And we'll start off 4 with a prayer and then the pledge of allegiance. Please 5 bow your head in prayer. 6 (Prayer and Pledge of Allegiance.) 7 JUDGE POLLARD: All right, now we're in the 8 part of the agenda where anybody in the audience wishes 9 to come forward and talk on an item that is not on the 10 agenda. If so, then please approach the podium, 11 identify yourself by name and address, and please limit 12 your comments to three minutes. Is there anyone wishing 13 to speak? 14 Okay, there being none, we'll move on to the 15 next part of the agenda and that's Commissioners' 16 comments, Commissioners and County Judge. Start with 17 Precinct 1. 18 COMMISSIONER BALDWIN: No, Sir. Thank you. 19 COMMISSIONER MOSER: Pass. 20 JUDGE POLLARD: I do too. 21 COMMISSIONER LETZ: I just have one brief 22 comment. And just related to our last meeting we talked 23 with the reuse project a little bit and some of that 24 stuff. I've just been told that a couple times that I 25 have been a little bit misquoted what I said at that 7 1 meeting when I said I was in favor of the project. I 2 want to make it clear I'm in favor of reuse as an option 3 for the City of Kerrville; I'm not in favor of any 4 specific details of it, including ponds. Not opposed to 5 ponds or for the ponds. I don't have the information 6 about it. I don't know what the County Engineer to come 7 back with that. But I've been told that several have 8 misquoted me on that and saying I was in favor of that 9 pond, and it's not what I said. Just wanted to clear 10 that up. That's it. 11 JUDGE POLLARD: Mr. Reeves. 12 COMMISSIONER REEVES: Just one note that 13 right after our last regular meeting in August, Precinct 14 4 had their brand new citizen, and his name is 15 Mr. Oehler Ott McMinn, and parents Trey McMinn and 16 mother Haley Oehler McMinn are both doing well. And I'm 17 sure if the gentleman that used to occupy this seat was 18 still with us, he'd have plenty of pictures to pass 19 around today of his new grandson. So we're just real 20 tickled about that. 21 JUDGE POLLARD: That's great. Anything 22 else? If not, we'll move to item 1.1 on the agenda 23 consider, discuss and accept certifications of unopposed 24 candidates, and issue an order that unopposed candidates 25 are elected. 8 1 MS. ALFORD: Yes. There 18 being none I hereby declare the public hearing closed. 19 We're now going to item 1.3 consider, 20 discuss, and take appropriate action regarding the final 21 revision of plat for lot 23 of Ingram Hills Subdivision, 22 Mr. Hastings. 23 MR. HASTINGS: Thank you. The owner of the 24 lot 23 Lance Keune wishes to subdivide his lot into two 25 separate parcels, 23-A be 15.85 acres, and 23-B 1.37 10 1 acres. The proposed subdivision is located outside of a 2 high density area. It meets the minimum required lot 3 size of one acre, because the smallest one proposed is 4 1.37 acres, and the maximum lot is five. He only has 5 two proposed lots. And he does have the minimum lot 6 frontage on a road of a hundred and 50 linear feet, and 7 I think he's got a hundred 92, and 150 respectively for 8 the two lots. County Engineer requests that the Court 9 approve the final revision of plat for lot number 23 of 10 Ingram Hills Subdivision, plat record volume 3, page 11 149, Precinct 4. 12 COMMISSIONER REEVES: And I would like to 13 comment, Mr. Hastings, that both of these lots are 14 served by a water system and not individual wells, is 15 that correct? 16 MR. Item 1.4 7 consider, discuss and take appropriate action regarding 8 a request for the installation of cattle guards on 9 Esquell Ranch Road and the replacement of an undersized 10 cattle guard on Esquell Ranch Road. Now, is that 11 undersized cattle, or is that undersized cattle guard? 12 MR. HASTINGS: Cattle guard. 13 JUDGE POLLARD: Okay. I just thought maybe 14 we were dealing with pygmy cattle. Go ahead. 15 MR. HASTINGS: Thank you. The 16 Transportation Code allows for construction of cattle 17 guards on county roads, and Kerr County did adopt a 18 cattle guard policy. It's in your packet there, so is 19 the Transportation Code, where cattle guards can be 20 removed based on the following criteria: Number 1 both 21 sides of the road are no longer owned by one family. 