We'll begin today 4 with Commissioner Moser leading us in the Prayer and the 5 Pledge of Allegiance. 6 (The Prayer and The Pledge of Allegiance.) 7 JUDGE POLLARD: All right, this is part of 8 the Commissioners' Court meeting where any member of the 9 public can come forward and talk on something that is 10 not on the agenda today. If we want to talk on 11 something on the agenda you'll wait until that item's 12 called. But at this point if you have something to say 13 about something not on the agenda come forward and 14 identify yourself by name, address and limit your 15 comment to three minutes. Is there anyone? 16 All right. There being no one, we'll go to 17 the next part, which is the Commissioners and County 18 Judge time to recognize achievements, etc. Do you have 19 anything, Mr. Moser? 20 COMMISSIONER MOSER: I do have one thing 21 real quickly. Really nice article in the Community 22 Journal last week highlighting Sammy Berney(phonetic) 23 who's been Center Point -- he's been a member of the 24 First Responders, and I see Dub is here today, since 25 1973. He's been in and out of the area, but he was born 8 1 and raised here. So he's 1 of 18, and just to recognize 2 him for what he has done, and the dedication. He was 3 Fire Chief down there for a long time also. But anyway 4 that's all I have. 5 JUDGE POLLARD: All right. I just have one 6 thing to say. They're trying to lose. I don't have 15 anything. 16 COMMISSIONER REEVES: Judge, you gotta 17 remember son-in-law is in y'alls camp right now, so I 18 kindly gotta feel good about that. 19 On a more serious note, I think -- and maybe 20 the Sheriff or Kelly want to update us out in the west 21 part of the County, pretty good rise. We've seen it 22 before, we'll see it again. I know quite a few roads 23 are closed. I don't know the update on what roads are 24 closed or open, but both Forks of the river, the way I 25 understood it, came down some, but I think North Fork 9 1 was the main one, wasn't it, Sheriff, or Dub ? 2 SHERIFF HIERHOLZER: Yeah, pretty well North 3 Fork was the main thing. We had probably a good 6 to 8 4 feet at Schumacher's over the bridge and Bear Creek. It 5 was back down to about two feet this morning at Bear 6 Creek, but I'm being told right now we're getting quite 7 a bit of rain out that way, so it very well may come 8 back up real quick. It's not going to take very long. 9 But even though some of those roads were open water-wise 10 back down, the issue we have right now with TxDot and 11 Road and Bridge are going to have, you know, the river 12 hasn't washed out in a long time so we're getting a 13 whole lot of debris coming down that river, and that's 14 what people need to wait for those road closed signs to 15 go away before you start trying to cross those things. 16 COMMISSIONER REEVES: And I'd like to stress 17 that, too. And hit on a meeting last night, I was there 18 at the Cade Loop Crossing and the water wasn't over the 19 bridge at that time, but the road was closed, and when 20 you close them there's a safety reason, and cars were 21 going around and crossing, and I'd like especially our 22 friends from the press to stress if there's a road 23 closed sign it's up there for a reason, and -- 24 SHERIFF HIERHOLZER: Until they can look at 25 those bridges with as much as debris as we've got coming 10 1 down them, you don't know what's hung up underneath them 2 and washed out underneath them. And until they can get 3 those bridges looked at and get those road closed signs 4 moved, they need to stay off the bridges, period. 5 COMMISSIONER REEVES: And that's what I want 6 to stress, if there's a sign up there's a reason for it. 7 Thank you, Judge. 8 JUDGE POLLARD: All right, we'll go to item 9 1.1 on the agenda, presentation and recognition of the 10 First Tee/4-H Golf Challenge Team. Carla. 11 MRS. SCHUSTER: Good morning. I'm Carla 12 Schuster, and I am with Juvenile Probation. Every year 13 I bring you my team from the First Tee/4-H Golf 14 Challenge. This year I want to introduce you to the 15 winning team. We won this year. This is Ivy 16 Crite(phonetic), Clavius Hierholzer, and Alex Bennett, 17 which is another member of the team is on the Tivy 18 football team but had practice this morning and he's not 19 here. But these boys, I wanted them to have a chance to 20 show you what they won, and let you see how proud I am 21 of them because they actually won this year, so -- 22 JUDGE POLLARD: Now, what did they actually 23 win? 24 MRS. SCHUSTER: It's a golf tournament, it's 25 a three-person scramble. It's the State 4-H golf 11 1 tournament. 