We'll start with Precinct 1. 6 MR. BELEW: No particular individuals to 7 note, just that we all have more fun in Precinct 1. 8 JUDGE POLLARD: Is there anyone that wants 9 to contest that? 10 COMMISSIONER MOSER: I don't have anything. 11 Thank you. 12 JUDGE POLLARD: I don't have anything. 13 COMMISSIONER LETZ: Nothing this morning. 14 COMMISSIONER REEVES: Just real briefly. 15 Attended the 4-H banquet Saturday night, well attended. 16 Got so see a lot of good kids be recognized for a year's 17 hard work, and got to see a lot of people so I'm glad I 18 was there. 19 JUDGE POLLARD: We'll go to item 1.1 on the 20 agenda, which is consider, discuss and take appropriate 21 action for the Court to set a public hearing regarding 22 changing existing "yield" sign to a "stop" sign at the 23 intersection of McDonald Loop North and Stapp Lane in 24 Precinct 2. Good morning, Kelly. 25 MS. HOFFER: Good morning. This is a 11 1 follow-up. We had a request to change a stop sign to a 2 yield sign. The Court decided to remain with a stop 3 sign. But Commissioner Moser had asked us to look at 4 some of the other intersections out in that Stoneleigh 5 area. Charlie, the County Engineer and myself went out 6 and looked, and so I've got -- I've got the intersection 7 of McDonald Loop and Stapp Lane that we currently have a 8 yield sign, and we would like to change that to a stop 9 sign. Charlie did the formula that you do for the 10 engineering part, and we need to set a public hearing 11 because that is a regulatory sign, and so at this time, 12 I ask the Court to set a public hearing for Monday, 13 September 25th, 2017 at 9 a.m., and this is in Precinct 14 2. 15 COMMISSIONER MOSER: So move. 16 COMMISSIONER LETZ: Second. 17 JUDGE POLLARD: Been moved by Commissioner 18 Moser, seconded by Commissioner Letz to set a public 19 hearing on the issue of changing a yield sign to a stop 20 sign at the intersection of McDonald Loop North and 21 Stapp Lane. Is there any further discussion or comment? 22 COMMISSIONER MOSER: Just for the record, 23 Kelly, I didn't ask you -- the request was not just for 24 the Stoneleigh area, but are you going to look at 25 throughout the entire County? 12 1 MS. HOFFER: Yes, yes. 2 COMMISSIONER MOSER: Because you know, I 3 think safety is critically important, and I think the 4 thing that you and Charlie have done are a move in that 5 direction. At the same time sometimes it's iffy, and I 6 think, you know, hearing what the residents like Trooper 7 Charlie Behrens -- I mean Jimmy Behrens, said last time 8 I think needs to be considered. But I think we need to 9 be consistent throughout the entire County, and there's 10 a lot of -- a lot of stop and yield signs. 11 MS. HOFFER: Yes, Sir. It's been an ongoing 12 process. 13 COMMISSIONER MOSER: Good deal, thank you. 14 JUDGE POLLARD: All right. Is there any 15 further comment on that issue? It's four 17 zero, unanimous. 18 1.2 consider, discuss and take appropriate 19 action to receive RFQ's for engineering services for the 20 2017-18 Community Development Block Grant Colonia fund 21 construction for the East Kerr County/Center Point 22 Wastewater Project, authorize a selection review 23 committee to rate competing respondents, and for the 24 Court to select an engineering consultant. This of 25 course lies and affects Precincts 2 and 3 in the County. 13 1 Mr. Hastings. 2 MR. HASTINGS: Thank you. Court Order 3 Number 36200 approved receiving RFP's for administrative 4 services, and Court Order Number 36206 authorized the 5 selection of GrantWorks to provide administrative 6 services and procurement action for an engineer, and to 7 apply for the 2017-18 Community Development Block Grant 8 Colonia fund construction for the East Kerr 9 County/Center Point wastewater project. GrantWorks has 10 advertised for the County to receive RFQ's, request for 11 qualifications for engineering service. Those RFQ's 12 were due to the County Clerk at 2 p.m. on July 31st, 13 2017. The County Engineer request that the Court open 14 and receive RFQ's for engineering services for the 15 2017-18 Community Development Block Grant Colonia fund 16 construction for the East Kerr County/Center Point 17 project, read the names of the respondents, authorize a 18 selection review committee consisting of Commissioner 19 Moser, Commissioner Letz, the County Auditor, County 20 Engineer and the County Attorney to rate the competing 21 respondents during a break today, and following the 22 break for the Court to review the committee's 23 recommendation and select an engineering consultant to 24 provide engineering services related to the grant, which 25 is due September 18th in 2017. This is Precincts 2 14 1 and 3. 2 JUDGE POLLARD: I understand there are three 3 submitted, do you have them? 4 COMMISSIONER LETZ: Yes. We have three 5 submittals. One is from KSA. 6 JUDGE POLLARD: Which stands for what? 7 COMMISSIONER LETZ: It doesn't say that I 8 can see. Says KSA. They have 12 locations, the nearest 9 one looks like it's Austin. 10 JUDGE POLLARD: Okay. 11 COMMISSIONER LETZ: That will be the local 12 office is Austin. Another proposal from Tetra Tech out 13 of San Antonio. And we have one from Slay Engineering 14 Company. Slay is, I believe, out of San Antonio, or 15 this office is. 16 JUDGE POLLARD: Okay. All right. Then is it 17 the desire of the Court to in a recess consider these 18 and then come back with a recommendation? 19 COMMISSIONER LETZ: Yes. Must be 18 in bad shape. Go ahead Kelly. 19 MS. HOFFER: I've got various pieces of 20 equipment that I've listed. I'll just kind of go down 21 the line for the record. RB6108 is a 1978 Chevrolet cab 22 and chassis. It did have a water tank on it, we did put 23 that water tank on another truck probably about four or 24 five years ago. So now all it is is a little cab and 25 chassis. The speedometer broke at 500,000 miles, so I 17 1 believe it may have come from the State when it was 2 purchased. 3 RB6110 is a 1972 six hundred gallon Chausse 4 tandem oil distributor. This company has been out of 5 business for a really long time. We've had to make our 6 own parts to try to make it work. It's time to go this 7 piece of equipment. 8 The third piece is RB6205, it a 1984 9 International water truck. At one time it was Center 10 Point voluntary fire department's water truck, but it's 11 an old truck, and it also doesn't have air brakes, so if 12 it's full of water you don't want to park it on a hill. 13 RB6409 is a 1984 Chevrolet eight to ten yard 14 dump truck. I think the year by itself we used it up at 15 Ingram yard for years. It's got a gas motor in it. 16 It's just -- it's worn out. 17 RB006 is a 1978 Ford haul truck. It's an 18 older semi truck. We currently have two other semi 19 trucks that serve the purpose just fine. Again 1978. 20 RB012 is a 1987 Broce T-ten rotary broom. 21 We have other brooms that are not near as old. It's 22 just an old piece of equipment. We did offer at one 23 time to the City of Ingram to purchase it, and they 24 purchased the maintainer, but didn't want the broom, so 25 it needs to go. 18 1 RBU026, 1989 GMC six yard dump truck, has a 2 gas motor in it. It doesn't have air brakes. We've 3 gotten our use out of it, it's pretty worn out. 4 RBU027 also a 1989 GMC six yard dump truck, 5 gas motor, no air brakes. 