next year. 19 This is a great project, because the 20 building is sound, it's a very good building. It's just 21 I hate to see it sit there, and you know going to pot. 22 It was built -- somebody spent a lot of money building 23 it, and it's eventually we'll have to knock it down. 24 COMMISSIONER MOSER: Well, you know that is 25 a City-County owned building, if it sits empty it's 27 1 going to deteriorate. This way it keeps it from 2 deteriorating and brings in a source of revenue for ten 3 thousand dollars or something. Well -- and the building 4 itself is also worth like about 50 thousand to bring it 5 up to speed. 6 MR. GRIFFIN: We're not -- 7 COMMISSIONER MOSER: You're not there 8 talking about that, okay. 9 MR. GRIFFIN: Yeah, we're not proposing to 10 do anything different there to the building, at this 11 point. The building is the same. 12 COMMISSIONER MOSER: So the Road and 13 Bridge -- 14 MR. KING: Basically Road and Bridge. 15 COMMISSIONER MOSER: Yeah. Asking Len and 16 Charlie -- 17 MR. KING: Asking Len and Charlie to help us 18 out on it. 19 COMMISSIONER MOSER: The question is doing 20 this project that's proposed by the airport board to do 21 the road from Peterson Farm Road and do the -- the 22 County doing that work, is that -- 23 JUDGE POLLARD: The apron. 24 COMMISSIONER MOSER: Well, the city's going 25 to do that. 28 1 MR. KING: City's going to actually do that 2 part. 3 MR. HASTINGS: Yeah, it's feasible and I 4 talked to Bruce about it and he said it wouldn't be 5 until this fall, so we should be done with our chip seal 6 program. And it's like six hundred foot long and 30 7 foot wide, pretty small project. Be done in a few 8 weeks. 9 COMMISSIONER LETZ: The other thing that 10 Steve didn't mention, I don't believe he mentioned it 11 anyway, is that this part of the airport is one of the 12 few flat areas over there that's left and this road will 13 provide access for future development. It's really -- 14 MR. KING: That's very true. I forgot to 15 bring that up. This is providing an entrance to the 16 airport to quite a few acres of land that we can't 17 access and build on. And whether this hangar, you know, 18 of whether we did this, eventually that road would have 19 to be built to have access to that area. So it's 20 opening up another part of the airport that's easily 21 buildable land. I hope in the future that will be part 22 of the development, because it's closer to town. It's 23 just -- it's the natural place to build some more 24 hangars, because of the terrain is pretty flat and we 25 spent -- oh gosh, a couple years ago when we were doing 29 1 one of our projects out there, we had a lot of dirt 2 hauled in over there. We have several -- 3 THE REPORTER: Excuse me, I can't hear you. 4 MR. KING: 60, 70, you know, thousand cubic 5 yards of dirt we had to haul over there to flatten out 6 that area. So really, it's a great area that we're 7 going to develop in the future. 8 COMMISSIONER MOSER: And that's in the 9 master plan too to put T-hangars there. So I move that 10 we approve this recommendation by the Airport Board for 11 the County to work with the City to do Number 1, put in 12 a road and gate, all the expenses for materials to be 13 provided by the Airport Board, for Peterson Farm Road to 14 Building 19, and encourage the City to do the work 15 around the apron on Building 19 and the way we've done 16 everything else out there recently. At some point in the 16 near future we're going to have some -- they'll be some 17 new people on the board, a lot of them. They'll be -- 18 unfortunately when it was -- when the new interlocal 19 agreement was written, I don't know, we didn't 20 stagger -- and there was not a method of staggering 21 these appointments, and because of that we're going to 22 have a fruit basket turnover and whatever you call that. 23 There's going to be some new members on the board pretty 24 quick and they'll be a lot of them. The cooperative that we've 22 done with the City and County with this use of the 23 equipment and everything, I think that's -- that's 24 something that I'm hopeful next year in the Texas 25 aviation conference that Bruce and I can present 32 1 something to the others airports, because I think that's 2 something that's very unique to Kerr County and the 3 City. I don't think it's done, I don't think people 4 realize what a savings that is to the taxpayers. I mean 5 that money we'd be out putting that in our budget to go 6 out and hire someone else to do it. And you guys are 7 very, you know, forward thinking to allow us to use that 8 equipment, and that labor is being paid for by the 9 citizens. Thank you. 10 COMMISSIONER MOSER: I would just add one 11 thing on the airport board itself, it's the reason -- 12 one of the reasons it's such a good Airport Board, is 13 it's not -- people are not chosen on a popularity 14 contest, it's what skills are needed when there's a 15 vacancy out there, so I think that that's served that 16 Airport Board extremely well, whether you need a lawyer, 17 developer, or engineer or whatever. Mr. Hastings. 24 MR. HASTINGS: Thank you. On January 25th 25 of this year the Court authorized Road and Bridge to 38 1 begin the process of notification -- of proper 2 notification to have these cattle guards removed on 3 Weatherby Road near I-10 and Fall Branch near its end. 4 Road and Bridge sent certified letters and notification 5 on February third, 2016. There's a 90 day notification 6 period. The deadline for one of those people to reply 7 and request a public hearing is April the 18th. That 8 day has come and gone. Road and Bridge has not received 9 any request for public hearings. 10 The law says that if there's no request for 11 public hearings, and after 90 days notification, which 12 would be May third, next week, that Road and Bridge can 13 remove those cattle guards. So I wanted to read that 14 into the record that we have not received any request 15 for public hearings by the deadline, and make sure that 16 this Court is okay with us to move forward, beginning -- 17 excuse me, beginning May third, but it'll probably be a 18 few weeks. We're still in the middle of some other 19 things. We won't do it exactly on May third, but we 20 will get it done. 21 COMMISSIONER BALDWIN: Is there any action 22 required today? 23 MR. HASTINGS: I don't believe so, because 24 of January 25th my main concern was to make sure that 25 you all didn't receive requests for a public hearing; we 39 1 didn't. And the letters we sent out were specific with 2 the instructions to send it to Road and Bridge. 3 COMMISSIONER BALDWIN: How many cattle 4 guards we talking about? 5 MR. HASTINGS: Two. 6 COMMISSIONER BALDWIN: Two on the whole 7 Weatherby Road? 8 COMMISSIONER REEVES: Well, there's more 9 than the one we're wanting to close on Weatherby. This 10 one is down by the old opera house and cafe. It hasn't 11 been utilized -- I mean you crossed it, but it hasn't 12 been keeping cattle in for years, and it's just been 13 setting there. 14 The second one is at the termination point 15 of a road there at Fall Branch Road that this Court had 16 earlier closed the remainder of the county road, and 17 we're just removing that because the new owners have 18 placed their own -- 19 MR. HASTINGS: They placed their own private 20 ones. 21 COMMISSIONER REEVES: -- their own private 22 cattle guards, so it's kind of redundant. So it's not 23 like either one has been utilized to keep stock in or 24 out, in a number of years. 