It's 9 a.m. and the Kerr 3 County Commissioners' Court is in session, and 4 Commissioner Belew, Precinct 1, will lead us in the 5 prayer and the pledge this morning. 6 (Prayer and Pledge of Allegiance.) 7 JUDGE POLLARD: This is the portion of 8 Commissioners' Court session where you are permitted -- 9 any member of the public, is permitted to come forward 10 and talk on a subject that is not on the agenda. If so, 11 please come to the podium, identify yourself, and your 12 address, and limit your comments to three minutes, 13 please. Is there anyone wishing to speak on something 14 not on the agenda? All right, step forward, Sir. 15 Good morning. My name is Gary Noller from 16 Center Point. And this is Bill Cantrell, also lives in 17 Kerr County. I'm the front commander of the Amvets Post 18 1000 here in Kerrville. He's the former commander and 19 current first vice commander. And we're here to invite 20 you to an event that's coming up. It's the fifth annual 21 Viet Nam Veterans welcome home event. It will be held 22 Saturday, March 25th. I'm going to drop off some little 23 papers here that you can take for a note that we started 24 this about five years. The significance of the timing 25 is that in 1973 according to the Paris Peace Accords 6 1 all American combat troops were to be out of Viet Nam by 2 the end of March, so the end of March is kind of 3 becoming a date that's circulating around the country 4 among Viet Nam Veterans as they welcome home, and many 5 locations such as Kerrville, we're trying to make this a 6 local event. It's free, it's open to the public, 7 there's no admission charge, we're not going to check 8 any papers, you don't have to identify yourselves, you 9 don't have to say anything, you don't have to buy 10 anything, and you sure as heck can't sell anything. But 11 we'd like to invite you to come on down and meet some of 12 your constituents, Viet Nam veterans, and have a good 13 time. Thank you very much. 14 JUDGE POLLARD: Anything else? There being 15 none, we go to the next part of the agenda, which is 16 comments from the Commissioners or the County Judge. We 17 start with Mr. Belew, you have anything? 18 MR. BELEW: Well, I went to the Road & 19 Bridge workshop Thursday and learned more about roads 20 and bridges than I knew, and then I toured the yard and 21 the facility. And it's very impressive what we have 22 making our own signs and all kinds of things that save 23 the County money. I found out that we have that daytime 24 sign checker, you know, to see how bright they're going 25 to be at night. We have one in Kerr County. There's 7 1 only four that TxDOT has, so we're doing very well. You 2 don't have to go out and check those signs at night. 3 Because those of us are getting older it's harder to see 4 them at night, so as we replace them we're replacing 5 them with a brighter one. And then went to a CAG 6 meeting Kerrville South on Saturday. Ray Garcia was 7 there, and Jimmy Pool from the Sheriff's Department, and 8 answered questions for folks over there, and people are 9 fairly happy. Everybody has some kind of a problem; 10 none of us is completely satisfied. But the meeting 11 went well and it was peaceful. Was able to get out with 12 my skin, so I was happy about that. That's what's 13 happening in Precinct 1. 14 JUDGE POLLARD: All right. Thank you. 15 COMMISSIONER MOSER: I don't have anything, 16 will pass. 17 JUDGE POLLARD: Nothing happening in your 18 precinct? 19 COMMISSIONER MOSER: Well, there's lots 20 happening. Just in the interest of time. 21 JUDGE POLLARD: I don't have anything. 22 COMMISSIONER LETZ: Well, I spent last 23 Monday and Tuesday in Austin with our legislature, which 24 is interesting, and then since then they filed a whole 25 bunch more bills. But maybe bring that to you in a 8 1 future meeting with some resolutions and things for us 2 to consider. 3 I was in beautiful Del Rio with Jody on 4 Thursday for Region J. Had a good meeting. That's it. 5 COMMISSIONER REEVES: Just one thing that, 6 you know, stock show season's still going on, and 4-H 7 and FFA members are making all of the shows, and quite a 8 bit of success at San Antonio, but I would like to 9 especially recognize one, because her father -- Harley 10 just mentioned Jimmy Pool. Cameron Pool won a ten 11 thousand dollar scholarship there at San Antonio. It 12 was not for the showing of animals; it was a skillathon, 13 which involved a test, a public speech that you had to 14 give, and demonstration of various methods of animal 15 husbandry, and so I'm sure that Jimmy's very thrilled 16 with the help come college time, but I'm also very proud 17 of her for getting that, and very special when it's one 18 of our own employee's daughters, so just to recognize 19 her. 20 JUDGE POLLARD: Okay, with that we're going 21 to item 1 on the agenda. We have a pretty short agenda 22 this morning, and Commissioner Belew and I are probably 23 going to have to leave and go to a ten o'clock funeral. 24 So we're going to try to move along and see if we can 25 finish the agenda promptly. 9 1 Item 1.1 consider, discuss and take 2 appropriate action to authorize Environmental 3 Health/Animal Services Director to accept a donation of 4 $200.00 from Lulu Stebbins to be used for animal 5 services. Mr. Garcia, and Lulu. That kind of sounds 6 like good, like an act. 7 MR. GARCIA: Good morning, Your Honor and 8 Commissioners. A few weeks ago I was contacted and 9 asked if we would accept a donation. And much to my 10 surprise it was from a young lady named Lulu Stebbins. 11 We graciously accepted, and here we are today. And I'm 12 going to let Miss Lulu Stebbins explain how this came 13 about. 14 MS. LULU STEBBINS: It started when like I 15 was making magnets one day with my baby sitter and my 16 Nanny over the summer. And I thought well maybe we 17 could do this and sell them like for a good cause or 18 something. And my mom, I asked her when she came home, 19 and she had told me all about all these animals that 20 were getting abused and they had just come into the 21 animal shelter, and I felt really bad, so like I should 22 start making them and selling them -- or not selling 23 them, but leaving them at my grandmother's store and 24 people could take them and leave a donation. So I have 25 $200.00 to donate. 