6 RBU086 a 1999 Dodge Ram 3500, a regular cab 7 diesel, it's a dual rear wheel. Starting to have some 8 problems, some transmission problems, going to start 9 costing some money so we decided probably time to get it 10 off the insurance so we've got that. 11 RBU087, 1999 Dodge Ram, 3500 pickup. Also a 12 diesel, dual rear wheel. Same thing, just starting to 13 have problems with it, and want to get it off the 14 insurance. 15 RBU088, a 1999 Dodge Ram 3500 pickup truck. 16 This one is a gas V-10. It's probably gets six or seven 17 miles to the gallon, it's a halfway decent truck, but 18 again we decided to go through our equipment and try to 19 get some things off the insurance to try to help out 20 with things. 21 2001 pickup truck, bed only, it came off of 22 RBU97 that we put a little three-yard dump bed on it. 23 We have no use for the bed and we could sure use the 24 space at our yard, it's sitting on the ground out in the 25 backyard. 19 1 RBU175 is a 1999 HTC 1800 side loader, we 2 fix edges with. It came off of RBU026. It's just -- 3 it's done its job, so it's time to go. It did come off 4 of a dump truck. 5 2012 pickup truck bed. It came off of 6 RBU192 that one of our supervisor uses. We put a 7 utility box on it. And again we have no use for the bed 8 on it, and we've started to order our trucks as cab and 9 chassis and then have the utility boxes on them. 10 Probably won't be ordering a whole lot of pickup trucks 11 for the field anymore. 12 We've got various auxiliary fuel tanks that 13 came out of trucks. 14 We have an old Lincoln shield ark welder 671 15 trailer mounted. It was up at the Ingram yard forever, 16 does not work. One of the previous mechanics, I asked 17 him what it would take to get that running, he said they 18 don't even make parts for it any more. And since then 19 we have bought couple Lincoln Ranger welders, so we 20 oughta be good with the welders. 21 Then we also have one from Center Point 22 yard, an old Lincoln welder, it's trailer mounted. It 23 was stored at the Center Point yard. And they got a new 24 Ranger welder probably about three years ago. 25 So I'm asking the Court to declare this 20 1 equipment surplus. 2 COMMISSIONER REEVES: I make a motion to 3 declare the items listed in the backup and which was 4 just read by Kelly as surplus, offer them onto 5 GovDeals.com and should no purchasers be found authorize 6 Road and Bridge to scrap or recycle said equipment. 7 MR. The owner of an unplatted 23.83 acre tract 24 off of Kelly Creek Road wishes to subdivide their 25 property by platting one lot of 5.01 acres, leaving the 21 1 remainder of 18.82 acres unplatted. The proposed Lot 1, 2 BB Estates, will be served by a private water well and 3 septic system. It is not within FEMA's special flood 4 hazard area. The 15 equipment will not be paid for until we get into the new 16 budget, the 17-18 budget, they estimated probably around 17 December by the time it was built. But we need to get 18 -- we need to submit a purchase order. McKEOWN: All right. Well, first off 13 I'm Courtney McKeown, I'm the owner and founder of Old 14 Fudge Bakery here in Kerrville, Texas. I bake from home 15 so I don't have a store front, so a lot of people can't 16 find me yet, but I came today to ask you guys and to 17 bring up an idea that I'm really wanting to, you know, 18 take part in. So currently through Facebook and through 19 people in the community of Kerrville, I have come up 20 with an event and a foundation, it's called Caring for 21 Kerrville Foundation. I have four thousand members on 22 my page, and I've got a lot of people interested in it, 23 and so for me I wanted to bring something to Kerrville 24 in order to give people an opportunity to know that they 25 are -- they are important, they are cared for. People 29 1 are willing to help out with financial issues or -- 2 currently, I actually held live auction on Facebook, and 3 the community came together and raised over 11 hundred 4 dollars, and I split that equally in three parts. And I 5 gave it to three different individuals, two of which had 6 cancer, and one that had a life threatening injury that 7 is getting better. 8 And what I'm wanting to do is as soon as I 9 can, but if possible if the Youth Event Center could be 10 donated for by Caring for Kerrville events so that I 11 don't have to pay a lot of money to reserve a location 12 for it. I'd rather give money to the individuals in 13 need. And with the event since it will be larger, I was 14 wanting to have five different families or, you know, a 15 few. I have to talk to them and get their approval, and 16 what they think about it as well. But there are 17 families and then a child has cancer, a lady who -- a 18 recent mother, she just had a baby two months ago, and 19 she has lupus. And so just for people like that I'm 20 trying to raise money for them just to help them out 21 with any medical bills that they may have, and just to, 22 you know, see that, you know, people here in Kerrville 23 are really willing to help. 24 As one of the individuals that I knew 25 personally, she had cancer, she passed away recently. 30 1 But she was -- she was actually able to afford 2 medication for two months, her pain medication. She 3 wasn't able to afford it before, so after that it was 4 really great. 5 JUDGE POLLARD: Thank you very much. Let me 6 ask a question or two. It's very admirable what you're 7 trying to do. You listed as a foundation? Is there 8 something in writing about that, or is it approved by 9 the IRS? 10 MS. McKEOWN: No. I can speak to the IRS 11 about it, but currently I am going to function as a 12 non-profit for the event. And any vendors would give a 13 15 to 20 percent off of whatever they profit. 14 JUDGE POLLARD: Do you have plans to try 15 to -- 16 MS. McKEOWN: I do. 17 JUDGE POLLARD: -- do the legal work to 18 create the organization? 19 MS. McKEOWN: Yes, uh-huh. 20 JUDGE POLLARD: And where are you in that 21 process? 22 MS. McKEOWN: I mean I could get it done as 23 soon as possible. 24 JUDGE POLLARD: Have you consulted with an 25 attorney? 31 1 MS. We don't, you know -- this is getting 10 -- this is a good cause. There are other good causes as 11 well, so we don't want to pick and choose. We have a 12 reduced rate structure for 501c3 to use that facility, 13 and you can use the outside or River Star, which is less 14 expensive than the Exhibit Hall, and you know we would 15 be glad to add you to that list once you get your 501c3. 16 MS. McKEOWN: So would I have to come back 17 after that? 18 COMMISSIONER LETZ: Yes. 19 JUDGE POLLARD: You're going to have to 20 create the organization first and then make application 21 to the IRS for that status. It's going to take you a 22 little while, IRS doesn't move very fast. 23 MS. McKEOWN: You know, and I've actually -- 24 I've been in that home bakery in business for maybe six 25 to seven months, but I already have an L.L.C., so that 32 1 was a pretty quick process, but I'll be willing to work 2 as fast as I can because I know people need it. 3 COMMISSIONER REEVES: I applaud you for your 4 efforts on helping the people; however, like the Judge 5 and Commissioner Letz the 501c3 is the first step, and 6 I'm sure -- I see Mr. Williamson from the event center 7 in the back, would be glad to talk to you, and help you 8 once all of that is established for it. 9 MS. McKEOWN: Absolutely. That would be 10 great. 