25 JUDGE POLLARD: What do you do with them 40 1 when you take them out? 2 MR. HASTINGS: We'll keep them in our yard 3 in case we need to use anything off of it and if not 4 then we'll scrap the steel. 5 JUDGE POLLARD: Are you asking for approval? 6 MR. HASTINGS: At this point, we're -- I'm 7 just -- if it's okay with the Court I'd like to proceed 8 with removing those cattle guards. 9 COMMISSIONER REEVES: Do we need any action, 10 County Attorney? 11 MRS. STEBBINS: I don't think so, because 12 the action was already taken in January. 13 COMMISSIONER REEVES: Thank you. 14 MR. HASTINGS: Thank you. 15 JUDGE POLLARD: All right, we'll go on to 16 1.11 consider, discuss and take appropriate action on 17 Resolution authorizing application from the Texas 18 Department of Agriculture feral hog abatement grant 19 program. Mr. Walston and Commissioner Reeves. 20 COMMISSIONER REEVES: I'll start off and 21 I'll let Mr. Walston finish up. Texas Department of 22 Agriculture has some grant programs that are available, 23 and it all hinges on certain things and the degree of 24 success that you have during the month of May this year. 25 The grants can be as high as 25 thousand dollars to be 41 1 put back for education, and to eradicate feral hogs in 2 Kerr County. I think this is something that 3 everybody -- each one of us up here has a problem within 4 our own precinct, maybe within our own land at times. 5 So I met with Mr. Walston, we've come up 6 with a program on holding educational sessions as well 7 as how to adequately track the number of feral hogs that 8 are eliminated during the month of May. And then I'll 9 let Roy take it from there. 10 MR. WALSTON: Okay, thank you. Bob 11 contacted me a month ago or so, and asked me to try to 12 look into what is going around the State on some of 13 these feral hog abatement programs. There are several 14 that can -- that they range basically from contests 15 where people bring in and they weigh the individual 16 hogs, and they -- whoever has the biggest hog, you know, 17 the longest tusk, different things, so they have a 18 contest. 19 The other option that basically they split 20 them into two is a bounty system, where they give five 21 dollars a tail for every tail they bring in. That's 22 kind of the two options that have come across. 23 They've been operating partially through the 24 County in some sort in conjunction with wildlife coops 25 and so several of them I've talked to, the program, 42 1 educational wise is something that we can certainly do. 2 And I've got an educational program set for May the 3 12th. This was something I had in my plans this year, 4 later in the fall, but I've already contacted our 5 speakers and it'll be an afternoon program and we can 6 have some CEU's included on that. I'm trying to get a 7 couple of commercial exhibitors to help out with it, as 8 far as with the different trap designs and some things 9 like that. 10 So I think we can have an excellent 11 educational program, and as Bob mentioned that is part 12 of the grant application and based on your attendance 13 and your outreach that you are reaching through your 14 educational program. 15 One area that I haven't realized and it's a 16 possibility, I don't know if we can get it done this 17 year, it's also an outreach education through the 18 schools. And we can reach a large number, a large 19 audience through the schools with videos and some things 20 like that. So there's a lot of opportunity here. 21 The grants from what I understand are from 22 five thousand to 25 thousand. So it's one of those 23 programs that you're basically operating the first year, 24 you've got some -- you've got some expense to it to get 25 that first year to where you can use the numbers from 43 1 this year to apply for the grant for next year. And you 2 receive the money that you can operate on the next year. 3 And it's an annual -- an annual grant. 4 COMMISSIONER REEVES: We won't be able to 5 offer the bounties this year. But that's where some of 6 the grant funds can go towards. And then along with the 7 education, and it's all based on the success that we 8 have in the month of May. In your backup is a 9 Resolution authorizing Kerr County to apply for such 10 grants, and this was out of the grant package, how it is 11 written. 12 We'll have information how we can adequately 13 track the number of animals that are eliminated during 14 the month of May. Roy and I are finalizing that. I've 15 had a very good response from the ranchers out west that 16 I've talked to and want to get involved with this. 17 The Resolution is attached and I move for 18 approval as presented, and authorize County Judge to 19 sign so we can apply for the grant. 20 COMMISSIONER LETZ: Second. 21 JUDGE POLLARD: Been moved by Commissioner 22 Reeves, seconded by Commissioner Letz that we authorize 23 the application and file for the grant. How much of a 24 grant you going to apply for? 25 MR. WALSTON: Well, you apply for the grant, 44 1 and it's basically depending on how you rank with the 2 other counties that apply. As to your numbers that -- 3 your number of kills and your number of outreach 4 education. They rank you in that -- 5 JUDGE POLLARD: So the State decides. 6 MR. WALSTON: Yeah. 7 COMMISSIONER MOSER: So what does the State 8 have in its budget for this? 9 MR. WALSTON: Zero. 10 COMMISSIONER REEVES: TDA has two hundred 11 thousand dollars. 12 COMMISSIONER MOSER: Two hundred dollars 13 from the State. 14 COMMISSIONER REEVES: That they will award 15 based on these grants. 16 COMMISSIONER MOSER: Okay, for the entire 17 State. 18 COMMISSIONER REEVES: Yes. Last year I 19 think Gonzales County ranked number five, and they 20 killed 250 hogs in a month, and had roughly 250 people 21 attend the education session. So that gives us a 22 benchmark. And they received a 25 thousand dollar grant 23 which then goes specifically for further -- what we're 24 trying to do here. 25 COMMISSIONER LETZ: And it doesn't sound 45 1 like the cost to the County is -- is pretty 2 insignificant the first year -- 3 COMMISSIONER REEVES: The first year. 4 COMMISSIONER LETZ: -- because if you do 5 seminars year round any way -- 6 COMMISSIONER MOSER: So what is the cost do 7 you think for the County? 8 MR. WALSTON: Well, the cost is going to be 9 what, you know, if we're coming up with some type of an 10 award for whoever brings in the most kills or most 11 tails, you know. 12 COMMISSIONER MOSER: So that would be the 13 only cost? 14 COMMISSIONER REEVES: Well, we're working on 15 private -- I say private, commercial donations. 16 MR. WALSTON: We're trying to get some 17 sponsorships through our program, and trying to do it as 18 inexpensively as possible. But still we've got to have 19 enough encouragement for them to participate. 20 JUDGE POLLARD: When you get tails in on 21 them on the bounty system, how do you tell a tail from 22 the domestic hog from a feral hog? 23 COMMISSIONER REEVES: I seriously doubt 24 they'll cut the tail off of a domestic hog for a five 25 dollar bounty. 