It's November the 2 28th, 2016. It's now 9 a.m. according to Mr. Moser's 3 cell phone. Kerr County Court is in session, and if you 4 would all stand please. 5 (Prayer and Pledge of Allegiance.) 6 JUDGE POLLARD: Next this is the part of the 7 agenda this morning that anybody that has something they 8 want to speak on that is not on the agenda, you have the 9 opportunity to to come forward, and stand at the podium, 10 identify yourself by name and address, and then please 11 limit your comments to three minutes. Is there anyone 12 wishing to speak on something that is not on the agenda. 13 Okay, there being none, we'll go to the next part of the 14 agenda and this has to do with the Commissioners' 15 comments. We'll start with Commissioner 1. 16 COMMISSIONER BALDWIN: Judge, I do have a 17 short comment to make today, and it's just something 18 personal and kind of fun that I thought I'd let 19 everybody know that doesn't know, tonight on National 20 Geographic, and I can't tell what you time, I missed 21 that, but they're going to start one of their fantastic 22 video film program things that they do that'll blow your 23 mind on Mars. And I'm saying this in honor of my 24 colleague next door to me here. And I just think that 25 would be such -- I can't wait until this evening. I've 7 1 got an insurance agent coming to my house and I'm 2 running him out. It's over with when that thing comes 3 on. So I'm exited about that. I think everybody would 4 enjoy that. Would you agree? 5 COMMISSIONER MOSER: It's good. I've seen 6 part of it. It's good. But I don't have anything else. 7 Just to enforce what he said. 8 JUDGE POLLARD: I've seen that ad for that, 9 too and I think part of it, the main part of it is 10 possible colonization of Mars, by us. And that sounds 11 really interesting to me. I'm going to try to make sure 12 and watch it, too. 13 COMMISSIONER BALDWIN: Get Hillary on the 14 first plane. 15 JUDGE POLLARD: Just by coincidence, I spent 16 my Thanksgiving in New Mexico, and on the way back I 17 stopped at the Sutton County Steakhouse out here in 18 Sonora and met Jeannie Hargis face to face, our former 19 auditor who was on her way. She'd been in Kerrville 20 visiting was on the way back to New Mexico where she 21 lives now. So that was kind of an unexpected encounter 22 out there. But she's doing fine. Says she's working 23 part time for her son out there, whatever that is. And 24 she said to say hello to everybody. 25 All right. You have anything? 8 1 COMMISSIONER LETZ: I just don't know how 2 y'all in the middle of a long trip eat steak. If it was 3 me I'd be asleep 30 minutes later if I did that. 4 COMMISSIONER REEVES: But it was in Sonora, 5 that was the whole point about it. 6 COMMISSIONER LETZ: For those that happened 7 to go to Comfort Saturday evening for the Christmas in 8 Comfort, it was a huge turn out. I mean I don't know 9 how many thousands of people, and they've added a fire 10 works show at the end, which will rival the City of 11 Kerrville's 4th of July. They had it going off in two 12 spots, which was interesting. But it really was good. 13 I don't know how many thousands of people there, I would 14 guess five, six thousand people, huge turn out. Weather 15 was fantastic. 16 JUDGE POLLARD: Very good. Anything else? 17 COMMISSIONER LETZ: No. 18 JUDGE POLLARD: Mr. Reeves. 19 COMMISSIONER REEVES: Just one item, Judge. 20 Remind everybody, December the 10th out at the Event 21 Center is the household hazardous waste drop off. Be 22 held in conjunction with the City of Kerrville. And 23 they'll also be a toy drive that Miss Grinstead is 24 working on, and pet adoption. Both of those will be at 25 River Star Park. So the center's going to be real busy 9 1 on the 10th. So I believe the Daily Times wrote a very 2 nice article about it in the front page this weekend. 3 We thank them. And we'll be reading a lot more about 4 it. So everybody put that down on your calendar. 5 JUDGE POLLARD: All right. We'll go to item 9 1.1 on the regular agenda, consider, discuss and take 10 appropriate action on request from the Pregnancy 11 Resource Center to use courthouse grounds on January 15, 12 2017 for a peaceful memorial in observance of the 13 sanctity of human life. Lainie Johnson, is she here to 14 make a presentation on that? 15 MS. JOHNSON: Yes. We're respectfully 16 asking permission to just hold a peaceful memorial. 