10 1 (Applause.) 2 JUDGE POLLARD: That's kind of a photo 3 event. Come on up here. 4 (Photo's taken.) 5 * * * * * * 6 We'll go to item 1.2 consider, discuss and 7 take appropriate action to approve contract for 8 MASA-Medical Transport Solutions and offer payroll 9 deduction to employees through the County payroll 10 system, and allow the County Judge to sign the contract. 11 Dawn Lantz. 12 MRS. LANTZ: Good morning, Judge. Let me 13 turn this over to Ken Euler this morning. He's going to 14 go over what MASA is. We currently have AirLife and Air 15 Evac, but this is also going to be able to help cover 16 ambulance service, which is a very expensive part of our 17 medical services. So I'm going to turn over to 18 Mr. Euler. 19 MR. EULER: Thank you, gentlemen, appreciate 20 the time, appreciate being on the agenda. Thank you, 21 Dawn, for working with me recently. Again my name is 22 Ken Euler. A little bit about me, I'm a retired fire 23 fighter, para med lieutenant right here in Kerr County, 24 worked for the City of Kerrville since '03, have been in 25 the works with the EMS system, and that time also I've 11 1 worked for one of the air ambulance services here, 2 marketing their membership program. 3 One of the issues with the membership 4 programs that are out there provided by the providers, 5 is that they are provider's specific. So if you're a 6 member of one company and transported by another company 7 then there's an issue, you're still going to get a bill. 8 So what we at MASA, Medical Air Services 9 Association, Medical Transport Solutions, what our 10 solution to that is we developed a comprehensive program 11 that covers you regardless of who transports you. Now, 12 that covers you for air ambulance transport anywhere in 13 the United States. But the big thing is it covers you 14 for ground ambulance, which what we're finding across 15 the State of Texas when we're talking to counties, 16 cities, hospitals, school districts, the financial 17 impact of that -- the positive financial impact that 18 does for your local communities. As y'all know, City of 19 Kerrville runs an EMS service here, and if we start 20 getting employees in this community with the City, the 21 County and the schools, to be on board with our program, 22 but our program pays that balance bill. So the way our 23 service works is if you're a member with us and you get 24 transported by EMS, insurance is going to pay it's 25 portion, the balanced bill that's left over is what we 12 1 pay. Simply, you get a bill from that EMS, say it's 2 City of Kerrville EMS that transported you, it's a 3 $2,000.00 bill, you get that bill it shows insurance 4 paid whatever it paid, and then that balance bill all 5 you have to do is call our company, file a -- not file a 6 claim, state a claim, they'll take that EMS bill and pay 7 that provider directly. 8 Now, we only offer this to businesses as an 9 employee benefit. We don't sell it on the street corner 10 just out to the general public. So the advantage of it 11 is we've already got Peterson Hospital participating 12 with us, Kerrville ISD, Ingram ISD, Medina, Hunt, all 13 the school districts around here. Also up in 14 Fredericksburg, City of Fredericksburg, is offering 15 this, Gillespie County. So we've got quite a bit of 16 attraction here really quick. Because everybody has -- 17 all these cities, counties, schools, all these 18 businesses we're talking to have realized that this is a 19 comprehensive product, this takes care of the issue of 20 well what if this helicopter's not available, what about 21 ground ambulance, who's going to pay that bill. So 22 that's why we're Medical Transport Solutions, we have 23 solved that. 24 The cost of the program is 9 dollars a 25 month. It covers your employee and everybody that lives 13 1 in the household. So the people that live in the 2 household do not have to be on health insurance, for 3 that matter the employee that works for the County can 4 get on our program; they don't have to be participating 5 in your health insurance as well. So it's for 6 everybody, even part-timer's, full-timer's, we work with 7 the HR Department and set up the payroll deduct and go 8 through the payroll deduction process, very user 9 friendly system. Been talking to Dawn a little bit, she 10 was very interested and that's why we're here talking 11 about it. 12 COMMISSIONER MOSER: So question. Where is 13 Dawn? Is Dawn still here? So we have air essentially 14 if we choose to select it for both for something like 50 15 something dollars? 16 MRS. LANTZ: Yes. Currently we renewed with 17 the other two air flights; however, it was my 18 understanding that if those two air carriers are busy 19 someone comes in from Austin, and they're not -- they 20 won't cover you under that plan. This will cover -- 21 COMMISSIONER MOSER: So this would be about 22 a hundred and eight, but one of them is potentially 23 going to go up next year did you say, Dawn -- 24 A. Yes. 25 COMMISSIONER MOSER: -- to fifty, so it's 14 1 going to be ball park in the same thing, but it doesn't 2 cover ground. 3 MRS. LANTZ: Ambulance. 4 COMMISSIONER MOSER: Yeah, okay. 5 COMMISSIONER REEVES: From an HR standpoint 6 do you feel this is worthwhile for employees? I know 7 what I feel, but -- 8 MRS. LANTZ: I do because mainly for the 9 ambulance service, because no ambulance is in the 10 network, which I've had a lot of complaints from our 11 employees when they've had to use or be transported 12 they get an enormous bill. And all EMS are not in that 13 network as Mr. Euler has said, and that is a big 14 expense. You could ride from where your house is to the 15 hospital, and you have a thousand dollar charge, and 16 they may cover a hundred dollars of it. 17 COMMISSIONER MOSER: So if we were to do 18 this, and we currently signed up for the two air 19 services, we could say we don't want that anymore, 20 correct? 