46 1 JUDGE POLLARD: If they kill them. 2 MR. WALSTON: Yeah. There's some of those 3 things that there's going to be some honor system to it, 4 I mean I realize it's pretty difficult to make it 5 completely foolproof. 6 COMMISSIONER MOSER: So you don't have a 7 ballpark of what it's going to cost. So we're voting on 8 something -- 9 COMMISSIONER REEVES: Well, for the month of 10 May it's going to cost us our time. He's already -- has 11 seminars like this. He's just moving up one that he was 12 going to have in the fall to now. It will be our time 13 for counting the animals. It will be our time to get 14 the word out. 15 COMMISSIONER MOSER: Jody can do that. 16 COMMISSIONER REEVES: Any prizes or etc., 17 are going to be offered will be offered through private 18 donations that we get in this year. 19 COMMISSIONER BALDWIN: I've got a couple 20 questions. Now, the third whereas says if the County is 21 awarded funds such funds must be used for the sole 22 purpose of continuing feral hog abatement activities 23 within the County. What -- what does that mean? 24 COMMISSIONER REEVES: We cannot take the 25 money awarded here and use it for coyote bounties. We 47 1 cannot take the money awarded here and use it for some 2 other agricultural activity. It's specifically for 3 feral hog abatement. 4 COMMISSIONER BALDWIN: Abatement activities, 5 what I've heard y'all say one is bounties and one is 6 education. 7 COMMISSIONER REEVES: Right. 8 COMMISSIONER BALDWIN: And that's the 9 abatement activities. 10 COMMISSIONER REEVES: As specified by TDA. 11 COMMISSIONER BALDWIN: We'll I'm voting on 12 this thing here, I don't have TDA in front of -- 13 COMMISSIONER REEVES: Yeah you do, it's 14 this. 15 COMMISSIONER BALDWIN: Okay. I may not vote 16 for it then. 17 COMMISSIONER REEVES: Okay. 18 COMMISSIONER BALDWIN: And then the second 19 to -- the fourth whereas, it's says official Bob Reeves 20 primary contact and official to represent the applicant 21 in dealing with TDA concerning the program. What does 22 that mean? 23 COMMISSIONER REEVES: When I fill out the 24 grant application all of them say who do you contact if 25 we have a question about the application. I can -- 48 1 COMMISSIONER BALDWIN: You're the contact. 2 COMMISSIONER REEVES: I can certainly change 3 it to Jonathan Letz or -- 4 COMMISSIONER LETZ: Or Buster Baldwin. 5 COMMISSIONER REEVES: -- Buster Baldwin, or 6 anybody like that. 7 COMMISSIONER BALDWIN: No, you can't. And 8 so when somebody walks in somewhere with a pig's tail 9 and says I want my four dollars, where do they walk into 10 and do they talk to you? Do you give them the four 11 dollars? 12 COMMISSIONER REEVES: During the month of 13 May, and I'll give it a two step answer to this. During 14 the month of May, since we can't offer a bounty it will 15 be the Friday of each week. You can bring in what you 16 have, we'll certify that number. After we get the 17 grant, I envision it to be similar to the same method as 18 used for coyotes at the present time where you go to 19 animal services, they certify, they send the form into 20 the County treasurer office and a check is then issued. 21 COMMISSIONER BALDWIN: So your sole duty is 22 to sign the request for money. 23 COMMISSIONER REEVES: Right now? 24 COMMISSIONER BALDWIN: Yeah. 25 COMMISSIONER REEVES: There won't be any 49 1 money to -- the Judge will sign this, and I will take it 2 upon myself to get the application completed and answer 3 any questions from the State. 4 MR. WALSTON: I guess basically you gotta 5 take the first step so that you can apply, and this year 6 being one that we actually were operating on no funds 7 we're going to have to get by on private funds, until we 8 can get that initial grant, then we have funds to 9 operate on. 10 COMMISSIONER BALDWIN: Did we go through 11 something that is pertaining to this a month or so ago? 12 COMMISSIONER LETZ: There was in previous 13 years has been a different program, which I believe is 14 called the hog wild program, and it was -- we never 15 could figure out a way to make it work real well, to 16 where it didn't cost taxpayers money. This program is a 17 lot more flexible it looks like to me and a lot easier 18 to administer. Administering the hog wild was a little 19 bit difficult. 20 JUDGE POLLARD: I'll mention there's a 21 pretty good incentive to kill hogs, too. Because they 22 sure barbecue good. 23 MR. WALSTON: And it's our -- I guess our 24 idea is to try to get as many brought in as we can 25 because with the population continuing to grow and 50 1 County and area is beginning to expand into their areas, 2 and into their habitat. We're just going to continue to 3 have problems, and so we're trying to figure out a way 4 that we can eliminate them. Feral gunning is one 5 option, trapping, and if there's a way that we can 6 encourage some of those things with a minimal expense of 7 the County, that's you know -- that's what we're trying 8 to do. 9 COMMISSIONER LETZ: There's a -- the hog 10 problem this year is worse than it has been because 11 we're having a wet year. Drought tempered their 12 reproduction a little bit, but they are breeding in full 13 force this year. 14 COMMISSIONER MOSER: Well, I think the whole 15 nation is just increasing, increasing, increasing in 16 feral hogs. 17 MR. WALSTON: Yeah. 18 COMMISSIONER MOSER: I don't know how 19 effective this program is going to be, but it's a step 20 in the right direction. People -- you know I have them 21 on my property, I don't need an incentive to get rid of 22 them, you know. 23 MR. WALSTON: And that's a lot of it is 24 people you know they want to get rid of them. We 25 just -- we just want to encourage everybody, and that's 51 1 what it is, just encouragement. 2 COMMISSIONER LETZ: And just one other quick 3 comment. A&M has done a tremendous amount of research 4 on this and they've got a lot of different things, and I 5 don't know what's going to be at the seminar, but they 6 have different trapping mechanisms, ways to do it and 7 how to build traps, and they've done the studies of how 8 high a fence needs to be to allow a deer to jump in and 9 keep a hog out. But once a hog's in how to keep the 10 hogs in, because the big hog can jump pretty high. So 11 it's pretty interesting a lot of this stuff. 12 MR. WALSTON: A lot of the research is going 13 on here in the Kerr management area. 14 JUDGE POLLARD: They don't have to jump much, 15 they can tear a fence up and go right through it. 16 COMMISSIONER LETZ: These aren't fences; 17 these are panels. 18 JUDGE POLLARD: All right. Is there any 19 further comment or -- 20 MR. CLARKE: Judge, what's the procedure, 21 would there be anyway to incorporate feed the hungry 22 into this program, where they brought live into a 23 processor, and got their five dollars for the tail 24 and -- 25 JUDGE POLLARD: That's a good thought. 52 1 COMMISSIONER REEVES: There's how many Roy, 2 three facilities right now? 3 MR. WALSTON: Well, there's three close 4 ones -- 5 COMMISSIONER REEVES: That you could bring 6 them into -- 7 MR. WALSTON: -- that they can bring live 8 hogs in and actually sell them. But as far as a 9 processing facility we'd have to probably check in as 10 far as and see if -- as far as health issues, as far as 11 animal health commission and things stuff like that. 12 MR. CLARKE: Just asking the question. 