It's now about 9:03 a.m. Kerr County 3 Commissioners' Court is in session. We'll start off 4 with -- who's up today? 5 COMMISSIONER MOSER: I don't know. 6 JUDGE POLLARD: I believe it's you. 7 COMMISSIONER MOSER: I believe it's me. 8 Stand and pray with me if you will, please. 9 (Prayer and Pledge of Allegiance.) 10 JUDGE POLLARD: Okay, this is the part of 11 the agenda where anybody in the public can come forward 12 and speak on some subject that is not on the agenda. If 13 they wish to do so please approach the podium, identify 14 yourself by name and address, and limit your comments to 15 three minutes, please. This has to be on something that 16 is not on the agenda. If you want to speak on something 17 on the agenda you'll wait until that item is called. 18 All right, is anybody wishing to speak at this time on 19 something not on the agenda? 20 Okay, there being none we'll go to the next 21 part of it, which is comments by the Commissioners and 22 County Judge for events or whatever. You got anything, 23 Mr. Moser? 24 COMMISSIONER MOSER: Yeah. Thursday at 7:00 25 we're going to have a town hall meeting in Center Point 7 1 to address a couple things that all related to the sewer 2 system. One is the central sewer system, and the other 3 one at Starlight. And so I think there's a lot of 4 questions being asked so the best thing to do is get the 5 questions on the table and get them answered. So that's 6 all I've got. 7 JUDGE POLLARD: Very good. A lot of heavy 8 equipment showing up along 27 out there now, along the 9 right-of-ways. That has to do with it? 10 COMMISSIONER MOSER: No. That's Highway 27 11 improvement. Well, it's a little bit of both. They're 12 doing both major construction on Highway 27, that's so 13 Commissioner Letz can get into Park East more readily 14 and safely, and then the sewer system. Both. 15 JUDGE POLLARD: All right. I don't have 16 anything. Do you have anything, Mr. Letz? 17 COMMISSIONER LETZ: Yes. And on the Highway 18 27 work, I may recommend people using I-10 if you're 19 heading east because they are down to one lane back and 20 forth, which is really backing up traffic. I'm not sure 21 how much that's going to take place, but a lot of 22 construction going on. 23 But on another note, we lost a member to 24 East Kerr County community last week, I think it was 25 last week. Charles Lewis passed away. And Charles -- 8 1 all the members other than myself on the Court may not 2 remember how he got -- what he was asked to do by the 3 County years ago. But believe it or not in the -- 4 probably close to 20 years ago 911 did not run real 5 smoothly, and it was in chaos, to be putting it mildly. 6 I see the Sheriff nodding his head. And Commissioner 7 Baldwin came to me and said because of political issues 8 we thought we better have someone from the eastern part 9 of the county. Can you come up with someone who's a 10 strong willed, honest tough person to get this whole 11 Board in order. And I thought of Charles who I know 12 lives on Lane Valley. Charles was a former Army 13 Colonel. From there he went to work for the IRS. And I 14 figure with those two qualifications he could straighten 15 out just about anything, and he did. He did a huge 16 service to the County getting that 911 whole system set 17 up and basically where it is now. And after that he 18 went to represent us on the Appraisal District Board. 19 Was there for a number of years, and various -- able to 20 get the new building built for them, and so did a lot of 21 work for the County. And he will be missed. 22 COMMISSIONER MOSER: Yes, he will. 23 JUDGE POLLARD: Anything, Mr. Reeves? 24 COMMISSIONER REEVES: Just to kindly 25 piggyback on Commissioner Moser's prayer. We do need 9 1 the rain, but while we have a burn ban on, I advise 2 everybody to be exceptionally careful just where they 3 pull off a road for some reason, high grass and 4 everything. Those of us that are in the pastures on a 5 daily basis also need to be very careful, it's a tender 6 box. I think they had a small fire out about mile 7 marker 500 this past weekend just on the interstate, and 8 so we just need to be exceptionally careful in whatever 9 we do that's off a paved road that it could lead to 10 danger, and watch out for that. 11 JUDGE POLLARD: Okay, let's go to item 1.1 12 on the agenda, and this is a public hearing for the 13 revision of plat for Lots 3 and 4 of Elm Pass Ranch, 14 volume 3, page 82 of the real property records -- 15 official records of Kerr County, Texas. Good 21 morning, Kelly. 