It's July the 9th, 2018, a 6 little bit after 9 a.m. The Kerr County Commissioners' 7 Court is in session. We just had the Pledge and the 8 prayer, and this is now that part of the agenda where 9 people can come forward and speak on something is that 10 is not on the agenda. Anybody in the public can come 11 forward to speak on something not on the agenda. If you 12 do then please approach the podium, identify yourself by 13 name and address, and try to limit your comments to 14 three minutes, please. I have one notice that somebody 15 named Dale Naumann wants to speak. Would you please 16 come forward. 17 MR. NAUMANN: I won't even take the three 18 minutes. My name is Dale Naumann, I represent the Texas 19 Angora Goat Raisers' Association. Just to put your mind 20 at ease, I am retired principal from Medina for about 25 21 years, and I'm also on the Bandera County Appraisal 22 Board District Board of Directors. So I always was 23 worried when someone comes sign up to speak at a public 24 meeting, but this is not a gripe or complaint; this is a 25 compliment. I just want to thank -- we had our 99th 5 1 annual show and sale out at the show barn last weekend. 2 And I want to brag on the two guys, Jake and Ed, that 3 work out there. Anything that we asked, anything that 4 we needed for them to do, they did. We had a great 5 show. Sale wasn't as good as we were hoping, but it a 6 was great facility. And also I want to compliment 7 whoever was in charge that has the wisdom to set 8 reasonable rates for that facility. It's a great 9 facility. So we said we'd have it here close to us to 10 be able to use. I priced one in San Angelo and they 11 wanted 25 hundred dollars a day, and it's not near the 12 facility that y'all have out here. It's something that 13 y'all should be proud of. 14 Next year we have our 100th anniversary of 15 the Texas Angora Goat Raisers' Association. There's not 16 near as many of those angora goats left. Not near as 17 many people as there were. Most of you may or may not 18 realize Kerrville was the hub of that for years for the 19 Schreiner warehouse, and sold millions of pounds of 20 mohair through that facility. 21 JUDGE POLLARD: I was here, I remember it. 22 MR. NAUMANN: Because there's a lot of 23 people have no idea what an angora goat looks like or 24 mohair. 25 JUDGE POLLARD: Unfortunately. 6 1 MR. NAUMANN: But we just to -- and we've 2 already set up next year, we're having our hundredth 3 celebration out there at the facility, and we appreciate 4 all the support that we've had. We want to invite 5 anyone to come out to look. We're going to have a 6 national colored angora goat show. People from all over 7 the country will be other bringing colored angora goats. 8 If you've never seen one of those they look just like an 9 angora goat, except they're a shade of red or black or 10 something in between. 11 JUDGE POLLARD: Did they dye them or breed 12 them that way? 13 MR. NAUMANN: Well, if you knew people that 14 had angora goats years ago anything that came out that 15 looked like that they'd take them out back and knock 16 them in the head and throw them in the brush pile, 17 because that was a cull, and they didn't want anybody to 18 know that. So somebody figured out several years ago 19 that they -- we can sell that colored hair to these hand 20 spinners that don't like using dyes. 21 And my wife and I go all over the country 22 from New York to North Carolina to Colorado selling 23 mohair at these fiber festivals, and they fight over 24 that good colored, naturally colored hair for those hand 25 spinners. So that's a really nice thing to have. 7 1 So we want to invite y'all to come out, it's 2 the last weekend of June. We already have it booked, 3 and we're having a big celebration that Friday night out 4 at the show barn itself in one of the rooms to invite 5 all the past directors, anybody that has anything to do 6 with the Texas Angora Goat Raisers in the last hundred 7 years. And we'd like to invite y'all out. We're going 8 to have a barbecue and have a good time visiting. 9 But as I said, my reason for showing up here 10 today was just to thank y'all for having the wisdom to 11 have a facility like that, and keeping those prices low 12 enough where groups like us could afford to have it. 13 There's lots of great motels and restaurants here. We 14 started in Rock Springs years ago, and then we moved to 15 Junction, and we kind of outgrew it out at Junction. 16 We had 225 goats in our show and sale this 17 year, and so we moved here. This is our second time of 18 being in Kerrville. And we have no complaints, so -- 19 and keep supporting the animal agriculture industry, 20 because it's dying in a hurry. 21 JUDGE POLLARD: Well, we appreciate your 22 comments, and we appreciate your using our facility, and 23 sounds like you're going to use it again next year. 24 MR. NAUMANN: We are. Hopefully as long as 25 these hard heads keep going, we're hopefully that 8 1 somebody will carry it on, but the numbers are dropping 2 every year. But we appreciate y'all's help. 3 JUDGE POLLARD: Thank you for your comment 4 about the folks running it out there. 