21 MRS. LANTZ: Well, the current air service 22 we have will just run out for the year, and then -- but 23 you still need to file a claim with them as well, so 24 whatever they pay, then the other one will -- 25 MR. EULER: And I'll speak to that a little 15 1 further if you don't mind, but being from that industry 2 the -- if you're an Air Evac member, let's say, you're a 3 member with them, you get transported by Air Evac. 4 What's going to happen is you're going to get your -- 5 Air Evac's going to look through their system, they're 6 going to find you're a member of their data base and 7 they take insurance payments and write off the rest. 8 Our members, if you're a MASA member Air 9 Evac will accept the insurance payment and then they'll 10 bill that patient the remainder. What they're going to 11 do if they're our members, they're going to -- our 12 member is going to file that claim with us and we're 13 going to pay that, so we're actually -- really good for 14 the air ambulance providers as well. It pays that 15 difference that they normally write off. And what we've 16 seen talking to Lori Zeewald(phonetic) up in Gillespie 17 County for Fredericksburg EMS, she was advising me that 18 several of their people that live in that community that 19 have been transported by Fredericksburg EMS, she's the 20 EMS billing clerk, and she's seeing a rise in payments 21 coming in, because our company pays so fast. Since 22 we've already increased our footprint out there, like I 23 say with the hospital, the City, the County, the school 24 districts reaching out to us as well. So as we get more 25 people in a community what we see is that reimbursement 16 1 rate that the EMS's are usually having to write off or 2 send to collections. The reimbursement rate goes up, 3 the write offs go down. You have better collects in 4 that area because we're paying that bill because we're 5 an EMS payer. We're not a provider; we're a payer. 6 COMMISSIONER LETZ: And this is national. 7 MR. EULER: Yes, Sir. And Alaska and Hawaii 8 included. 9 COMMISSIONER BELEW: Within the cost you 10 mentioned is it per household or per individual? 11 MR. EULER: Per household. 12 COMMISSIONER BELEW: Per household. 13 MR. EULER: Per employee includes everybody 14 that resides in the house. That includes kids away at 15 college, if you're a divorced parent, you're custodial 16 or noncustodial doesn't matter. Your kids are your kids 17 and they're going to be covered. And if your mother and 18 father-in-law live with you, your mom and dad live with 19 you, your brother and sister move in. The way we do it 20 is once you sign up with us your address becomes address 21 of record. So the employee's address is the address of 22 record. So any EMS bill that comes to that address, 23 regardless of the name of the patient that was 24 transported, they're going to be covered. 25 The simple thing is, everybody gets a card, 17 1 a plastic-like credit card style. On the back of that 2 there is an 800 number for a claims office, we're out of 3 Dallas. You'll call that, they'll say okay you got a 4 bill, yes we got a bill, go ahead and take a picture of 5 it, e-mail it, they'll get the e-mail. And from there 6 they'll start working with that provider directly, get 7 that bill resolved. And then they'll send you a letter 8 showing the payments been made and you have a zero 9 balance. 10 COMMISSIONER LETZ: Do you have a specific 11 sign-up period, or how would that work? 12 MR. EULER: Under IRS Code we're chapter 13 155, which is voluntary products versus your 125 14 cafeteria plan, so we can sign up any time off cycle. 15 MRS. LANTZ: If approved in Court today we 16 will be effective March first as the effective date. 17 And that'll give people time to find out if they want 18 to. But again, we'll do it at open enrollment and we'll 19 try to keep it on our open enrollment cycle with our 20 other ancillary products. 21 JUDGE POLLARD: Okay. Thank you very much. 22 COMMISSIONER LETZ: Has the County Attorney 23 looked at it? 24 MRS. STEBBINS: Yes, I did. But I didn't 25 have any issue with it. 18 1 COMMISSIONER LETZ: I make a motion then 2 that we approve contract for MASA Medical Transport 3 Solutions, and allow to offer payroll deduction to the 4 employees through the Kerr County payroll system. 5 COMMISSIONER REEVES: Second. 6 JUDGE POLLARD: Been moved and seconded that 7 we accept the MASA proposal and authorize the payroll 8 deduction to the employees and to authorize the County 9 Judge to sign the contract. It's four zero, unanimous. 2 Thank you again. 3 Item 1.3 consider, discuss and take 4 appropriate action regarding contract negotiation and 5 award for the construction of the East Kerr 6 County/Center Point wastewater collection project. 7 Mr. Burger, howdy. 8 MR. BURGER: Good morning, howdy. We opened 9 bids on the 31st of January for the East Kerr 10 County/Center Point wastewater collection project. The 11 low bid was from Pesado Construction at $30,473,320.00. 12 Our budget is about $26,637,427.00 for this phase of the 13 project. That leaves us short about $3,935,893.00. The 14 review committee met and we discussed various options to 15 change the project, change the scope of the project to 16 try to account for the shortfall, and have selected a 17 couple things that we can move into Phase II. One is an 18 area known as Nickerson Farms, it's valued at about 19 $2,521,000.00, if we move that portion of the project 20 into Phase II. Another is there was a Lift Station M, 21 and the gravity sewer that would serve the baseball 22 fields in the eastern portion of the County right off of 23 27. That was really the only current customer that 24 would be immediately on that portion of the line. And 25 so we can save $490,000.00 by taking that portion out 20 1 and pushing it to a later date, Phase II, or maybe 2 further into the future. 3 That would then leave us with a shortfall of 4 about $825,000.00. We anticipate applying for up to a 5 million dollars in CEDAP money, Community Economic 6 Development money through the Texas Department of 7 Agriculture. That would then cover that $825,000.00. 8 The Texas Water Development Board funds do include a 9 contingency amount that is 2.8 million dollars just 10 about. So in the meantime until CEDAP funds are applied 11 for, until we find out what we're going to get, we could 12 cover that shortfall, the $825,000.00 out of the 13 contingency. 14 We feel like we have a plan to move forward. 