Lucy 6 Wilke. 7 Let me point out that at the last time I 8 announced that I found out that my granddaughter was 9 working for Kendnel Kasper, and so I did not vote on 10 that. And if I don't vote today, we won't have a quorum 11 on that, do we? 12 COMMISSIONER REEVES: I believe there is 13 a -- and I'm going to practice law without a license, 14 excuse me, Miss Wilke. But I believe there is -- if 15 there's enough conflict that we could not have a vote 16 then you are permitted. 17 MRS. WILKE: That's right. And I am not 18 giving legal advice, but that's what I understand from a 19 City Council meeting that I was at. 20 COMMISSIONER REEVES: We may have been at 21 the same City Council meeting that they said that. 22 COMMISSIONER LETZ: Judge, you can sign 23 this. 24 JUDGE POLLARD: Both of you raise your right 25 hands. You agree to indemnify me and hold me harmless? 4 1 SHERIFF HIERHOLZER: I'm a witness, Judge. 2 COMMISSIONER REEVES: You could abstain, and 3 it just takes a majority of the Court voting. 4 JUDGE POLLARD: That would work. That's 5 what I was going to point out, I think that would work. 6 And so I'm going to have to abstain because, I guess, 7 there's a -- 8 COMMISSIONER REEVES: Conflict of interest. 9 But it still would be two zero with one abstention, and 10 that's a majority of the Court voting. 11 COMMISSIONER LETZ: I think you're probably 12 safe on it. I think you're playing over safe, which is 13 good. But I think that you -- 14 JUDGE POLLARD: I just want to be careful 15 about this, okay. All right, I'm sorry. Go ahead now, 16 Lucy. 17 MRS. WILKE: Okay. Commissioners and Judge, 18 we have 1, 2, 3 -- well, change orders 5 through 9. We 19 are not seeking approval for change order 6, which is 20 wall cabinets to the workroom for 11 hundred dollars 21 plus, or the nice -- the ceiling tin metal tile, which 22 is almost $9,000.00. We are seeking approval for 23 $920.00 for some pendant lights in the main lobby area, 24 and it's a total of six lights, six pretty large lights, 25 and then also a window in the lobby. I didn't realize 5 1 until they started construction putting up the sheet 2 metal how dark it is in the lobby area, so we asked them 3 to give us a price on adding a window there. And in the 4 ceiling tile originally to save cost, we were just going 5 to leave the ceiling exposed, which right now all it has 6 is the insulation, and after looking at it some of the 7 insulation is falling down. They said they could fix 8 it, but we would like some ceiling tile. This is very 9 reasonable. It's just similar to this tile that's up in 10 the courtroom, so it's not anything fancy. And we're 11 seeking approval for those three change orders. 12 COMMISSIONER LETZ: Lucy, just -- no 13 problems in what your requests are. I'm confused on 14 what -- change order 9, that last item of ceiling tiles, 15 of 19 hundred dollars. 16 MRS. WILKE: Yes, Sir. 17 COMMISSIONER LETZ: The lighting one -- I 18 don't see -- is that change order 10? 19 MRS. WILKE: That should be change order 5. 20 COMMISSIONER LETZ: 5. 21 COMMISSIONER REEVES: Are those change 22 orders that were previously within the dollar amount 23 that was permitted without -- and maybe that's a 24 question for the Auditor. 25 MRS. DOSS: I'm sorry. What is the 6 1 question? 2 MRS. WILKE: Yes. That was change orders 1, 3 2, 3 and 4. And those totalled almost ten thousand 4 dollars; not quite. 5 COMMISSIONER REEVES: Which was under a 6 previous court order. I see Mrs. Grinstead nodding her 7 head that it had already been approved. 8 MRS. GRINSTEAD: Yes. 9 COMMISSIONER REEVES: So the change order on 10 the agenda today is 9. 11 COMMISSIONER LETZ: 9 is the only one we 12 need to approve. I think 1, 2, 3 and 4 -- 13 MRS. GRINSTEAD: What you have before you -- 14 1, 2, 3 and 4 were already done in the past. What's 15 before you now 5, 6, 7, 8 and 9. They are not asking 16 number 6 and number 8 to be approved; they want to 17 approve 5, 7 and 9. 18 MRS. WILKE: Correct. 19 COMMISSIONER REEVES: I don't have any 20 information on -- I've got 8 and 9. 21 MRS. WILKE: I have it here if you -- 22 COMMISSIONER LETZ: What's the dollar amount 23 for those two? 24 MRS. WILKE: Lights is $920.00 -- 25 MRS. DOSS: That's number 5. 7 1 MRS. WILKE: -- which is number 5. 2 JUDGE POLLARD: Which is already approved? 3 MRS. WILKE: No, it's not. 4 MRS. GRINSTEAD: Here. 5 MRS. WILKE: And number 7 is for a window in 6 the lobby area, which is $1,576.65, and then the ceiling 7 tile which is $1,935.45. 8 MRS. DOSS: That's number 9. 9 MRS. WILKE: That's number 9, correct. 10 MRS. DOSS: But the whole total adding up 11 everything that she's asking for approval so far is 12 $13,688.10. 13 COMMISSIONER REEVES: To date. 14 MRS. DOSS: To date. 15 COMMISSIONER REEVES: And that's within the 16 statutory allowance for change orders. Isn't there a 17 cap on it, how much we can change on a bid? 18 MRS. DOSS: I don't -- 19 COMMISSIONER REEVES: I believe it's 25 20 percent. 21 MRS. DOSS: 25 percent? 22 COMMISSIONER LETZ: We're not -- 23 MRS. DOSS: We're not near that. 24 COMMISSIONER REEVES: I just wanted to 25 verify that for the record that we're within that. 8 1 COMMISSIONER LETZ: I make a motion that we 2 approve change order 5 of $920.00 for lights, and change 3 order 7 in the amount of $1,576.65 for adding the 4 window, and change order 9 of $1,935.45 for ceiling 5 tiles. 6 COMMISSIONER REEVES: And those are the ones 7 we need? 8 MRS. GRINSTEAD: Yes. 9 COMMISSIONER REEVES: I second. 10 JUDGE POLLARD: Okay, Commissioner 3 has 11 moved for approval of change orders 5, 7 and 9. 5 being 12 $920.00 additional cost, 7 being $1576.65, and change 13 order 9 $1,935.45. First one is for lights, additional 14 lights, 7 is for a window, and 9 is for ceiling tiles. 15 Is there any further comment or discussion? There being 16 none, those in favor of the motion signify by raising 17 your right hands. I do not vote, I declare a conflict 18 of interest. But I declare that it passes, too, 2 to 19 nothing.