13 MR. WALSTON: I think there probably is a 14 way maybe. Of course when you're dealing with the 15 public and you have to have inspections and things, so 16 that there may be a way. But we just need to figure out 17 what all details are. 18 COMMISSIONER REEVES: And I'll be glad to 19 look into it, because any ways that we can do it. 20 JUDGE POLLARD: Good question. Thank you, 21 Sir. 22 COMMISSIONER MOSER: Yeah, they sure do that 23 with deer, a lot of deer. 24 JUDGE POLLARD: Okay. If there's no further 25 comment on it let's call for a vote on the motion. Now, 53 1 this is a motion to authorize an application to be filed 2 seeking a grant with the Texas Department of Agriculture 3 feral hog abatement grant program. Is that correct? 4 Okay. The next item is 14 item 1.12 consider, discuss and take appropriate action 15 to approve a resolution regarding Schreiner Premier 16 Partnership, Commissioner Letz and Michael Stebbins. 17 COMMISSIONER LETZ: And I'll turn it over to 18 Michael pretty quickly. But, this is a program that 19 Schreiner has that doesn't cost the County anything. It 20 does offer our employees some benefits potentially if 21 they want to get a masters. Why don't you explain it. 22 MR. STEBBINS: Absolutely. Judge, thank 23 you, and Commissioners, thank you for this opportunity. 24 We have two graduate programs at Schreiner University, a 25 master's of business and a master's of education. 54 1 Currently these programs run about 20 thousand dollars, 2 20 to 25 thousand dollars to obtain that master's 3 degree, so we've come up with a reduced price called the 4 Schreiner Premier. 5 What it is or how you obtain that price is 6 it's just a verbal agreement with any organization in 7 the community whether it's non-profit, the Kerrville 8 Independent School District as well as surrounding 9 school districts, so that you can get a reduced price. 10 That reduced price makes the master's of business ten 11 thousand dollars versus 23 thousand dollars. It makes 12 the master's of education degree nine thousand dollars 13 versus 20 to 25 thousand dollars, depending on 14 certification. This is a verbal partnership, there is 15 no legal binding agreements. We just ask that if your 16 employees are having some coffee and talking about 17 getting a degree, a master's degree, that you say hey 18 why don't you check out Schreiner University, and in 19 return we would like to put some fliers up around 20 courthouse, just small fliers so people could have that 21 information, and send some e-mails out to the employees 22 on who to contact, and how they can go about obtaining 23 these degrees. 24 COMMISSIONER MOSER: How does Schreiner 25 reduce the cost by that amount, just by saying here -- 55 1 MR. STEBBINS: Say again. 2 COMMISSIONER MOSER: I say how does 3 Schreiner reduce the cost from 20 thousand to ten 4 thousand, ballpark, just by us saying yeah we'd like to 5 participate? 6 MR. STEBBINS: It's just a matter of sitting 7 around and saying what do we have to do to be 8 competitive and right now with the way the market is, 9 there are two things we have to do to be competitive. 10 One we have to offer a complete on-line master's 11 program, which we do, so you can do them from the 12 comfort of your couch or whatever you want to do. 13 The other thing is competitive and price. 14 These prices right now are the cheapest in the state of 15 Texas. We're not going to publish that on a piece of 16 paper so then our competitors will eat us up and draft 17 something different, so hopefully they don't already. 18 So it's just -- it's a simple amount of 19 hoping that if we're not charging as much, we see more 20 people getting into these programs. A lot of the 21 research we've done has indicated that the reason people 22 aren't trying to get these master's degrees is because 23 they can't finance 20 to 25 thousand dollars. We're 24 hoping that financing nine to ten thousand dollars, 25 while not cheap, at least makes it somewhat more 56 1 affordable and more obtainable for people in this 2 community. 3 COMMISSIONER MOSER: So it's just an 4 incentive to get more people in the larger quantity -- 5 MR. STEBBINS: That's correct. 6 COMMISSIONER MOSER: -- and hopefully reduce 7 the cost? 8 MR. STEBBINS: That's correct. 9 COMMISSIONER LETZ: And in the packet 10 there's a Resolution and I'll just go ahead and read it 11 real quickly, or Michael you can read it. I'll read it. 12 Resolution authorizing partnership between Kerr County 13 and Schreiner University related to the Schreiner 14 Premier Program, whereas Schreiner University is a 15 valuable asset to the Kerr County community. And 16 whereas Schreiner University offers the Schreiner 17 Premier Program to participating partners, employees, 18 and whereas Kerr County Commissioners' Court finds it in 19 the interest of and benefit to its employees to 20 authorize the partnership with Schreiner University. 21 Now, that it therefore be resolved by the Kerr County 22 Commissioners' Court of Kerr County, Kerr County 23 Commissioners' Court of Kerr County authorizes the 24 partnership with Schreiner University to participate in 25 the Schreiner Premier Program whereby Schreiner 57 1 University will offer reduced rates for master's 2 programs for Kerr County employees and elected 3 officials. Passed and approved, 25th day of April, 4 2016. And I'll make a motion to approve that 5 Resolution. 6 COMMISSIONER REEVES: Second. 7 JUDGE POLLARD: It's been moved by 8 Commissioner Letz, seconded by Commissioner Reeves to 9 approve the Resolution submitted in the agenda package 10 as to item 1.12, and it's a Resolution that was just 11 read into the record, concerning the partnership between 12 Kerr County and the Schreiner University related to the 13 Schreiner Premier Program. Is there any further comment 14 or discussion? 15 COMMISSIONER MOSER: One question. What 16 other entities in the area has Schreiner University 17 offered these partnerships to? 18 MR. STEBBINS: Established right now? 19 COMMISSIONER MOSER: Yeah, I mean is it 20 offered to the City? 21 MR. STEBBINS: It will be offered to the 22 City. We're actually in partnership with Kerrville 23 Independent School District. With any school district 24 are automatically partners because our education 25 department works with them to get our students involved 58 1 in student teaching at their schools. So because of 2 that, we basically just told them you are partners and 3 this will be the price for your educators. And so we're 4 hoping that some of the teachers in the community and 5 the surrounding communities will pursue this master's 6 degree. This doesn't just benefit the school district, 7 it also benefits the children in these classrooms, if 8 you get cutting edge skills in these degrees they can 9 take into the classroom, implement into their 10 instructions and so we're hoping to shape things for the 11 better. 12 COMMISSIONER MOSER: Well, would it go to 13 Center Point, Ingram and Hunt? 14 MR. STEBBINS: Yes, Sir. Yes, Sir. 15 COMMISSIONER LETZ: The other thing is I 16 think it's an effort by Schreiner to give back to the 17 community a little bit. 18 MR. STEBBINS: Absolutely. 