22 Number 2 traffic accidents occurred near the cattle 23 guard more than three times in the five-year period, or 24 3 when the traffic count on the road meets or exceeds 25 801 cars per day. The Road and Bridge Department has 12 1 received a request from Mr. Ernest Gabriel for the 2 installation of a cattle guard on KC 476 -- 3 COMMISSIONER REEVES: Mr. Hastings, this 4 is -- 5 MR. HASTINGS: I'm sorry, I'm skipping 6 ahead. I need to look at Esquell. Okay, I apologize. 7 Here we go. The Road and Bridge Department has received 8 a request from Mr. Jody Lange for the installation of a 9 cattle guard on Esquell Ranch Road where one he owns 10 both sides of the road, it satisfies that criteria. 11 Number two there are no recorded traffic accidents in 12 the proposed cattle guard location. And number three 13 the average daily traffic counts are less than 801 cars 14 per day. We counted 57 cars per day per the attached 15 traffic count that's in your packet there. It was 16 conducted from August 16th through August the 19th, 17 2016. In addition to the request for the new cattle 18 guard on Esquell Ranch Road there's an existing 12-foot 19 wide cattle guard on Esquell, located about a half mile 20 west of Esquell Ranch Road's intersection with FM 479. 21 It's on a map that's in your packet, and we do recommend 22 at this time that it be upgraded to a 20-foot wide 23 cattle guard for safety and consistency throughout the 24 rest of the County. It is recommended that the Court 25 authorize the Road and Bridge Department to upgrade this 13 1 cattle guard. Further recommend that the Court 2 authorize Road and Bridge to install a new cattle guard 3 on KC 476 -- I'm sorry, I'm getting ahead again. On 4 Esquell Ranch Road approximately 0.9 miles west of the 5 intersection with FM 479, and replace an existing cattle 6 guard on Esquell Ranch Road approximately half a mile 7 west of its intersection with FM 479. There is a line 8 item -- 9 JUDGE POLLARD: So more than one cattle 10 guard? 11 MR. HASTINGS: Yes, there are two. And Road 12 & Bridge has a line item specifically for cattle guards, 13 installation of cattle guards, and there's currently 14 about 17 thousand dollars in that line item. And these 15 two cattle guards would be 35 hundred for the first one, 16 three thousand for the second one, a total of 65 17 hundred. The entity that was giving us a quote on that 18 was giving us a break on any additional ones. 19 COMMISSIONER LETZ: Just explain -- the 20 replacement, I understand that, that is fine. And are 21 both of them replacement or one of them's a new one? 22 MR. HASTINGS: One of them would be brand 23 new. That's the one that's about 9 tenths from that 24 intersection of 479. 25 COMMISSIONER REEVES: That is due, 14 1 Commissioner, to some partitioning of land with family, 2 and one heir received land on both sides of the road out 3 there, and water for stock on one side of it and they 4 need a cattle guard to facilitate this. 5 COMMISSIONER LETZ: Question. Is the County 6 paying for both? 7 MR. HASTINGS: Yes. 8 COMMISSIONER REEVES: The replacement one 9 and yes. I've been out there with the engineer and the 10 road administrator, along with Mr. Sims, the crew chief 11 out there and it's my opinion that this one's needed out 12 there, so I move for approval of the agenda item. 13 COMMISSIONER LETZ: Second. 14 JUDGE POLLARD: It's been moved by 15 Commissioner Reeves and seconded by Commissioner Letz to 16 approve the request installation of cattle guards on 17 Esquell Ranch Road, be two of them, one is a new cattle 18 guard and the other one is a replacement cattle guard. 19 is there any further discussion? 20 Let me ask, Mr. Reeves, is this on land 21 related to some of your relatives? 22 COMMISSIONER REEVES: Way down the line. 23 JUDGE POLLARD: Way down the line, okay. 24 COMMISSIONER REEVES: Yeah. It's four zero, 4 unanimous. 