15 The documents are in review at the Water Development 16 Board currently, we have some additional documentation 17 we requested and received from the low bidder that has 18 to also be reviewed by the Water Development Board. 19 Once we get an approval from the Water Development 20 Board, we'll come back with a request to award contract, 21 and then these change orders at the same time, so that 22 we'll have the contract ready to go. 23 JUDGE POLLARD: So this is a status report 24 rather than -- 25 MR. BURGER: Basically. 21 1 JUDGE POLLARD: -- requiring any action at 2 this time? 3 MR. BURGER: At this time, yes. 4 JUDGE POLLARD: Any questions? 5 MR. BURGER: Unless we have some issues or 6 something we need to plan. 7 JUDGE POLLARD: Any questions or comment? 8 COMMISSIONER LETZ: I'll make a brief 9 comment. The other thing while we were reviewing where 10 we could adjust the budget a little bit and move into 11 Phase II, we have identified some other areas that need 12 in the future, we kind of have a contingency available 13 if we don't get the CEDAP, you know, there's some other 14 things, we know what to do. There's some other areas 15 that we can push to Phase II. But right now we feel 16 pretty comfortable this will work. 17 COMMISSIONER MOSER: Good job. 18 COMMISSIONER LETZ: Thank you. 19 JUDGE POLLARD: Thank you, Sir. 20 All right, we'll go to item 1.4 consider, 21 discuss and take appropriate action to approve 22 nomination of Dr. Mark Mosier to the Kerrville/Kerr 23 County Joint Airport Board. Mr. McKenzie, how are you 24 today? 25 MR. McKENZIE: I'm fine, Judge. How are 22 1 you? 2 JUDGE POLLARD: Great. 3 MR. McKENZIE: Good morning, Commissioners. 4 Last month we had a vacancy on our Airport Board, Steve 5 King served for 12 years, and served admirably, did 6 well, did a wonderful job but that left a vacancy when 7 he retired off the board. We had three excellent 8 applicants for our Board, and they were all interviewed 9 and after much discussion the Board chose Dr. Mark 10 Mosier to succeed in Steve's position on our Airport 11 Board. Dr. Mosier retired -- he's not retired. He 12 moved here about five years ago. He -- I can speak to 13 his aviation credentials; I can't speak to his dental 14 surgery credentials. I'll let him speak about that. 15 But he's got over 5000 flight hours, he's a Mooney 16 aficionado. He's owned five and he's looking for 17 another one, I think, or maybe a faster one. 18 He's been -- in the last four and a half 19 years he's come to our airport board meetings 52 percent 20 of the time, so he's interested in our Board. And he 21 showed a great deal of interest in our airport. I do have Airport Board experience, was 20 very involved for many, many years in an Iowa Airport 21 Board where we accomplished a lot of growth in the 22 airport, including extending runways, adding much 23 technology. 24 My involvement with the local Airport Board 25 started with friendship with Tom Moser, and I found 24 1 myself on the new hangar committee, and I like to think 2 I stirred the water enough to start the process for 3 finding funds that were available to build 12 new 4 hangers at the airport. So my local track record really 5 starts and stops with the new hangar committee. 6 But aviation is my background, and I have 7 extensive history serving on boards; not currently. And 8 most of these boards are nationwide boards, and my 9 current job is -- actually I have two jobs also. I 10 manage two companies, one's nationwide and one's 11 regional and Midwest. 12 JUDGE POLLARD: And you moved to Kerrville 13 just to get closer to Mooney headquarters. 14 DR. MOSIER: Well, actually had very little 15 to do with that. Just to put it -- I mean God brought 16 us here, it was the culture that brought us here. 17 COMMISSIONER MOSER: You might add Mark 18 looked all over the nation for the best place to live. 19 And since then several families that are associated with 20 his family, they don't even research, they just move 21 here. 22 DR. I'm the 16 president of the Child Services Board, and every year we 17 do put the signs out on the courthouse during the month 18 of April for child abuse awareness month. We don't have 19 our number yet, I'm not sure exactly. Last year it was 20 326. I mean it would be my dream one day to have none, 21 but we just ask for permission to on Friday, March 31st, 22 put out those signs and then we'll take them up at the 23 end of April, which is like the 28th, I think is a 24 Friday we'll make sure they're put up. 25 So that's one of the things I wanted to ask 26 1 for, and then the other is a proclamation I'm going to 2 read it real quick that we ask that y'all sign. 3 Whereas, two hundred thousand children in 4 Texas are reported as abused or neglected every year; 5 and whereas, child abuse prevention is a community 6 responsibility, and finding solutions depends on 7 involvement among all people; and whereas, communities 8 must make every effort to promote programs that benefit 9 children and their families; and whereas, effective 10 child prevention programs succeed because of 11 partnerships among agencies, schools, religious 12 organizations, law enforcement agencies, and the 13 business community; and whereas, everyone in the 14 community become more aware of child abuse prevention 15 and consider helping parents raise their children in a 16 safe, nurturing environment. 17 Now, therefore be it resolved that the Kerr 18 County Commissioners' Court does hereby proclaim the 19 month of April, 2017 to be child abuse prevention month 20 in Kerr County, and urges all citizens to help reduce 21 child abuse and neglect significantly in years to come. 22 We are working on a joint project with 23 several other of the agencies in town, and CPS, to put 24 up -- we usually have a seminar on child abuse 25 awareness, and a lot of volunteers that deal with 27 1 children and school counselors come, and we're working 2 on that for the month of April, so here's my -- 3 COMMISSIONER LETZ: I move that we approve 4 both items, declaring April, 2017 as child abuse 5 awareness month, and to approve the proclamation as 6 presented. 7 COMMISSIONER MOSER: Second. 8 MS. Commissioner Moser. 