It's 2 Monday, August the 27th at 9 a.m. The Kerr County 3 Commissioners' Court is in session. We got a long 4 agenda today so we're going to have to move right along. 5 We'll begin today with opening with the prayer and 6 recitation will be by Mr. Letz. 7 (Prayer and Pledge of Allegiance.) 8 JUDGE POLLARD: This is the part of the 9 regular agenda where the public can come forward and 10 speak. It has to be on something that is not on the 11 agenda. This is the part where you want to speak on 12 something not on the agenda, come forward now, identify 13 yourself by name, address and approach the podium and 14 try to limit your comments to three minutes, please. I 15 have a request to speak publicly, but it's on item 1.15 16 by Mrs. Mitchell, so she waits until then. Is there 17 anyone else wishing to speak on this part not on the 18 agenda. Anyone? 19 There being no one, we next go to the 20 Commissioners comments. We'll start with Mr. Belew. 21 COMMISSIONER BELEW: Well, nope, don't have 22 anything to report. I subjected one of my grandchildren 23 to mutton busting this weekend, and I think I cured him 24 permanently. Out at Crider's, so out in Precinct 4. We 25 spent a little money out in Precinct 4. 7 1 COMMISSIONER REEVES: I'm glad you did. 2 Always appreciate it. 3 COMMISSIONER BELEW: That's all I got. 4 COMMISSIONER MOSER: Just real quickly on 5 the East Kerr County/Center Point Wastewater System, we 6 should have stuff flowing within a couple of weeks, 7 flowing down to Comfort, and lines are being installed 8 in Center Point. So anyway things are moving quickly. 9 JUDGE POLLARD: That's a momentous occasion. 10 A culmination of a long project. 11 COMMISSIONER MOSER: And Bill Williams and 12 Jonathan Letz started this thing ten years ago or so. 13 COMMISSIONER LETZ: Mostly Bill Williams. 14 JUDGE POLLARD: All right. I have nothing. 15 Go ahead, Mr. Letz. 16 COMMISSIONER LETZ: Two comments. One, I 17 put the burn ban on back in my Precinct. I think it may 18 still be off in a few, but it's got to the point where 19 we need it back on in Precinct 3, probably should have 20 been a week ago, but today's better. 21 And the item is I think there was a 22 communication in the past about the City of Kerrville is 23 going to put on their agenda tomorrow our agreement with 24 the Animal Services. After a couple meetings with Mark 25 McDaniel last week, that's been postponed until early 8 1 September. So we will address it at our meeting and 2 they'll address it the following day. It's not a big 3 issue. The issue was inconsistency between the City 4 ordinance and County rules, and I'm proposing to make 5 two changes to our County rules that will solve the 6 problem rather than trying to get really into a whole 7 lot of details. So we're in agreement to what we're 8 doing; we're just not quite there yet. That's it. 9 JUDGE POLLARD: Mr. Reeves. 10 COMMISSIONER REEVES: As far as follow-up on 11 the burn ban, I will be contacting the Chiefs out in the 12 west part of the County this morning and get their 13 opinion and see what the conditions are, and how they 14 feel about it, so I may be putting mine back on. When we were there in the 24 primary and in the run-off back in May they only have 18 25 chairs that are available for us to use. And I feel 10 1 like since the November election will be so big and 2 busy, and that because I have Kerrville ISD Bond 3 Election, Harper ISD Trustee Election, and then the 4 General that I'm going to need at least 20 more chairs. 5 And I was wondering if we can get them from the Hill 6 Country Youth Event Center. I spoke to Jake and they 7 said they don't normally let their chairs out, but that 8 I can come to Court and ask y'all what I could do. 9 COMMISSIONER REEVES: You need 20 like 10 folding chairs? 11 MS. ALFORD: Yes, folding chairs. 20 12 folding chairs for the voters to sit in at the tables. 13 COMMISSIONER REEVES: Is it okay if we use 14 them for a county event, Jake? 15 MR. WILLIAMSON: It's fine by me, Sir. It's 16 just I just need to know if county property is through 17 all county. 18 COMMISSIONER REEVES: In this instance it's 19 needed to help with the election. There being no one, I declare the public hearing 4 closed. 5 We go to item 1.4 consider, discuss and take 6 appropriate action on a request to abandon, vacate and 7 discontinue a portion of Higbee Road, and accept 8 additional of right of way for turn around on same. 9 Situated in Precinct 4. Charlie. 10 MR. HASTINGS: Thank you. The Kerr County 11 Engineering Department is in receipt of a petition to 12 vacate, abandon and discontinue a portion of Higbee 13 Road. The petition was posted on Friday, June 15th, 14 2018. Please see the attached petition in the packet. 