22 MS. HOFFER: Good morning. I feel like 23 every time I come here I'm asking to refill positions. 24 A lot of people leaving. And I've got now two open road 25 maintenance tech positions that I need to fill, and 11 1 these are budgeted positions so there's no impact to the 2 budget. I'm just asking the Court for permission to 3 have Dawn put them on the County web page and try to get 4 them filled. 5 COMMISSIONER MOSER: Kelly, are these 6 retirements, or they -- primarily? 7 MS. HOFFER: Some of them in the past have 8 been retirement. I've had two people left to go and 9 work in the Maintenance Department here for Kerr County, 10 and then I have one that is leaving to go become a 11 fireman for the City of Kerrville. So it's just been 12 various things. And then probably in the next five 13 years, I probably have, I think it's six or seven people 14 that could retire today, so the next five years are 15 going to be tough. I wasn't quite expecting some of the 16 things that have happened here recently. But over the 17 next five to six years we're going to be losing a lot of 18 experienced Road and Bridge people. 19 COMMISSIONER MOSER: The reason I asked 20 because of the job market as it is, I was wondering if 21 you were losing people because of going to different 22 higher paying positions or anything? 23 MS. HOFFER: I think there is a little bit 24 of that. On the maintenance moves, I think just 25 employees wanting to get probably into something that 12 1 was a little less strenuous than the Road and Bridge 2 Department, and especially it doesn't help with it being 3 so hot this year. 4 COMMISSIONER MOSER: Fighting fires is hot. 5 MS. HOFFER: Yeah. So we're hanging in 6 there. But please be patient with us, we are very, very 7 short staffed. 8 But after this morning with what got done 9 with our sealcoat, we were at 30 percent done with our 10 sealcoat. But I think they said they figured is about 11 an additional layer of ten miles so we oughta be at 12 about 38 or 40 percent of our sealcoat left completed, 13 which is good. Because we still have all of August and 14 all of September. So we're hoping that we're going to 15 meet our mark, and our mark is set pretty high. It's 51 16 miles. I don't know if financially we'll have enough to 17 get all of it done, but be the first time to do that 18 much sealcoating in a very long time. 19 COMMISSIONER LETZ: I move for approval of 20 the agenda item. 21 COMMISSIONER REEVES: I second. 22 JUDGE POLLARD: Been moved by Commissioner 23 Precinct 3, seconded by Commissioner Precinct 4 to 24 approve the filling of two open 15 grade road 25 maintenance technician positions in the Road and Bridge 13 1 Department. There being no 10 one, I close the public hearing. 11 We go to item 1.5 consider, discuss and take 12 appropriate action to abandon, vacate and discontinue a 13 portion of Camp Verde Road, situated in Precinct 2. Mr. 14 Hastings. 15 MR. HASTINGS: Thank you. The Kerr County 16 Engineering Department is in receipt of a petition and 17 request for the Court to abandon, vacate and discontinue 18 a portion of Camp Verde Road from the cattle guard 19 immediately west of the intersection of Camp Verde Road 20 with Saw Mill Road for a distance of approximately half 21 a mile to the end of county maintenance. Copies of the 22 petition were posted on May 30th, 2018 at the courthouse 23 and at the beginning and ending parts of Camp Verde Road 24 well in advance of the Transportation Code 20-day 25 posting requirement, and the Affidavit of Posting was 14 1 dated May 31st is attached, it's in your packet. 2 A public hearing has just been held, and the 3 County Engineer requests that the Court approve and take 4 action to abandon, vacate and discontinue a portion of 5 Camp Verde Road. This is in Precinct 2. 6 COMMISSIONER MOSER: This has been a long 7 time in coming forward, and I move that we approve the 8 recommendation by the County Engineer. 9 COMMISSIONER LETZ: Second. 