11 COMMISSIONER MOSER: How large an area do 12 you need? 13 MS. McKEOWN: You know, not very big. But 14 enough for people to come in and know that it's there, 15 so -- 16 COMMISSIONER MOSER: The reason I ask that 17 is because maybe there's some other facilities around 18 Kerrville that -- 19 MS. McKEOWN: And that would be great. 20 JUDGE POLLARD: Like the Union Church maybe. 21 COMMISSIONER MOSER: But I think that's part 22 of the County thing, so we have this same problem. But 23 unlike some of the churches and all, and I think that 24 you know some of them have fairly large areas that -- 25 and do similar work that you do, and so may be able to 33 1 partner with some of those, and get it, you know, a 2 reduced cost or no cost and maybe will be a win-win for 3 two things. 4 MS. McKEOWN: And you know I've been to the 5 Blue Sage, I've been to Inn of the Hills, I've gone to a 6 couple of different places and asked if they'd be 7 willing. And so the Youth Event Center was one of other 8 ones that I wanted to. And when I heard Jake speak 9 about, you know, if you go to Court see if they can 10 donate it, but if I need a 501c3, I'm willing to get 11 that done. 12 COMMISSIONER MOSER: In the meantime while 13 you're processing that through the Federal government, 14 the IRS, you might try some of these other other 15 organizations that do a lot of that kind of work and 16 have some open space. 17 MS. McKEOWN: Yeah, that would be wonderful. 18 JUDGE POLLARD: There might be a question of 19 anybody that makes donations to you prior to getting 20 that status of whether or not it's deductible to them, 21 so it will help you, encourage gifts to you to get 22 started with your 501c3, so they can deduct it as a 23 charitable donation. 24 MS. McKEOWN: That would be great. Because 25 whenever I was doing the live auction I went door to 34 1 door to almost every business in Kerrville. And I got a 2 lot of different people to donate like Schreiner Goods, 3 a couple of the other stores, and it did really well. 4 It was a really long process, like about three hours 5 long for a live auction on Facebook, but people come in 6 and it was really good. The Art 2 2 Heart Foundation is going to be a Motown music festival, 3 a gathering of sorts, that will be put on so we're 4 excited for. Of course the fair, we're doing this just 5 so we can have additional space off of premise for this. 6 The Wild West Victorian Festival is a Victorian era 7 festival, Queen Elizabeth and Mark Twain. There will be 8 a tea party and a ball associated with this. We're 9 excited to welcome them to town, and see if it's a 10 success here. Whereas, GrantWorks was previously selected 9 on July 10, 2017 to provide application administration 10 services; whereas, the 2017-2018 Texas Community 11 Development Block Grant Colonia fund construction 12 contract requires engineering services by a State 13 registered engineer experienced in federal funded 14 projects; whereas, the selected engineering firm will 15 coordinate with the selected administrative services 16 firm on application preparation, and if funded, contract 17 the implementation; whereas, in order to identify 18 qualified and responsive providers for engineering 19 services a request for qualifications for engineering 20 services has been completed in accordance with the Texas 21 CDBG requirements; whereas, the proposals received by 22 the due date have been reviewed to determine the most 23 qualified and responsive providers for such professional 24 services. Now, therefore be it resolved that Tetra Tech 25 be selected to provide Texas CDBG application and 49 1 project related professional engineering services for 2 the 2017-2018 Colonia fund construction project in Kerr 3 County, Texas. LANTZ: We can, and then whoever works 25 the weekend will have to just be submitted the following 56 1 payroll. There's a timeline in order to get it 2 disbursed has to be to the bank by Wednesday. 3 COMMISSIONER LETZ: So what it would impact 4 would be people that are working -- 5 MRS. LANTZ: Well, I do it all the time, and 14 I never get payroll in on time, so that's the 15 frustrating part. I hate for an employee not to get 16 paid because their payroll's not being submitted. 17 COMMISSIONER MOSER: Remind them now though, 18 it will probably help. It's a 4 proposed budget, so we can make -- there's a couple of 5 minor changes I think that need to be made, but they can 6 be made -- is it best to make them now, today or -- 7 MRS. DOSS: It's best to make them now, yes. 8 Or authorize me to add them to the budget and then I'll 9 file it. Also, I have not added any -- if there's any 10 tax increases they are not added to this budget, so I 11 would have to add that also. 12 COMMISSIONER LETZ: The changes I had one, 13 my understanding is I'm not sure if you added this or 14 not, and animal control, that supervisor, that salary 15 needs to go up 5000 more to get that to make that an 16 exempt salary. If we don't increase it it won't end up 17 exempt, and it will cost us more, so that needs to go up 18 5000. 19 COMMISSIONER REEVES: So we don't have to 20 pay overtime. 21 COMMISSIONER LETZ: Overtime, right, an 22 exempt position. 23 COMMISSIONER LETZ: And the other one is 24 Juvenile Probation. The salary was split for that -- 25 the head of that department was split in two sections, 59 1 or two departments I guess you'd say. And the running 2 the juvenile detention facility two months of that 3 salary's included. I would recommend there being an 4 increase to his salary due to increased responsibilities 5 so he can get from part of this change of ten thousand 6 dollars to his other salary. 7 COMMISSIONER MOSER: And that would be from 8 what to what? 9 COMMISSIONER BELEW: It's actually a 10 reduction, isn't it? 11 COMMISSIONER LETZ: It's a 15 thousand 12 dollar reduction. 13 COMMISSIONER BELEW: But it's an increase 14 for the -- 15 COMMISSIONER MOSER: I gotcha. Forget my 16 question, okay, got it. 17 COMMISSIONER LETZ: And you know I wouldn't 18 have a problem with it being a 15 thousand dollar 19 increase, because it's a reduction in salary. 20 COMMISSIONER BELEW: Savings to the County. 21 It's part of this overall -- 22 MRS. DOSS: Yes, it's part of the Juvenile 23 Detention. 24 COMMISSIONER LETZ: It's part of that 25 restructuring, reorganization. I think it should be, in 60 1 my mind, a reduction of ten thousand. 2 COMMISSIONER BELEW: But that'll change the 3 figures you gave us? 4 MRS. DOSS: Yes, it will. We've already 5 increased 5000 to the Animal Control Manager. And then 6 10, 15, which one do you want to go with? 7 COMMISSIONER LETZ: 15. 8 COMMISSIONER BELEW: I don't have a problem 9 with 15. 10 JUDGE POLLARD: You got a problem with 15? 11 MR. DOSS: Right. Okay, so you want to go 19 any other changes? 20 COMMISSIONER LETZ: These are the only two 21 that I saw while I was going over. 22 MRS. DOSS: Okay. Before you you have 23 estimate of increases to the 2017-18 budget. There was 24 a one percent COLA that was assessed to all employees. 