5 All right, item 1.5 consider, discuss and 6 take appropriate action on change order number 4, Texas 7 Department of Agriculture for Texas Community Block 8 Grant Project 7214025, Precinct 1 and 2. 9 Good morning, Katie, how you? 10 MS. FALGOUST: Good. How you doing? 11 JUDGE POLLARD: Good. 12 MS. FALGOUST: So Charlie Hastings, the 13 contractor and the owner of the Park Hill Apartment 14 complex are meeting this Wednesday to discuss the 15 sodding at the apartment complex. This is the last part 16 of the project to complete, and one of this has been 17 re vegetation of the property that was disturbed in the 18 construction of the sewer line. And so we have a change 19 order to consider today to add three hundred square 20 yards of sod, in the event that this meeting determines 21 that more sodding is needed to finish it out. So it 22 would be increasing the contract by $1,800 and it would 23 be covered by grant funds. And so if you have any 24 questions, Charlie -- yeah, can help. He's been the one 25 who's been inspecting the property and determine what's 16 1 needed. 2 COMMISSIONER BALDWIN: What if we approve 3 today, and come Wednesday of the meeting it's determined 4 that the sod is not needed there, what happens? 5 MS. FALGOUST: Then we wouldn't submit the 6 change order. We wanted to be proactive in having it 7 ready. 8 COMMISSIONER BALDWIN: So we're not ordering 9 a change order then. 10 MS. FALGOUST: Could we have it that the 11 change order would be signed contingent upon the 12 determination of Wednesday's meeting? 13 COMMISSIONER BALDWIN: I think that's wiser, 14 because I drive by there daily, I don't see where y'all 15 are talking about. It's pretty solid grass to me. 16 MR. HASTINGS: That's right. And as of two 17 weeks ago when we were considering this because of the 18 timing of the grant and everything necking down and 19 we've got to get it done. Two weeks ago there was a lot 20 of seed that was popping up. But it wasn't even a 21 quarter inch tall yet. It had just started to germinate 22 and we're hoping by yesterday it would be unnecessary to 23 have the sod, but if we don't have the change order 24 approved by you guys, then if we meet Wednesday and we 25 need it we're going to lose a couple of weeks. 17 1 COMMISSIONER BALDWIN: Move for approval. 2 COMMISSIONER MOSER: Second. 3 JUDGE POLLARD: Been moved by Commissioner 4 Baldwin, seconded by Commissioner Moser for approval of 5 the change order that may or may not be used if it 6 passes, it'll be available if needed. All right, thank you, Katie. 21 Item 1.6 consider, discuss and take 22 appropriate action on request from Charlie Hicks, the 23 Constable for Precinct 2, to appoint three deputy 24 constable's pursuant to the Texas Local Government Code 25 section 86.011. Good morning -- 18 1 CONSTABLE HICKS: Good morning. 2 JUDGE POLLARD: -- Constable Hicks. 3 CONSTABLE HICKS: This all came about a 4 couple months ago. Ray had came to me and we found out 5 that Constable Lavender was going to retire and asked me 6 if I would consider carrying the commission in order for 7 a smooth transition, you know, instead of having to go 8 through a new constable and having to learn his job plus 9 their job and everything else. 10 JUDGE POLLARD: So we can continue with 11 deputy constables in Ray Garcia's department with a 12 seamless -- 13 CONSTABLE HICKS: Yes. 14 JUDGE POLLARD: Seamlessly, without 15 interruption. 16 CONSTABLE HICKS: The only difference would 17 be that it would be Precinct 2 Constable instead of 1. 18 COMMISSIONER MOSER: Move for approval. 19 COMMISSIONER BALDWIN: Second. 20 COMMISSIONER REEVES: Second. 21 JUDGE POLLARD: Well, I've had two seconds. 22 COMMISSIONER REEVES: You can have it, Sir. 23 COMMISSIONER BALDWIN: Thank you very much. 24 I feel like my life is complete now. 25 JUDGE POLLARD: Moved by Commissioner Moser, 19 1 seconded by Commissioner Baldwin with permission from 2 Commissioner Reeves, that we approve the hiring of the 3 deputy constables by Charlie Hicks, Precinct 2 4 Constable, which are the same ones that are present 5 deputy constables working in Ray Garcia's environmental 6 health department. Is that a good statement of the -- 7 COMMISSIONER MOSER: Probably instead of 8 hiring; appoint them. 9 JUDGE POLLARD: Appoint them is a good idea, 10 right. Any further discussion? 