15 A site visit was made by Commissioner Precinct 4, 16 Engineering Department and Road and Bridge personnel to 17 review the request and it was determined that additional 18 right of way is necessary in exchange for right of way 19 that is being abandoned to allow adequate space for 20 vehicles to turn around. The requester had their 21 surveyor develop a metes and bounds description dated 22 July 31st, 2018. It's in your packet and it's entitled 23 Metes and Bounds Description, Higbee Road Extension 24 0.123 acres. 25 The County Engineer requests the Court 13 1 consider, discuss and take appropriate action on a 2 request to abandon, vacate and discontinue a portion of 3 Higbee Road. We just had the public hearing, and if 4 approved to accept the additional right of way for a 5 turn around on the same. Precinct 4. 6 COMMISSIONER REEVES: I'd like to say on 7 this -- and I believe Kelly and Charlie are both in 8 agreement. This portion of the road is not closing at 9 all, but this portion of the road only serves, in my 10 understanding, one property owner, and that's the owner 11 whose -- the road goes through his ranch. He's 12 requested to have it closed, and I see it's a very 13 workable way to handle this. We won't have to be 14 maintaining a road that gets very little traffic on it 15 at any other time. 16 Mr. Hastings, it does not affect anybody 17 else using that road -- 18 MR. HASTINGS: It does not. 19 COMMISSIONER REEVES: -- to your knowledge? 20 I see Mr. Clack is here who represent the Petitioner. Item 1.5 consider, 24 discuss and take appropriate action for the Court to 25 release a one-year road maintenance financial guarantee 16 1 to the developer of Harper Estates for Jenna Lane in 2 accordance with the Kerr County Subdivision Regulations, 3 and accept Jenna Lane for county maintenance effective 4 August 28, 2018. This is situated in Precinct 4. Mr. 5 Hastings. 6 MR. HASTINGS: Thank you. Owners/developers 7 J&DMC Management LLC previously submitted a final plat 8 for Harper Estates, and proposed 12 lot 64.64 acre 9 subdivision off of KC 476 in Precinct 4. The Court 10 approved the final plat on August 28, 2017, Court Order 11 No. 36285. In order to file the final plat, the owner 12 submitted a financial guarantee in the amount of 13 $7,500.00 to cover the cost of the cattle guard. On 14 October the 3rd, 2017 pictures were taken of the 15 completed cattle guard installation, and approved by the 16 County Engineer Hastings and Road & Bridge crew leader 17 Sims. 18 Approval of the final plat also began the 19 one-year maintenance period for the road Jenna Lane. 20 Cash in the amount of $9,000.00 was submitted as a 21 financial guarantee for the one-year maintenance period 22 required for the road. The one-year maintenance period 23 ends tomorrow, August 28, 2018 and the road has been 24 inspected by the County Engineer and determined it is 25 ready for county maintenance to commence effective 17 1 August 28th, 2018. 2 The County Engineer requests the Court 3 release a one-year road maintenance financial guarantee 4 in the amount of $9,000.00 to the developer of Harper 5 Estates for Jenna Lane in accordance with Kerr County 6 Subdivision Regulations, and accept Jenna Lane for 7 County maintenance effective August 28th, 2018, Precinct 8 4. 9 COMMISSIONER REEVES: Mr. Hastings, just 10 once again, you feel the road is satisfactory and meets 11 the standards? 12 MR. Mr. Hastings. 9 MR. HASTINGS: At the March 12, 2018 10 Commissioners' Court meeting the presentation was made 11 by the County Engineer that a local developer, Douglas 12 McRae was in the process of subdividing and selling 13 large tracts of land along Spur 100 in the Twin Springs 14 Subdivision area. The tracts were so large that the 15 subdivision was exempt from the planning process. The 16 new property owners were not interested in owning the 17 portions of the tracts that have Spur 100, a County 18 maintained road, running through them. This left a 19 remainder of the larger tracts that forms the Spur 100 20 right of way, and Mr. McRae wishes to donate this right 21 of way to Kerr County subject to Kerr County paying for 22 the survey. The Court authorized Voelkel Surveying to 23 prepare the survey, and Voelkel has been paid. 24 The County Engineer requests the Court to 25 accept 6.05 acres of right of way for Spur 100 Road from 19 1 Douglas McRae, Precinct 2. 2 COMMISSIONER MOSER: I move that we accept 3 the offer from Doug McRae for the 6.05 acres right of 4 way for Spur 100 Road that is discussed by the County 5 Engineer and is surveyed by -- in the handout, in the 6 package. 7 COMMISSIONER LETZ: Second. 8 JUDGE POLLARD: Been moved by Commissioner 9 Precinct 2, seconded by Commissioner Precinct 3. Rusty Hierholzer. 25 SHERIFF HIERHOLZER: This is the -- you did 20 1 two agreements last time with SAVNS, which is part of 2 the Attorney General's Office. Now, this is the company 3 that actually supplies the computer and does everything, 4 okay. We do not pay for this ourselves; it's paid 5 directly through -- it's passed through the AG's Office, 6 it doesn't cost Kerr County. It has been looked at by 7 the County Attorney, and I did notice that the only 8 thing you added in there, Heather, was in the indemnity 9 part, and to the extent permitted by law. I don't know 10 whether or not they'll accept it that way. It's the 11 same agreement that's been -- 12 MRS. STEBBINS: I sent you an email 13 following that and said disregard my recommended changes 14 because I don't know if they'll accept it either. 