17 We've done it every year for seven years. Actually more 18 than seven years. I've been in charge of it seven 19 years, so prior to me I'm not sure exactly how many 20 years. But we simply stand, we pray, we hold banners. 21 We call attention to the fact that every child conceived 22 deserves a chance at life. And we do it peacefully. We 23 have -- I have a flier if anybody wants to see it where 24 we tell people what we're doing. We're -- it's a 25 national day that is recognized throughout the country 10 1 because it is the day that is closest to the passing of 2 Roe versus Wade, and it was put in as a national holiday 3 in, I believe, 1974, or 1975, and it is something that 4 all pregnancy centers and most communities honor 5 annually. And it's a peaceful demonstration that's what 6 we have in our flier that we stress peacefully. 7 Tasteful banners are welcome. Pastor David Bass from 8 Hosanna Lutheran Church will lead us in prayer. 9 And the other thing we say on the flier that 10 we're sending out, is that if we took a moment of 11 silence for each life lost to an abortion we would 12 remain silent for a hundred years. So we're trying to 13 quietly call attention to the fact that every child 14 deserves life. And we've lost 58 million so far. And 15 we're just respectfully asking permission to do this 16 again this year. 17 COMMISSIONER BALDWIN: Miss Johnson. 18 MS. JOHNSON: Yes. 19 COMMISSIONER BALDWIN: I think that if we 20 honor anything, we need to honor that. 21 MS. JOHNSON: Thank you. 22 COMMISSIONER BALDWIN: You're welcome. HOFFER: Good. How about you, Judge? 18 JUDGE POLLARD: All right. 19 MS. HOFFER: Good. Commissioner Reeves was 20 contacted regarding possible speeding in the Cedar Cliff 21 Subdivision off FM 1340. On October 7th, 2016, we ran a 22 traffic count. The 85th percent tile, which is the 23 percentile that you look at in these traffic studies 24 showed the speed to be 13 miles an hour. But the 25 highest speed in the count, I think in the 90th and 95th 12 1 percentile was 27. It does not appear to have a 2 speeding issue, but if you got the signs posted then 3 they can be ticketed with the posting of the signs. 4 We'd like to set a public hearing for Monday, January 5 9th, 2017 at 9:10 a.m. 6 COMMISSIONER REEVES: Move for approval. 7 COMMISSIONER LETZ: Second. 8 JUDGE POLLARD: Been moved by Commissioner 9 Reeves, being seconded by Commissioner Letz to post a 30 10 MPH speed limit signs on Cedar Cliff Loop West located 11 in Precinct 4. But to put up signs when you don't 4 need them, don't get it, but that's the way -- that's 5 the way things are. 6 JUDGE POLLARD: Item 1.3 this is a public 7 hearing regarding the revision of plat for tract 1 of 8 Houston Estates in Precinct 2. Is there anyone wish -- 9 I declare the public hearing open. Is there anybody 10 wishing to speak in this public hearing? There being 11 none, I declare the public hearing closed. 12 Item 1.4 consider, discuss and take 13 appropriate action regarding the final revision of the 14 plat for tract 1 of Houston Estates in Precinct 2. 15 Mr. Hastings. 16 MR. HASTINGS: Thank you. The owner and 17 developer James Houston has submitted a revision of plat 18 for tract of the Houston Estates Subdivision comprised 19 of 54.88 acres. He wishes divde the tract into Tract 20 1-A, 36.25 acres, and tract B, 18.63 acres. Both lots 21 will be served with water wells and OSSF and therefore 22 meet the minimum requirements for acreage, five plus 23 acres, and the minimum frontage on the road, 150 linear 24 feet. 25 We have just had the public hearing and the 14 1 County Engineer requests the Court approve the revision 2 of plat for Tract 1 of Houston Estates, Precinct 3. 3 COMMISSIONER MOSER: So move. 4 COMMISSIONER BALDWIN: Second. 5 JUDGE POLLARD: Commissioner Moser moved to 6 approve the plat for the revision of tract 1 of Houston 7 Estates, seconded by Commissioner Baldwin. It's four zero, unanimous. 10 All right, 1.5 consider, discuss and take 11 appropriate action for the Court to set a public hearing 12 regarding the naming of a private road as Blue Quail 13 Lane North. Kelly Hoffer. 14 MS. HOFFER: Bill and Peggy Schmidt applied 15 through the 911 office on November 3rd, 2016 to name a 16 currently unnamed private easement Blue Quail Lane 17 North. The Schmidt's own the 1.61 acre road easement. 