19 COMMISSIONER LETZ: It's been a big part of 20 the community a long time. 21 COMMISSIONER REEVES: Schreiner's always 22 tried to help residents in the area through the Hill 23 Country College Fund. I know I was a beneficiary of 24 that, a couple years ago. I won't say how many. So 25 they always offer those type of incentives for the 59 1 people here to attend Schreiner. And so it's a very 2 important program. 3 MR. STEBBINS: On a side note this Premier 4 pricing is offered to veterans. So they don't have to 5 be affiliated with a business that's in a partnership; 6 they just have to bring in a DD214, their official 7 records, and they will get this price. And it wasn't 8 included in the agenda. Hopefully people will take that 9 out into the community and spread the word. There are a 10 lot of veterans getting out right now, looking at 11 education, a lot of veterans that obtained a four year 12 bachelor degree. And so hopefully, this will convince 13 them that they can pursue a master's. 14 COMMISSIONER REEVES: Please watch out for 15 going off the agenda, our County Attorney takes offense 16 to that. 17 COMMISSIONER BALDWIN: What size handcuffs 18 does he have? 19 JUDGE POLLARD: All right. And we are very proud to announce that May 15 is Blaze a Trail, it's the theme of this years Older 16 Americans Month. 17 We were funded through the Older Americans 18 Act of 1965, and we offer a great variety of services 19 for seniors, sixty and older. The only exception is for 20 grandparents raising grandchildren, and they can be 55 21 years of age. And these two lovely ladies are on our 22 advisory counsel. And so I'm very happy they're here as 23 backup. 24 I brought some materials for the 25 Commissioners, and I will leave them on the table there, 61 1 or wherever you want, that will talk to you about our 2 program. We have a senior guide that has resources from 3 this area. I brought some program brochures, the number 4 folks need to call, if you know anyone that needs help 5 with a utility bill, with grab bars, with a provider for 6 two months, and we're very happy to provide that 7 service. 8 Well, we have lots of programs as you know 9 at AACOG and I brought one of the other programs because 10 it's so important, and it's the weatherization program. 11 May I answer any questions? 12 COMMISSIONER MOSER: Let's see you're with 13 the Alamo Area on Aging. DOSS: I just put them all in there 15 based on how many we had last year. We don't have to 16 have them. 17 COMMISSIONER LETZ: And I'm just wondering 18 if we shouldn't, you know, build a few more in after, 19 and the President has been a little bit late getting 20 that number to us in recent years, so we can put some 21 workshops in early August so that we're not scrambling 22 trying to make decisions in a hurried manner right at 23 the end, as we tend to have done in some of the years 24 past. That's my only comment. 25 JUDGE POLLARD: So you are suggesting all of 65 1 the workshops? 2 COMMISSIONER LETZ: No, not all. Not all. 3 JUDGE POLLARD: Some. 4 COMMISSIONER LETZ: Some. Or maybe we could 5 even leave the ones that are here and just cancel them 6 if we don't need them. But I would add two workshops in 7 early August. Before the -- on July the 28th, I would 8 delay that a little bit. That July 28 elected officials 9 issue until -- and maybe put two workshops between right 10 in the first week of August. Dawn Lantz. 21 MRS. LANTZ: Good morning, Judge, good 22 morning, Commissioners. I am bringing this back to the 23 Court for it's approval. I did send it out to all the 24 elected officials and department heads to review it. I 25 did get some responses and we made some corrections, 69 1 minor corrections. 2 COMMISSIONER BALDWIN: Have the corrections 3 been made in this document that we have? 4 MRS. LANTZ: Yes, Sir. 5 COMMISSIONER BALDWIN: Okay. Good, cool. 6 MRS. LANTZ: And I met with the Sheriff and 7 he -- we corrected some things that matched his policy. 8 So we're kind of on board the same way. 9 COMMISSIONER BALDWIN: All I want to know is 10 what does this do for me? 11 MRS. LANTZ: Gives you benefits. 12 COMMISSIONER BALDWIN: I'll take it. 13 SHERIFF HIERHOLZERE: There are a couple 14 things that just need to be noticed by the Court because 15 they will affect future employees. 16 MRS. LANTZ: Yes. One thing that we 17 discussed was changing our sick leave policy. 18 Currently, we earn 8 hours a month, which a lot of 19 employees have many, many hours on the books, which 20 probably will never get used. With the new regulations 21 of fair labor standards act and the policies, basically 22 employees are given 12 weeks of protected leave, that's 23 not saying we can't go to beyond that. But we did 24 change that, we would have a cap on our sick leave to 25 720 hours that you can accrue, and after that it stops. 70 1 But if you go below that it starts accruing again and 2 you accrue basically two weeks a year sick leave, where 3 prior it was 8 hours and you could have thousands and 4 thousands of hours. Employees thought that because they 5 had all those hours they could be out. 6 COMMISSIONER MOSER: So when an employee 7 leaves, if they have sick leave -- 8 MRS. LANTZ: It does not get paid out. 9 COMMISSIONER MOSER: So 720 hours is max. 10 MRS. LANTZ: Once you go below you can start 11 accruing again, but that's the most you can have. Kind 12 of like our vacation, you can only accrue 160 hours, 13 anything above that, you lose. And that does get paid 14 out if you do. 15 SHERIFF HIERHOLZER: Current employees with 16 more than that were grandfathered in, they just have 17 stopped earning until their's drops back down. 18 MS. LANTZ: We're not going to take it away 19 from them. It's just that's the maximum you can get. 20 JUDGE POLLARD: All right, is there a 21 motion? 22 COMMISSIONER REEVES: Well, I have one 23 thing. I just noticed this reading, Mrs. Lantz, I think 24 it's on page 38 about fringe benefits. It says Kerr 25 County will comply with IRS with regard to fringe 71 1 benefits such as uniforms, County vehicle usage and day 2 trip meals. You may be responsible for paying payroll 3 taxes. What does that mean? 4 MRS. LANTZ: Basically, the IRS regs, there 5 are some things that employees can be liable for, and 6 that will have to be worked out with the auditor's 7 office. Sometimes if you're not law enforcement, the 8 vehicle you take to and from work, you can be charged 9 your travel to and from home. 10 COMMISSIONER REEVES: If you're not in law 11 enforcement. 12 MRS. LANTZ: Correct. So basically those 13 regulations are in the IRS. And there's some rules for 14 governmental entity's regarding those fringe benefits, 15 which the new ruling, I did give Brenda and the County 16 Attorney a copy that's updated as of January 19th, 2016 17 where some of those may fall on our employees. 18 COMMISSIONER LETZ: Are we going to let the 19 employees know if they're going to be subject before the 20 end of the year? 21 MRS. DOSS: We have to. 22 MRS. LANTZ: Yeah. 23 MRS. DOSS: And it's emergency vehicles 24 also. 25 COMMISSIONER LETZ: Well -- and what I'm 72 1 thinking of -- 2 MRS. DOSS: Any emergency vehicle. 3 COMMISSIONER LETZ: Some of the Road and 4 Bridge people take their -- anyway the supervisor take 5 their vehicle home because they may be on call. Is it 6 going to cover something like that? I mean this may be 7 a big change on how we do our policy. 8 MRS. DOSS: Right. 