5 MR. NAUMANN: They're great. 6 JUDGE POLLARD: That's very valuable. 7 MR. NAUMANN: Somebody brag on them whenever 8 y'all see them, because they're doing a great job. And 9 if you had anything to do with the rain, we appreciate 10 that, too. I know the Commissioners in Bandera, 11 somebody will take credit for that, but I'm sure you 12 guys won't do that. 13 JUDGE POLLARD: We don't have anybody here 14 that will take credit for it. 15 MR. Is there anyone 19 else that wishes to come forward to speak on something 20 not on the agenda? 21 If not we'll move to the first item on the 22 agenda then, and that is comments from the Commissioners 23 and County Judge as to achievements of persons in their 24 Precinct, or make comments on matters not listed on the 25 regular agenda. 9 1 COMMISSIONER BELEW: I want to say, Judge, 2 from Precinct 1, we had a fire up here at Scenic Hills. 3 How long ago was that, ten days ago, something like 4 that? It rekindled this last Friday, I think it was, 5 after the rains we have had. And people get upset when 6 you have a burn ban as long as we've had it, and they 7 want to burn their brush pile and they don't care about 8 anybody else, and they think that since their rain gauge 9 since they got an inch and a half, everybody got an inch 10 and a half. It doesn't work that way. And if after 11 that kind of rain you can have a rekindle up there, you 12 can see how dangerous it is right now for us to burn 13 even after some rain. So I just want to caution 14 everybody that after it rains a little bit, we don't run 15 out and start burning brush piles. 16 And we also issued a citation to a guy in 17 Precinct 1 this week, because he just was a hard head, 18 he just kept going. He got in trouble once, thought it 19 was okay cuz' he didn't get -- he just got his hand 20 spanked. Did it again and got a fine. 21 So there you are. That's all I got. 22 JUDGE POLLARD: That's great. That's very 23 well appreciated. Good 9 morning. How are you today? 10 MS. FIEDLER: Good morning. You said it 11 all. 12 JUDGE POLLARD: I know you're not Lindsey 13 Forster, I know that. I know you by name. 14 MS. FIEDLER: She called me early this 15 morning, I'm first on the agenda and I don't expect to 16 be there. You going? So we just need approval to keep 17 it were its at. 18 COMMISSIONER LETZ: I have no problem with 19 it. It's not in the way. I make a motion -- 20 MS. FIEDLER: I think Commissioner Reeves is 21 probably the one that's been working with it the most 22 being that it came from the show barn. 23 COMMISSIONER LETZ: Right. Enjoy the rain. 13 JUDGE POLLARD: All right. 1.2 conduct a 14 public -- I declare a public hearing for the revision of 15 plat for parts of Subdivision No. 3 and Subdivision 16 No. 4 of the George Baldwin Estate, to be known as the 17 Hunt Diamond S Acres, Lot 1, Volume 2, Page 68. That's 18 in Precinct 4. Is there anyone wishing to speak at this 19 public hearing? There being no one, I declare the 20 public hearing closed. 21 We go to item 1.3 on the agenda consider, 22 discuss and take appropriate action for the Court to set 23 a public hearing for 9:05 a.m. on August 13, 2018 for 24 the revision of plat for the Horizon Section One, Lots 25 118 and 119, Volume 6, Pages 323-326 of the official 12 1 public records of Kerr County Texas. Mr. Hastings. 2 MR. HASTINGS: Thank you. This proposed 3 revision of plats combines lots 118 and 119 into one lot 4 119R. It would be a total of 9.67 acres when the two 5 lots are combined. The minimum lot size is one acre. 6 It is on a public water system Aqua Texas. They will be 7 on OSSF. It's out of the floodplain. There's no 8 proposed roads; just a combination of two existing lots. 9 County Engineer requests the Court set a 10 public hearing for 9:05 a.m. on August 13th, 2018 for 11 the Horizon Section One, Lots 118 and 119, Volume 6, 12 Pages 323 through 326, Precinct 1. 13 COMMISSIONER BELEW: I move for the public 14 hearing. 15 COMMISSIONER LETZ: Second. 16 JUDGE POLLARD: Been moved by Commissioner 17 Precinct 1, seconded by Commissioner Precinct 3 to set 18 the public hearing pursuant to item up 1.3 of the 19 agenda. Set the public hearing at 9:05 a.m. on August 20 13, 2018 for the revision of the plat for Horizon 21 Section One, Lots 118 and 119 of record in Volume 6, 22 Pages 323 to 326 of the official public records of Kerr 23 County. HASTINGS: Something like that, yes. 4 They're trying, that's right. 5 JUDGE POLLARD: That's kind of what I 6 figured. Okay. All right, let's go to item 1.4 7 consider, discuss and take appropriate action for the 8 Court to approve a concept plan to revise lots 34 and 35 9 of Woodcreek in record of Volume 4, Page 285 of the 10 official public records of Kerr County. Mr. Hastings. 11 MR. HASTINGS: Thank you. We discussed this 12 item 2 weeks ago at the last Commissioners' Court 13 meeting, and the Court requested that we bring it back. 14 At the time we were just setting a public hearing, so 15 the public hearing is set, but we've been asked to bring 16 it back so they could have some discussion, some 17 background on this. 18 It's joint property owners of lots 34 and 19 35. They have come together and they wish to revise the 20 shared lot line to accommodate an existing structure. 