15 SHERIFF HIERHOLZER: Yeah, it's been the 16 same agreement that's been done for years and years, the 17 same exact thing. And it's just a good way for victims 18 to find out about suspects, and follow them through the 19 court system and through the prison system. Dawn. 23 MRS. LANTZ: Good morning. These are just 24 some items that I'd like to surplus. There's some 25 departments that have already requested some of the 24 1 items. And I was contacted by 216th D.A., one of the 2 items was not listed. There's a storage cabinet, a tall 3 black with two front doors. My understanding is there 4 was two cabinets in that office, Indigent Services, and 5 one was repurposed to the Constable 3's office, which 6 left an extra one, which I think was grant funded, so 7 the one that I have is already being used by the 8 Constable, so the one I have on my list is actually 9 grant funded so that needs to stay with that current 10 office. So everything else that I have is to be 11 repurposed. 12 COMMISSIONER BELEW: And the grant is up, 13 right? So how does that work with real property that's 14 actual physical property? 15 MRS. LANTZ: That, I don't know. That would 16 have to be the Auditor with that grant money -- 17 COMMISSIONER BELEW: Have we done that 18 before, Brenda? 19 MRS. DOSS: We have to get their approval to 20 dispose of it. 21 JUDGE POLLARD: I would ask the the County 22 Attorney, are we really declaring that surplus or we 23 just transferring that from one department to the other. 24 It's still owned by the County. 25 MRS. STEBBINS: I think we start out with 25 1 finding the people who have given us the grant what 2 steps to take next. 3 MRS. DOSS: I'll contact them. 4 MRS. LANTZ: I think the 216th and the 198th 5 are able to keep that cabinet for whatever purposes they 6 need for that position, I think they're requesting that. 7 So if that's possible. 8 SHERIFF HIERHOLZER: They are supposed to 9 get ahold of Dawn today and come over and look in that 10 office and see what else is in there, because they would 11 like to be able to get anything they can out of that 12 office for the next Crime Victims Coordinator to be 13 moved out there to the office they're going to have out 14 there. 15 COMMISSIONER BELEW: That's the purpose, 16 that's why they want it. 17 MRS. HASTINGS: Thank you. 17 COMMISSIONER MOSER: Let me introduce 18 something on this subject. This is property that the 19 County owns. There's a small building on the property 20 that I think was president there, and Commissioner Letz 21 probably knows about this more than I do. I think Bill 22 Williams put it there so he could have a local office in 23 Center Point. It's never been used -- I walked in it 24 one time in five years. I checked with Kelly -- this is 25 to whether or not we want to hook up to sewer, which 31 1 will cost us $55.00 a month to do that, and probably 2 $4,000.00 or so to have the line run. It won't cost us 3 that, but grants will cover that. So the question is 4 whether or not we want to commit those funds out of the 5 grant and those funds every month to pay for this. I 6 don't think that building is used. I don't use it. I 7 checked with Road & Bridge, they -- some of the staff 8 use the restroom out there on occasion, but we have a 9 porta potty about a block or two away at the park. I 10 checked with the Constable of Precinct 2, and he doesn't 11 have any need for it. So I think before we commit to do 12 that, we oughta look at whether or not we even want to 13 keep that building, or surplus it, or trade it to 14 somebody for something, but it's not used for anything. 15 And I can't see, you know, obligating additional funds 16 to do that. Plus there's electricity and probably a 17 telephone out there that we can save some funds on. So 18 I guess with that, it's -- I don't know what 19 Commissioner Letz has. 20 COMMISSIONER LETZ: My only comment is Road 21 and Bridge, if Road and Bridge uses it. They do use 22 that facility quite a bit for storing equipment. 23 COMMISSIONER MOSER: The property. 24 COMMISSIONER LETZ: The property. Whether 25 they use the building or not, I don't know. You know, 32 1 from a -- that's the main thing. If they need it I 2 think we need to hook it up and pay. I don't know if we 3 need a phone out there. I think the phone could be 4 discontinued because everybody uses cell phones. 5 JUDGE POLLARD: What do you think, Kelly? 6 MS. HOFFER: Really it's up to the Court. 