25 There was a two and a half percent increase assessed on 61 1 elected officials, except for the Commissioners' Court, 2 and that was approximately a 190 thousand. New 3 positions and other salary increases 975,500. Road & 4 Bridge projects and new equipment payment 329,500. 5 Sheriff new vehicle payments and electronic monitoring, 6 and this also includes his communication system payment, 7 315,000. Increase in jail operating 225,246. Increase 8 to juvenile probation operating 84,815, and this is due 9 to increased operating because we're closing the 10 juvenile facility and some functions will be moved over 11 there. Animal service operating increase of 19,491. 12 And a savings from the juvenile facility closing 13 estimated at about 800,000. 14 COMMISSIONER BELEW: Okay, I have a 15 question. In the juvenile probation operating, do you 16 have specifics, have they given you some -- 17 MRS. DOSS: Yes. We have a specific line 18 item that we had in the budget book that we went over 19 the other day. It was purchasing a new van and then -- 20 COMMISSIONER BELEW: Oh, okay. 21 MRS. DOSS: -- meals for travel, and -- 22 COMMISSIONER BELEW: So the van is. 23 MRS. DOSS: The van is a big part of it. 24 COMMISSIONER BELEW: About 30 some odd 25 thousand. 62 1 MRS. DOSS: Yes, it was about 30 thousand, I 2 believe. 31 thousand. 3 JUDGE POLLARD: All right then is there a 4 motion to approve the proposed budget with the changes 5 discussed? 6 MRS. DOSS: I don't have any increase in 7 property taxes if you choose to do that, so that will 8 have to be included in your motion, or you have to 9 decide if you're going to increase property taxes. Is there one 12 now? 13 COMMISSIONER REEVES: I want to make some 14 comments first on the entire budget process, the taxes 15 and the entire thing. This is my fourth budget I've 16 worked on. I've worked on school budgets, on the school 17 board. This was an extremely hard year. We had to make 18 some very hard decisions regarding to get our numbers 19 down. And while we got pretty vocal on it, or I got 20 pretty vocal on it, I applaud each and every department 21 head, elected official, everybody who was involved, they 22 voluntarily cut positions, cut their budget, but yet 23 still tried to make sure we had the best services we 24 could offer. There's some increase in here that we 25 talked about on some of these things, to get our roads 64 1 back up, to put more deputies on the street, which the 2 Sheriff has been saying we needed, and I echo those 3 sentiments. I think we've come a long way from where we 4 started, and I applaud everybody that worked on it. I 5 don't know how many hours Mrs. Doss put in on this, and 6 how hard she worked on it, and I know just as we take it 7 personal, she takes it personal, and I applaud her 8 efforts on that. 9 With that said, if I understand this right, 10 in order to reach our desired amounts of fund balance 11 looks like we need to go up 1.3 cents, is that correct? 12 MRS. DOSS: Yes, Sir. 13 COMMISSIONER REEVES: If we maintain our 14 current tax rate, our fund balance will be just under 15 two percent, and our general fund from our desired 16 rate -- 17 MRS. DOSS: It would drop, yes. 18 COMMISSIONER REEVES: From our proposed 25 19 percent, or what is recommended, so we instead of having 20 three months, we'd have about 2 months, three and a half 21 weeks or something. 22 COMMISSIONER MOSER: So the percentage would 23 be what? 24 COMMISSIONER REEVES: 23.61 with that. 25 COMMISSIONER MOSER: I think that's what we 65 1 need to put in the record. 2 COMMISSIONER REEVES: And if -- look over 3 these no line bifocals -- just a second. And then Road 4 and Bridge fund is about a hundred thousand dollars 5 short of reaching their desired 15 percent. That's the 6 way I understand it? 7 MRS. DOSS: Yes, Sir, that's correct. 8 COMMISSIONER REEVES: We're close. And I 9 think a lot of this -- and you may touch on it because 10 you're just as mad as I am about these unfunded 11 mandates. 12 COMMISSIONER MOSER: I do want to touch on 13 it. I think that's a key thing so what we're 14 discussing, and Commissioner Reeves just mentioned, and 15 it's presented to be a 1.3 cent increase in the tax rate 16 and the Auditor provided some information the other day 17 that on unfunded mandates, okay, it's going to be 18 somewhere in the neighborhood of a hundred and 50 to two 19 hundred thousand dollars, this year, increase. Okay. 20 It's still a big number. But that's the increase in 21 unfunded mandates, which is equivalent to one and a half 22 is or two cents on the tax rate. So if we did 23 everything else that we added that Commissioner Reeves 24 just mentioned, plus we improved animal control, I 25 think, which is -- could enable of an agreement with the 66 1 City for the library. It enabled us to have a place 2 holder for Flood Warning System, so there's some big 3 things we could have done, okay, without the tax rate 4 increase if we hadn't had the unfunded mandates, so I 5 think that's important to have -- 6 MRS. DOSS: It's about half a cent. 7 COMMISSIONER MOSER: The unfunded mandate? 8 MRS. DOSS: Yeah, if you're looking at a 150 9 thousand. 10 COMMISSIONER MOSER: Excuse me, you're 11 correct, it's a half a cent, correct. 12 MRS. DOSS: And that has been the trend, it 13 has been increasing from a hundred and 50 to two 14 hundred. 15 COMMISSIONER MOSER: Okay, thank for your 16 correcting me. 17 COMMISSIONER LETZ: And one of the increases 18 of our Road and Bridge Department on the roads, and that 19 is a huge -- I won't say unfunded mandates totally, but 20 they took our revenue away. We used to get a much 21 larger percentage of the license fees and all that, 22 which they've taken. So it's really frustrating to hear 23 our legislature in Austin talking about how terrible 24 local governments are raising taxes all the time and 25 they're the ones causing us to raise taxes, because they 67 1 either take our revenue, which they've done on the 2 ticket, they put our -- we used to get a lot of speeding 3 revenues. And they sent all the highway patrolman to 4 the border, so we don't get that revenue. We don't get 5 road and bridge revenue like we used to. And then they 6 come in with other mandates every year, so it's just 7 frustrating thing to hear in Austin oh, you know, we're 8 run away spending in local government. Well, it's 9 because they keep on pushing more things, and it's 10 requiring us to do things that they used to do. 11 COMMISSIONER MOSER: There's two pieces, 12 unfunded mandates number one. Number two taking away 13 sources of revenue, right. 14 COMMISSIONER LETZ: So I mean, you know, the 15 reason we have tax increase at least in this 16 jurisdiction is because Austin is doing those two things 17 on a regular basis. So it is frustrating, but I think 18 we had a lengthy budget process again. I was a little 19 bit more involved this year than I have been in trying 20 to get the organization going on. The Judge asked me to 21 do that and I was glad to try to help with that. And I 22 think it's a good budget. I think it's what we can 23 afford. I wish we could have given employees, you know, 24 more increase. It's pretty minimal what we're doing 25 there, one percent which is almost negligible, but it's 68 1 a little bit. 2 COMMISSIONER BELEW: It's an expression of 3 what we can do. 4 JUDGE POLLARD: Unfunded mandates also, and 5 rising cost of medical care for the inmates in the jail, 6 which seems to be just going crazy. And paying for 7 attorney ad litems on things where the courts claim we 8 have to protect people's rights, so we gotta pay these, 9 gotta appoint ad litem attorneys and we have to pay 10 them. There's some other unfunded mandates. Everything 11 going crazy and we're on the squeeze, we're caught in 12 the squeeze here in the County. 