21 Lot 34 is currently 0.40 acres, and would be revised 22 into lot 34-R at 0.56 acres. Lot 35 is currently 0.57 23 acres, and would be revised into lot 35-R at 0.41 acres. 24 So they did their best to just let's move -- let's just 25 re-angle the lot line so that we're basically the 14 1 same -- almost the exact same acreages as we were before 2 except switched. It's an existing subdivision. The 3 road frontage for each lot doesn't change at all because 4 of the way they're doing this. 5 If you'll look at the exhibit, and I think 6 the main concern or driving issue is that there's a rule 7 or law that says you have to have a half acre in order 8 to have septic. These lots are already on septic, but 9 they're changing the lot line. So one of them is going 10 to -- that is over half an acre is now going to be less 11 than half an acre, and the other one under half an acre 12 is going to be over half an acre. So let you guys 13 discuss it now and see how you want to go. 14 COMMISSIONER BELEW: There's no way to fix 15 this. They just want -- one of them's built on the 16 property line, and they need to move it, and they need 17 to move the property line. It's like cutting your two 18 by four too short, you can't get a board stretcher out. 19 So they got as much land as they've got and just want to 20 settle who owns what part of the fence line. 21 JUDGE POLLARD: Didn't have the boundaries 22 staked, just told somebody to build. 23 COMMISSIONER BELEW: Yeah. 24 COMMISSIONER LETZ: I mean we have had 25 similar situations to this in the past. The issue from 15 1 our subdivision rules comes into that as a half acre 2 minimum, and there is a provision in our rules that says 3 a revision of a lot has to comply with our current 4 rules. This -- it can't any way they do it. It can't. 5 It isn't is in compliance right now under our current 6 rules, wasn't in compliance when they did it originally. 7 It is very -- in my mind very similar to situations when 8 we've taken lots less than three acres or one acre and 9 let them reconfigure and try to fix a problem, or make 10 it the best they can. This is the problem. I think we 11 should waive that requirement and allow them to proceed 12 with the revision as presented. 13 COMMISSIONER BELEW: Yeah. 14 JUDGE POLLARD: Okay. If there's -- I 15 forgot, is there a motion on the floor? 16 COMMISSIONER BELEW: You can make the 17 motion. 18 COMMISSIONER LETZ: I make a motion that we 19 waive the requirement of the revision of plat in this 20 situation waived regarding bringing current compliance 21 on the lot size. 22 COMMISSIONER BELEW: See why I wanted him to 23 do it. 24 COMMISSIONER LETZ: I'm not sure that 25 sounded very good, but -- 16 1 COMMISSIONER BELEW: And I second. 2 JUDGE POLLARD: All right. Moved by 3 Commissioner Precinct 3, seconded by Commissioner 4 Precinct 1 as to item 1.4 on the agenda, just to adjust 5 the common property line between those lots 34 and 35 6 accommodate the building of the structure that was on 7 one of the common property line. Well, it was 8 previously approved. This isn't making the situation 9 worse than it is on a septic system. So this is 10 approval as presented in the agenda package for item 11 1.4. All right, any further comment or discussion? 12 COMMISSIONER LETZ: It's approval of the 13 concept plan; it's not -- you know, there still will be 14 a public hearing. 15 MS. HULETT: Only one of the lots have a 16 septic -- 17 JUDGE POLLARD: Okay. Court approval of the 18 concept plan right now. All right, is that the motion? 19 COMMISSIONER BELEW: What's Tish say? 20 JUDGE POLLARD: Pardon? 21 COMMISSIONER LETZ: Make that comment again, 22 Tish. 23 MS. HULETT: Yes. Only one of the lots have 24 a septic system; the other one has not been installed as 25 yet, pending -- we were pending waiting for the Court's 17 1 decision. 2 COMMISSIONER LETZ: Right. 3 JUDGE POLLARD: All right, are we ready to 4 vote? All right, those in favor of the motion signify 5 by raising your right hands. It's three zero, 6 unanimous. 7 All right, item 1.5 consider, discuss and 8 take appropriate action to authorize the County Judge to 9 execute a contract amendment with Lockwood, Andrews & 10 Newnam, Inc. (LAN) for the easement acquisition services 11 related to East Kerr County/Center Point Wastewater 12 Project, and authorize a Texas Water Development Board 13 budget transfer to fund same. This affects and is 14 located Precincts 2 and 3. Mr. Hastings. 15 MR. HASTINGS: Thank you. The easement 16 acquisition process for the East Kerr County Wastewater 17 Project has had a larger scope than originally 18 anticipated. It resulted in increased expenses. In a 19 good faith effort our easement acquisition consultant 20 LAN, Inc. has prepared an invoice in the amount of 21 $20,000.00 to recuperate their expenses that total 37 22 thousand dollars -- $37,427.50. In addition parcel 12-K 23 in Center Point requires acquisition services from LAN, 24 Inc. above the original scope in the amount of 25 $8,865.00. The Texas Water Development Board project 18 1 number 10366 budget transfer in the amount of $30,000.00 2 from the Contingency to the Easement Acquisition line 3 item under the LF1000495 Funding Source is required to 4 fund the additional services from the easement 5 acquisition consultant. 