7 I know I had spoke to them this morning at our Monday 8 meeting, and they do on occasion use the bathroom there, 9 and they have used the building. They don't use the 10 phone. But I mean I wouldn't say it's a daily thing, 11 but they have used it ever since Bill Williams, he used 12 it, and he stopped using it, and then one of the 13 Constables used it for a brief period of time, and then 14 it stopped being used. So whatever direction the Court 15 wants to go, it's workable with us. 16 COMMISSIONER BELEW: I have a question of 17 our appraiser here. What does it do for the value of 18 the property, does it make a more valuable piece of 19 property if it already has all that hooked up? 20 COMMISSIONER REEVES: If we were to -- 21 COMMISSIONER BELEW: Try to sell it. 22 COMMISSIONER REEVES: Subsequently just sell 23 the real estate? I didn't know that's what we were 24 talking about. 25 COMMISSIONER BELEW: No. I'm just talking 33 1 about down the road. 2 COMMISSIONER REEVES: Well, naturally if we 3 have real property that has all utilities connected to 4 it, it will be more attractive than if we do not. 5 COMMISSIONER MOSER: See on that subject 6 even though that's not an item, the building is way at 7 the back side of the property, it's far away from the 8 road as you can get. And the sewer system we'll have a 9 stub-out there, so it'll have -- 10 COMMISSIONER BELEW: It'll have it anyway. 11 COMMISSIONER MOSER: It'll have sewer 12 available to the property. And electricity is there, 13 water's there, everything is there. So I was just 14 concerned about at this time committing, you know, the 15 County to paying the -- 16 COMMISSIONER BELEW: Well, wait a minute. 17 COMMISSIONER MOSER: Let me finish. Having 18 that sewer line all the way to the back of the property 19 which is probably going to cost several thousand dollars 20 out of the grant; won't cost the county that. It's not 21 a location where you put a building on this property 22 probably anyway. So question is do we commit to having 23 sewer service to that building where it's located. And 24 so I think -- I'm not in favor of that. 25 COMMISSIONER LETZ: I think the benefit what 34 1 we should do at a minimum is use the grant funds to 2 demolish the septic system. 3 COMMISSIONER MOSER: I agree with that. 4 COMMISSIONER LETZ: Because that would be a 5 cost to the County to do that down the road. And the 6 other thing -- I mean, if it's paid by grant funds could 7 you not under our agreement hook the sewer up and then 8 put it as inactive, so we don't pay the bill. 9 COMMISSIONER BELEW: See that's what I'm 10 thinking about, making the property more attractive and 11 if the Court decides to sell it at some point, as long 12 as the grant is paying for it. 13 COMMISSIONER MOSER: It doesn't make it more 14 attractive, look at the layout. 15 COMMISSIONER BELEW: I understand what you 16 are talking about, how far back you take it. But having 17 as much available there for somebody to -- whether 18 they're going to build or I use it for whatever purpose. 19 COMMISSIONER MOSER: It's going to be right 20 there at the property line. 21 COMMISSIONER LETZ: And I think the other 22 side of it if we were to get rid of the property they 23 would demolish the building, and the lines so they'd run 24 a new line anyway. So as long as we get the tank 25 demolished, that's fine. 35 1 COMMISSIONER MOSER: Okay, so with that -- 2 COMMISSIONER LETZ: But we still need the 3 documents for them to go on property, it's the right of 4 entry and the easement. Mr. Reeves. 24 COMMISSIONER REEVES: Yes, Sir. A little 25 background on this, a couple weeks ago myself and 38 1 Commissioner Moser had a visit with four representatives 2 from various veterans offices here in the County. And 3 they were talking how they would like to be involved and 4 to help the County better serve those who've served our 5 country through our Veterans Service Office, and they 6 asked to look into forming a committee. And with the 7 help of the internet, I notice that Hayes has set up 8 similar one to this. I'm sure there's other ones, but 9 that was close. What the purpose of the committee would 10 be is to prepare and submit suggested goals and 11 recommendations to the Commissioners' Court regarding 12 the operation of the service office. And it would 13 include current programs of Kerr County, assessing 14 additional needs and demands from our county veteran 15 community. Some of their responsibilities and tasks 16 would be categorize by current services, services to be 17 provided, ongoing evaluation of services and the growth 18 in the future. I would suggest that the committee be 19 comprised of not less than four members nor more than 20 six members of recognized veterans organizations in Kerr 21 County, and then one of the Liaisons from the 22 Commissioners' Court. And I would ask the committee to 23 appoint -- or report on a quarterly basis. I understand 24 that this would be probably subject to open meetings 25 laws and everything like that, and I think everybody 39 1 respects that. We'd certainly need the help of the 2 County Attorney's Office outlining the goals and what we 3 can and cannot do. 4 With that said, I would like to accept -- 5 the Court to accept letters from potential members for 6 this committee until 5 p.m. September 8th of this year 7 at which time at the following meeting we would make our 8 selections if it was deemed appropriate. And therefore 9 I make a motion to approve the establishment of a Kerr 10 County Veterans Services Advisory Committee as I've 11 outlined and to accept letters of interest from 12 potential members. 