13 SHERIFF HIERHOLZER: One thing I think 14 oughta be mentioned -- 15 JUDGE POLLARD: And I hope the public 16 understands that that it ain't us, okay. 17 SHERIFF HIERHOLZER: One thing I oughta be 18 mentioned that Jonathan said about the highway patrol 19 going to the border, now they quit doing that, but they 20 are sending the highway patrol to the larger cities to 21 help them with law enforcement, so we are still losing. 22 Now they're rotating out to the larger cities like San 23 Antonio and Austin, so the rural counties that truly 24 taking a serious hit on having to do law enforcement 25 without DPS. 69 1 JUDGE POLLARD: So taxpayers do something 2 about the legislature, do something. It's up to y'all 3 to change it, okay. I'm part of that, too. 4 COMMISSIONER REEVES: With that said, I feel 5 we're still close enough we can do it with last year's 6 tax rate, because I think when it's said and done we'll 7 be at our 25 percent, and I feel we've got this close, I 8 feel that we can do it without a tax rate increase. 9 MS. DIANE BOLIN: Okay, can I just make a 10 statement? Today all we're going to do is do the 11 proposed tax rate. Whatever date you set to adopt the 12 tax rate you can go below that, but you cannot go above 13 that, so even if the proposed rate is higher, if you 14 choose to go to 50 cents, when we adopt the budget and 15 the tax rate in September you can do that. But you 16 cannot go above in September if we do not put a higher 17 amount as a proposed rate. 18 My suggestion is go with the higher amount, 19 the Auditor has suggested the .5130. We can put that as 20 proposed, and then in September whatever y'all choose to 21 adopt, if you choose to adopt that, we're covered, if 22 you choose to adopt lower, we're still covered. That's 23 the difference in what we're doing today and what we'll 24 do in September. 25 COMMISSIONER REEVES: In other words what we 70 1 adopt give us some room to see -- 2 MS. DIANE BOLIN: Yes, Sir. 3 COMMISSIONER BELEW: We could stay with last 4 year's rate but we're not stuck with that if we can't 5 get by with it. 6 COMMISSIONER REEVES: If we stay at last 7 year's rate we can't go above the 50 cents. 8 MS. DIANE BOLIN: So that's what's printed 9 in the paper. 10 COMMISSIONER LETZ: I mean I'll just make a 11 general comment, that I think it's -- what Austin keeps 12 doing, and we have the mandates and talking to the 13 J.P.'s, additional expenditures from them starting 14 September first. There are more requirements that they 15 have to do and stuff like that, and therefore, I think 16 that it's probably wise to go with a one cent increase. 17 I think that, you know, we never know what's going to 18 happen in a little bit. We have really cut this budget 19 back a lot, in a lot of areas, and that's kind of 20 roughing, we should end up with at this point and then 21 if we cut it back a little bit, you know. 22 JUDGE POLLARD: Well, Brenda didn't your 23 figures say the balance should be 1.3 cents? 24 MRS. DOSS: That's what I have. 25 COMMISSIONER MOSER: This is a proposed tax 71 1 rate as opposed to adopting the tax rate, and what 2 Diane, Tax-Assessor Collector is recommending is that we 3 do what the Auditor recommends so that we can always go 4 below, but not above -- 5 MS. DIANE BOLIN: That is correct. 6 COMMISSIONER MOSER: -- when we set the tax 7 rate. So I would make a motion that we adopt a 8 proposed -- not adopt. That the proposed tax rate be 9 increased by 1.3 cents. 10 COMMISSIONER REEVES: Is there specific 11 wording? 12 MS. I 3 mean and just because if expenditures if we have 4 $500,000.00 left as expenditures at the end of the year, 5 but I mean to offset that we also could not hit our 6 revenue target by that much. So it's not just looking 7 at expenditures or revenue, you have to look at the two 8 together. 9 JUDGE POLLARD: And your figures indicate 10 that if we go up a half a cent, a cent, like the motion 11 that hasn't been seconded yet, we'll have a shortfall, 12 is that correct, and will it affect our reserve and drop 13 it below 25 percent? 14 MRS. DOSS: If we hit our budget, yes. If 15 the budget -- if the estimate for this year ending for 16 next year, yes. 17 COMMISSIONER MOSER: We're below 25 percent 18 anyway. With this, with the 1.3 cent increase of 23 -- 19 23.6 percent, is that what the reserve is? 20 MRS. DOSS: Yes. Sheriff Hierholzer. 11 SHERIFF HIERHOLZER: We have a contract with 12 both City of Ingram and City of Kerrville. City of 13 Kerrville we will refer to in the next agenda item. 14 It's for housing what we call City prisoners, and let me 15 give you that definition real quick if you don't mind 16 just so everybody's on the same page about what a City 17 prisoner would be, and this goes to the same for the 18 City of Kerrville. 19 A City prisoner shall mean those persons 20 charged with violation of a City ordinance, and State 21 laws which are classified as misdemeanors lying within 22 the jurisdiction of the municipal court of herein above 23 stated City; furthermore, the City prisoner shall mean 24 those persons arrested for Class A and B misdemeanors, 25 and felonies, who have not been formally charged by a 89 1 Judge or a Magistrate. In other words a warrantless 2 type arrest. Once a prisoner arrested for Class A or B 3 or felony has been charged by a warrant or magistration 4 by a Judge or Magistrate, the prisoner shall be the 5 responsibility of the Sheriff, and no longer considered 6 a City prisoner. 7 So normally it's that on-view arrest for the 8 very first night in jail, first day in jail, until they 9 see a magistrate. If they go get a warrant first, then 10 they're our's, because they've already had that order, 11 okay, or a City ordinance. The change in this currently 12 we're charging both those cities 45 dollars a day for 13 housing City prisoners, and if you look at our cost 14 based on our current budget this year of the number of 15 staff I have, the entire budget, I'm taking the whole 16 thing, divided out by our ADP or average daily 17 population, including our medical contract; not what's 18 above, you know, the medical, what we went above, but 19 just the medical contract itself, total expenses in my 20 overall budget for this year, and you divide that out by 21 ADP it equals $50.11 a day is what it's costing us to 22 house prisoners inside our County Jail, and so I'm 23 recommending that we go to 50 dollars a day with both 24 the City of Kerrville and the City of Ingram for housing 25 there for that one day. 90 1 COMMISSIONER BELEW: Didn't you say in the 2 last meeting that we were going to charge $45.00 for 3 prisoners out of County? 