10 JUDGE POLLARD: Been moved by Commissioner 11 Precinct 2, seconded by Commissioner Precinct 3 pursuant 12 to item 1.5 on the agenda, and that is to abandon, 13 vacate and discontinue a portion of Camp Verde Road, 14 situated in Precinct 2. Because 22 the beginning of the abandonment will start at that 23 cattle guard, and the cattle guard is for enough away 24 from the intersection that we'll be able to have a 25 turn-around. 15 1 COMMISSIONER REEVES: We have enough turn 2 around for equipment and emergency vehicles? 3 MR. HASTINGS: It will be similar to a 4 T-Head, so it's not like a cul-de-sac so you can turn 5 around in a circle, but you can pull in and back into 6 Sawmill and then get back out yes, Sir. 7 COMMISSIONER REEVES: Thank you. 8 MR. Commissioner, I 20 didn't know if you want to take it. 21 COMMISSIONER REEVES: Go ahead, and then 22 Mr. Doyle is here if we have any questions on his 23 behalf. 24 MR. HASTINGS: Very good. Just as you read 25 A-1 Transmission is going celebrate their 40th 16 1 anniversary, and it would be very beneficial if a 2 portion of the road, the back half of Gasoline Alley was 3 closed that day to aid in that celebration and make the 4 traffic safe. It's the last about 175 feet of road 5 Gasoline Alley, the last portion. You go in Gasoline 6 Alley off of Highway 27 and get about halfway up that 7 road and then from there on it should be closed for the 8 duration of their event. 9 COMMISSIONER REEVES: I have no problem with 10 this. I visited with the Doyle's, I visited with Mr. 11 Hastings. And I just want to congratulate the Doyle 12 family for 40 years of doing business in Kerrville. I 13 wasn't there 40 years ago getting a truck fixed, but I 14 think it was 38 years ago. So I can attest to at least 15 38 years of them being in business. So congratulations. 16 MR. Item 1.7 consider, discuss and 3 take appropriate action to authorize the County Judge to 4 execute a contract with Voelkel Surveying to perform a 5 land survey of the right of way along Peterson Farm 6 Road. Mr. Hastings. 7 MR. HASTINGS: Thank you. The intersection 8 of Peterson Farm Road and State Highway 27 is not at a 9 90 degree angle; rather it's closer to a 45 degree 10 angle. Roadway intersections should be as close to 90 11 degrees as possible to allow for traffic to negotiate 12 the intersection and have proper sight visibility. In 13 order to realign Peterson Farm Road with State Highway 14 27 the road must be shifted east onto and through 15 property currently owned by James Ernst. Mr. Ernst has 16 agreed to allow this property to be surveyed and staked 17 on the ground before considering dedication to 18 accommodate a proper intersection with State Highway 27, 19 so he has authorized a surveyor to go out there, and the 20 surveyor can actually do everything without getting on 21 his property. 22 The County Engineer requests the Court to 23 authorize the County Judge to execute a contract with 24 Voelkel Surveying in the amount of $1,650.00 to perform 25 a land survey of right of way along Peterson Farm Road, 19 1 this is Precinct 2. And we do have money in Road and 2 Bridge contract fees. That's line item 15-612-553 to 3 cover this. 4 JUDGE POLLARD: Now, is that money dedicated 5 for the -- do you have the money to do the work 6 correcting it, or is it -- 7 MR. HASTINGS: No. At this point this is 8 just to get the survey done. Once the survey's done 9 then we can engineer and figure out everything, total 10 it. 11 JUDGE POLLARD: I notice you used the word 12 after it was surveyed Mr. Ernst will then consider 13 whether or not to dedicate it. 14 MR. HASTINGS: That's correct. He wants to 15 see it staked on the ground before we do anything else. 16 And I need a surveyor really to show me exactly where 17 the right of way is over there. I've done the best of 18 my ability, but I'm not a surveyor, so -- 19 COMMISSIONER MOSER: We need to start with a 20 three-step process here. For background though it's an 21 intersection where related to our Lady of the Hills High 22 School goes in, all the Mooney traffic uses that 23 intersection, and it is -- it's an oblique angle, it's 24 not safe. 25 Then once the survey's done and Jim Ernst 20 1 can decide what he would care to do as far as action in 2 donating or whatever, or purchasing. Next thing is 3 getting the State, TxDOT, to agree to make that change 4 on their part, and third step is to approve it in our 5 budget, which I think we put 71 thousand dollars in the 6 budget for next year for this action as I recall. So I 7 move for approval as recommended by the County Engineer. 