13 COMMISSIONER MOSER: And I'll second that. 14 JUDGE POLLARD: Moved by Commissioner 15 Precinct 4, seconded by Commissioner Precinct 2 pursuant 16 to item 1.29 of the agenda package, and that is to 17 establish an advisory committee for the Veterans Service 18 Office with all the details discussed by Commissioner 19 Reeves. Sometimes it's best if 2 it's approved just to be quiet. 3 MR. WARREN: Good morning, Commissioners. 4 My name is Byron Warren, I live at 2944 Dry Hollow Dr., 5 Kerrville. I'm Commander of Military Order of Purple 6 Hearts, and also a member of the Hill Country Veterans 7 Counsel. Not to take any of your time on this issue, we 8 are very interested enhancing the services and 9 opportunity to our county of veterans, and to enhance 10 the Veterans Office -- Veterans Assistance Office in 11 doing that job, and also to the Commissioners. We don't 12 want to do the job at the county level, and we don't 13 want to cost you any money, so we come with no budget. 14 JUDGE POLLARD: That sounds good. 15 MR. WARREN: But we are very interested in 16 the veterans of Kerr County, which we estimate it's 17 about 13 percent of our total population. So it 18 would -- at your pleasure we would like to advise, and 19 also at times do special jobs as required throughout the 20 county for our county veterans, and for the county. 21 COMMISSIONER REEVES: Thank you. 22 COMMISSIONER MOSER: Thank you very much. 23 COMMISSIONER LETZ: Comment I want to make. 24 I think it's a great idea. I put this on the agenda, we've talked 6 about it before, and I've done some research on this. 7 And one of the things that I found is that there's a 8 provision under the Health and Safety Code for advisory 9 committees. We are not -- and requires many counties to 10 have it, but it starts -- the requirement starts at a 11 population of 75 thousand for a county. Since we're 12 under that, we're not required to have one, but it seems 13 to me that that framework makes a lot of sense to follow 14 that statute voluntarily, and it's kind of what I've 15 done. I think I've handed out to everybody the outline, 16 and I'll read it for members of the Court. 17 And it requires 5 members. The members are 18 mandated by the policy. It's one veterinarian, Director 19 of the Kerr County Animal Services, a Commissioner, a 20 person that is operator of an animal shelter, outside 21 but not including the county facility, and then it would 22 be an RKK representative from the City of Kerrville that 23 they would appoint. It would be a five-member Board. I 24 did what Commissioner Reeves did, I wrote down several 25 points that would be referred then to the County 50 1 Attorney to write the actual bylaws, and what I wrote 2 down. Meet at least quarterly and make written reports 3 to the Commissioners' Court quarterly. Must be a 4 resident of Kerr County, and receive no compensation, 5 will be subject to the open meetings law. And 6 appointments by Commissioners' Court, which would be 7 four, and the City would have one. 8 The advisory committee is advisory to the 9 Commissioners' Court, and does not have operational 10 authority over the Kerr County Animal Services 11 Department. Commissioners' Court may appoint ex officio 12 members. I put that in here because I think depending a 13 little bit on the -- on what the committee comes back. 14 The County Attorney or maybe somebody from the Sheriff's 15 Department may be ex officio members needed to get some 16 expertise in certain areas, and the Commissioners' Court 17 may assign tasks and give recommendations. That's kind 18 of the outline that I put together. And I'll make a 19 motion to direct the County Attorney to prepare bylaws 20 to this effect. 21 COMMISSIONER MOSER: Any timeline? 22 COMMISSIONER LETZ: I'd say hopefully have 23 them at our next meeting, and I didn't put on here like 24 Commissioner Reeves did, but to solicit recommendations 25 for the membership. Your proposed tax rate is a half a 17 cent hundred. Last year, my understanding from the Tax 18 Board that all the properties were reappraised and all 19 the taxes -- the appraisals were higher, and so the 20 taxes were raised at that time. So now you're still 21 asking for another half a penny per hundred even though 22 across the board there wasn't a tax rate increase this 23 year. So I'm wondering why and what that money is going 24 to go toward. 