23 COMMISSIONER MOSER: Thank you, Judge. This 24 is an update of what's happening at the cluster septic 25 system in Castlecomb's. Just to review the history, 28 1 just the recent history on that, there's been an 2 extensive involvement by the County, the Castlecomb, Ray 3 Garcia and his team every day of the week are out there 4 inspecting that system. It has failed many times in the 5 past. There's legal action against the owner-operator 6 of that system, which I'll not discuss today, both civil 7 and criminal, that's ongoing. But we've had a town hall 8 meeting of which I think a lot of members of this Court, 9 TCEQ, Texas Commission on Environmental Quality, State 10 representative Andy Murr attended that, as did Kellie 11 Early. And the TCEQ to date has spent 150 thousand 12 dollars in emergency response to that system. And the 13 purpose of this, me putting on the agenda today, is to 14 highlight a letter that Andy Murr wrote. He wrote a lot 15 of it himself as I understand, probably wrote it all 16 himself, but it was mailed to every resident of 17 Castlecomb, and basically it reiterates the fact that 18 there's a potential for that system to tie into the 19 City, that TCEQ has done its thing, but the County 20 continues to monitor, but it's the responsibility of 21 Castlecomb to take action. 22 And I want to read one paragraph, if I may, 23 and I submit Representative Murr's letter to the records 24 also for full content. And this one paragraph he said 25 other ideas may also be suggested; however, I stress 29 1 that the emergency repairs by TCEQ to your septic system 2 to make it operational were and are temporary, and 3 without efforts by the stakeholders, namely you and your 4 neighbors, this is the owners of property and residents 5 in Castlecomb, you will very likely experience 6 additional septic system failures in the medium-term to 7 long-term future. These failures will likely affect the 8 quality of your life and your property values. Without 9 your engaged and ongoing interest, a solution will not 10 be found and implemented, period. 11 So that's the bottom line. I think 12 everybody's stepped up, it's not -- you know, it's going 13 to be up to the residents to take charge of this and 14 take some action, and hopefully they will -- they'll do 15 that, so it's complicated, but also it's very important 16 to their life, it's very important to the community. 17 But it's also not the proper thing to do is to ask other 18 taxpayers in the County to foot the bill on that. So 19 that's where we are. So -- that's -- that's all I have 20 to say, just wanted to bring everybody up to date and 21 let the Court know where we are. 22 COMMISSIONER LETZ: I think it was an 23 excellent letter. And I think Andy did a great job of 24 pointing or letting the residents know that it's their 25 responsibility. Everybody's helped them the best we 30 1 can, but it's their responsibility to get this problem 2 resolved. 3 JUDGE POLLARD: He chaired the community 4 meeting over that, did a very well job -- very good job 5 of organizing that, and he was able to pull several 6 State agencies in, and get some excellent looks by those 7 agencies into the situation. And this letter is 8 extremely well written, and it's in our agenda package, 9 and it'll be available for anybody to get a copy and I 10 recommend the media get a copy of it, and it needs to be 11 emphasized to those people in that subdivision it's 12 pretty much in their hands now. Their options have been 13 developed and the best option appears to be them asking 14 for annexation into the City, which will cost them some 15 money, but it's important to protect their property 16 values in order to do that, and we hope they do that. 17 All right, any further comments or questions? I'm Kevin Casey, I work 4 with Unifirst, we're a local uniform service provider 5 and also a facility service provider. We're located 6 here in Kerrville, we've been here a long, long, long 7 time. All but three of our employees actually live here 8 in Kerr County. I've been with them for 12 years. Most 9 of the employees there have a long tenure of 15 or more 10 years. 11 I'm approaching you today, I'm trying to 12 find access or permission to go and do an evaluation 13 with the Road and Bridge Department. We service every 14 other Department in the County except Road and Bridge, 15 and we have for years. With looking through public 16 records and doing an initial evaluation there's a 17 savings potential for an over spend of about six 18 thousand dollars a year just on uniforms alone. With 19 that, I'm just seeking permission or, you know, a way -- 20 a contact or what not to go into a full evaluation and 21 do a full cost evaluation. 22 COMMISSIONER LETZ: I mean I don't have a 23 problem at all, and I would direct you to Kelly Hoffer 24 is the contact person. 25 COMMISSIONER REEVES: Have they contacted 32 1 you before, Kelly? 2 MS. HOFFER: Many times. 3 COMMISSIONER REEVES: Do you have any 4 problems with them? 5 MS. HOFFER: I've told them they can give me 6 that proposal. I'm really happy with the service I 7 currently use, couldn't be happier, and nobody has ever 8 brought a proposal to me, so -- 9 COMMISSIONER LETZ: All right. I recommend 10 you do. 11 JUDGE POLLARD: I think the other 12 departments are real happy with them. I've been 23 speaking with the Sheriff, and something has come to 24 light where he is going to be able to provide that 25 training at no cost to Kerr County employees. So I'm 34 1 going to pass on that item. 2 JUDGE POLLARD: Okay, thank you. Thank you, 3 Sheriff. 4 Item 1.10 consider, discuss and take 5 appropriate action to issue a court order for exemption 6 from the competitive bidding requirements of Section 7 262.023 of the Local Government Code in order to repair 8 fire damage to the Kerr County Sheriff's office. 9 Sheriff Hierholzer. 10 SHERIFF HIERHOLZER: Well, as you know this 11 is in reference to the fire that we had out there a 12 couple months ago. Actually it's been almost 8 weeks 13 exactly right now, and still haven't been able to get 14 some of it repaired, so we're trying to get that moving 15 forward. I've gotten the county's insurance involved 16 and the other insurance company involved. 