11 COMMISSIONER BALDWIN: Judge, I would like 12 to make a comment. It's many years ago when we started 13 this program, I went to AACOG and had a choice of the 14 grants, had that choice of law enforcement type grant or 15 a non law enforcement and I chose law enforcement, 16 because I felt like these guys going up and knocking on 17 doors and telling them that their septic tank doesn't 18 work, it was just kind of scary back then, all that 19 going on. And the law enforcement side of it was the 20 badge has helped that immensely, and in order to have a 21 law enforcement officer that somebody has to carry the 22 license. And that's what Charlie's willing to do to be 23 the sponsor of license for these guys. And I appreciate 24 you doing that. That's all. 25 JUDGE POLLARD: You recommend it? 20 1 COMMISSIONER BALDWIN: Oh, highly, highly. 2 JUDGE POLLARD: Okay. I would make the 3 observation that during these days of meth labs and that 4 kind of stuff that it's probably even more appropriate 5 and necessary now than it was back then. 6 All right, is there any further discussion? 7 Those in favor of the motion signify by raising your 8 right hands. Is 12 this -- we're getting an additional break on cattle 13 guard bids here? 14 MR. HASTINGS: We would, yes. Absolutely. 15 JUDGE POLLARD: Do we have anymore in the 16 County we need to put in now while we need to take 17 advantage of that? 18 COMMISSIONER BALDWIN: We've been taking 19 them out. I'm surprised at all this. 20 MR. HASTINGS: Yes. 21 JUDGE POLLARD: Go ahead, Charlie. 22 MR. HASTINGS: Well, pursuant to the 23 conversation that we had earlier, everything applies, 24 the Transportation Code and the current cattle guard 25 policy that we have. We did receive a request from 21 1 Mr. Ernest Gabriel for the installation of a cattle 2 guard on KC 476. It's in a location where Number 1, he 3 owns both sides of the road. Number two there are no 4 recorded traffic accidents in the proposed cattle guard 5 location, and number 3 the average daily traffic counts 6 are less than 801 cars per day. Our traffic counts from 7 August the 16th through August the 19th, 2016 recorded 8 three cars per day. 9 JUDGE POLLARD: They'll wear it out pretty 10 fast then. 11 MR. HASTINGS: Yes, Sir. The same break on 12 the cost of cattle guards would apply to this as well. 13 So this one would cost three thousand dollars, it's well 14 within the budget. And the County Engineer recommends 15 that the Court authorize the Road and Bridge Department 16 to install one new cattle guard on KC 476, approximately 17 a quarter mile south of its intersection with the county 18 line. 19 COMMISSIONER REEVES: I'd like to point out 20 KC 476 is a Kerr County road that you can only get to 21 through Kimble County. Several months ago the 14 City had approached us, and the Court agreed to apply 15 for a grant for the hazardous waste disposal. The City 16 had been receiving the grant, the City of Kerrville been 17 receiving the grant for several years. Because of 18 receiving it so many years in a row they could not apply 19 for it again so they asked us to apply for it. We did 20 receive a 25 thousand dollar grant from AACOG. This 21 grant will also go over -- well 25 thousand, plus the 22 City of Kerrville budgeted ten thousand dollars and our 23 only other contribution will be one of our facilities to 24 hold a hazardous waste disposal. There will be a 25 company, as I understand it, Mr. Garcia, that will 32 1 provide the people, it won't be our staff -- 2 MR. GARCIA: Right. 3 COMMISSIONER REEVES: -- having to dispose 4 of anything. The trained people will come in. 5 COMMISSIONER LETZ: Which facility of ours, 6 Mr. Reeves? 7 COMMISSIONER REEVES: We have two choices. 