25 COMMISSIONER MOSER: Of all the, you know, 54 1 public hearings we've had on the budget we took into 2 account the increase in property values, and the need by 3 the county, okay, and one of those major needs was a two 4 and a half percent of raise for the employees, okay, as 5 a cost of living adjustment. And then we had other 6 things relative to the new jail, and there were -- I 7 don't know, there were hundreds of items. 8 COMMISSIONER BELEW: Unfunded mandates. 9 MS. MITCHELL: Okay. Is -- 10 COMMISSIONER MOSER: Let me finish to answer 11 your question. Went through all those things, and 12 clearly took into account the increased revenue just 13 because of the increased property values, and with that, 14 that was not sufficient in our judgment, okay, and in 15 establishing the budget to meet the needs of the County, 16 so we increased the -- we had a tax rate increase of one 17 and a half cents; not a half. One and a half cents per 18 hundred. 19 MS. MITCHELL: Well, the paper then -- the 20 paper said it was half a percent, but anyway. Okay, and 21 there was meetings and stuff before, I was not able to 22 make them because they don't put them in the newspaper 23 until the Saturday before the Monday morning meeting. 24 It's really hard for people that work Monday through 25 Friday 8 to 5 to be able to get here with a notice on a 55 1 Saturday morning. So I would implore y'all and maybe 2 that is in keeping with the mandate by law you have to 3 do it, but I would implore y'all to whenever you're 4 going to have those meetings either maybe change your 5 meetings to an evening meeting so the public can attend, 6 or at least put it in a little sooner so the people that 7 work are able to arrange their schedule to be able to 8 get here to ask questions and all that before, you know, 9 you are -- I mean, I know you discuss it, but a lot of 10 the public is not able to get here because of the 11 shortness of the time frame of the notice, and we -- 12 many of us work 8 to 5 Monday through Friday. 13 COMMISSIONER MOSER: That's a good point. 14 It's an interesting process, so I don't know how many 15 budget workshops we had, four or five budget workshops. 16 And the draft budget, Brenda, it's available. 17 MRS. DOSS: It's posted online on our 18 website. 19 COMMISSIONER MOSER: So it's available to 20 you at any time on the website, to go into any line item 21 that you want. I think any member of the Court would be 22 more than happy -- 23 MS. MITCHELL: Right. But we can't -- if we 24 don't know -- you know, if we are not knowing that the 25 meeting, that part of it, is on the agenda, we can't 56 1 come ask you questions. If it is the 9 pleasure of the Court we can continue forward with the 10 process and request an actual cost proposal from that 11 contractor, or your other option is to either reject 12 that and go back to another process, or solicit 13 qualifications again. FALGOUST: So the Civil Rights 5 Resolutions the best practice is -- TDA recommends that 6 they're passed during the grant period, and so these 7 Resolutions probably look extremely familiar, they were 8 passed earlier this year, but since these grants started 9 in April it's recommended that they're passed or 10 readopted. It includes a civil citizen participation 11 plan, section 3 plan, excessive force policy, a limited 12 English proficiency standard plan, which basically 13 requires us to translate documents into Spanish since 14 it's over a five percent population of Spanish speakers 15 in the county, and then -- which is new to include on 16 these Civil Rights Resolutions. Consider 15 discuss and take appropriate action regarding the 2018 16 Veterans Day Parade and the annual expenditures for the 17 County Veterans Service Officer. Maggie Baker, please 18 come forward. Howdy. 19 MS. BAKER: Good morning. Okay, these 20 agenda items are first. The Veterans Day Parade. This 21 is just a reminder about the Veterans Day Parade. This 22 year because of it being on November 10th -- or the 23 11th, I'm sorry, which is a Sunday, and most churches 24 will have a service, we have decided it's going to be 25 Saturday, November 10th at 12 o'clock noon. And then we 69 1 have got a new route that we're trying. Last Veterans 2 Day Parade former Mayor White had suggested about that 3 if she was still the Mayor that we would have it a 4 longer route. And I've met and asked Mayor Blackburn 5 the same question. He got with the Police Department 6 and Streets Department and they thought the new route 7 should start on Water Street and then end up here at the 8 courthouse. And so I've got a copy of the proposed map. 9 The second item is the expenditures for Kerr 10 County from the numbers from the Texas Veterans 11 Commission as well as the other 254 counties. We 12 receive our numbers the following May, and this year we 13 received them in June and will be presenting on August 14 27th, which is today. As you can see -- I think you all 15 have a copy of that, that it showed that our numbers -- 16 I have a copy here. This year our Kerr County 2017 17 numbers, our population of veterans has gone up to 53 -- 18 5355. The total expenditures that come into Kerr County 19 is 77 thousand -- 77,044,000. The compensation and 20 pension that goes directly into our veteran's pockets 21 32,714,000. Education benefits and rehab is 2,087,000. 