17 But one of the main things is to be able to 18 bypass the bidding process, because the damage is over 19 50 thousand dollars, which would normally require it. 20 Under Section 262 of the Local Government Code, 262.023, 21 or .024(a)(3), due to unforeseen damage to public 22 property it is possible that this Court, as long as 23 y'all issue the order, we can bypass that bidding so we 24 can go ahead and contract with Huser, who's already 25 doing a lot of construction out there, or another 35 1 company to get that repaired, once the smoke mitigation 2 part is complete by Blackmon Mooring. This has been 3 discussed with our County Attorney, and in fact she's 4 the one that drew up the order for y'all to be able to 5 sign to give us the authority to bypass. 6 Now, once we go to enter into a contract, 7 of course that contract would have to be brought back to 8 this Court to actually approve entering it. I can't 9 sign a contract. This would just allow us to bypass the 10 bidding part of it. 11 COMMISSIONER LETZ: I make a motion that we 12 approve the exemption for bidding requirements under 13 section 262.023 of the Local Government Code to repair 14 the fire damage of the Sheriff's Department. 15 COMMISSIONER BELEW: Second. 16 JUDGE POLLARD: Been moved by Commissioner 17 Letz, seconded by Commissioner Belew to approve the 18 exemption from competitive bidding requirements of 19 Section 262.023 of the Local Government Code in regard 20 to repair fire damage at the Kerr County Sheriff's 21 office. STEBBINS: Yes, Sir, absolutely. And I 11 reached out to the attorneys general's office because I 12 couldn't find anything specifically on point, and they 13 agreed with me and said that it's real clear that this 14 is precisely what that section is for. 15 COMMISSIONER REEVES: Thank you. 16 MRS. It's four 20 zero, unanimous. 21 Item 1.11 report regarding national 22 accreditation process for the Kerr County Veteran 23 Services Officer. Maggie Baker. You got here just in 24 time. 25 MS. BAKER: Yes, thank you. Good morning. 37 1 Well, it started out when you first become a veteran 2 service officer there's a lot of steps that you need to 3 go through. The first is being accreditated and that 4 means you'll end up going through the computer system 5 and be able to help your veterans a lot more, and 6 surviving spouses. So I've gone through all those 7 steps. I went through this last training in January, 8 and you have training for a week, and then you have a 9 test, you get a certificate, and all that is from all 10 the training you've already had, and you have several 11 mentors that come here, or you have to go to other 12 places. And you have training every six months, you 13 have tests, and I recently became accredited; not a 14 hundred percent accredited, but what I've done so far 15 leads up to now, I have to have a mentor that will be 16 here with me for about a week, and then I'll have to 17 shadow a Texas Veterans Commission employee, and that 18 will be another week. They train you to be able to get 19 into the computer system for Houston, and that's where 20 my TVC organization is at. There's two, one in Waco, 21 one in Houston, and I'm with Houston. So along with 22 that, we have to go and with the training to help our 23 veterans a lot more. That's where the mentoring comes 24 in, getting into the computers systems, because as of 25 right now I can't get into the Houston computer systems, 38 1 so I'll be able to do that. If a veteran comes in, it 2 doesn't matter, you know, what State. There are some 3 organizations that won't let you in their system. But 4 there's probably like 150 to 200 different veterans 5 organizations, and if you want to be accredited with 6 those, then you have to go and write a letter to them, 7 do the same process I've done so far, with the letter 8 from the Judge, and HR, saying the number of hours I 9 work, what I've done already, I have to give them a 10 resume of everything, and then they'll decide whether 11 they want another VSO in their organization. Because 12 most organizations, the VFW, American Legion, and that 13 there's numbers. If they want you in their organization 14 to help their veterans, you'll have to go through the 15 same process, you go in for an interview, and you really 16 have to, you know, have at least two to three years of 17 working as a VSO before one of these other organizations 18 will let you help. 19 Now, right now with me being TVC 20 commissioned and trained I can get into any -- well the 21 records, I'll have to call Houston or I'll have to call 22 a TVC person to get into their records, because right 23 now I can't unless the veteran is in my office because 24 of the HIPAA policies. 25 And that's another training that we have 39 1 between three to five days of HIPAA training that have 2 to do just with the veterans, the Texas Veterans 3 Commission Organization. There's just so much that has 4 to be done. I'm trying to think of all the steps. I 5 gave you all a really long step by step, but I won't go 6 into all of that right now. It's probably going to be 7 another four to six months after I go through the 8 mentoring process with, you know, I have Houston, and 9 then there's a gentleman here is Kirk Bonner(phonetic), 10 he works for the State for the Texas Veterans 11 Commission. He's worked as a VSO in Houston, as well as 12 TVC for about 40 years. They're thinking that I might 13 just be able to go and he will be one of my mentors for 14 a week, so I will have to go to Houston, and then to San 15 Antonio, and then this person. So I'll go and I'll 16 shadow him, and then he'll come to my office, and there 17 are a lot of veteran service officers that don't 18 accredited. Sometimes it's because they got a very 19 small County and they don't really need it. There are 20 VSO's that have more than one County. There are some 21 VSO's that might have maybe 50 veterans a year. There's 22 even one that has just one veteran. But if he wants to 23 be accredited maybe he ends up, you know, going to 24 another County or something, then it would be good for 25 him to do that. 40 1 COMMISSIONER MOSER: So Maggie, let me ask 2 you a question, if I may. So this is just to bring us 3 up to date on where this is, and I think when we created 4 this position, we always envisioned that the veterans 5 service officer be accredited. And then the real 6 benefit, and correct me if I'm wrong, the real benefit 7 is that really expedites the processing of claims and 8 also when something is submitted in the system you can 9 access it through the computer system you just 10 described, and then see where it is without waiting for 11 it to kick back and say no, you didn't dot an "I" or 12 cross a "T", so it's really a huge benefit for the 13 veterans you serve in this County, correct? 