4 SHERIFF HIERHOLZER: Well, what the deal is 5 you have to start looking as your population goes up -- 6 remember after this construction we'll have a 328 bed 7 facility, and as your population goes up, and we won't 8 have to change the staff then that cost will start 9 coming down because you're housing more with the same 10 amount of staff. So your average daily population goes 11 up. But that's my recommendation. That's what this new 12 contract shows on both. The only change in it at all is 13 the 45 dollars a day to 50 dollars a day. 14 MRS. STEBBINS: Rusty, didn't you suggest 15 medical expenses? 16 SHERIFF HIERHOLZER: I did, and we met both 17 with the City of Kerrville and the City of Ingram and we 18 came to an agreement with thePolice Chief that if they 19 have one that has medical, you know, number one we try 20 and refuse those, and get them to go to the hospital 21 first. But we ran into a situation where a couple 22 weren't -- kind of slipped under the crack you might 23 say, and what they've agreed is that they would come 24 back and take that prisoner to the hospital prior to 25 them being magistrated; not just being in our facility. 91 1 COMMISSIONER LETZ: I want to get back to 2 your conversation with Mr. Belew. There are -- we need 3 to charge Ingram and Kerrville the same price we're 4 charging other counties. 5 SHERIFF HIERHOLZER: Well, what I was 6 saying -- 7 COMMISSIONER BELEW: Is this a temporary -- 8 SHERIFF HIERHOLZER: No. The four 9 hundred -- I think what we said last week, what I wrote 10 down, you know, where we came up with an estimated 11 revenue at $405,000 total at 50 dollars a day. We can 12 figure that every different way you want to figure it, 13 and I just didn't know how y'all wanted to look at it. 14 Commissioner Reeves and I looked at it at 45. We looked 15 at it at 50. Just depends on when we get those 16 contracts with those other counties, once we're 17 finished, where this Court wants to say. 18 COMMISSIONER LETZ: Well, I think that the 19 the City -- the Counties should be made now before we 20 defer on the City -- or the two city's contracts. 21 SHERIFF HIERHOLZER: We're paying Bell 22 County 68 dollars a day to house our prisoners while 23 we're out. Effective October 1, we will be paying 24 Burnett County 40 dollars a day. 25 COMMISSIONER MOSER: But I think all we're 92 1 saying is stay the same. 2 COMMISSIONER REEVES: What was the number we 3 talked about in budget workshop that we arrived at a 4 four hundred and -- 5 JUDGE POLLARD: 405,000, yeah. 6 COMMISSIONER LETZ: Fifty. 7 JUDGE POLLARD: That was 50 -- 8 SHERIFF HIERHOLZER: You add 50 dollars a 9 day at 50 inmates, for 180 days, that's 450,000. 10 COMMISSIONER REEVES: I think we went down 11 to 405 to try to give a little more wiggle room, or 400 12 or something like that. 13 COMMISSIONER LETZ: How about 48? 14 MR. BELEW: Well, it costs what it costs, 15 but you're talking about people in our County charging 16 them more than somebody in the next County. I don't 17 think that's -- 18 SHERIFF HIERHOLZER: I agree. Y'all have to 19 set the rate. I don't have a problem with you. And I 20 agree it needs to be the same, set the same for 21 everybody. 22 JUDGE POLLARD: Well, it oughta be 50 23 dollars. I don't think we oughta be -- 24 COMMISSIONER MOSER: 50 dollars. 25 JUDGE POLLARD: -- in other counties or 93 1 whatever. 2 COMMISSIONER MOSER: I mean you just got 3 through saying 68 at one place, wherever that was, 4 and -- 5 SHERIFF HIERHOLZER: Bell County is where 6 we're paying -- 7 COMMISSIONER MOSER: -- and based on your 8 average daily prisoners or whatever you have, that was 9 $50.11. So I think it oughta be 50 dollars per day per 10 inmate. 11 SHERIFF HIERHOLZER: And when we get those 12 contracts with other counties after we open -- we don't 13 even have those contracts yet, Commissioner. Those 14 would have to be drawn up and drawn up exactly the same 15 as this one, if that's what you wish. It's just there's 16 different rates throughout the State. 17 COMMISSIONER BELEW: My idea is this: 18 Everybody that comes from Ingram or Kerrville, those 19 people are all Kerr County taxpayers. 20 SHERIFF HIERHOLZER: Yep. 21 COMMISSIONER BELEW: And those could be at a 22 break even, and you can charge all you want for the 23 people from out of County, whatever the law will allow, 24 but I don't think that people here should be paying 25 above the cost. 94 1 SHERIFF HIERHOLZER: I agree with you. 2 COMMISSIONER BELEW: Because they're already 3 paying the taxes for. 4 JUDGE POLLARD: Well, the cost is $50.11, 5 isn't it? 6 SHERIFF HIERHOLZER: It cost us to house 7 right now based on the budget of $50.11 so I had 8 proposed this year we go from 45 to 50. If you want to 9 leave it at 45, that's fine, too. 10 COMMISSIONER MOSER: I make a motion that we 11 set the rate for the Interlocal Agreement between the 12 City of Kerrville and the City of Ingram at 50 dollars 13 per day. 14 JUDGE POLLARD: Is there a second? 15 SHERIFF HIERHOLZER: The issue that I think 16 you get into also, you have to remember. Some of these 17 may be burglary cases, theft cases, whatever. Any case 18 that ends up in the City of Kerrville that's worked by 19 the City of Kerrville. Once we accept that prisoner 20 into our jail, that entire case is the county's 21 responsibility. You also have to remember that -- 22 COMMISSIONER LETZ: That's -- that's a 23 different subject. I mean that's law, that's just the 24 way the Constitution is written. 25 SHERIFF HIERHOLZER: Yes. 95 1 COMMISSIONER REEVES: Excuse me. Just to 2 get one thing clear, once -- I know once you talked 3 about medical if there's an issue they would come take 4 them back. What if we have a prisoner arrested in the 5 City of Ingram or in the City of Kerrville, 12 hours 6 after he was booked he has not been brought before the 7 J.P., and there's a medical issue, who pays for it then? 8 SHERIFF HIERHOLZER: At this point they 9 verbally agreed that they would take that prisoner and 10 get that prisoner released from our custody, if it's 11 prior to seeing the Judge, they can get the Judge to 12 release that prisoner, okay, so the prisoner would be 13 responsible for it. If they do not Kerr County's going 14 to be responsible for it. 15 COMMISSIONER REEVES: Between that time of 16 that -- I believe once he's before the J.P., and staying 17 in our facility it's our medical expense, correct? 18 SHERIFF HIERHOLZER: Right. 19 COMMISSIONER REEVES: And where out of 20 County prisoners we won't be paying their medical 21 expense? 22 SHERIFF HIERHOLZER: Out of County prisoners 23 are always that county's responsibility. 24 COMMISSIONER REEVES: So we do run the risk. 25 JUDGE POLLARD: All right, I'm going to ask 96 1 one more time, is there a second to that motion, Mr. 2 Moser's motion? 3 COMMISSIONER BELEW: One more question. 4 You're saying it's going to cost us 50 dollars a day to 5 house whoever we take in at the Kerr County Jail? 6 SHERIFF HIERHOLZER: At this point. 7 COMMISSIONER BELEW: At this point. And 8 that's going to as you have -- 9 SHERIFF HIERHOLZER: As your average daily 10 population goes up, your actual cost per inmate will go 11 down. 12 COMMISSIONER MOSER: The denominating 13 increase is the rate goes down. 14 SHERIFF HIERHOLZER: We change -- 15 COMMISSIONER MOSER: This is just for the 16 Interlocal Agreement between the City and between the 17 County and -- 18 COMMISSIONER BELEW: I don't want you to 19 feel like that we're trying to gouge them. 20 JUDGE POLLARD: I don't want to either, but 21 I don't want to lose money on it either. 