22 General operating expenses 102,000,000. Insurance and 23 indemnities, and this is insurance that goes to our 24 surviving spouses when our veterans pass, 25 $742,000,000.00. Medical care for our veterans 70 1 41,399,000. Our unique patients, that's the actual 2 patient that goes to the Kerr County VA Hospital, the 3 Medical Center, excuse me. Two million -- or 2,651, and 4 that's the ones that actually go to VA. Okay, and then 5 I have on here Kerr County 2016, which shows we have 6 increased the veteran population from 4771 up to that 7 5355. The total expenditures for 2016 is 72,514,000. 8 With that increase up to 77,044,000. The actual 9 compensation and pension, it went down because just last 10 year we had an approximate a hundred veterans that have 11 passed that were in our VA system who actually have 12 disability or pension claims. And then Kerr County for 13 construction, what that means is renovations to their 14 homes, which that went down. We had no claims coming in 15 for renovation. The education information, this went 16 up. General operating expenses increased. Insurance 17 and indemnities increased. The medical care, that 18 decreased because of a lot of the veterans that were in 19 the healthcare field who have passed, and that dropped 20 from 41,399,000 this year, for 2017, from 36,230,000 in 21 medical care. And then with the actual unique patients 22 the numbers it just shows that we had lost seven 23 veterans into the healthcare field. Now, a lot of it 24 has to do with a lot of our veterans that have passed. 25 We have a lot of new veterans that have come in, but 71 1 some of them either don't want to get into the 2 healthcare field, they have found jobs after they've 3 gone out, and some of them are going to school, which 4 that helps for the education and vocation. And I have 5 helped many, many of our young veterans concerning the 6 40 and 50 year olds that have gone back to school or 7 rehabilitation to where they can get on the job 8 training. 9 And then I had a few other counties that are 10 closest to our county veteran population. And you can 11 see that their numbers, like Rockwall, Hood, Orange, 12 they're all lower than the Kerr County total 13 expenditures including the compensation and pension. 14 Like with Rockwall, 6,024 veterans. Their total 15 expenditures are 46,848,000. And their compensation and 16 pension is only 30,426,000 compared to all of our 17 numbers. Now, the only thing that's a little different 18 is because of the education, and Rockwall has more money 19 paid to the veterans for their education. And that even 20 with the medical care and the unique patients that 21 actually go to see the VA. 22 JUDGE POLLARD: Thank you, Ma'am. 23 COMMISSIONER MOSER: Maggie, a question. On 24 the agenda item it's appropriate action regarding the 25 Veterans Day Parade, which you're suggesting it be at 72 1 noon on November the 10th. The other thing is annual 2 expenditures for the County VSO. Do you have -- are you 3 requesting expenditures for you? 4 MS. BAKER: No. 5 COMMISSIONER MOSER: Well, that's what the 6 agenda item says. 7 COMMISSIONER LETZ: That's what it says. 8 COMMISSIONER MOSER: Okay, you're just 9 reporting on the expenditures associated with the 10 veterans? 11 MS. BAKER: Right. 12 COMMISSIONER LETZ: I have a question. You 13 mentioned changing -- the Mayor wants to change the 14 route to Water Street? 15 MS. BAKER: This was suggested last year, 16 and so -- with Mayor White. And so I've talked to him, 17 I sent him an e-mail. And there was a meeting with the 18 Police Department, and the Streets Department. Now, I 19 have a map -- I'm just going to show you, it's a 20 proposed route. 21 COMMISSIONER LETZ: My question is if you're 22 on Water Street and you get to the courthouse, you have 23 to cross Highway 27. 24 MS. BAKER: Right. 25 COMMISSIONER LETZ: And that is a dangerous 73 1 thing, because we're going to have to stop traffic for 2 the parade. So to me, I'd just be concerned about that. 3 MS. BAKER: Well, they have the Christmas 4 Parade, which does a lot more. And ours last year was 5 just going from the far east intersection of Jefferson 6 and come straight down here to courthouse, and because 7 we have had so many more entries. We started out with 8 just 14 people walking the first year. Well, I wasn't 9 in charge of that one. But the first year that I took 10 over, we had 30 entries. Last year we had 50 entries. 11 And this wasn't just veterans organizations, there are a 12 lot of different medical organizations, businesses, 13 Schreiner University, their entire athletic department, 14 which is over 80 people. 15 COMMISSIONER LETZ: I'm not questioning 16 that. I just want to make sure we're safe. 17 COMMISSIONER REEVES: Yeah, Commissioner -- 18 MS. BAKER: It's not set in stone, and I'll 19 show you this -- 20 COMMISSIONER REEVES: If I may -- 21 MS. BAKER: -- this is a proposed new route. 