9 COMMISSIONER LETZ: When will we know that? 10 MRS. DOSS: I'm looking into it right now. 11 Because I don't want to change anything until we're 12 absolutely positive about it that it has to be. So I'm 13 looking into it. 14 MRS. LANTZ: And we just have to make sure. 15 COMMISSIONER REEVES: And you said it 16 applies to emergency vehicles. 17 MRS. DOSS: Things like law enforcement, 18 like EMS, fire, or emergency management. 19 COMMISSIONER REEVES: That are taxable. 20 MRS. DOSS: That are not, they're exempt. 21 You can take those home. 22 COMMISSIONER BALDWIN: But maintenance and 23 Road and Bridge -- 24 MRS. DOSS: Those are the ones that we're 25 looking at right now more closely, yes, Sir. 73 1 MRS. LANTZ: Even if you're on call you can 2 take your vehicle; but if you're not on call just to 3 have the benefit to drive it back and forth may be 4 taxable. 5 COMMISSIONER BALDWIN: Well, we don't do 6 that anyway. 7 MRS. DOSS: And how that works is they would 8 tax it on the standard mileage rate for someone to 9 commute home. That would be included then in their 10 income. And they would have to pay -- we would -- they 11 would have to pay the withholding taxes on that. 12 COMMISSIONER MOSER: So Road and Bridge 13 taking a vehicle home they would only -- they're having 14 it in case they need to be called, which could be an 15 emergency. 16 MRS. DOSS: Well, but they're not classified 17 as an emergency vehicle. They have very, very specific 18 guidelines in the IRS code. 19 COMMISSIONER MOSER: I see. They define 20 what emergency means then? 21 MRS. DOSS: Yes. 22 COMMISSIONER MOSER: So a bridge washing out 23 is not an emergency? 24 MRS. DOSS: Well, it's based on the vehicle. 25 MRS. LANTZ: The vehicle. 74 1 SHERIFF HIERHOLZER: If it's defined an 2 emergency vehicle. 3 COMMISSIONER MOSER: Vehicle, and not the 4 event. I see. 5 COMMISSIONER LETZ: And you'll -- during or 6 before our budget hearing start you'll have an idea of 7 how the impact will be -- 8 MRS. DOSS: Yes, Sir. 9 COMMISSIONER LETZ: -- if any. DOSS: That's not enough according to 15 the IRS though. 16 COMMISSIONER BALDWIN: Well, we'll put him a 17 little siren in there then -- whoooo thing. 18 JUDGE POLLARD: What chance have the 19 employees had to look at it? I know you mentioned 20 elected officials, but how about the employees in 21 general? 22 MRS. DOSS: To the new policy? 23 JUDGE POLLARD: If they have any comments on 24 it, or substitutions? 25 COMMISSIONER LETZ: I mean it went to the 75 1 elected officials and the department heads. 2 JUDGE POLLARD: Okay, I know that. And did 3 they disseminate it is my question. 4 SHERIFF HIERHOLZER: Well, the difference is 5 if it's Road and Bridge or maintenance, that's fine. If 6 it Sheriff's office, under an elected official, okay, 7 it's only part of this policy we really look at is the 8 benefits of the County. My employees don't get this 9 policy. I mirror what the benefits with mine because I 10 have the policy for the elected -- for the employees 11 under me. 12 COMMISSIONER REEVES: And that would be the 13 same for any elected official. 14 SHERIFF HIERHOLZER: And that's the way with 15 any elected officials. Actually they're employees of 16 elected officials. They get the benefits from the 17 County. 18 MRS. STEBBINS: My employees will receive a 19 copy and sign for it after you all adopt it and choose 20 to adopt it. For whatever it's worth. 21 MRS. DOSS: Mine will, too. 22 MRS. LANTZ: And most of the employees will 23 go by the guidelines whatever the Court approves. 24 Basically we're under the regulations of what basically 25 the law is. 76 1 JUDGE POLLARD: So they're going to be aware 2 of what these changes are. 3 MRS. STEBBINS: Yes, Sir. 4 JUDGE POLLARD: That's all I have concerns 5 about. Does that 9 mean that they are property owners down -- 10 JUDGE POLLARD: You're talking about the 11 Comanche nation. 12 COMMISSIONER BALDWIN: I'm talking about the 13 Comanche nation. 14 JUDGE POLLARD: Yeah. And there's another 15 one in there, too, up in New Mexico. 16 COMMISSIONER BALDWIN: Do they own property 17 in Center Point? 18 JUDGE POLLARD: I'm not aware of that. It's 19 whatever the statute requires is what they're trying to 20 follow. 21 COMMISSIONER LETZ: Commissioner, there's -- 22 and I'm not sure how, but I believe there were two 23 tribes that the State law requires, I think, and I 24 should say it's Federal law probably, requires that they 25 sign off on the environmental review and I think it's 78 1 because they had some ties to the County at some point 2 in their history. I'm not sure if they own property or 3 not, but it's a requirement of environmental law, yeah. 4 COMMISSIONER BALDWIN: Indian mounds and 5 things. 6 COMMISSIONER MOSER: Artifacts. 7 COMMISSIONER BALDWIN: Artifacts. There were different -- all of the other 7 work that we've done, a right of way and on the sewer 8 project did not -- it came from a different funding 9 source. This, I believe, is through HUD, and because of 10 that it's a different funding source. That's why these 11 additional requirements were mandated. 12 COMMISSIONER BALDWIN: HUD would be a 13 federal deal. 14 COMMISSIONER LETZ: That's the reason it's 15 coming in at this point. We haven't done it previously. 16 JUDGE POLLARD: It was surprising that the 17 two particular Indian nations had to be in. 18 COMMISSIONER LETZ: And I think it's largely 19 because there was a large Apache and Comanche presence 20 in the County. 21 JUDGE POLLARD: At one time. Mescalero 22 Apache's. 23 COMMISSIONER MOSER: They were in New Mexico 24 and they were here too? 25 JUDGE POLLARD: And used to roam down this 80 1 way. The Comanche's ran them back to New Mexico. 2 Originally it was all Apache's down here. 3 COMMISSIONER LETZ: Comanche's were -- 4 COMMISSIONER MOSER: Mean. 5 COMMISSIONER LETZ: They were based in Camp 6 Verde. That's where their main compound was. 7 COMMISSIONER MOSER: Very strong 8 constituents. Emphasize strong. 9 COMMISSIONER BALDWIN: Just can't stand it 10 can you? 11 JUDGE POLLARD: Item 1.18 -- 12 COMMISSIONER REEVES: We've already covered 13 that, Judge. 14 JUDGE POLLARD: Hu? 15 COMMISSIONER REEVES: We've already covered 16 those. 17 JUDGE POLLARD: That's right. 1.18, 1.19 18 and 1.20 have already been covered. 19 1.21 consider, discuss and take appropriate 20 action on personal matter. Dean Golden. Dean Golden 21 wish to speak? 22 MR. GOLDEN, JR.: Good morning. My name is 23 Carole Dean Golden, Jr. I'm up here because I was 24 wrongfully terminated and I would like my job back. I 25 got write ups that were never given to me and when I 81 1 filed for unemployment, the investigators found it 2 unworthy and found the individuals un credible. So I'm 3 not kind of used to being up in the spotlight. 4 And these write ups that just makes no 5 sense, and when they -- and in the hearings they asked 6 my supervisor Jason Roberts to give more details on it, 7 he couldn't. And then I got some write ups that 8 happened after I was terminated. One doesn't even have 9 my signature, just has the supervisor's signature. 10 Doesn't have the chain of command. And another one is 11 dated six weeks after I was terminated. 12 EEOC tried to get my job back, and 13 everything else, and they wouldn't do it, so I'm up here 14 trying to get my job back back and everything. One 15 write up just says I didn't do what I was told. 16 COMMISSIONER MOSER: What Department was 17 this? 18 MR. GOLDEN, JR.: Road and Bridge. 