18 There are other property owners that use this easement 19 to access their property. Of the four different 20 property owners, all but one of the property owners are 21 good with this proposed private road name. Normally we 22 go ahead and name it, but since there is somebody who's 23 opposed, we figured setting a public hearing would be 24 the right thing to do. So at this time I ask the Court 25 to set a public hearing regarding the proposed private 15 1 road name of Blue Quail Lane North for January the 9th, 2 2017 at 9:20 a.m., and this is in Precinct 2. 3 COMMISSIONER MOSER: Move for approval. 4 COMMISSIONER LETZ: Second. 5 JUDGE POLLARD: Been moved by Commissioner 6 Moser seconded by Commissioner Letz, to set a public 7 hearing for January the 9th at 9:23 you said? 8 MS. HOFFER: 9:20. 9 JUDGE POLLARD: 9:20 a.m. for the purpose of 10 determining whether or not a private road should be 11 named Blue Quail Lane North. Is there a name on it now? 12 MS. HOFFER: No, it's unnamed. 13 JUDGE POLLARD: Unnamed, hu. Not many quail 14 in Kerr County, most of them are bobwhites instead of 15 blues, it's kind of unusual. Maybe it's just south 16 Texas clutter. 17 COMMISSIONER MOSER: Maybe they got a 18 hunting lease they're going to start out there. 19 JUDGE POLLARD: All right. Is there any 20 further discussion? There being none, those in favor of 21 the motion signify by raising their right hands. It's 22 four zero, unanimous. 23 MS. HOFFER: Thank you. 24 JUDGE POLLARD: Thank you, Ma'am. 25 1.6. Consider, discuss and take appropriate 16 1 action to regarding authorization to advertise for bids 2 for the construction of the East Kerr County/Center 3 Point Wastewater Collection Project, Phase I. It's 4 located in Precincts 2 and 3. Mr. Hastings. 5 MR. HASTINGS: Thank you. The construction 6 plans for Phase 1 of the East Kerr County Wastewater 7 Project, as prepared by Tetra Tech Incorporated are 8 complete and easement agreements have been secured. The 9 scope of work for Phase 1 is identified on the attached 10 invitation for bid. In general consists of the 11 installation of approximately 20 miles of wastewater 12 mains, six pumping stations, 650 wastewater connections, 13 and expansion of the Kendall County Water Control 14 District Number 1 wastewater treatment facility. The 15 engineers estimated cost of construction for Phase I is 16 approximately 26 million. The schedule is below on my 17 memo. Advertise for construction in the Kerrville Daily 18 Times December 2nd and December 9th, 2016. A pre-bid 19 meeting December 21st, 2016 at 3 p.m. at Commissioners' 20 Court chambers. Bid opening January 10th, 2017 at 2 21 p.m. Bid award, that's tentatively set for January 22 16th, 2017 at 9 a.m., January 16th, 2017. Executed 23 contracts, that takes approximately two weeks. After 24 that the bid award, and then we're schedule for a 25 pre-construction conference and notice to proceed 17 1 February 1, 2017. The project is scheduled to take 2 about two years to build from that date. 3 County Engineer requests Court the 4 authorization to advertise for bids. The construction 5 of the East Kerr County/Center Point Wastewater Project 6 Phase 1, Precincts 2 and 3. 7 COMMISSIONER LETZ: I'll make a couple 8 comments. And I'm in favor, but I think that we need to 9 let the Court be aware that there are things that have 10 not been finalized yet. There are two easements that we 11 did not get in Center Point as of yet, and one of them's 12 an important one, one of them could put this off. Once 13 we get the finalized plans with Kendall County WCID, 14 we'll finalize that agreement, and that agreement has 15 not been finalized and not signed yet. We have the 16 agreement for Kendall County regarding road permits, so 17 I think there are things that -- there's a little bit of 18 risk by going out for bid. 19 And the reason I think because Mr. Moser and 20 I support this, and I don't want to speak for Mr. Moser, 21 I think he'll have a comment himself in a moment, is 22 that there's a deadline coming up for an important grant 23 early February so we need to get for the connections. 24 And that's a two-year cycle, so if we miss that, we 25 potentially have a delay in getting some of the 18 1 connections done under a grant anyway. 