22 COMMISSIONER REEVES: If I may, it sounds 23 like it's the same streets that are involved with a lot 24 of the other parade days. And Christmas parade will 25 start down some place around G Street, come through, and 74 1 they block it. 2 COMMISSIONER LETZ: They block it off. 3 Okay. 4 COMMISSIONER REEVES: And the fair parades 5 has come both ways, but using the same streets. I think 6 last year, year before, they started up here on Earl 7 Garrett, came down and went down Water Street, and other 8 times it's been a reverse. But it sounds like that this 9 is the route that's most used. I think other than 10 probably homecoming parade, that takes a little bit 11 different route. This is one that's the most used 12 parade route for the City, so I'm trusting our friends 13 across the street to have it where they've got it. 14 COMMISSIONER MOSER: Maggie, another 15 question, on the expense for the parade, is that -- 16 MS. BAKER: There's no expense for the 17 parade. 18 COMMISSIONER MOSER: No expense for the 19 parade. 20 MS. BAKER: No. Everyone gets in free. 21 Anybody can show up and be in the parade, and I 22 announced that on the radio stations and in the 23 newspapers. 24 COMMISSIONER MOSER: Okay, so no expense. 25 MS. BAKER: No. 75 1 COMMISSIONER MOSER: Do people donate funds 2 for the -- 3 MS. BAKER: The past couple of years, no. 4 The very first year we did it there were donations, and 5 those were helped for decorations, and to help get our 6 veterans here. 7 COMMISSIONER MOSER: But in general there's 8 no expense and -- 9 MS. BAKER: There's not even a penny, no, 10 Sir. 11 COMMISSIONER MOSER: -- there's no 12 donations. 13 MS. BAKER: No, Sir. I don't believe we 14 should charge our veterans. 15 COMMISSIONER REEVES: Thank you. 16 MS. BOCCACCIO: Good morning, all. 4 JUDGE POLLARD: How you doing today? 5 MR. BOCCACCIO: I am good. I have to tell 6 you there's no better feeling on a Monday morning than 7 looking in the rearview mirror and leaving the Austin 8 traffic behind as I head to the Hill Country, so quite 9 proud to be here. 10 Anyway, I was just looking on the wall in 11 there, and there's another one of these to add to the 12 collection. This is a Gold Star, folks. And I got two 13 sentences I want to read you. Says Kerr County has 14 earned 2017 Gold Star Safety Award from the Texas 15 Association of Counties Risk Management Pool for its 16 record of excellence and commitment to safety in the 17 work place, as well as for controlling the workers 18 compensation claims. And that's a big one. Only nine 19 Texas counties received the 2017 Gold Star Safety Award. 20 I only issued three in my whole territory, so it's a big 21 achievement. A lot goes out to Road and Bridge, and the 22 Sheriff's Office as well, because I actually looked at 23 claims Friday before I left the office for this year, 24 and looking good. So yeah, like I said it's a pleasure 25 to be here. And -- oh, I do have one quick thing, 78 1 something brand new TAC is offering. I'm now an 2 instructor of National Safety Counsel Defensive Driving 3 School. We offer the six-hour program, and it gives 4 your employees a ten percent discount on their liability 5 insurance for three years. So new program. 6 COMMISSIONER REEVES: I'd like to say one 7 thing. Definitely compliment Road and Bridge, the 8 Sheriff's office, they're the two biggest departments, 9 but it's every other department that we have that we 10 watch out for. And also, right there in front, our HR 11 representative who rides herd on them, and keeps us 12 where our rates are down, which ultimately saves the 13 taxpayers because we control the rates. And with the 14 risk and everything that we're controlling it's a 15 countywide effort. 16 COMMISSIONER MOSER: Certainly is. Thanks. 17 MR. Two things, the airport 17 received a $600,000.00 to build new T-hangars, so 18 they're looking at the ways to do that, when to do it, 19 but there won't be any matching funds until next fiscal 20 year. Won't be in 2019; be in 2020. So in the past the 21 T-hangars return on investment since it's a 90/10 22 matching funds, so ten percent by the County and the 23 City, but return on investment is realized in about two 24 to three years, so it's a good investment. The 25 T-hangars are full. That's the reason there's no 82 1 outside revenue from the County for that, or the City. 2 And the other thing is they're beginning a 3 strategic planning process which will involve all the 4 stakeholders in their long-term change of plans for the 5 airport. That's all I have. 6 JUDGE POLLARD: Anybody else have anything? 7 COMMISSIONER REEVES: Yes, Sir. And this 8 might affect the revenues as they come into the budget. 9 I have not received anything in writing, but the City 10 Administrator for Ingram has indicated verbally that 11 they will not fund the $21,000.00 each year for Animal 12 Services.
