It's November the 2 21st, 2016. It's now 10:35 a.m., and this is a special 3 Commissioners' Court meeting for the purpose of 4 considering three items on the agenda today. The first 5 one is to -- let's go to -- you want to jump to the 6 canvass and do that first then the others? 7 COMMISSIONER LETZ: I've got to be out of 8 here by 11. 9 JUDGE POLLARD: I do, too. 10 Let's do 1.3 first, the canvass first and 11 then we'll on into the other stuff. All right. The 12 canvass of the election is the highlighted numbers here. 13 The blue almost makes them unreadable. 14 MS. ALFORD: Do you need a plain copy, 15 Judge? 16 JUDGE POLLARD: Color blind. All right, 17 thank you. 18 The election results are that the total 19 number of voters were 24,579 out of 35,839, which was a 20 68.58 percent turn out for the election. That's a 21 pretty high turn out. 22 COMMISSIONER BALDWIN: That's a huge number 23 for Kerr County. 24 JUDGE POLLARD: It is. Okay. Now, the 25 Republican Party had 10,668 voters, Democratic Party had 4 1 2,243, Libertarian Party had a 122, the Green Party had 2 30. The total cast votes were 13,063 votes, and under 3 votes -- over votes were 2, and under votes were 10,538. 4 Now, going for the presidential election 5 Donald J. Trump and Mike Pence, 17,727 voted, which is 6 76 percent, 76.09 percent. Hillary Clinton and Tim 7 Kaine received 4,681 for a total of 2.82 percent(sic). 8 And Jill Stein for the Green Party, and Ajamu Baraka had 9 116 votes, and which was .50 percent. Darrell Castle 10 and Scott Bradley had 14 votes. Scott Cubbler and 11 Michael Rodriguez had 4 votes, Cherunda Fox and Roger 12 Kushner had 1 vote. Tom Hoefling and Steve Schulin had 13 two votes. Laurence Kotlikoff, I guess, and Edward 14 Leamer had 1 vote, and Jonathan Lee and Jeffrey Erskine 15 had zero votes. Michael A. Maturen and Juan A. Munoz 16 had 1 vote. Evan McMullin and Nathan Johnson had 93 17 votes. Monica Moorehead and Lamont Lilly had zero 18 votes. Robert Morrow and Todd Sanders had zero votes. 19 Emidio -- wow, Soltyski, or something like that, and 20 Angela Walker had zero votes. Dale Steffes and Paul E. 21 Case had zero votes. Tony Valdivia and Aaron Barriere, 22 I guess is the way you pronounce that, had zero votes. 23 Total. 23,297, 1 over vote, and 421 under 24 votes. 25 COMMISSIONER LETZ: Judge, I think you 5 1 skipped Gary Johnson. 2 JUDGE POLLARD: What? 3 COMMISSIONER LETZ: I think you skipped Gary 4 Johnson. 5 JUDGE POLLARD: Okay. Gary Johnson, 6 Libertarian Party, they had 657 votes. Okay. 7 Let's go down to the United States 8 Representative, District 21, Lamar Smith got 17,759 9 votes. Tom Wakely got 4,023 votes. Mark Loewe got 893 10 votes, and Antonio "Tony" Diaz got 325 votes. For a 11 total of 23,000, 8 over votes, and 595 under votes. 12 Now going to the Railroad Commissioner vote. 13 Wayne Christian got 17,042 votes. Grady Yarbrough got 14 4,078 votes. Mark Miller got 1,110 votes. And Martina 15 Salinas got 521 for a total of 22,751 votes, 6 over 16 votes and 8 -- damn, my eyes haven't adjusted from the 17 sun outside yet. What is that? 18 COMMISSIONER MOSER: 846. 19 JUDGE POLLARD: 846 under votes. These are 20 pretty small figures. 21 All right, now going to Justice of Supreme 22 Court Place 3. Debra Lehrmann got 17,586 votes. Mike 23 Westergren got 3,935 votes. Kathie Glass got 952. And 24 Rodolfo Rivera Munoz got 325, for a total of 22,798 25 votes, 3 over votes and 802 under votes. 6 1 For Justice Supreme Court, Place 5. Paul 2 Green got 17,376 votes. Dori Contreras Garza got 4,269 3 votes. Tom Oxford got 856 votes. And Charles E. 4 Waterbury got 248 votes for a total of 22,749 votes, 3 5 over votes, and 851 under votes. 6 Justice, Supreme Court, Place 9. Eva 7 Guzman, 17,352 votes. Savannah Robinson 4,139 votes. 8 Don Fulton got 945 votes. Jim Chisholm got 280 votes. 9 For a total of 22,716 votes, 5 over votes, and 852(sic) 10 under votes. 11 COMMISSIONER MOSER: You want somebody to 12 pinch hit for you for a while. 13 JUDGE POLLARD: Yeah, go ahead. 14 COMMISSIONER MOSER: For Judge, Court of 15 Criminal Appeals, Place 2. Mary Lou Keel got 17,491 16 votes. Lawrence "Larry" Meyers got 4,033 votes. Mark 17 Ash got 922 votes. Adam King Blackwell Reposa got 225. 18 For a total of two hundred and -- 22,671 votes, over 19 votes 2, under votes 930. 20 Judge, Court of Criminal Appeals, Place 5. 21 Scott Walker receives 17,405 votes. Betsy Johnson 22 received 4,226 votes. William Bryan Strange, III has 23 675 votes. Judith Sanders-Castro 384 votes. Total of 24 22,690 votes, 4 over votes, and a 110 under votes. 