22 COMMISSIONER BELEW: We don't want to lose 23 money. 24 COMMISSIONER MOSER: It's 50 dollars and 11 25 cents. 97 1 JUDGE POLLARD: Well even at 50 dollars we 2 lose 11 cents. Add that up with the number of 3 prisoners. 4 COMMISSIONER BELEW: 50 dollars and 11 cents 5 then is what it oughta be. Seriously. 6 SHERIFF HIERHOLZER: That's a nightmare for 7 bookkeeping. I would much rather we just -- we either 8 stay currently. We went to 45 dollars, what was that 9 about two years ago, I think something like that, from 10 40 to 45 dollars about two years ago, okay, is what we 11 did. And then this year we were going to 50 for both 12 cities. 13 COMMISSIONER BELEW: Well then I'll second 14 the motion. 15 JUDGE POLLARD: Yes, Ma'am. 16 MRS. GRINSTEAD: Real quick just to clarify. 17 I believe Commissioner Moser included the City of Ingram 18 and the City of Kerrville. Yeah, and City of 19 Kerrville's another item, so I just wanted to clarify 20 this motion. 21 COMMISSIONER BELEW: This is just for 22 Ingram. 23 COMMISSIONER MOSER: I'm sorry. I didn't 24 read the -- okay. Just for the City of Ingram, right. 25 I amend the motion. 98 1 MRS. STEBBINS: I don't know if either of 2 those entities or this one, the City of Ingram has any 3 recommended changes for the contract. I haven't -- 4 this particular contract it wasn't the one that I sent 5 over to the City Attorneys for either of those entities. 6 I -- 7 JUDGE POLLARD: Do you need to have time to 8 check it over and approve it? 9 MRS. STEBBINS: I've looked at the change -- 10 the Sheriff is the one who made the change here in 11 Section 4-A, and I believe that's the only changes that 12 he's made to the contract by taking out the medical, 13 which was the last one that I reviewed and forwarded it 14 to the City Attorneys, but what happened after that was 15 both law enforcement entities -- agencies were working 16 with the Sheriff to find what was agreeable for them, 17 and that was the last that I knew of it, and so I 18 haven't talked to either the City Attorneys to see if 19 they have any recommended changes for the agreement. 20 SHERIFF HIERHOLZER: What that was is after 21 we sent them a copy of the agreement -- first, let me do 22 it one agenda item at a time, unless you want to call 23 both. But the City Manager of Ingram contacted 24 Commissioner Reeves and myself, met at my office to go 25 over it. They had kind of an issue with the cost. The 99 1 contract's exactly the same except they didn't like the 2 medical because that was an undefined. We had in there 3 a deal that any medical prior to magistration or prior 4 to them actually being committed on a City inmate would 5 be their responsibility. And they were having a real 6 hard time with not being able to find what that cost 7 would be, and I could not give them what that cost would 8 be, so we just agreed to take that out of my proposed 9 contract, just leave in the change in the daily cost and 10 other than that the contract is identical to what it has 11 been for the last number of years. Nothing has changed. 12 So at this point the two contracts are identical to the 13 last ones, or the ones that are currently in effect 14 except for the dollar amount. 15 JUDGE POLLARD: So you approve or not? 16 MRS. STEBBINS: I have reviewed the contract 17 and it is a legal document. I'm just advising y'all 18 that I hadn't heard back from either of the City 19 Attorneys who I forwarded it to if they have any 20 recommended changes. 21 SHERIFF HIERHOLZER: And the City Manager of 22 Ingram was advised that it would be on the agenda today 23 if they would like to come, and he told us that day in 24 my office that they would not come to the meeting. 25 COMMISSIONER REEVES: But you're saying 100 1 haven't heard from legal from the City of Ingram? 2 MRS. STEBBINS: No, Sir. And if they have 3 suggested changes then -- and it's something that we 4 have to address, we can bring it back to the Court. 5 COMMISSIONER REEVES: Can we wait until we 6 hear back from them and do this in two weeks? 7 SHERIFF HIERHOLZER: That's fine, but my 8 purpose of bringing it to the Court is number one, I 9 don't think it should be from me telling the City of 10 Ingram and the City of Kerrville this is what we're 11 doing. I think it technically needs to come from this 12 Court, because it is Kerr County's contract so that's 13 why I wanted the Court's approval on it, then let them 14 work on it on their end. If they disagree that's when 15 we start negotiating. But at least it is a Kerr County 16 Court approved document and not just a Kerr County 17 Sheriff's approved document. 18 JUDGE POLLARD: So I think the question is 19 it's a little premature by two weeks it sounds like. 20 COMMISSIONER MOSER: Yeah. 21 JUDGE POLLARD: Maybe put it off for two 22 weeks. 23 SHERIFF HIERHOLZER: It's up to y'all. 24 COMMISSIONER MOSER: I withdraw my motion 25 until we see -- until both City of Ingram and Kerr 101 1 County has had chance to look at the proposed contracts. 2 SHERIFF HIERHOLZER: I don't know if you'll 3 hear back from them until y'all say something. 4 COMMISSIONER LETZ: But my question is, it 5 sounds like there is -- there are more changes than just 6 the dollar amount. 7 SHERIFF HIERHOLZER: No. The ending 8 contract is only the dollar amount changed. You'll see two parts of this in your 19 backup, the installation fee of $1,250.00 should come 20 out of the bond issue, it's already been sent to Huser 21 and DRG, our people that are working that because that's 22 installing it. And actually this is paid out of inmate 23 commissary so it's not taxpayers, it's not really a 24 contract that the County can control, it's up to the 25 Sheriff, but it is a contract, so for that regard I do 105 1 bring it to the County Attorney, and the County Attorney 2 has reviewed it and looked at it, and I believe given 3 her okay on it also. 4 MRS. Mr. Hierholzer. 21 SHERIFF HIERHOLZER: This is, as you 22 remember last time we were here over the fire damage at 23 the jail, the County approved in Court Order number 24 36110, an amount not to exceed 49,500 to fix Phase 1 of 25 the fire damage, which has been done. Now we are at 106 1 Phase 2 to finish the exterior wall and around the foyer 2 area of the J.P., and Kerr County has received a check 3 from the insurance company for 22 thousand -- hold on. 4 $22,089.61. In the backup you will see that that's what 5 the check was. There is a recoverable depreciation 6 amount of $1,332.54 resulting in the claim of 7 $23,422.15, so this in Phase of the contract is for the 8 amount of $23,422.15 to complete the repairs from the 9 fire damage. It will include the check that we received 10 for the $22,089.61. And then it also includes, I guess 11 which would be the recoverable depreciation of 13,032.54 12 is what -- 13 COMMISSIONER REEVES: And what you're saying 14 we've gotta pay the recoverable? 