8 COMMISSIONER LETZ: Second. 9 JUDGE POLLARD: Been moved by Commissioner 10 Precinct 2, seconded by Commissioner Precinct 3 to 11 approve item 1.7 on the agenda, and that is to authorize 12 the County Judge to execute a contract with Voelkel 13 Surveying to perform a land survey of the right of way 14 along Peterson Farm Road situated in Precinct 2. This is in early 13 June opened RFQ's, and Peter Lewis was the lone company, 14 architect that submitted a proposal. County Attorney 15 has drafted a professional services agreement, which is 16 enclosed. Mr. Hastings. 4 MR. HASTINGS: Thank you. Over the recent 5 years heavy rainfall has caused severe erosion to the 6 Camp Scenic Loop bridge foundation over Fall Branch. In 7 an inspection report issued by TxDot in February of 8 2018, this year, the bridge engineer commented that 9 "Scour below the weir, the dam weir, at the upstream 10 side of the bridge has removed approximately ten feet of 11 shale at the Bent 3 drilled shaft foundation. Remaining 12 embedment of the drilled shafts at Bent 3 is less than a 13 foot. Install concrete spillway below the dam weir to 14 fill the scour hole and protect the bridge foundation." 15 Those were his comments. 16 This bridge feature received a rating of 4, 17 which is poor condition, deterioration significantly 18 affects structural capacity, and the recommendation was 19 "U - Urgent", meaning six months to make the repairs. 20 We received that report in February so we've got through 21 August to get it done. 22 Road and Bridge crews have worked through 23 the summer to place hundreds of yards of large rock and 24 gravel and base material to fill all the voids in the 25 stream channel noted in the report. So they've 24 1 corrected the issue; however, we need a concrete cap 2 over the top or a big storm could wash that away as 3 well. 4 Quotes and estimates were received from two 5 contractors for the labor, forms, steel reinforcement, 6 placement and finishing of the reinforced concrete cap. 7 And the low quote was $29,951.75 from Rojas Concrete 8 Company. Road and Bridge will supply concrete, 9 approximately 120 yards, it's about $13,705.25, and a 10 concrete pumper truck, approximately $2,000.00. The 11 total cost of the concrete rip rap is estimated at 12 approximately $45,657.00. The Road and Bridge 13 Department proposes to use funds from various line items 14 to cover the cost as suggested in the attached spread 15 sheet that y'all have. 16 The proposed construction schedule is for 17 the contractor to set forms and steel beginning Monday 18 July 30, 2018 and place concrete Friday, August 3rd, 19 2018. The following week, the 6th thru the 10th, would 20 serve as an alternate if needed due to weather. We 21 don't anticipate that to be a concern at this time. 22 Closure of the bridge on an as-needed basis is requested 23 during the time from July 30th through August 10th, 24 2018; however, is it is anticipated only to be closed 25 only for one day depending on when concrete is placed 25 1 with the pumper truck. It's all about placing the 2 concrete, and that pumper truck is up there, and there's 3 concrete trucks backing up to refill it and dump and put 4 loads on it. We need the bridge closed on that day. 5 Should only take one day to place all the concrete, but 6 we're asking for that two week window just in case 7 there's any kind of issues. 