2 JUDGE POLLARD: All right, the State 3 Tournament. 4 MRS. SCHUSTER: Yes, the State Tournament, 5 and it's held at River Hills Golf Club. They get -- 6 allow us to play there on a Monday, they donate that to 7 us. Their golf pros help the kids, they coach the kids. 8 But it's a three-person scramble, and this is done 9 throughout the State, so whatever team from the State 10 4-H club that wants to come they're available to come. 11 They play a 9-hole three-person scramble, best ball. 12 And then they take a -- what was it, probably a 75 13 question test, and who takes tests during the summer? 14 Nobody but the kids I work with. So, and they -- those 15 two scores are added together, and that's how we figure 16 out who wins, because it's not all about the golf; it's 17 about the test, too because it's educational. And they 18 actually listened to me this year about the test, 19 because I said if you really do well on the test that's 20 what'll make a difference, and they did. They really 21 did. 22 But I was so excited about them, I'm so 23 proud of them because they worked so hard, I wanted them 24 to have this opportunity to come before y'all and say 25 look what we did. 12 1 (Applause.) 2 JUDGE POLLARD: Congratulations to you very 3 much. 4 COMMISSIONER LETZ: Congratulations. 5 (Showing trophy.) 6 COMMISSIONER MOSER: Fantastic. This is the first team I've had that had a 13 par out on the golf course. I was at the clubhouse and 14 all of a sudden I heard this squealing going on, and 15 they had a par, so they were so excited about it. 16 JUDGE POLLARD: Which hole was it you got a 17 par on? 18 MRS. SCHUSTER: The one where you had to go 19 up and over. 20 MR. CRITE: We actually had to go over the 21 top of the creek, we had to chip. I think I was using 22 my 7 iron, I had to chip it right over the top, and when 23 I chipped it right over, and Alex had chipped it right 24 over, and we used Alex's best ball, and I knocked it 25 right on in with my putter, and knocked it right on in. 13 1 COMMISSIONER MOSER: Pars are hard at River 2 Hills. 3 MR. CRITE: We figured that out right after 4 that. 5 JUDGE POLLARD: All right, you're going to 6 have your pictures taken now. 7 (Photographs taken.) 8 JUDGE POLLARD: One other thing. Most 9 people don't know that Carla has a son who's a graduate 10 of Schreiner who is one heck of a skeet and sporting 11 clay shooter. I mean he's won several state 12 championships, and even in the world. So she comes from 13 a very athletic family. We're real proud of Cameron 14 Schuster, her son. 15 And we've been talking about you and 16 Cameron. 17 MRS. SCHUSTER: Oh, have you. Cameron just 18 got through with the world shoot, he was four out from 19 high overall. So the high overall was a 448, and 20 Cameron shot a 446, so he was two away. 21 JUDGE POLLARD: That means he missed four 22 targets out of 446 -- that would be 450, yeah. 23 MRS. HASTINGS: Over the recent years heavy 16 rainfall, which is what we're experiencing now, has 17 caused sever road damage to the low water crossing on 18 the 200 block of Honey Creek Road. Quotes and estimates 19 were received from two contractors for the labor, forms, 20 steel reinforcement, placement and finishing of 21 reinforced concrete pavement and drainage rip rap. The 22 low quote was $20,790.00 from Rojas Concrete Company. 23 Road and Bridge line item 15-612-459, flood damage 24 repairs, that's what would be used to pay for this. 25 Road and Bridge will demolish the existing 17 1 concrete pavement, prepare the road base, install a 2 culvert pipe, and supply concrete for the contractor, be 3 approximately 80 yards of concrete, about $10,000.00. 4 That's Road & Bridge line item 15-612-556, 5 concrete/cattle guards. 6 The County Engineer requests the Court 7 approve a contract with Rojas Concrete Company in the 8 amount of $20,790.00 for the labor, forms, steel 9 reinforcement, placement and finishing of concrete 10 pavement and drainage rip rap on Honey Creek Road, 11 Precinct 4. 12 JUDGE POLLARD: And authorize the Road & 13 Bridge to furnish $10,000.00 worth of concrete to the 14 contractor -- 15 MR. One abstention, myself. 