15 SHERIFF HIERHOLZER: I guess, but it's a 16 recoverable depreciation, so I'm not sure how that 17 works, okay, that's insurance company. My understanding 18 was we file it after it's done and they pay it back. 19 That's what they get back from the other ones. 20 MRS. But in this change order it states first 16 paragraph in it, add video monitors in the control room 17 and provide additional video equipment, supporting CPU's 18 to allow enhanced simultaneous viewing of video cameras 19 and all as indicated on the attached supporting 20 document. The construction manager will have from 21 August the 21st, 2017 to December 21st, 2017 to complete 22 the interior renovations to the existing building, 23 including successful completion of inspections by 24 authorities having jurisdiction so that the owner can 25 begin moving inmates back into the facility. Liquidated 109 1 damages will apply after December 21st, 2017. All other 2 terms of the construction managers contract apply, and 3 that would be the change. What we wanted and we're 4 setting forth, since we have started moving inmates out, 5 I wanted some real firm dates on when and how long we're 6 going to have these inmates out and how long it's going 7 to take for the renovations on the inside, because there 8 were a lot of changes since the contract all started and 9 been a lot of discussion about different things, so I 10 could understand our contractor needing some additional 11 time, but we needed for the county's benefit to be able 12 to say this is how many days we're going to leave before 13 liquidated damages occur, because once we close that 14 facility by the middle of this week, I'll have all 15 inmates out of it. Kerr County will be paying close to 16 nine thousand a day to house inmates in other counties. 17 Contracts. 18 COMMISSIONER MOSER: Sheriff, agree with the 19 intent, but does the contractor does he have full 20 control on being able to stay within those dates? If he 21 has outside inspectors -- 22 SHERIFF HIERHOLZER: Outside inspectors, he 23 agreed with that, and what we're talking about is 24 Commission on Jail Standards, and then we get down here. 25 COMMISSIONER MOSER: Okay. But my question 110 1 is he agrees to that even though he can't control 2 outside inspectors, he agrees with what you're 3 proposing? 4 SHERIFF HIERHOLZER: Yes. Mr. Hastings. 4 MR. HASTINGS: We got some consultants here 5 that can walk us through this with GrantWorks. 6 MS. SISCO: Hi, I'm Robin Sisco, and I work 7 with GrantWorks. We're working on the applications for 8 the Colonia construction fund, and this Resolution that 9 you see in front of you would allow -- would authorize 10 the County to apply for two Colonia construction fund 11 projects. This year the State is allowing two 12 construction projects per applicant. The Resolution 13 authorizes you to submit two applications for the 14 Community Development Block Grant Colonia construction 15 fund at $500,000.00 each, benefitting the residents of 16 Eastern Kerr County Colonia, and I'll talk about which 17 Colonias here in just a second. 18 Basically says that the County Judge would 19 be designated as the chief executive officer and 20 authorize representative to sign all paperwork, and act 21 in all matters in regard to the application and grant, 22 and that the County would commit 25 thousand dollars for 23 each application, or 50 thousand dollars total from the 24 Texas Water Development Board assistance as a cash 25 contribution towards the activities of this project. 114 1 Basically these would be like other grants that you've 2 already gotten from the Texas Community Development 3 fund. They would put in yard lines for low and moderate 4 income people on the front lines that Texas Water 5 Development Board is putting in. 6 In addition to this the next item is the 7 Colonia economically disadvantaged. 8 JUDGE POLLARD: I'll call item 1.32 9 consider, discuss and take appropriate action on a 10 resolution to apply for a Texas Community Development 11 Block Grant Colonia economically distressed areas 12 program. I have a quick one 19 with -- Dawn and I have been working together to get 20 with TAC to get some training for elected officials and 21 department heads, and that training is scheduled for 22 October the 6th at 8:30 and through 4:30 at the Event 23 Center. There will be a couple other counties invited 24 to participate, but while y'all can't instruct elected 25 officials to come to this training with their -- with 133 1 the people who supervise in their departments, I am 2 requesting that at this time that the Court advise them 3 that this would be very beneficial to their departments 4 in Kerr County to send their supervisors, along with 5 themselves for this training for Human Resource 6 purposes. 7 SHERIFF HIERHOLZER: What is the training? 8 MRS. STEBBINS: I'll get you a list of the 9 agency, but it is for HR purposes. Several type of 10 supervisor training for hiring, and discipline, and 11 other types of -- 12 COMMISSIONER LETZ: Supervisory management. 13 MRS. STEBBINS: Yes. 14 MRS. LANTZ: And TAC has offered to do a 15 mini regional, so they're going to provide refreshments 16 and so forth. 17 JUDGE POLLARD: All right. Sheriff, you got 18 a comment as an elected official? 19 MRS. DOSS: And you're going to be sending 20 out e-mails? 21 SHERIFF HIERHOLZER: Just as you heard we 22 will be closing our current facility officially Monday 23 morning. We should have all inmates out of there by 24 this Wednesday, and then the employees will be being 25 moved over to the old juvenile facility starting 134 1 Wednesday so that by Monday morning we can be up and 2 running at the old juvenile facility, just as a lockup 3 24-hour holding facility so it's going to create a lot 4 of issues. But I think it's moving along. 5 A little bit of good news, I think some of 6 y'all know my Chief Deputy's daughter was released from 7 the hospital. She's recuperating, singing, and doing 8 everything. She was even in church yesterday, but she's 9 still going through lots of rehab,but a blessing. 10 JUDGE POLLARD: That's amazing. 11 SHERIFF HIERHOLZER: The last thing, I would 12 like to thank the auditor's office. I know Brenda's 13 worked extremely hard this year on a very hard budget, 14 and I'd like to thank y'all. And I think it's been 15 difficult for everybody to figure out this budget. But 16 I think Brenda about lost a lot of her hair trying to 17 get it figured out. 18 COMMISSIONER MOSER: Welcome to the club. 19 SHERIFF HIERHOLZER: Well, you had already 20 lost it, so we don't care about you. Talked to 9 the City Manager about it, but -- 10 JUDGE POLLARD: That's great. 11 COMMISSIONER LETZ: -- so anyway I'll be 12 part of that. I don't know the last time I did it, I 13 ended up not speaking to the Mayor for about two or 14 three years, but I'm hoping that won't be the case this 15 time. 16 COMMISSIONER MOSER: I said no issues so 17 don't screw it up. 18 JUDGE POLLARD: Okay. But 3 what she is attempting to accomplish, I believe, was 4 doing it sooner than that so that it can be built by 5 December, and so I request that you change that to not 6 include the budget adoption, but the proposed budget 7 filing. 8 COMMISSIONER BELEW: Well, she won't need it 9 until next -- 10 COMMISSIONER LETZ: But she has to order it. 11 COMMISSIONER REEVES: But the way the 12 wording was -- 13 COMMISSIONER LETZ: She couldn't order it 14 until after we approved the budget.