6 The County Engineer requests that the Court 7 authorize the County Judge to execute a contract 8 amendment with LAN, Inc. in the amount of $28,865.00 and 9 authorize a Texas Water Development Board project #10366 10 budget transfer in the amount of $30,000.00 from the 11 contingency to easement acquisition line item under the 12 LF1000495 funding source to fund the same. This is in 13 Precincts 2 and 3. 14 I have had some discussions with the County 15 Attorney, and I think she has a little better, easier 16 way to do this. 17 MRS. STEBBINS: Yes, Sir. I think we should 18 not necessarily do a contract amendment. There was a 19 process in the original contract that permitted them to 20 submit a change in the work, I guess, and that didn't 21 happen so there was this $20,000.00, I think, was the 22 settlement because the process didn't go the way it had 23 been set out in the contract. This can be done with 24 your approval and probably just a court order today to 25 pay that $20,000.00 instead of the 37 and the change 19 1 that they submitted the invoice for. And when that 2 payment is made that letter can go with it saying it's 3 in full settlement of the invoices, and indicate what 4 those are and when the work was done. 5 COMMISSIONER LETZ: How do we handle the 6 8,865 for the additional services? 7 MRS. STEBBINS: You can approve that 8 additional services request. Isn't what that was 9 called? 10 MR. HASTINGS: Yes. 11 MRS. STEBBINS: That request today. 12 COMMISSIONER LETZ: We can approve both of 13 them. 14 MRS. STEBBINS: Yes, Sir. You can approve 15 both of them and then the transfer in those budget items 16 as requested in the agenda item. 17 COMMISSIONER BELEW: I thought we voted for 18 you and Commissioner Moser to -- 19 COMMISSIONER LETZ: We can do a lot of 20 stuff, but when it comes to moving money and expanding 21 the scope, Commissioner Moser and I feel -- 22 COMMISSIONER BELEW: This is a change of 23 work order I thought. This is expanding the scope? 24 COMMISSIONER LETZ: Yeah. Yeah. And what 25 happens there was -- you know, once we got into the 20 1 actual -- they mainly gave us a not to exceed amount to 2 do all of these acquisitions. And there were some 3 things that were just unforeseen and far more difficult 4 than they could have possibly foreseen, and they did 5 spend more money. You know Charlie's monitored very 6 closely, and they did a very good job, in my opinion, 7 and they are certainly being very reasonable. Their 8 expenses, I think, truly were 37 thousand and change. 9 And they've agreed to accept 20 thousand as payment for 10 that. 11 The other part, the 8,865 that's a very 12 unique situation and become extremely time sensitive. 13 We need to get that cleared up. What has happened is 14 the title work when it came out the gentleman who thinks 15 he owns it, doesn't own it, even though he is adamant 16 that he owns it. It gets into a life estate situation. 17 The heirs -- she had a life estate, but the heirs -- 18 the remainder of that property, some of them have now 19 died, some of them they're scattered. Some are in New 20 Mexico, some of had run-ins with the law and they're 21 hard to reach at the moment. And the solution is to 22 send -- LAN's going to hire someone to find these people 23 and get them signed up for whatever interest they have, 24 and pay them a nominal amount to do so. 25 COMMISSIONER BELEW: Do we have any legal 21 1 fees in this? 2 COMMISSIONER LETZ: No, no legal fees. That 3 amount will cover everything. Though we just need them 4 to get signed off on it. 5 EX-COMMISSIONER BALDWIN: Where do you think 6 I'm going to sit, out in my truck? 7 COMMISSIONER BELEW: Well, you can't sit 8 here. 9 (Laughter.) 10 COMMISSIONER BALDWIN: I found that out. He 11 is bigger than I am. Good to see you. My God, the 12 heavy duties are in here this morning. 13 COMMISSIONER LETZ: Anyway, so both of these 14 are reasonable. I make a motion that we approve 15 $20,000.00 as a change in services. 16 MRS. STEBBINS: The $20,000.00 to settle the 17 invoices submitted for the -- 18 COMMISSIONER LETZ: 37 thousand -- 19 MRS. STEBBINS: Yes, Sir. 20 COMMISSIONER LETZ: I forget the numbers. 21 MR. HASTINGS: $427.50. 22 JUDGE POLLARD: The way this is worded, can 23 we do this strictly as a budget transfer -- 24 MRS. STEBBINS: Yes, we can do that. 25 JUDGE POLLARD: Instead of an amendment to 22 1 the contract? 2 MRS. STEBBINS: Yes, Sir. 3 JUDGE POLLARD: Okay. 4 COMMISSIONER LETZ: Okay. I make a motion 5 that we authorize payment, or authorize to increase in 6 services amendment to the agreement, is that what it is? 7 MRS. STEBBINS: I think that you need three 8 motions. One motion to pay the $20,000.00 in settlement 9 of the invoices submitted. 10 COMMISSIONER LETZ: Okay. I make a motion 11 that we authorize payment of $20,000.00 as payment in 12 full for the invoices that totals $37,427.50 to LAN for 13 right of way acquisition services. 