9 Item 1.5 consider, discuss and take 10 appropriate action to set a public hearing for 9 a.m. 11 November 26th, 2018 to set 35 mile per hour speed limit 12 for all of Wharton Road and Center Point River Road from 13 State Highway 173 to Sutherland Lane situated in 14 Precinct 2. Mr. Hastings. 15 MR. HASTINGS: Thank you. Court Order 16 Number 36920, dated August 13th, 2018 directed the 17 County Engineer to conduct a detailed study regarding 18 establishing load limits and reducing the speed limit 19 for Center Point River Road, Precinct 2. All studies 20 and data needed to render a decision concerning the use 21 of load limits were presented at the August 13th, 2018 22 Court Meeting. The conditions have not changed and no 23 new information is available; therefore, the required 24 engineering data does not support the use of load limits 25 on Center Point River Road; however, speed limit 19 1 engineering studies were conducted by the County 2 Engineer in August through October of 2018 utilizing 3 standard ball bank indicators for horizontal and 4 vertical curve speed checks, narrow roadway payment 5 width criteria, limited sight visibility due to 6 horizontal and vertical curves, areas of high driveway 7 density, rural residential areas, narrow shoulder 8 widths, and 85th percentile speeds. A summary of the 9 results are listed below, and I'll read them to you. 10 For Center Point River Road from State 11 Highway 173 to Sutherland is approximately two and a 12 half miles in length and has a posted speed limit of 45 13 miles per hour. Speeds appropriate for sections along 14 the route starting at State Highway 173 and traveling 15 east are: 35 miles per hour for six tenths of a mile 16 due to limited sight visibility on horizontal and 17 vertical curves and narrow shoulder widths; 35 miles per 18 hour for four tenths of a mile due to entering and 19 exiting the "Y" intersection with Wharton Road; 45 miles 20 per hour for half a mile due to the flat straight 21 section of the road and the associated long sight 22 visibility, average 85th percentile speed of 45.7 miles 23 per hour, and low driveway density; 35 miles per hour 24 for the remaining one mile to Sutherland Road due to 25 limited sight visibility on horizontal and vertical 20 1 curves as well as heavy pedestrian/recreational aquatic 2 water use of the low water crossing, Brinks Crossing, 3 over the Guadalupe River. Since both ends and the 4 majority of the route are appropriate for a maximum safe 5 speed of 35 miles per hour, the entire road should be 6 limited to 35 miles per hour to accommodate future land 7 development and their associated driveways. 8 For Wharton Road from State Highway 173 to 9 Center Point River Road is approximately two miles in 10 length. It has a posted speed limit of 40 miles per 11 hour. Speeds appropriate for sections of the route 12 starting at State Highway 173 and traveling east are: 13 35 miles per hour for 1.1 miles due to limited sight 14 visibility on horizontal and vertical curves, narrow 15 shoulder widths and areas of high driveway density; 40 16 miles per hour for half a mile due to a flat straight 17 section of the road and the associated long sight 18 visibility, average 85th percentile speed of 42 miles 19 per hour, and low driveway density; 35 miles per hour 20 for the remaining four tenths of a mile due to entering 21 and exiting the "Y" intersection with Center Point River 22 Road and areas of high driveway density. Since both 23 ends of the majority of the route are appropriate for a 24 maximum safe speed limit of 35 miles per hour, the 25 entire road should be limited to 35 miles per hour to 21 1 accommodate future land development and their associated 2 driveways. Similar to Center Point River Road. 3 COMMISSIONER MOSER: I move that -- excuse 4 me. 5 MR. In the August 5 13th, 2018 Commissioners' Court meeting, the Court 6 rejected the request for "No Thru Trucks" for Center 7 Point River Road. On October 2nd, 2018 a new request 8 was made by Rick and Gloria Louk, Jerry and Linda 9 Moore, Doris Tyler, and Al and Sue Dingman. The request 10 is to prohibit commercial truck traffic from using all 11 of Wharton Road and Center Point River Road from State 12 Highway 173 to Sutherland lane. The group was 13 identified as the Center Point River Road Community, and 14 presented the request in a meeting on October 2nd, 2018 15 with the Road and Bridge Administrator, the County 16 Engineer, and Commissioner Precinct 2. The group 17 provided sample ordinances from the City of Burnet, 18 Texas, and the City of Combine, Texas that limited the 19 prohibition to commercial truck traffic and allowed 20 defenses for authorized emergency vehicles, school 21 buses, light trucks, including 1-ton trucks, trucks 22 seeking service or repairs with proof of route, etc. 23 Commissioner Moser requested that an item be 24 placed on the October 9, 2018 Court Agenda to set a 25 public hearing at 9:05 a.m. on November 26, 2018 for 23 1 consideration to prohibit commercial truck traffic from 2 using all of Wharton Road and Center Point River Road 3 from State Highway 173 to Sutherland Lane, Precinct 2. 