8 The County Engineer request the Court 9 approve the contract with Rojas Concrete Company in the 10 amount of $29,951.75 for the labor, forms, steel 11 reinforcement, placement and finishing of concrete rip 12 rap over Camp Scenic Road bridge foundation on Fall 13 Branch, and authorize closure of the bridge as needed 14 from July 30th, 2018 to August 10th, 2018 to aid in said 15 construction. Charlie did try to get 6 extensions to fix it so we'd be in another budget year, 7 but we're unable to do it, so they have found funds 8 through various line items, and we will be faced with 9 some amendments to their budget and in upcoming 10 meetings. All the utilities will be along the 2 side so there's not going to be any problems -- we don't 3 anticipate any problems achieving that. It has four windows, 9 one overhead door so they can move any larger equipment 10 in and out, and one swing door. It's a two part 15 process. The first part is just the qualifications and 16 that's what we're asking for today to go forward with 17 that, to receive those. We do 17 not have a dispatching agreement, although we do most of 18 their dispatching after hours in running with all their 19 paperwork, and actually even help them cover some of the 20 calls. So I got to looking at how do we come up with a 21 price on it. And what the agreement would be, and 22 finding some other jurisdictions what most of them do is 23 take a portion of whatever the cost of dispatching is, 24 divide it by the population of the entire County, which 25 gives us a cost per head, and then you multiply that by 52 1 the number of citizens inside the City of Ingram. 2 Because we're not doing it totally it would 3 have been a lot higher if we'd have done that it would 4 have been about 18 thousand instead of 12 thousand, but 5 since we're not doing it 24 hours in most cases, and 6 just helping, I think the $12,000.00, which is a 7 thousand a month is a good agreement to come to. And 8 the agreement has been looked at and redone and approved 9 by the County Attorney. And after this if y'all approve 10 it then I will forward it to the City of Ingram so they 11 can consider it in their budgeting process also. I know 12 that amount has been temporarily put in their budget but 13 their budget is like our's, it's not final approved yet. 14 COMMISSIONER REEVES: And question for the 15 County Attorney. 16 MRS. STEBBINS: Yes. 17 COMMISSIONER REEVES: You feel that an 18 agreement with consideration is necessary because it's 19 two separate entities? 20 MRS. We went with the digital. The ones that 5 were there most of those were all the analog-type 6 cameras. They even tried to get the company that 7 installed them back then to purchase them back, and they 8 said they were of no use to them and had no use for them 9 and did not want those type of cameras anymore. Okay. 10 Most of those cameras, I believe, were actually 11 purchased over the years through the commissary account, 12 so I don't really know what action the County would 13 have, but some of those, I know also could have been 14 purchased through the County budgeting process. So what 15 I'm asking to be done is just to declare them all 16 surplus that way we're covered on both ends, and 17 Lampassas County and Bandera County both still are using 18 those older type of analog cameras, and have come down 19 and looked at them, and they would like to have them. 20 If we could donate them to them and to get 21 them out of the flooring in my office, I think it would 22 be a great way to do it, so there's probably over a 23 hundred of them. 24 COMMISSIONER MOSER: Is there any use in the 25 County, other facilities, maintenance, Road and Bridge? 55 1 SHERIFF HIERHOLZER: No. You have to have 2 the right DVR's and everything, and we're keeping those 3 for out there. What do 9 we have? 10 MRS. LANTZ: Well, overall we had a 2.3 11 percent in our health plan, and 3.3 percent in our 12 dental. And I had some figures that I shared with the 13 Court during budget hearings that the Auditor had 14 prepared several different scenarios. If we leave it 15 the same and have no cost it will be an additional 16 $63,000.00 added to the budget. If we do increase the 17 dependent coverages we can alleviate some of the cost 18 depending how you would like to do that. 19 COMMISSIONER MOSER: Do we need to approve 20 that today, or is that just part of our budget? 21 MRS. We're in the overall pool and that 3 was our rate increase within the pool because depending 4 on what our medical usage was, our prescription usage, 5 then they divide it by certain factors, that's what 6 gives us our rate, increase or non increase. So overall 7 I believe there was 6.5 percent increase overall for the 8 entire pool, so we're pretty lucky we only got a 2.3 9 percent for our medical. 