25 Judge, Court of Criminal Appeals, Place 6. 7 1 Michael E. Keasler, 17, 339 votes. Robert Burns got 2 4,176 votes. Mark Bennett got 951 votes. Total of 3 22,466 votes, 4 over votes, 1,133 under votes. 4 Member, State Board of Education, District 5 5. Ken Mercer got 17,115 votes. Jason 21 Pull -- 22 JUDGE POLLARD: Pulliam. 23 COMMISSIONER MOSER: Pulliam, 17,784 votes. 24 Irene Rios 4,559 votes. Total 22,343 votes, over votes 25 1, under votes 1,259. 8 1 District Judge, 216th Judicial District. 2 Keith Williams 18,629 votes. That was a hundred 3 percent. 4 District Attorney, 198th Judicial District. 5 Scot Monroe 16 thousand -- 18,726 votes -- 28 votes, 6 excuse me. 7 District Attorney, 216th Judicial District. 8 Lucy Wilke 18,745 votes. 9 District at Large Headwaters Groundwaters 10 Conservation District. Keith Jones 8,128 votes. 11 Charles Wiedenfeld 4,585 votes. Total of 12,713 votes, 12 10 over votes, 10,880 under votes. Wow. 13 Proposition 1. For, F-O-R, 6,177. Against 14 13,769. Total votes 19,946. Over votes 15, under votes 15 3,642. 16 JUDGE POLLARD: That's one of the open range 17 questions. The next one is, too. 18 COMMISSIONER MOSER: Proposition 2. For 19 5,581. Against 14,393. Total votes cast 19,974, over 20 votes 10, under votes 3,619. And that's it. 21 JUDGE POLLARD: Let's proceed now to -- 22 MS. ALFORD: We need a vote. 23 COMMISSIONER LETZ: Make a motion to approve 24 the canvassing of the votes. 25 COMMISSIONER BALDWIN: Second. 9 1 JUDGE POLLARD: Been moved by Commissioner 2 Letz, seconded by Commissioner Baldwin to approve the 3 canvass of the votes as read into the record and as 4 reflected by the exhibit that's before the Court. Commissioner Letz. 14 COMMISSIONER LETZ: This morning everyone 15 probably received a slightly different version, Buster 16 claims it's like the 25th. 17 COMMISSIONER BALDWIN: Since yesterday 18 morning, it's the 25th change since yesterday morning. 19 COMMISSIONER LETZ: What we've done is we 20 have gone through and made this job description exactly 21 in line with the grant. There's been input from the 22 Sheriff's Department, the County Attorney, and both 23 District Attorneys, because they're the -- those four 24 entities, elected officials, are the ones that uses the 25 Department a great deal. 10 1 JUDGE POLLARD: You make a motion for 2 approval. 3 COMMISSIONER LETZ: I move that we approve 4 as presented. 5 COMMISSIONER BALDWIN: Second. 6 COMMISSIONER MOSER: Second. 7 JUDGE POLLARD: Moved by Commissioner Letz, 8 seconded by Commissioner Baldwin that the general 9 description and essential job duties as described in the 10 exhibit as to the Victim's Rights Coordinator be 11 approved. The issue is that the -- it 19 came up last week during payroll that we just need to 20 clarify that Rosa is staying on full-time until a 21 replacement is picked. It was kind of set up in the 22 records and the way we handled it originally at 23 Commissioners' Court meeting when we -- 24 MRS. STEBBINS: Because we're going to be 25 talking about a specific employee, I think it would be 11 1 better if we went into executive session, I'm sorry. Or 2 no? 3 COMMISSIONER LETZ: All right. 4 JUDGE POLLARD: All right. We're going into 5 closed session. Everybody in the courtroom remove 6 themselves. 7 (Executive Session.) 8 (Open Session resumed.) 9 COMMISSIONER LETZ: I make a motion that 10 we -- that Rosa Lavender continue as Victim's Rights 11 Service Coordinator until such time as -- 12 JUDGE POLLARD: Full-time. 13 COMMISSIONER LETZ: Full-time, until such 14 time as a replacement has been hired. 15 JUDGE POLLARD: Is there a second? 16 COMMISSIONER MOSER: Second. 17 JUDGE POLLARD: All right. 18 COMMISSIONER REEVES: Question. Full-time 19 until a replacement is hired, and then she will go to 20 the part time as we've discussed -- 21 COMMISSIONER LETZ: Yes. 22 COMMISSIONER REEVES: -- in previous budget 23 meetings? 24 COMMISSIONER LETZ: Yes, that's correct. 25 JUDGE POLLARD: Now. What if that full-time 12 1 extends past January first? 2 COMMISSIONER MOSER: We'll be back in 3 session. 4 COMMISSIONER LETZ: It's planned we were 5 interviewing the final group today and it'll be before 6 the Court Monday, next Monday. 7 COMMISSIONER BALDWIN: The final five. 8 COMMISSIONER LETZ: It'll probably be -- 9 well, probably -- how many people do you want to 10 interview? 11 COMMISSIONER BALDWIN: I thought that's what 12 we agreed to. 13 COMMISSIONER LETZ: No; we're interviewing 14 seven today. 15 COMMISSIONER BALDWIN: Oh, I thought we -- 16 okay. I don't care.