4 If the Court wishes to set the public hearing, the 5 request should be researched by the County Engineer and 6 County Attorney, and results released on or before the 7 date and time of the public hearing. 8 The County Engineer recommends that the 9 Court consider, discuss and take appropriate action to 10 set a public hearing at 9:05 a.m. November 26th, 2018 11 for consideration to prohibit commercial truck traffic 12 from using all of Wharton Road, and Center Point River 13 Road from State Highway 173 to Sutherland Lane, Precinct 14 2. 15 COMMISSIONER MOSER: So move. 16 COMMISSIONER BELEW: Second. 17 JUDGE POLLARD: Been moved by Commissioner 18 Precinct 2, seconded by Commissioner Precinct 1 -- this 19 all has to do with item 1.6 of the agenda, and that is 20 to set a public hearing at 9:05 a.m. on November 26, 21 2018 for consideration to prohibit commercial truck 22 traffic from using all of Wharton Road, and Center Point 23 River Road from State Highway 173 to Sutherland Lane. 24 All situated in Precinct 2. The public hearing's only going to be 4 to eliminate all truck traffic, and that's not what the 5 County Engineer was talking about recommending. He was 6 talking about a limited for commercial vehicles, so I 7 think we need to have a specific item as exactly how 8 it's going to be worded before we have a public hearing 9 on it. 10 COMMISSIONER BELEW: Well, he said he would 11 have that ready. 12 COMMISSIONER LETZ: But our public hearing 13 is all commercial vehicles; we cannot consider whatever 14 he's going to propose and we'll have to have a second 15 public hearing at that point. 16 MRS. STEBBINS: If I may make a suggestion 17 that the Court schedule either a workshop or an 18 opportunity to really flush this out. The County 19 Engineer, and Kelly and I have met recently, multiple 20 times, about these issues and there are various issues 21 that y'all need to consider. And we'd like an 22 opportunity to present them to you before you make this 23 type of -- 24 COMMISSIONER MOSER: I don't think it needs 25 to be a workshop; it can be done in a Court session or 25 1 in a public hearing. 2 MRS. STEBBINS: I don't think a public 3 hearing is appropriate for that, because of what 4 Commissioner Letz is saying it has to be very specific, 5 and they're several items that we'd like to present to 6 you and discuss that aren't limited to this request for 7 a public hearing. 8 COMMISSIONER MOSER: Well, then I don't 9 necessarily want it to be a workshop; it can be on an 10 agenda, and if we need to be more specific in the public 11 hearing statement, we can do that. I think we're ready 12 to do that; didn't realize we needed to do it. 13 Commercial vehicles are limited by state law of 26,001 14 pound, okay? So this would be a limitation on those 15 vehicles for that, it would fall in that category, and I 16 don't -- and also in consideration is are there 17 alternate routes for vehicles larger than that, okay? 18 So I don't think that we need to do a workshop; I think 19 we can do it as an agenda item, and we can set a public 20 hearing. If we need to be more definitive, we can be 21 more definitive. 22 JUDGE POLLARD: How about a meeting; not a 23 workshop. Just a meeting with Commissioner Moser, 24 County Attorney, and Charlie Hastings and y'all sit down 25 and hash it out, and then put it on the agenda to come 26 1 back and approve it. 2 COMMISSIONER MOSER: We have done that, but 3 we can certainly do that. 4 JUDGE POLLARD: Yeah, but it didn't get 5 hashed out right. 6 MRS. STEBBINS: We've been before the Court 7 now multiple times with the same topic and issues, so I 8 think it needs to be discussed with the entire Court, 9 which is why I suggested a workshop. There are various 10 road issues, sign issues, rules that apply to multiple 11 requests for restrictions on traffic regulations within 12 the County, and it might be very helpful at this time to 13 sit down with all of you and have a workshop about all 14 of these requests that are coming in from each of your 15 precincts. 