14 MRS. Commissioner Letz. 19 COMMISSIONER LETZ: At our last meeting we 20 approved a Resolution related to submitting the EDAP 21 grant, and I thought we oughta really bring it back to 22 the Court to make it a little bit clearer. We talked 23 about it in general, but there are some additional 24 documents in there, there will be some things we need. 25 Here's a drawing, or a map, that we had 29 1 prepared that kind of shows the phasing a little bit by 2 color code to make it a little bit easy, or to look at. 3 It shows Phase 1, which is under construction right now. 4 Phase 2 has been approved by the Water Development Board 5 and that is pending closing right now. And it was 6 listed as Phase 3, Project 1 and Phase 3, Project 2 will 7 be the applications that are due the 18th of this month 8 at the Water Development Board. 9 There's quite of bit of paperwork that goes 10 in with these applications, including another 11 Resolution. And I believe a lot of this stuff came in 12 late Friday, and I did not -- over the weekend I was out 13 of town, did not have time to look at a lot of it. 14 There are two new Resolutions, is that correct? Did you 15 look at that email? 16 MR. HASTINGS: I hadn't seen it, it was late 17 Friday. 18 COMMISSIONER LETZ: I think the best way to 19 do it, because we do have to get it in this week is to 20 authorize the submission of the Phase 3, Project 1 and 21 Phase 3, Project 2 areas as outlined. I believe those 22 numbers have changed a little bit, have increased. 23 These are both grant applications. I think they're 24 submitted as grant or loan -- or loan forgiveness, that 25 they would come back to us. Hill River 2 Estates, which is at the far end of Skyline. And just 3 for that project, and then those hookups along that 4 area. And then project -- or Phase 3, Project 2 is an 5 area that goes along the JJ Lane and over towards 6 Stoneleigh, in that area only. 7 MR. BALDWIN: Are these two new areas that 8 we're picking up? 9 COMMISSIONER LETZ: No. They are part of 10 the original project. Just due to the funding the way 11 the funding came through these are the last two pieces 12 of the original project. 13 MR. BALDWIN: And you're not expecting me to 14 pay for it? 15 COMMISSIONER LETZ: We hope that the EDAP 16 program's going to pay for it. 17 MR. BALDWIN: Yeah, me too. Okay, that's 18 all. Under court order 11 36656, we have a number of, I guess, rules or guidelines 12 for the customers to hook up to the system. Item 7 of 13 that gave the property owners 90 days to make a 14 decision. We have found that that 90 days is, you know, 15 becoming a problem, and that we'd like to reduce it to 16 45 days because by the time that we need to get the 17 connections done and when we started out in Westwood, 18 you know, which is the first area that we're doing 19 actual hookups right now. It's just taking a little bit 20 longer to get all the documentation we need. And so I 21 think we just shorten the period to 45 days, which is 22 certainly sufficient. Most of the people by far, 23 probably 90 percent of them we're hearing back from that 24 quickly. But it just enables us to move a little bit 25 quicker and move to Center Point where we're going to 33 1 have even a lot larger number of hookups, and make our 2 lives and really our contractor's and subcontractor's 3 lives a little easier. 4 JUDGE POLLARD: Would it help to exclude 5 these? 6 COMMISSIONER LETZ: No. I think it's just a 7 matter that we just -- you know, we haven't had -- I 8 mean very very few people have objected to hooking up. 9 We've had a few people complain about the cost and we 10 have addressed that some. But I think that it's just a 11 matter of trying to get them to make an answer. When 12 they get a letter that says they have 90 days to make a 13 decision they procrastinate, and if we go to 45 days, I 14 think it'll hurry it along a little bit in making a 15 decision. And most of them are making decisions -- 16 JUDGE POLLARD: Is that a motion? 17 COMMISSIONER LETZ: Yeah. It's three zero, unanimous. 4 So this is the one we've been looking for. 5 1.11 consider, discuss and take appropriate action for 6 the Court to approve request to the City of Kerrville 7 for an amendment to the Kerr County Animal Services 8 agreement between the City of Kerrville and Kerr County. 9 Commissioner Letz. 10 COMMISSIONER LETZ: We have talked about 11 this several times. And since I think we talked about 12 this originally in executive session at one point, and 13 we talked to the Court on a number of issues before. 14 Several weeks ago Commissioner Reeves and 15 myself met with the City Manager Mark McDaniel, and he's 16 aware of the gist of this, maybe not the exact items, 17 but he was aware of them. And he had agreed to some and 18 didn't agree with some. He didn't agree with paying any 19 money, but I think he agreed with the rest of items. 