8 The Event Center, then the indoor arena's available on a 9 weekend that we choose, because of past traffic concerns 10 that would be the best one. But because of the parking 11 lot and the ability to pull through and right out the 12 back door. The second one would be the old recycling 13 center, and it just depends on the dates. 14 Now, the grant application came in right 15 before I had to leave. I have not 100 percent reviewed 16 it, but I don't know if County Attorney has or not? 17 MRS. STEBBINS: I have. 18 COMMISSIONER REEVES: Is there any problems 19 with the wording or anything? 20 MRS. So there have not been any changes made to 4 it. We have not established what the date would be on 5 releasing the RFP, and I don't know if County Attorney 6 was going to look at this. Have you had a chance to 7 look at RFP? 8 MRS. STEBBINS: Yes, Sir, I have. But I 9 don't know which dates that will apply. 10 COMMISSIONER MOSER: The dates. Yeah, we 11 just need to establish the date here today, too when we 12 want to release this RFP. Been several companies that 13 have inquired about this RFP. They've taken a look at. 14 I've had some discussions with them about their -- what 15 their thoughts are. The idea here would be to have a 16 model set of things to which they would bid, so we know 17 exactly what type of fixtures that they'd be bidding to 18 so all be apples and apples comparison. So that 19 would -- they give some indication of what their pricing 20 structure is and what their warranties are. 21 The other thing is there are several 22 different ideas on financing these. Some of them are 23 lease, some of them are loans. And all of them, I think 24 they would be where the County doesn't have to establish 25 any funding source for these. The first payments are 40 1 not until 13 months or so after we were to approve this. 2 It could be phased. If we wanted to do courthouse, or 3 juvenile facility or whatever we want to do, rather than 4 do the whole County, which I think would be appropriate, 5 we'd have that option in there. So I think that's 6 basically it. 7 What I would recommend is that we release 8 the RFP the first of October and then have the -- and 9 then give the proposers at least two weeks to respond to 10 that, and then put in those dates in the RFP. So that's 11 my motion is that we release an RFP to consider okay, 12 not to commit, but to consider proposals for improving 13 the lighting throughout the County facilities, using 14 light emitting diodes as opposed to just current things. 15 JUDGE POLLARD: A second? 16 COMMISSIONER LETZ: I mean I'll second, but 17 I have a question. And apologize for not getting with 18 Mr. Moser since the last meeting, because I have the 19 same question as I had then. And the question comes in 20 is I have some concerns about our ability to modify what 21 we're doing once we get responses in, because my 22 recollection is and looking at the County Attorney is 23 that we cannot substantially change what we're doing. 24 So if we put out a bid for them to upgrade a definite 25 thing, there's very narrow how much we can change that 41 1 when we go to award a contract. 2 JUDGE POLLARD: So the wording needs to be 3 broad. 4 COMMISSIONER LETZ: So I just need to make 5 sure that I don't want to go through, waste our time on 6 this, if this is the right approach. So you know I'm in 7 favor of doing it, I'm just -- don't know how we do it. 8 COMMISSIONER MOSER: Yeah. I think the next 9 step once we get the proposals in, and if they all look 10 like there are things that we should consider, or if we 11 prioritize those, and have those companies come in, and 12 make presentations to us at a workshop, or in whatever 13 form it would be appropriate, probably executive 14 session, but same way we did with the managing the AG 15 barn. We brought the separate proposals in to 16 understand what they were offering. This is a fairly 17 complex thing. I don't think we can delineate in the 18 RFP exactly what we want. It's too complex to do that. 19 MRS. STEBBINS: And that there can be 20 language included in the