19 COMMISSIONER MOSER: Road and Bridge. 20 MR. GOLDEN, JR.: And in the hearings they 21 asked what did I not do. Jason Roberts said I did not 22 do the flagging. If I'm assigned for the chipper truck 23 that means I gotta throw the brush and stuff in. We 24 have three man crews. Jason Roberts was just cutting -- 25 COMMISSIONER REEVES: Mr. Golden, we want 82 1 you to speak freely, but please -- and tell me if I'm 2 out of line, Miss Attorney, refrain from using any other 3 County employee names. Please just refer to them as 4 supervisor or -- 5 MRS. STEBBINS: I think that's good advice. 6 COMMISSIONER REEVES: Thank you. 7 MR. GOLDEN, JR.: So the supervisor would be 8 cutting the brush. The third individual just be 9 standing there watching the supervisor cut. So of 10 course with the chain saw it takes -- that you can move 11 faster and then drag the brush over. So when they stop, 12 fill up the gas on the chain saw or oil it up, I'll 13 still be chipping brush, and then I would get blamed for 14 not flagging. 15 Another write up, I got because I got stuck. 16 We're on a -- our trucks are almost seven foot wide. 17 We're on a 14-foot wide road. And sometimes when I go 18 to a job I might be sitting there 30 minutes before they 19 show up. So I pulled just a hair off the road, just a 20 little bit and sank. The day before we had about four 21 or five inches of rain, so of course we sank, or I kind 22 of busted through. I parked a little bit on the base 23 and just kind of sank through. And they tried to say it 24 took over three hours to get me unstuck; it didn't take 25 that long. And so he tried to say -- write me up for 83 1 that. We're the only crew that would go out and chip 2 brush on the side of the road after a rainstorm. 3 Usually only the time that we would do something like 4 that if a tree fallen or limbs had fallen from a storm. 5 Not go out and clear the whole roadway because it is 6 dangerous for our vehicles, for us and for the 7 community, having to go around us. 8 JUDGE POLLARD: Is there anything else you 9 want to add to it? 10 MR. GOLDEN, JR.: Not at the moment. I got 11 more. I was kind of waiting for your questions. 12 JUDGE POLLARD: I don't have anymore 13 questions, unless you want to put something else on. 14 Help yourself, you got an opportunity now if you want to 15 put further -- further materials in it, it's your time. 16 MR. GOLDEN, JR.: Okay. Then I got one 17 write up from another supervisor, this happened about 18 two years ago, because I asked to take some classes, and 19 it's all up in the chain of command. And it got to one 20 person, the one supervisor, and it stopped. So I asked 21 my supervisor about it. And he went up and that 22 supervisor said don't worry about it, we don't need 23 anybody right now. 24 About two months later, another guy was 25 hired and a couple months later he asked how he could 84 1 take some of these classes. And one of them was the 2 herbicide class, because he wanted to use it for 3 personal use on his family's ranch. So Kerr County paid 4 for him to go to the class, and gave him the pay bump so 5 he could kind of help use it for his personal use, so I 6 went to a supervisor and talked to him about it and then 7 that supervisor wrote me up for not following chain of 8 command. But technically if I have a problem in the 9 chain of command, I have the right to go around. And I 10 did, and I got wrote up for it. 11 For some reason I was just targeted, and my 12 record is clean, except for those bogus write ups. 13 JUDGE POLLARD: All right. Anything else 14 you want to add to it? 15 MR. GOLDEN, JR.: Not at the moment right 16 now. 17 JUDGE POLLARD: You want to say something. 18 MR. GOLDEN: I'm Carole Golden, Sr. I'm 19 Golden as most of you know me. Part of this problem is 20 that these write ups and everything are not clear. 21 I'm forgetting where I'm at, I'm sorry. 22 Anyway, we're trying to get this straight 23 and everything to prevent having to go with a lawsuit 24 and everything. We'd rather go this way now, because 25 we're not really after the County. We're after the 85 1 people who caused the problems. And these write ups 2 that he got most of them were taken off once it was 3 explained that he had to park on the side of the road 4 and he got stuck, to give cars the ability to get 5 around, the public. So that was one of them. That was 6 chunked. 7 Some of the others -- 8 MR. GOLDEN, JR.: Well, like with the write 9 ups for getting stuck, it's sort of like when you work 10 with a wheel barrel, do you park your wheel barrel way 11 off and then pick up stuff, and you walk 20 feet to put 12 it in the wheel barrel. The thing is to get it closer 13 to the pile that you gotta move. We were clearing 14 brush, and if you can get off the road without sliding 15 off the hill or whatever, you pull off so you can move 16 it quicker and easier without hurting yourself. And 17 that day when it rained, I tried to get off just to let 18 the public through, that way I didn't make the public go 19 in the mud and slide off the road or into a fence. 20 And all these write ups happened after my 21 child was born. My child was born on May 1st, I took a 22 week off, through FMLA, which the Road and Bridge said I 23 had to use my vacation time, that was their procedure, 24 and the day I got back I just got a write up and all it 25 said on the deal nature of problem, didn't do what I 86 1 said. And so when I asked him why, you're writing me up 2 for -- I need details. He said like sign it or I'm 3 going to write you up again for not signing it. And all 4 this happened after my child was born out of wedlock. 5 MR. GOLDEN, SR.: We just believe that it 6 has gone to the extremes of trying to do like a group 7 getting together, conspiracy type deal, to get him out 8 of the way for no reason, and there was no reason. Some 9 of the other men that he worked with told him the 10 supervisors that they were the problem, they caused it, 11 so they erased his name off of it. Some of the papers, 12 he never signed, never saw, never got a copy of it of 13 what happened to him. They just took it and ran with 14 it. And you know, they didn't let him know anything 15 about it, and doesn't know anything about it. 16 The paperwork went through and for instance 17 on this it says Carole Golden. Well that's me. And how 18 did I get sued by the Kerr County Road and Bridge. He's 19 my son, but he's a Junior, and he goes by Dean. 20 MR. GOLDEN, JR.: What he's talking about is 21 when we had that unemployment hearing one individual 22 started to say well you worked for the County before you 23 got a full-time position. Somehow they pulled his 24 paperwork from when he worked for the Sheriff's 25 Department and got our names mixed up. They didn't look 87 1 down to see Senior or Junior. 2 And when I run into other people from Road 3 and Bridge, they come up and ask me how's everything 4 going at Kerr County Juvenile Detention Center. I don't 5 know. And that's what we were told you did was you 6 transferred over. So how come people are telling me 7 this but yet I was terminated and it originates back to 8 certain -- to certain people in the conspiracy. 