20 So, you know, what I want to do today is 21 just kind of go through a little bit of what this is. 22 JUDGE POLLARD: Wait. 23 COMMISSIONER LETZ: I wrote this over the 24 weekend largely about what we've talked about 25 frequently. The term is basically staying the same, but 35 1 it's changed a little bit of the language because of 2 making the amendment, and a little bit of another kind 3 of -- during the first year having another step back and 4 look at it a year from now, or the end of 2019. 5 But the main parts of it are changing 6 paragraph A little i or iii, it's under Animal Control 7 Services A.i. Currently the agreement calls for the 8 County to be on call, or be on duty I guess, twenty-four 9 seven. This provision or paragraph will be modified to 10 be 8 a.m. to 8 p.m. They'll be a 12-hour period. That 11 way people actually on duty. And then they'll be on 12 call after that for emergencies and requests by the 13 Kerrville Police Department. So that's the main change 14 on that one, it's just the time that we actually have 15 officers on the street. 16 And from talking with the City Manager he 17 did not have a problem with this, with the exact hours 18 that I talked about specifically. So I think he was -- 19 the City was okay with this. 20 Item A.ii. under the same section addresses 21 the changing of the operating hours a little bit. As 22 it's written right now the facility will be open from 9 23 to 5 Monday, Wednesday and Friday. 12 to 5 Tuesday and 24 Thursday, and then Tuesday Thursday evenings from 5 to 25 7, and Saturday mornings 9 to 11. There's a lot of 36 1 concerns, complaints from the community that it's 2 difficult to do pet adoptions during this standard work 3 day, so it's expanding the hours for evenings and 4 Saturdays to, you know, offer or provide more 5 flexibility to the public. 6 Later on in this paragraph it does mention 7 that we increased our staff from to five Animal Control 8 Officers right now under the agreement, and that will 9 stay the same. 10 Slight wording change on the next one, which 11 is just minor. 12 Item A.iv. I'll just read this one. County 13 shall manage the reclamation of animals by owners and 14 the adoption of unclaimed animals by the public. To 15 improve community education related to Animal Control 16 Services and animal adoptions, County will increase 17 Animal Control officer staff by an additional staff 18 member. The primary responsibility of this staff person 19 will be coordinating animal adoptions and community 20 education. City of Kerrville agrees to pay $50,000.00 21 annually to help offset the cost of this new ACO 22 position and the additional staff added to increase 23 services to the City of Kerrville. 24 In our meeting the the City Manager was not 25 real fond of this idea, but I think from our standpoint 37 1 and -- you know, the public clearly wants, from what I 2 hear, us to do this, it's gotta be paid for. I mean our 3 increased cost this year over the prior years about 4 $130,000.00. It's hard to compare budget to budget 5 because we changed departments a little bit, but that's 6 a pretty good number. If you add another person on top 7 of that we're approaching from probably 170, $180,000.00 8 that we've increased our budget. The library, which was 9 part of this original agreement, you know -- I'll let 10 them speak for themselves, but I don't think they've 11 increased their budget by that amount, and I think it's 12 fair for them to help offset part of this. There are 13 not requirements under the rabies control as the County, 14 you know, is mandated to operate, but it is something 15 that I think the community clearly wants, so according 16 to the agreement. 17 And then the last item is that the -- and 18 I'll read this one as well. This is addressing the 19 original agreement, but it was just as a if it happened, 20 and this makes it mandatory. County shall create an 21 Animal Services Advisory Board to provide community 22 input for the operations of Kerr County Animal Services 23 Department. This Advisory Board will be approved by 24 Commissioners' Court not later than November 1, 2018. 25 The bylaws of this Advisory Board will be approved by 38 1 Commissioners' Court and the County will accept 2 recommendations from the City as to the bylaws; however, 3 the final draft of the bylaws will be at the sole 4 discretion of the County. The County -- or City will, 5 at its option, appoint one fourth of the members to the 6 Advisory Board. The term of the Advisory Board will be 7 from November 1st, 2018 to September 30th, 2019. The 8 term may be extended by the County. 9 This is something that, you know, I see 10 positives and negatives about this. But I think we -- 11 I think we really want community input, and I think this 12 is the way to do it. The intent of this in my mind is 13 not just a complaining session; we want constructive 14 work done, and working with us. You know, we have to 15 work together to make the improvements out there that a 16 lot of the public seem to want. But I think it's 17 certainly worth trying, and I talked to Commissioner 18 Reeves this morning, and he's in favor of it, so you 19 know, I think it's worth pursuing it, and I think it's a 20 good way to get more community into it. 21 So anyway. These are the -- it's a draft. 