14 MS. BAKER: Yes. 15 COMMISSIONER MOSER: And so is there some 16 specific action today that we need to take or is -- the 17 item just says report. 18 MS. BAKER: Well, Commissioner Reeves had 19 thought that it would be really good to, you know, get 20 my certificate out there, get the process, you know, 21 because there is a lot to this -- 22 JUDGE POLLARD: So this is just a report. 23 MS. This was -- it is an 14 annual fee and there was a note on it that it should be 15 processed on 3-1, which means that it needs to be 16 available to be paid on 3-1. 17 COMMISSIONER REEVES: And what is it for? 18 MRS. DOSS: It is for fees for -- they're 19 administration fees for the Lake Ingram debt payments. 20 COMMISSIONER REEVES: I move to pay late 21 bill number two as discussed. 22 COMMISSIONER MOSER: Second. 23 COMMISSIONER LETZ: Motion and second to pay 24 late bill number two. Sheriff. 4 SHERIFF HIERHOLZER: Just a quick little 5 view of what has been going on out there with the 6 expansion. This first picture is on our front porch, 7 it's where they started digging the hole, it's been 8 complete now to put in sewer for the outside restroom 9 area that you'll be able to get into, there is no public 10 restroom area there. 11 And this is -- some of these I'll just flip 12 through and you can start kind of seeing what all was -- 13 it's a three hundred ton crane to lift some of those 14 walls. 15 COMMISSIONER MOSER: Those are tilt walls. 16 SHERIFF HIERHOLZER: Yeah, tilt walls. They 17 were poured onsite. They did the foundation and poured 18 the walls onsite and then stood them up. Future jail 19 door, some of those are being installed now. Those are 20 tilt walls that were on the slab. Some of them they 21 were starting to stand them. That wall is 29 feet tall. 22 COMMISSIONER MOSER: Good gosh. 23 SHERIFF HIERHOLZER: It's one of the last 24 tilt walls they were pouring. The slab itself had over 25 800 yards of concrete. We're having to keep guards on 48 1 top of the roof anytime roofers are up there, because of 2 the open access into the safety or into the rec yard of 3 the current facility, which is causing a nightmare, and 4 killing my overtime and everything else, but we don't 5 have a choice. 6 COMMISSIONER LETZ: Brenda, on things like 7 that that we're having to do additional overtime, can 8 that come out of the bond? 9 MRS. DOSS: I'm sorry. 10 COMMISSIONER LETZ: When we have additional 11 overtime with employees that's brought on because of the 12 construction project, can that amount come out of the 13 bond? 14 MRS. DOSS: No. 15 COMMISSIONER LETZ: Seems like it should. 16 SHERIFF HIERHOLZER: Yeah, I'd like to. 17 Okay, that's that first group. 18 COMMISSIONER REEVES: You ask that, but if 19 Huser was providing the security, then would it come out 20 of the bond? 21 MRS. DOSS: Yes. If it was his part of the 22 construction contract, yes. 23 COMMISSIONER REEVES: Could Huser hire off- 24 duty to do that? 25 MRS. DOSS: Yes. But it's not in his 49 1 contract right now. 2 COMMISSIONER LETZ: Maybe you oughta put 3 that on our next agenda. 4 COMMISSIONER REEVES: I'm just thinking that 5 instead of breaking the Sheriff's current budget with 6 additional staff up there, if we can look into the 7 legality of Huser paying off-duty. 8 SHERIFF HIERHOLZER: Well, we can look -- 9 MRS. DOSS: But we have to look to what our 10 budget is for the construction contract. We can't go 11 over -- well right now it is. But there's also still 12 the fact that we're going to pay out-of-County housing, 13 and there's a lot of other things that may come up. 14 SHERIFF HIERHOLZER: The only other thing is 15 the last I saw the update on the roof, that's the most 16 -- that's where it's really been hurting us that roofing 17 going on, the new roof on top of the old facility, and 18 the last I saw is hopefully that may be completed by 19 about March the 10th. 20 COMMISSIONER LETZ: Maybe something that 21 needs to look at a budget update. 22 SHERIFF HIERHOLZER: Look at it, okay. 23 COMMISSIONER LETZ: And we'll go back and 24 sort these out if we could. 25 MRS. DOSS: The architect is supposed to be 50 1 here tomorrow and I'm going to have a meeting with her, 2 so we're going to go over the budget. 3 SHERIFF HIERHOLZER: This is the -- where 4 the addition actually is out the back of the jail or 5 down the side that's all the tilt walls that are up in 6 place. And part of the red iron going up. The inside. 7 It's from the backside. 8 COMMISSIONER MOSER: Is it on schedule or 9 behind schedule, or what? 10 SHERIFF HIERHOLZER: It's on schedule right 11 now. So far, I will say. 12 COMMISSIONER REEVES: Well, I know at our 13 last monthly meeting that once they can get it dried in, 14 then the rain delays won't be affecting us because 15 they'll be working inside. 16 SHERIFF HIERHOLZER: Right. This is the 17 inside of the lobby. If you've been out there that used 18 to be the receptionist window where there was two -- or 19 one large window that is now gone. It has caused 20 issues, but this is part of the new dispatch area, which 21 was civil and warrants. This is right behind where that 22 wall is gone. That's the dispatch supervisor's cubicle 23 or office area now as it's been upgraded. And this is 24 getting into the dispatch part of that same room. And 25 this is the new dispatch center for the Sheriff's 51 1 office. Of course it's a little cluttered. We're still 2 trying to get into it. There will be -- there's three 3 complete stations. Each station has six computer 4 monitors, I think they're 23-inch monitors. And then 5 it's got the two monitors that are in the middle are 6 your 911 monitors. And they are shared by two 7 stations -- or three stations. 