16 COMMISSIONER BELEW: Is this about setting 17 precedents? 18 MRS. STEBBINS: Nope. This is about 19 educating the Court about what's permitted and the 20 consequences of the decisions you make. 21 COMMISSIONER BELEW: So what is your report 22 then, Charlie? You said you will have something to 23 present that was a consideration of yours, and the 24 County Attorneys. Is that not ready to go now? 25 MR. All right, we'll 2 move on to item 1.7 consider, discuss and take 3 appropriate action to close Flat Rock Park to the public 4 on November 10, 2018 and November 11, 2018 for the 5 purposes of allowing Volunteer Fire Departments to 6 engage in "Moving Big Water Training". Mr. Thomas. 7 MR. THOMAS: Good morning, Judge, 8 Commissioners. First of all we need to change the name 9 of that training from "Moving Big Water", which is 10 actually a name that belongs to a company that runs that 11 and call it "Water Tender Operations". We came before 12 the Court last time and asked for November 11 to shut 13 down, or close to the public, Flat Rock Park and to 14 conduct this training. And we looked at different 15 training dates, and we had an issue with number one with 16 instructor availability, number two with TEEX oversight 17 for moderating the training. So what we did is we've 18 taken a look at Flat Rock Park, and instead of closing 19 the entire park, we have come up with a plan. You 20 should have a map there in front of you. I'll let Tony 21 explain that to you here in just a minute. But the 22 agenda item also says November the 10th, which is 23 Saturday, to shut down the park. We're not asking for 24 November the 10th; we just want November 11 from 8 to 5. 25 So you have a map in front of you that our 29 1 instructor is available that day, as well as our TEEX 2 moderators, so we have a plan to close just a portion of 3 the park and leave the majority of it open to the 4 public. And I'll let Tony explain how that's going to 5 happen. 6 MR. LENARD: Judge, Commissioners, good 7 seeing y'all again. 8 COMMISSIONER MOSER: I thought you retired. 9 MR. LENARD: I failed. So after -- I got 10 the word about closing the park. I just went out and 11 took a look at it, and I really don't think we need to 12 close the park. We want to make sure that we're safe 13 with the trucks around other people, that's what I was 14 really trying to figure out how to do, and I think with 15 some flaggers, and maybe some barricades that we can 16 possibly get. With the draft sight that's the launch, 17 so we'd be drafting water out of there, and do a tender 18 operation to what's called the tender dump sight, it's 19 on that little peninsula over there. And I think as 20 long as we just keep that where the lines are drawn, 21 where it says flag, we'll put some flaggers out. We can 22 keep that main road open to the park, to the Dog Park, 23 and people can still go there, and they can still use 24 the Riverside down there where it says open to the 25 public. And we'll just been mindful of the traffic. 30 1 This is not an emergency, so the trucks will not be -- 2 have zero reasons to have -- we'll probably have lights 3 on just for -- just so they can see them, you know, be 4 seen. But there wouldn't be an emergency response mode, 5 and we would make sure that each driver knew that, 6 they'd have to follow all the state law. Just being 7 very mindful of that two-way traffic, so that was -- now 8 our concern was if we moved it -- now, I'm not sure this 9 morning if that's much of a concern was y'all know we 10 had to get the permit for -- to borrow the water for 30 11 minutes out of the Flat Rock. We're borrowing it for 12 about 30 minutes. We're going to put it back. We were 13 worried after the first of the year maybe the drought, 14 so that's why we were just trying to get the class 15 going. So the drought this morning, I'm not really 16 worried about it after my drive here from the west side 17 of town. It's raining out there. So that's -- you have 18 any questions, any concerns about that map or -- 19 COMMISSIONER MOSER: So, Tony, what you're 20 doing is closing two areas, or proposing to close two 21 areas. One is the boat ramp -- 22 MR. LENARD: Yes, Sir. 23 COMMISSIONER MOSER: -- and the other is the 24 dump sight and the -- 25 MR. LENARD: Yes. 31 1 COMMISSIONER MOSER: -- thing is very rarely 2 ever used. I mean some people fish there. But I mean 3 leaving the rest of the park entirely open just with 4 flags isolating those two areas. 