10 COMMISSIONER MOSER: So we have to approve 11 that before July 31st so you can send it back to TAC 12 even though we're still in the process of looking how we 13 fit all this stuff in the budget, is that correct? 14 MS. LANTZ: Yes, Sir. 15 JUDGE POLLARD: The cart before the horse, 16 hu? 17 MRS. LANTZ: And we need to get this out to 18 the employees as well and they have to publish the books 19 for open enroll. So the mix between 14 employee only and employee plus children etc. etc., that 15 can vary and you won't know that until you have the open 16 thing, and then if it changes from the $69,000.00 then 17 we have to figure out where in the budget do we do that. 18 MRS. DOSS: Yes. And it also can change in 19 the middle of the year. If someone leaves a position 20 and they're employee only, and then we add someone else 21 that has family coverage, it's going to change a lot. 22 So that's why I have a contingency -- a payroll 23 contingency line item to where I can transfer from there 24 to use the budgeted amount. 25 COMMISSIONER MOSER: Okay, gotcha. Like to recognize him as a 2 longstanding member of the Historical Commission and a 3 great member of our community. 4 JUDGE POLLARD: Sure was. And a really nice 5 man. 6 COMMISSIONER LETZ: And I know Karen, she 7 said I didn't really know him, and I said well he was 8 one of the nicest people you could ever meet. 9 JUDGE POLLARD: And very honest and 10 competent, and he contributed a lot to the community 11 over the years. 12 Okay, any other comments from reports from 13 elected officials or department heads? 14 SHERIFF HIERHOLZER: (Shakes head no.) 15 JUDGE POLLARD: From Boards, Commissions and 16 Committees. City/County joint projects. 17 Update on East Kerr County/Center Point 18 Wastewater Project? 19 COMMISSIONER LETZ: I'm just glad it's 20 moving mostly out of my precinct into Precinct 2. 21 COMMISSIONER MOSER: Town Hall Meeting. 22 Town Hall meeting Thursday evening. I think the thing 23 is 9 hundred properties, we're tracking every single 24 property in there, what the status is on application 25 moving forward. It's a day-to-day thing. It's -- it's 68 1 a big deal, I'll tell you, but it's moving well. 2 COMMISSIONER LETZ: It's moving well. And 3 actually to show how well it's actually moving in 4 Westwood, which is a big -- the first big subdivision 5 that's been tackled, 150 or so. There's only one 6 property owner that has to hook up that is 7 procrastinating. I don't think -- I won't say that he's 8 not going to, he just won't say he is going to, and I 9 think he will. And there's quite a few that are over -- 10 actually, there's a bunch that are over the minimum one 11 acre that are hooking up as well. 12 COMMISSIONER MOSER: Right. And paying 13 contributing significantly to the connecting to the 14 system. So that's good. 15 JUDGE POLLARD: That's been a massive 16 project. I mean it's unbelievable it's coming to a 17 close here. 18 COMMISSIONER LETZ: I know. Another year or 19 so. 20 COMMISSIONER MOSER: I might add that one of 21 the facilities that is not within the area we're looking 22 at is Starlight Recovery Operation Center in Center 23 Point, and part of the discussion on Thursday night is 24 with them, and they're looking at putting in a new sewer 25 system so can they connect to our system. And there's 69 1 some costs associated with it, but they could and that 2 would be really good. It would be good for them in the 3 long run and good for the system, too. So anyway -- 4 JUDGE POLLARD: Okay, with that we'll go 5 into closed session. 6 (Executive Session.) 7 JUDGE POLLARD: All right, we're back in 8 open session, and as to item -- no announcement on 1.26. 9 But item 1.27 of the agenda is acquisition of real 10 estate. I'd like to 12 make a motion to execute a letter of intent to purchase 13 1.72 acres of land, more or less, out of survey 132, 14 abstract 152 in Kerr County, Texas, and authorize County 15 Judge to sign the letter of intent, and submit it to the 16 respective owners, current owners. 17 COMMISSIONER MOSER: Second. 18 JUDGE POLLARD: Been moved by Commissioner 19 Precinct 4, seconded by Commissioner 2 to authorize the 20 execution of letter of intent to purchase 1.72 acres as 21 described by Mr. Reeves in his motion, situated in Kerr 22 County, Texas.