8 We normally right now have two dispatchers 9 on duty at a time. The center's built now that you 10 could expand it out to four. Remember we tried to 11 project everything out 20 years to make sure it would 12 last. Three stations are totally complete with radio 13 and all. That's where in case we had flood, had to call 14 in a third one, or if PD needed to use one, you know 15 they went down like we did, so that we can all work 16 together on that. And then the 4th station we'll just 17 have all the monitors, but no radio at that point. 18 Those consoles are very expensive, that's for future 19 expansion when it comes up, when it goes. 20 COMMISSIONER REEVES: I would say if you 21 have not seen the new one, it's worth a tour. 22 SHERIFF HIERHOLZER: Just need to go out and 23 see it. This was the dispatch center, now a big tore 24 out wall, will be the new reception area with new 25 windows going in. That's where you would walk up 52 1 normally, that will be taken out. That window and 2 they'll be a door put in there. This is what used to be 3 the training room inside the older part of the sheriff's 4 office, now the new training room in the annex building, 5 but this was the training room inside. We've moved, as 6 you know now, civil and warrants is now the dispatch 7 center. So the training room is now civil and warrants. 8 And I saw the new cubicle furniture as it was being 9 installed. Some of those people standing there are 10 actually the installers that are putting it in. So that 11 was being done Friday as we were trying to finish up. 12 And of course, it's just total chaos right 13 now. This is Friday afternoon out in the outside area 14 and they are starting to put up the cinder block walls 15 inside in the door frames, inside the -- that's nothing 16 but concrete where all the masonry. 17 And other than that, that's kind of it. 18 It's kind of hard to really show you good, to get a feel 19 of how much there is going on out there. We have had 20 severe issues with roof leaks, because if you get on top 21 of that old jail, it looks like almost like a cemetery 22 with everything protruding through the roof. And with 23 the new roof going on it's hard to get those seals 24 around even where they had conduit sticking up for 25 electrical stuff, so they're trying to figure out that, 53 1 just to change it so there's no electrical penetration 2 is where the electricity is coming out on top of that 3 roof is over a hundred and some odd different things 4 they've got to change, just for those alone; not 5 counting all the air conditioners, and antennas, and 6 that they're still working on some of those issues to 7 get that done. Because we have had numerous issues with 8 serious leaks inside the facility. 9 COMMISSIONER MOSER: Anybody contact Huser 10 or whomever about the LED in the old? 11 SHERIFF HIERHOLZER: They're still all 12 working on that, I think between Gondeck and them. I've 13 stayed out of that part, but you know it has come up at 14 each one of the construction meetings that we have, and 15 the next one is on the 7th, so if you're still part of 16 being there -- 17 COMMISSIONER MOSER: No. I was just curious 18 whether or not they'd been in communication. 19 SHERIFF HIERHOLZER: No. 20 COMMISSIONER MOSER: Okay, super. 21 SHERIFF HIERHOLZER: It's moving along. 22 We'll start the remodel of the old juvenile facility, 23 we've been over there, the plans are being finalized on 24 that, so that will probably start within the next two 25 weeks of actual construction over there. So that once 54 1 we get to that point this facility can be closed. We 2 still have a contract for housing all our inmates over 3 in Burnet. We did get our new van in, which is a total 4 transport van. It is not on the road yet, still has not 5 been marked. Plus we are trying to find a full bumper 6 replacement for it. But it's one of those new Ford 7 transit vans, and trying to get one to see if we can 8 find one that would fit. I have found one, but it's 9 aluminum and I don't know how well that's going to hold 10 up when a deer gets hit anyhow. But driving back and 11 forth at all hours day and night to Burnet, I'm sure 12 we're going to find a deer, so I'd rather have the full 13 bumper replacement, a deer guard on it. But other than 14 that -- 15 COMMISSIONER MOSER: Good report. 16 COMMISSIONER REEVES: And I notice you did 17 get your -- you had your jail inspection? 18 SHERIFF HIERHOLZER: We did have -- yes. 19 That was not a fun day. It was a day after the rain, 20 and I had 15 leaks in the jail, and I was sitting at my 21 computer cussing contractors, and Huser, and architect 22 and everybody else, and jailer walked in behind me and 23 said Jackie's here, and I said a few explicit words, but 24 I didn't realize she was already standing behind me. 25 She had went ahead and brought her all the way into my 55 1 office before I turned around. But she was there for an 2 entire day. We did have some issues. We did pass the 3 inspection fine, everything worked out. But they did 4 find in one of the female cells where we had water in a 5 light fixture, but since she heard me already on the 6 phone when she walked in trying to deal with some of the 7 leaks, she knew that that was being addressed at that 8 time. 9 And the only other issue we had is when we 10 came over to this facility the standpipe and firehose 11 connection in this facility were over their year 12 inspection. Maintenance had failed or forgot or 13 whatever to have them reinspected, so unfortunately 14 because we have holding cells in this facility, if this 15 facility fails, that facility fails. So I got -- and it 16 has to be someone, you know, who does the inspection. 17 So I got on the phone with them and we were fortunate 18 enough that they had an inspector already over at Sid 19 Peterson Hospital, so before the day was out they sent 20 that same inspector over here, and him and I got all 21 these done at the same time. So it worked out that they 22 were able to go ahead and pass that. So after those two 23 things we did pass with no other demerits, or not even 24 demerits; issues that they had. It was mainly because 25 of the roof leak and because of all the paperwork, and 56 1 everything else that y'all's staff does was in good 2 shape, so it worked out. 3 COMMISSIONER LETZ: Thank you, Sheriff. 4 SHERIFF HIERHOLZER: Thank y'all. 5 COMMISSIONER LETZ: Other elected officials 6 reports?