5 MR. LENARD: What I was hoping was maybe we 6 could get some barricades from Road and Bridge for those 7 four locations. And if we need to right at those 8 foreclosures we'll put somebody there in a safety vest 9 just to keep -- 10 COMMISSIONER MOSER: So you want it for 11 November 10th and 11th? 12 MR. THOMAS: Just the 11th. 13 MR. LENARD: I don't think -- on that 10th 14 we'll have classroom, and then we may do some drafting 15 operations, but if we were to do that we definitely 16 would not need -- it would just be a single truck and a 17 group of people, we could blend well with the public. 18 It would not be an issue. 19 COMMISSIONER MOSER: I move that we close 20 portions of Flat Rock Park as delineated in the map as 21 presented by Tony and Dub for Flat Rock Park on November 22 the 11th, and for the purposes of allowing Volunteer 23 Fire Departments to engage in "Big Water Moving 24 Training" and borrowing some water from the -- and 25 Commissioners' Court endorses that, borrowing water from 32 1 the river for that. 2 MR. THOMAS: Well, he sent the -- I sent 15 Brian Alexander all the information, application for the 16 permit and everything from the South Texas Water Master. 17 It's just a matter of him getting the money and the 18 permit sent in, and she said I don't think there's going 19 to be any problem with y'all getting the permit, but the 20 permit is good for a year. A little wet right now, but I'm doing great. 16 Thank you for helping us get this, being able to apply 17 for this grant from AACOG to do this. And we just 18 finished getting our -- calculating our numbers for last 19 year. We served on -- Meals on Wheels, we served 68,581 20 meals last year for the Meals on Wheels program, which 21 averages about 5,715. And then counting, if you want to 22 add on to that, we've served 22,577 meals, congregate 23 meals where people come in and dine in. So that's a 24 significant number. Our numbers are up about four and a 25 half percent on the home delivered meals, and about 35 1 three and a half percent on the congregate meals. So by 2 doing this Resolution helps us to be able to apply for 3 the grant, that we receive some reimbursement. We don't 4 get enough to do it, we have to raise local monies to 5 cover the difference. But this allows us to work with 6 AACOG to get some funding. 7 COMMISSIONER REEVES: I'd just like to say 8 from the time at AACOG, and Judge, you probably heard it 9 as well, when you're there at the Board of Directors 10 meetings, Kerrville's fortunate to have somebody like 11 the Dietert Center running the Meals on Wheels. CASH: Good morning, Judge. Good 16 morning, Commissioners. Thank you for having me. I 17 wanted to bring to your attention that the State 18 Department of Family and Protective Services has -- I've 19 given you some background information, I don't know if 20 you had a chance to look at that. But as a result of a 21 Federal lawsuit the Department of Family and Protective 22 Services is privatizing foster care. And that 23 privatization will be coming to our area in the spring 24 of 2019, and they'll be part of a 27-county community 25 that will need to be self sufficient in providing beds, 37 1 placement, services for children and for parents. That 2 27-county area extends from Gillespie in the north to 3 LaSalle in the south, Val Verde on the west to Jackson 4 on the east. And we're projected to serve about 2500 5 children in that area every year. By contrast we have 6 595 foster care beds in that same area right now. CASA 7 is -- as you know, we provide guardians ad litem for the 8 eyes and ears for the child in the Child Protective 9 Court. We're not as an agency in a position to take 10 that building over; however, we know that there is a 11 significant capacity shortage for children coming into 12 foster care in our community, and we're hopeful that we 13 can work with some community partners to find a way to 14 use the building over there to house children in foster 15 care. I've got a -- BCFS is here behind me today in a 16 show of support, and I've talked to several other 17 agencies in town. We're working to get a meeting 18 together to try to see who -- an agency that might 19 approach to take the building over. If this is 20 something you all could be done. 21 COMMISSIONER LETZ: Which building, the new 22 or the old? 23 MRS. CASH: I think the new one is the one 24 that we were looking at first, yeah. 25 COMMISSIONER LETZ: Yeah. I don't have any 38 1 problem at all with y'all looking at it, but making a 2 commitment at this point to figure out what exactly is 3 involved -- 4 MRS. CASH: I'm not asking for a commitment. 