2 So I just want the Court to be aware that 3 there are some outstanding issues. All of those, if 4 they're not finalized by the time the bids come in, my 5 recommendation at that point would be to cancel, and 6 rebid at that point. Because I do not think that we can 7 award a contract until we have every item done. And I'm 8 really uncomfortable having trouble with the easements 9 in Center Point not having them under this part of the 10 agreement. We're very close on one of them. And we're 11 fairly close on the other one, you know. We've been 12 fairly close on one of them for quite a long time. The 13 other one's a matter of the attorneys working out the 14 deal and getting back with us. And so I just want the 15 Court to be aware of that. 16 In my mind no problem proceeding at this 17 point, but if we don't have most of those items 18 finalized when these bids come in, I won't support 19 awarding the contract or proceeding. 20 JUDGE POLLARD: Well, do you think that -- 21 well, we don't know. 22 COMMISSIONER LETZ: We don't know, yes. I 23 don't have a problem doing this, but it is a risk and I 24 want the Court to know that if we don't, I'm not going 25 to support certainly awarding any contract until we have 19 1 every piece of paper. 2 JUDGE POLLARD: I appreciate it. 3 COMMISSIONER LETZ: I mean every piece of 4 paper. 5 JUDGE POLLARD: I appreciate that. 6 COMMISSIONER MOSER: And I'll just add that 7 out of how many we started with 72 easements. 8 COMMISSIONER LETZ: Yes. 9 COMMISSIONER MOSER: And so we're down to 10 these two. One of them sounds like probably a little 11 bit of a family issue of maybe not communicating. And 12 don't know what to do about that. And the other one is 13 probably the lawyers just getting the right words in 14 there. So I agree with Commissioner Letz. But we got 15 to bet on the come right now to proceed that these 16 things are to go get done, so it's -- 17 JUDGE POLLARD: Two more that you gotta try 18 to get done. 19 COMMISSIONER MOSER: Right. 20 COMMISSIONER LETZ: And they're being put in 21 as alternates under the bid documents. So that -- and 22 if, you know, and if we didn't get either one of those 23 easements, just wouldn't do them until Phase II. And 24 that's what we're faced with, you know. That issue is 25 not as critical to me as some of the other ones, the 20 1 more contractual obligations. 2 COMMISSIONER MOSER: And I think that's 3 important to state, too, correct me if I'm wrong here 4 Charlie and Don, these could be under Phase II if we 5 needed to, so we could still proceed, okay. But getting 6 the contract without these two parcels, or without that 7 portion of the system being installed. 8 JUDGE POLLARD: Is it eligible to get the 9 grant funds? 10 COMMISSIONER LETZ: Well, I mean there's 11 going to be a Phase II regardless. And I guess the risk 12 there is you're competing for that money. At this time, 13 at the moment, we have it in hand. 14 COMMISSIONER MOSER: Yeah. So I think just 15 to put it in perspective if worse comes to worse on 16 these two parcels, we would move for Phase I contract, 17 okay. Which was estimated at 20 -- 18 COMMISSIONER LETZ: 26 million. 19 COMMISSIONER MOSER: -- 26 million. So that 20 30 million in Phase I, probably going to need about 10 21 million in Phase II. And it took a long time to get the 22 Phase I approval. Largely because of good work by 23 Commissioner Letz over years about making this thing 24 happen. 25 COMMISSIONER LETZ: To put it in perspective 21 1 one of the easements that we don't have affects about 8 2 customers. And the other one really -- well in Phase II 3 it affects more, but initially I mean what we would 4 actually do under this phase affects one family. So I 5 mean it's an important one, but it's that family is 6 important for another part of Phase II. 7 COMMISSIONER MOSER: And put in perspective 8 this Phase I has how many connections in it? 9 COMMISSIONER LETZ: 650. 10 COMMISSIONER MOSER: So a hundred fifty -- 11 MR. HASTINGS: 650 in Phase I. 12 COMMISSIONER MOSER: I mean 650. So we're 13 talking about 9 potential connections that may have to 14 be put into Phase II, which would really become an issue 15 if we don't get, I guess, the Mosty property. 16 COMMISSIONER LETZ: Right. 