22 I think it needs to go to the County Attorney. She got 23 it this morning or yesterday, depending on when she 24 looked at her emails. I think it needs to go to her for 25 possible wordsmithing. I know there's one typo that the 39 1 County Judge found, but I think we need to get this 2 moving. I wanted to get something to the City so it's 3 kind of why I drafted it. And I know the City has a 4 representative here, Miss Meismer. I don't know if she 5 wants to make any comment or not. 6 MS. MEISMER: (Moving head in negative 7 manner.) 8 COMMISSIONER LETZ: That was a quick no. 9 Anyway, so that's kind of what it is. I guess we could 10 either take no action today, or we could approve the 11 concepts of it and authorize it to go to the County 12 Attorney for working with the City to get feedback from 13 the City. Please approach, identify 15 yourself by name and address, Ma'am. Try to limit your 16 comments to three minutes. 17 MS. HANSON: I'm nervous as a cat, so I 18 don't know if I can do that. I live in Mountain Home, 19 and I network with a lot of 501c3's and a lot of animal 20 controls. We ship dogs and cats all over the United 21 States, Oregon, California, Washington. Most have spay 22 and neuter laws, which I truly wish Texas had, because 23 we have too many puppies being born that do not have 24 homes, and that's a big problem. But the other thing is 25 we need people to be hired, and I know of some that 41 1 would be willing to be hired that are ethical and kind, 2 and respect life and value these animals. These animals 3 save our lives. They're our therapy, they're our 4 doctors, they're police dogs. They take care of our 5 safety. I train a lot of VA service dogs. I've seen 6 them safe lives first hand. And we even have one 7 that'll find your lost cell phone, and we all need that. 8 And we have one that counts. I can hold up fingers and 9 he'll count them for you. I travel all over doing a 10 trick dog show to educate children that these animals 11 are very intelligent. We way underestimate them. And 12 they need to be brought up with rules, yes, just like 13 children. And then they make a great -- a good citizen. 14 But I'm just saying our tax dollars go 15 toward this. We are willing to even donate more if it 16 would go to the animals. I don't want my donation that 17 I need to take better care of pets in the shelter to go 18 somewhere else, it just isn't right. I work very hard 19 for that donation money. 20 So that's what I have to say. I just want 21 us to respect life and hire people that do so, and I 22 know for a fact Kerr County's in trouble and they're not 23 treating the animals right, and I can prove it. And 24 even Charity Barnes would help. She's running Kendall 25 County right now, and she also knows firsthand. So 42 1 that's all I have. 2 JUDGE POLLARD: Thank you, Ma'am. The one 9 question that on -- or not really a question, or a 10 statement regarding section A.iv. where we're asking the 11 City for the money. I do hope that if the City denies 12 that, which we know what their current stance is, which 13 is not handing over any, that that does not mean that 14 position for the adoption coordinator will automatically 15 be discarded because you are also adding another ACO 16 officer. So we do hope that that will -- is not a one 17 for one tradeoff, and its other options will be 18 explored. 19 COMMISSIONER LETZ: I'm answer that. The 20 answer is yes. I mean it'll -- and I thought about this 21 a lot, you know, and I don't want it to -- and I'll say 22 this because I don't want it to get out into the media 23 that we're going to throw away the library agreement if 24 City says no here. I think it's the right thing for the 25 City to do. We are spending additional funds, you know, 43 1 compared to what the library cost. So I think, you 2 know, it's the right any to do. If the City says no, I 3 think that we'll look at our alternatives, but I hope 4 that the City does right thing. 5 MS. SANDY: Okay. Yes, come forward. 13 MS. McBRIDE: Hello, my name is Cynthia 14 McBride. I work with Diane at her kennel training dogs 15 and everything. And I just want to say that the County 16 should utilize with the Animal Control, they should 17 really bring in the people on a voluntary basis, you 18 know, to get the people involved. We have a lot of 19 animal lovers, and it wouldn't cost the County anything 20 because I know you're trying to keep cost down. But you 21 know, get more in the county, you know, get people to 22 volunteer. And I realize that the Animal Control is 23 more concerned about rabies than dog lives, you know, I 24 understand that. But as far as the, you know, getting 25 this spay and neuter, and getting people involved and 44 1 just people will -- people will respond. Most people 2 when you say The Pound, oh they kill dogs. You know, 3 they kill dogs because there's too many dogs because you 4 don't spay or neuter your dog. 5 So if we could somehow get people to 6 volunteer, and I know we could do it, because we know 7 plenty of people that could do it, so it wouldn't cost 8 anything. 