9 MR. GOLDEN, SR.: They were trying to hide 10 it from their own employees, their own supervisors. Had 11 one supervisor that ran into him one time says well how 12 you like working for the road -- juvenile detention, he 13 says I don't, I was fired. So they didn't even know it. 14 And that was a supervisor. 15 MR. GOLDEN, JR.: And one of the supervisors 16 I ran into three weeks ago even asked me how it was 17 going at juvenile detention center. He didn't know that 18 I was terminated. 19 MR. GOLDEN, SR.: So he came back, after he 20 was fired, and put in some applications and everything 21 at different places, and he was apparently blackballed. 22 People wouldn't even talk to him or anything else, 23 around town and everything, businesses. 24 MR. GOLDEN, JR.: Have yet done an interview 25 in Kerrville, in Kerr County. All my interviews been 88 1 out of County because of the blackballing. I've had 2 people come up telling me that they will not write a 3 statement because they don't want to get involved. 4 JUDGE POLLARD: All right, anything else to 5 that you'd like to add to it or say? 6 MR. GOLDEN, JR.: Give me a second to 7 backtrack to it right quick. 8 MR. GOLDEN, SR.: I think we got it all. 9 MR. GOLDEN, JR.: Yeah, I think that's it. 10 MR. GOLDEN, SR.: There were a lot of other 11 things that we have that we don't want to bring out, 12 because we're not sure which way we're going to go on 13 this or anything else. But we wanted the County to know 14 what was happening and try to prevent any cost to the 15 County. And he's wanting his job back. And we don't 16 want the County to pay for something and then -- 17 JUDGE POLLARD: Okay, I think we understand 18 your position then. 19 MR. GOLDEN, JR.: And just like with the 20 blackballing, I applied just a couple days after I was 21 terminated, I applied for Juvenile Detention Center, and 22 Jason Davis came up to HR and asked and he was flat out 23 told I was un hirable, and even though yet all the Road 24 and Bridge think I work out at juvenile detention 25 center. 89 1 JUDGE POLLARD: All right. Dean went to HR, got an application, 12 Teresa filled it out, Dean took it back to HR, never 13 heard anything. Diane called Paula, said, if Teresa 14 doesn't want the job, she hasn't showed up I'm going to 15 have to hire somebody. Then Paula called Teresa, Dean 16 got her another application, filled it out, took it 17 straight to Diane Bolin's office. Diane read it, called 18 her in, interviewed her and hired her. She's now 19 working at the tax office. Now, is that not 20 blackballing, because Dean took her application in? 21 And another time, Dean and Teresa went in 22 before she applied for Diane's office, before that 23 position came open, and she was told -- they were told 24 that the position she was going to fill out was already 25 filled, and Dean said well, the things are still on the 90 1 wall. And she says well they stay up there a couple 2 days, but they're filled. So is that not blackballing? 3 And he was fired in May of last year, and he hasn't got 4 a job yet. We don't 22 deal with Guadalupe Blanco River Authority a great deal, 23 but we do deal with them mainly because we have an MOU 24 that we're still working with them. But their general 25 manager Bill West has retired. 97 1 COMMISSIONER BALDWIN: Hallelujah. 2 COMMISSIONER LETZ: How can you say that. 3 But he has retired. And his replacement is a gentleman 4 named Ken Patterson -- excuse me Kevin Patterson. And I 5 don't know if this is good or bad, but Kevin is someone 6 I know because he is former executive director of the 7 Texas Water Development Board. And I've already 8 communicated with him and welcomed him and look forward 9 to working with him, and he sent me an e-mail right back 10 right away and said he looked forward to working with 11 us. I view this as a positive. But it is a change that 12 does have impact in Kerr County, and an agency that we 13 do work with on occasion. 14 JUDGE POLLARD: Okay. You have anything? 15 COMMISSIONER REEVES: No, Sir. 16 JUDGE POLLARD: Okay. Let's go to reports 17 from elected officials and department heads. Any? Yes, 18 Ma'am. 19 MRS. LAVENDER: I just wanted to report that 20 almost two weeks ago we went to AACOG and on our 21 juveniles and our victims services grants, and the 22 juvenile grant will not be funded next year, came in 6th 23 of 6th. The victim service grants will be funded for 24 the next two years, and so that will give you a little 25 bit of cushion in the transition time with the new 98 1 person. And Dawn is going to help me. We're going to 2 post the position on May 2nd, which means Monday, and 3 we'll go ahead and see if we can find somebody with them 4 starting on October first. But it is time to interview 5 beginning looking for the right person hopefully to do 6 this. 7 And if you haven't been down and looked at 8 our new office room edition, come down. Pretty cool. 9 Tim's people did a really good job, and in building it. 10 And they should be commended for their efforts. 11 COMMISSIONER BALDWIN: Rosa, your grant, was 12 it increased over last year's? 13 MRS. LAVENDER: Yes. 14 COMMISSIONER BALDWIN: By what amount and 15 why? 16 MRS. LAVENDER: We put in that two percent 17 pay raise contingent on whatever y'all decide to do with 18 the position. And then we put in a two percent for the 19 following year because it was a two year grant. It 20 would start the first of October. So this -- it was -- 21 I don't remember how much, but not much. I think it was 22 a hundred and something thousand dollars total for the 23 two years. 24 COMMISSIONER BALDWIN: Was anything put in 25 there for like you staying on until the end of the year 99 1 and a new employee coming in and getting training? 2 MRS. LAVENDER: No, we could not do that. 3 That was not allowable with a new grant. 4 COMMISSIONER BALDWIN: So it has to be done 5 in this County budget? 6 MRS. LAVENDER: That's the reason I 7 suggested to go to a 32 hour, because that will save you 8 some. And you know it's up to you when you get ready to 9 do the budget work you do. 10 COMMISSIONER MOSER: I'd like to add one 11 thing on the subject of grants. On this line, I 12 mentioned the flood warning system. There is a 13 potential in the State, and just was approved the other 14 day, that I think the State has I think about seven 15 million dollars in for systems like this. So as we look 16 at it and decide should something be needed and just go 17 about what that would be and then bring it back and try 18 to get something like that funded, too. And Jonathan's 19 looking at -- you know, this thing we just looked in 20 Kerr County but probably need to look at downstream, 21 too, once we find we meet the potential benefit, and 22 partner with some of those folks. 23 COMMISSIONER LETZ: I think from what -- 24 whoever was talking about the old system we had, Mark 25 Beavers, I think was the one who told us, I think it was 100 1 partially funded by GBRA. So it is sort of a -- 2 whatever impact happens here impacts everyone down to 3 Canyon Dam certainly. 4 JUDGE POLLARD: All right. Anyone else? 5 All right, 5.3 reports from boards, commissions and 6 committees. Anybody? 7 City/County joint projects or operations 8 reports, or any other reports of any kind. Anyone?