RFP that like you mentioned 21 earlier separating it into buildings, so that there can 22 be choices about particular buildings, and exclusions 23 without having to substantially change what -- 24 JUDGE POLLARD: But in so far as 25 specifications are concerned for it, need to be pretty 42 1 broad about that and say, RFP's proposals for 2 replacement of the lighting with LED-type light, and 3 don't get specific, because it was clear when they were 4 in here with the two guys last time, one of them had one 5 type of product, and the other one had another product, 6 had a different kind. So make it broad so they can make 7 whatever their proposals are, you know, without being 8 too specific on these specs. 9 COMMISSIONER MOSER: I think it's very broad 10 the way it's written, but let's look at it again before 11 we release it. And we'll say release it at that time 12 contingent on the County Attorney looking at it again 13 to make sure it's broad. And we went over 23 what the landscape committee went over several years 24 ago, and pretty much the basic footprint. 25 First thing that needs to be done because 44 1 the benches are coming before long, is over by the war 2 memorial. And at this point all I want to do is 3 authorize the Maintenance Department to remove all the 4 shrubbery around the war memorial except the two larger 5 cedar trees that are on the backside. I think there's a 6 bunch of, I think, some boxwoods, I don't know, bunch of 7 shrubs. Get rid of all of them and the next meeting 8 we'll come back with kind of a temporary plan for the 9 benches. I don't think -- the full design for a 10 landscape concept is going to be pretty expensive. But 11 I think on a short term fix for the benches, and I think 12 the initial idea we kind of talking about is getting rid 13 of the shrubs. Making an area of gravel around the 14 memorial to get more room and place the benches on that 15 gravel, that would be a pretty small area. It would be 16 kind of a black gravel so it would kind of match the war 17 memorial, and then go from there. But at least have a 18 spot that looks nice right away, and we should be able 19 to do six benches around the memorial pretty 20 comfortably. And then the additional ones we would 21 propose possibly on the -- somewhere on the courthouse 22 square. 23 JUDGE POLLARD: How many you got coming? 24 COMMISSIONER LETZ: I think 11. 25 COMMISSIONER MOSER: How many, 11? 45 1 COMMISSIONER LETZ: I think it's 11. 2 COMMISSIONER MOSER: I keep getting 3 inquiries on too that people that want to contribute to 4 that. Have they all be funded, do you know, or that's 5 probably Maggie? 6 COMMISSIONER LETZ: Maggie's the one to 7 answer that. But I think she has -- quite a few of them 8 have been. I'm not sure of the order, she's got a list. 9 But I think what we, you know, on that I mean I don't 10 want to turn them down, but I think that we can only 11 need so many. We don't want to get 20 benches out 12 there. 13 COMMISSIONER MOSER: That's my question. 14 How many do we need and how many have been funded. 15 Because there are other people I think still would like 16 to fund a bench. But it's not clear whether we need 17 them. 18 COMMISSIONER LETZ: I think there will be 19 additional funding needed that could go towards the war 20 memorial doing that area. And I think we might just 21 pass that on. And it's kind of trying to figure out how 22 to make a bigger seating area. Peter had some pretty 23 good ideas, and the landscape committee had some good 24 ideas. And I think the whole of it is trying to get a 25 plan to look at it, and trying to raise funds. The idea 46 1 will be -- it will not be tax dollars go into this 2 project. It will be all donations. 