9 COMMISSIONER LETZ: Thank you. 10 JUDGE POLLARD: Thank you, Ma'am. Anyone 11 else? 12 COMMISSIONER LETZ: Another thing, I'll make 13 a general comment. I think it was the first lady's 14 comment, and I know the people that work out in the 15 Animal Control facility, they are kind people, they do 16 care about animals. They have a really difficult job, 17 and I would -- what they do; I couldn't do. So you 18 know, I do take a little bit of offense giving the 19 indication that they're not caring people, because they 20 do care a great deal. They just have a hard job, and 21 they're given guidelines and rules by the County and by 22 the State, and we have to follow on the rabies control. 23 Unfortunately, we have a very small facility. And you 24 know when it gets full and -- you know, we have to do 25 something, and of course euthanizing is part of it. And 45 1 also I hear a lot of comments about well, we need to 2 contact more people. Changing the agreement to allow 3 our staff to have more flexibility in time will allow 4 them to spend more time trying to -- I see your hand, 5 lady. Allow us more time to reach out. I mean our 6 people work 8 to 5. They're not allowed to work more 7 than a 40 hour -- or not 8 to 5; they work 40 hours a 8 week. They work a 40-hour week, and they're doing the 9 best they can. The agreement created a lot of 10 unforeseen consequences on staffing that we really 11 didn't see. It was kind of set up as a best case 12 scenario. I know this past week we had one of our 13 officers just needed to take break, take a week off, 14 several days off. All of a sudden that just makes it so 15 much more difficult to tighten as our shifts were set 16 up. So I think a lot of these problems will, you know, 17 if we can change the staffing hours and work around this 18 a little bit will help a lot. 19 And as another comment, Reagan here our 20 Director, you know, a couple of comments, because I've 21 talked to him, I talk to Reagan almost daily, I think. 22 I know he's been to Atascosa County this past week. 23 he's been to Kendall County, he's met with their 24 directors, he's talked to them. He's talked with 25 software providers about various programs. You know, we 46 1 get people come to our Court and present that they have 2 a system, and we appreciate that. But at the same time 3 we have to look at -- I say we as being Reagan doing it, 4 and our IT Department. What is the best software 5 program that fits with our computer system. So we're 6 moving forward on a lot of -- it just takes a little bit 7 of time for us to do the full research, and at the same 8 time doing our job as rabies control. 9 And you had a comment? 10 JUDGE POLLARD: Yes, Ma'am. 11 MS. HANSON: All right. There is an episode 12 that happened a couple of weeks ago that I can prove 13 that you guys can improve without increasing hours, work 14 hours, or anything. There was a Plott Hound running 15 across 27. My assistant picked him up, knocked on doors 16 and brought him out to my kennel. That was on a 17 Saturday. On Monday morning, we called Animal Control, 18 she said oh yeah there's a man looking for that dog. 19 And I said oh, well give me his phone number. We don't 20 take phone numbers. That is a big problem. I said well 21 then take my phone number and call him if you have it 22 and don't want to give it to me, and tell him to come 23 get his dog. That's all we want to do is reunite the 24 dog with its owner. Oh, we don't take your phone number 25 either, it has to come through us. And I said I'm in 47 1 Mountain Home, she says well bring him in. I said I'm 2 working. I work a lot of hours training these service 3 dogs, and I don't have time for that. So she sent a 4 guy, a wonderful person named Chris out to pick up the 5 dog. He was a wonderful person, loved dogs. And anyway 6 he took the dog in, and we called later and the guy did 7 come back luckily to Animal Control and pick the dog up. 8 Had that guy not shown up, they didn't have his name, 9 his phone number, nothing. That poor dog would have 10 been probably euthanized. 11 Now, that's what I'm saying. It doesn't 12 take but a second to write down a phone number. 13 JUDGE POLLARD: All right. Thank you, 14 Ma'am. Anybody else? 15 COMMISSIONER BELEW: Well, I have something 16 to say. 17 JUDGE POLLARD: Yes, go ahead. 18 COMMISSIONER BELEW: I don't want us to lose 19 sight of what Animal Control is for. It's for the 20 protection of the citizens. Animals get hit on the 21 road, animals biting people, rabies being spread. It's 22 for the protection of you guys; it's not set up to be a 23 hotel for animals. And I'm as big an animal lover as 24 anybody in the room. But we cannot lose sight of what 25 it's for and what the majority of the taxpayers pay 48 1 their money for, all right? Let's bear that in mind, 2 please. 3 JUDGE POLLARD: And what is mandated by the 4 law. 5 COMMISSIONER BELEW: What is mandated. 6 We're not mandated to make it a hotel; we're mandated to 7 protect the public. 8 JUDGE POLLARD: We can't exceed what the 9 mandate is. 10 MS. HANSON: But our tax dollars pay for it. 11 COMMISSIONER BELEW: Everybody's. Taxpayers 12 pay for it. 13 MS. HANSON: That's right. 14 JUDGE POLLARD: All right, that's it.