17 COMMISSIONER REEVES: What about going out 18 for bids. At this time of year, do you feel we still 19 can get competitive bids with it being towards the end 20 of the year? 21 COMMISSIONER MOSER: Let Don talk. Tell 22 them who you are, Don. 23 MR. BURGER: I'm Don Burger with Tetra Tech, 24 thank you. One of the reasons we want to go out for 25 bids this early in December is to help compensate for 22 1 the holidays. The biggest problem with getting 2 competitive bids when you bid a project at this time of 3 year is contractors don't like to work over the 4 holidays. So we give them more time to put their bids 5 together. We set the bid opening date at January 10th 6 to give them time to get back from the holidays, and 7 sharpen their pencils, to give us the best bids that we 8 can have. 9 That being said, the bidding climate what 10 I'm seeing in construction right now is that contractors 11 are busy. And so I'm hopeful that we get good bids 12 because of the size of the project and the 13 attractiveness of the project to various contractors. 14 But I've seen some projects that were bid at San Antonio 15 Water System, where they only got two bids. And other 16 contractors that would normally bid that work said we 17 didn't bid it because we're too busy. So that is a 18 concern though even still. So if we do get all the 19 paperwork done we may get down to bid date and decide we 20 need to extend or something like that to try to generate 21 more interest if the contractors are too busy, too. 22 That may be something we can talk about when we get 23 there. So it is just a busy time. For 8 a number of years the stock show kickoff breakfast was 9 hosted by the Chamber of Commerce. This year they're 10 not going to be able to participate or host it. So the 11 Convention and Visitor's Bureau has agreed to take that 12 role. 13 The 2017 Hill Country Junior District Junior 14 livestock show will celebrate its 73rd year this year, 15 and provide education and scholarships for thousands 16 of -- and this organization has provided scholarships 17 for thousands of Kerr County FFA, 4-H and other students 18 participating in agriculturally-based programs. 19 Courthouse grounds of been the location for this event 20 for the past 12 years, and for that reason, we would ask 21 the Court to consider and approval for the kick off 22 breakfast event. 23 COMMISSIONER REEVES: Normally, get it 24 started early in the morning, and it's over by the time 25 business gets going on here. 25 1 MR. It's actually for consultation. We 19 have psychiatric services for the inmates in our medical 20 contract, but this does allow consultation through them. 21 And visiting with our medical people they thought it 22 would also be a good idea. It gives direct tele psych 23 services. They provide all the equipment and that to 24 the jail, kind of like you get when you go over to Sid 25 Peterson Hospital, they have the same type of contract. 34 1 As I said, the Court did approve it for 2 Juvenile Detention last time, but the County Attorney 3 did have some comments on this that she made. I didn't 4 see any that required many changes. But other than they 5 wrote on there that representative of Sheriff's Office 6 would approve this. That just needs to be scratched, 7 and it's the County and Kerr County Judge approves it, 8 and I'd ask that it be approved and signed by the Judge. 9 JUDGE POLLARD: Been approved? 10 MRS. So my second stands. 2 JUDGE POLLARD: Let me comment that I share 3 your concerns about that, but it's better than no 4 psychiatric services, and that's the alternative. 5 COMMISSIONER BALDWIN: That's probably true. 6 JUDGE POLLARD: And there's just a shortage 7 of people -- psychiatrists, and those that do this kind 8 of thing, and so we're going to have to take what we can 9 get is really what it amounts to. And hopefully it'll 10 be of benefit to the -- I notice that this contract is 11 set up for execution by the Kerr County Sheriff's 12 office. 13 SHERIFF HIERHOLZER: That's what I 14 commented. Sheriff Hierholzer. 3 SHERIFF HIERHOLZER: This is as you recall 4 in the budget process this year the County decided to go 5 back to the leasing program for patrol vehicles and 6 equipment that goes in those vehicles, being the cages, 7 and the cameras system and all that kind of stuff. So 8 this is the contract with that leasing cooperation to do 9 that. The only difference is because I probably failed 10 to get this contract in soon enough, okay, and we didn't 11 -- last time we did it with Ford Motor Credit and they 12 just sent it along with the cars when they came and 13 there wasn't an issue. This time being that they're 14 Chevrolets and coming from another supplier it's done a 15 little bit different, and it's not really GMAC-type 16 financing, so it's an outside financing. And not 17 realizing that we didn't get it before the election. 