3 COMMISSIONER MOSER: So you'll come back 4 with something with -- 5 COMMISSIONER LETZ: I'll come back with a 6 preliminary just right at the war memorial and get it 7 through the end of this year. It was also discussed when all this was done -- 21 Commissioner Reeves, if you'll take that and pass that 22 around, that's the minutes from that Commissioners' 23 Court that that problem should be addressed. It came 24 about because I filed a salary grievance when the chief 25 was making more than the Sheriff. Buster was absent 53 1 during that Commissioners' Court hearing, in which the 2 kind of negotiation between Judge Tinley and the Court 3 and myself was that I would drop the salary grievance if 4 you adopted that order for that year. And in that 5 discussion and in that Commissioners' Court it was 6 agreed also that the issue would be discussed and talked 7 about and involved for all future years so that we 8 wouldn't have to keep going through this every single 9 budget year. And for some reason that never happened, 10 okay. I don't know why. I will tell you that 11 regardless of whether it's me in the Sheriff's position 12 or anybody else, that's not the point here. The point 13 is in this County, the way this Court has done it, is 14 when I took office, the chief deputy actually made more 15 than the Sheriff. And the way we're sitting right now 16 if you look at the salary of the DPS Sergeant it's about 17 a hundred and 18 thousand a year starting. The level of 18 your salary of your police chief is over a hundred and 19 20 thousand a year. If you look at the salary of what 20 you did pay your Road & Bridge administrator it was over 21 a hundred and 20 thousand a year. When you look at the 22 salary you're considering paying your Sheriff, which is 23 95 thousand, there's not a big enough gap in between the 24 Sheriff and his Chief. Just like there is with other 25 departments in this -- in this County. And I think it 54 1 does need to be addressed. I think the chief law 2 enforcement officer of this County, whether it's me or 3 anybody else, should be making at least as much as the 4 DPS Sergeant or as the Kerrville Police Chief when his 5 duties are ten times as many, and having a jail also. 6 And that's what I would consider saying. 7 COMMISSIONER MOSER: But that latter part's 8 a different subject. Rather than -- that's relative to 9 other law enforcement officers. This is relative to the 10 Chief Deputy. 11 SHERIFF HIERHOLZER: Because that's what was 12 set. But the discussion if you'll read those Court 13 minutes was to solve the issue once and for all, and it 14 never happened. 15 COMMISSIONER LETZ: I don't think you can, 16 Rusty. The problem -- I don't think we can -- we can't 17 say that budget from now on we're always going to pay 18 the Sheriff X number of dollars. 19 SHERIFF HIERHOLZER: The only way and what 20 was discussed a lot back then was that you're going to 21 have to set the salary at a point that there is -- that 22 it takes that issue away. 23 COMMISSIONER LETZ: We could set it, that 24 issue will always come up, unless we just raise the 25 Sheriff or -- 55 1 SHERIFF HIERHOLZER: No. Because the chief 2 deputy is in the step and grade. And when a new chief 3 deputy comes in it goes back to that step and grade. 4 And depending on the year, it's just like with the 5 District Clerks and everybody else here, if there's a 6 big enough difference between those, you don't have that 7 come up. There's not a way that the district clerk's 8 chief deputy would catch up to the District Clerk. 9 There's a big enough salary gap in there. Y'all have 10 never put that gap in between the chief deputy and the 11 Sheriff, and that's the difference. 12 COMMISSIONER MOSER: Okay. But I'm with 13 Commissioner Letz. Let's do it on a -- each year. 14 COMMISSIONER BALDWIN: I just don't think 15 you can commit a future Court. It's kind of like a blank 3 check is what you want, Sheriff? 4 SHERIFF HIERHOLZER: No, no definitely not. 5 If you'll recall at last Commissioners' Court we 6 approved housing inmates in Burnet County Jail, but 7 unfortunately the way -- I had made a mistake and had 8 the agenda item done was said only during the remodel of 9 the inside, was the only time it could be. You know, 10 we've been having to house already some in Gillespie 11 County because of overcrowding now. And in the current 12 agreement if that continues over the next 18 months or 13 something, I may need to be able to do it at a different 14 time, and in reality the housing in Burnet County is ten 15 dollars an inmate cheaper per day than it is in 16 Gillespie County at this time. So I would just like to 17 have the flexibility that if we do have to house over 18 there we can do it in a bigger -- in a wider area than 19 what had been approved. 