18 And right after the election, interest rates went up so 19 this first year's lease on this two hundred and 20 something thousand dollars is about a thousand dollar 21 increase than what I had in the budget. 22 COMMISSIONER BALDWIN: Total. 23 SHERIFF HIERHOLZER: Total. For the first 24 year. And then the payments for the next few years I'll 25 adjust in the budget, okay. But for this first year 37 1 it's about a thousand dollars increase. 2 MRS. DOSS: Actually it's 573, I ran the 3 numbers. 4 SHERIFF HIERHOLZER: $573.00. So it would 5 be a budgeted amendment or adjustment that I would make 6 from another line item to cover that $573.00. 7 COMMISSIONER BALDWIN: From what I'm hearing 8 you say, just something you over looked and dropped the 9 ball in, etc., but that in my opinion by the lease 10 program makes up for it. I think that is the best way 11 to go about, because we do make so many purchases and 12 it's just an easier way to obtain vehicles for your 13 people. 14 SHERIFF HIERHOLZER: Right. 15 COMMISSIONER BALDWIN: This route. So to 16 me, you know, this is not a big deal. Commissioner 2 17 here spills that much on a Saturday night, so -- 18 SHERIFF HIERHOLZER: Well, I mean if I'd 19 have known about getting the contract done sooner I 20 certainly would have done it sooner. Some questions 16 that we requested the City of Kerrville hold off on 17 submitting the CLOMR. So Third Creek they're doing, I 18 guess, connects and the reason they did for their reuse 19 pond. And would like -- I think that we need to verify 20 some of their survey marks right around the AG barn and 21 the County property, specifically the little league 22 fields and the Ag barn property just to verify that that 23 CLOMR -- that the elevations of the CLOMR are accurate, 24 because it will have an impact on us financially on 25 insurance, and ability to get insurance on the Youth 43 1 Event Center. 2 And I mentioned it to Lee Voelkel, I'm not 3 sure if he has come up with an estimate number or a 4 dollar amount. 5 MR. What we're looking at is 16 we found a need to add some additional security lighting 17 in the parking lot and the cheapest route to do this is 18 to have KPUB add a flood light to one of the existing 19 light poles. It's on the far west end of the property. 20 It would help illuminate the River Star Park entrance 21 that the Farmer's Market has been using. Just for 22 safety reasons so there's some lighting back there 23 that's not existed at this point. 24 COMMISSIONER MOSER: So it's just at the 25 River Star. 48 1 MR. WILLIAMSON: It was -- it would be on 2 the event parking lot. 3 JUDGE POLLARD: Pointed west. 4 MR. He's former County Judge at Palo Pinto 3 County for many years, and he and I served on the Texas 4 Association of County Board together a hundred and seven 5 years ago, I think. And great guy, he comes through 6 here occasionally. And good guy. I'm sorry I didn't 7 get to introduce him. Because he's obviously busy 8 heading down the road, and that's all. 9 COMMISSIONER MOSER: In that same vain 10 recognize that Mayor Bonnie White's here with us today. 11 COMMISSIONER BALDWIN: She is that. She's 12 the one with the red jacket on. 13 MAYOR WHITE: That's why I wear it so you'll 14 see me. He has a brother that's in 24 the business of bottling hot sauces and selling them, 25 and you can buy your own from his brother, and even have 57 1 your name put on the labels and all and send it as gifts 2 to people, and it is really hot stuff. He's got some 3 mild stuff for mandy pansies, and his brother's got 4 really hot stuff, it's called saddle burn, for obvious 5 reasons. And that's the one I like. 6 COMMISSIONER BALDWIN: You can imagine the 7 TAC Board is a pretty stuffy crowd, you know, they got 8 their nose up in the air, and Mickey and I serving on 9 that board, we had a good time and turned that thing 10 upside down. 11 JUDGE POLLARD: You and he would. 12 COMMISSIONER BALDWIN: He and I did. And it 13 was a lot of fun, we really enjoyed it. 14 COMMISSIONER MOSER: Mickey is now in 15 business developments.