20 COMMISSIONER LETZ: And as I recall the 21 contract that we have allows for any time is just -- 22 SHERIFF HIERHOLZER: Yes. 23 COMMISSIONER LETZ: -- the way the agenda 24 item was worded is the difference, so I'll make a motion 25 to approve the agenda item to allow Burnet County to be 60 1 used as needed for housing out of County prisoners. 2 JUDGE POLLARD: Is there a second? 3 COMMISSIONER MOSER: Second. 4 COMMISSIONER REEVES: Second. 5 JUDGE POLLARD: Been moved by Commissioner 6 Letz, seconded by Commissioner Moser that the Sheriff be 7 authorized to house inmates at the Burnet County Jail at 8 any time that it is required. It is a 8 true inmate transport van with three separate 9 compartments in it that we can separate out in case you 10 have that on the keep apart list, you have males and 11 females. And instead of having to increase those trips 12 more the total cost of that van with that insert is 13 $58,213.00. Commissioner Letz and everybody had said 14 that towards Sheriff's office vehicles there was that 15 amount $32,574.00 left in the capital expenditure, is 16 that right, Miss Doss? 17 MRS. DOSS: Yes. It was in reallocated, but 18 then we moved it to Sheriff's vehicles. 19 SHERIFF HIERHOLZER: So I would like to use 20 that and then I will use the remainder out of commissary 21 funds to pay for that van to be able to have one that's 22 actually meant for transporting inmates. 23 COMMISSIONER BALDWIN: Rusty, is this a 24 brand new vehicle? 25 SHERIFF HIERHOLZER: Yes. 62 1 COMMISSIONER BALDWIN: I've never seen one 2 of those. Is this a new concept? 3 SHERIFF HIERHOLZER: No, they use them all 4 over. We've just never really looked at needing one. 5 COMMISSIONER BALDWIN: Can I borrow it for 6 my friends to go around in? 7 SHERIFF HIERHOLZER: No. It's a 2017 Ford 8 F250 van. And the compartment is -- actually it's a 9 cargo van, but there's an insert that goes into it 10 that's camera and air-conditioning and that for inmates 11 and it's got separate compartments in that for inmates 12 for being able to safely transport them. 13 COMMISSIONER BALDWIN: So when you purchase 14 it it's ready to go, the insert's in there. 15 SHERIFF HIERHOLZER: Right. 16 COMMISSIONER BALDWIN: The camera's in there 17 and ready to go? 18 SHERIFF HIERHOLZER: Right. They install it 19 at the factory. 20 JUDGE POLLARD: So you could use it to 21 transport prisoners or take wine tours. 22 SHERIFF HIERHOLZER: Yeah. I don't know how 23 many people would want to be in the back part of it for 24 wine tours. LAVENDER: It's good once in a while to 18 just update our policy and it's been two years since we 19 officially did it. The only change in it and this was 20 one that you actually made last year with a court order 21 is on the very last page of it. And Kerrville Drug 22 Company instead of HEB does our prescriptions now. 23 Other than that it's the same policy. Along with it is 24 form -- I hate when I can't read these little bitty 25 numbers. 120, which we have sent into the State, which 65 1 tells the State that we do not offer any optional 2 services through our indigent health program; that we 3 only offer basic services. Some counties offer things 4 like dental care, and ambulatory surgical center 5 services and stuff like that. Of course that would 6 increase the cost of the program and we have never 7 offered any of those optional services. And that form, 8 that form 120, needs to be signed by the County Judge, 9 so I'd ask you to authorize the Judge to sign the form 10 to be submitted to the State. 11 JUDGE POLLARD: Is that something that's 12 been submitted to the County attorney for approval? 13 MRS.