5 COMMISSIONER LETZ: Yeah. We're, you know, 6 trying to find a use for those buildings. I think it'll 7 be on our next agenda. You know, Peter Lewis has done a 8 preliminary look out there, some engineering. And 9 there's not a whole lot of use other than this type of 10 use for the newer building you're talking about. There 11 is potential use for the old building. So I'd say, you 12 know, look at it and come back with a proposal of some 13 sort without spending a whole lot of money. 14 MRS. CASH: Sure, sure. 15 COMMISSIONER LETZ: But you know, we're 16 looking for a use for that building, and we need some 17 kind of proposal, I think. 18 MRS. CASH: Yes, Sir. I wanted to give 19 y'all some information, and also gain some information 20 so we could move forward. But we'll look at the 25 bed 21 building then. We need to get 15 those paychecks run in December versus January because 16 we report health insurance premiums on W2's, and if we 17 do the final check in January, we refund premiums paid 18 in December, and it creates a negative on a W2 for a 19 future year, which we can't do that, IRS doesn't like 20 that. So I'm requesting because now and have a payroll 21 approved prior to distribution. That's the last day 22 that we can process a payroll. 23 COMMISSIONER LETZ: Do you have a specific 24 time? I mean any time on the 31st? 25 MRS. SOLDAN: The later the better, because 40 1 you never know when a termination might occur. 2 JUDGE POLLARD: You want to celebrate New 3 Year's? It's valuable, some of 9 it, for Historical reasons, and some of it's just old. 10 And they're going to sort through it, and try to find a 11 permanent home for it. Judge Pollard and I have talked 12 about it, and Julius Neunhoffer and I've talked to Julie 13 about it in the past. So I'm glad to see that number 31 14 on here is a biscuit warmer, because I don't know what 15 we would have done without that. Anyway -- 16 MRS. LEONARD: I was going to give you a 17 little of what my understanding of how the Historical 18 Commission became in possession of these items. They 19 came from the sale of the Schreiner Mansion to the 20 Cailloux Foundation. Mike Bowlin, Vice Chair of the 21 Kerr County Historical Commission was contacted, in my 22 absence, by Dr. Candice Scott, she's a Schreiner 23 University Librarian and archive curator. About four 24 years ago she said they were cleaning out a storage unit 25 that had many items that belonged to the Schreiner 43 1 family and that were left from the Schreiner Mansion 2 with the museum, and she offered the items to the 3 Historical Commission on the condition they had to be 4 moved immediately. Members rallied with trailers, 5 pickup trucks to rescue significant Kerr County 6 Historical items that they feared would be lost or 7 discarded. Some of the items had been stored at the 8 Turtle Creek School, I think taking up the whole school, 9 and others at member's home storage areas. The 10 Historical Commission, we've been requesting storage 11 space from the County for several years since we don't 12 have the monies, resources to pay for storage. I met 13 with former Commissioner Buster Baldwin several times 14 and former Maintenance Supervisor Tim Bollier was told 15 there was no space available. I believe Judge Pollard 16 and Commissioner Belew were also trying to help us find 17 a solution to store these items. The Board of the Kerr 18 County Historical Commission is asking for your approval 19 to donate these items to the Friends of the Kerr County 20 Historical Commission, a 501(c)(3) organization, and in 21 order for the Kerr County Historical Commission as part 22 of the County Government can be released from the 23 responsibility of storing these items. 24 The Friends group has raised funds for the 25 restoration of the Union Church building in 2000, a 44 1 significant Historical building in Kerrville and Kerr 2 County history. This organization recently improved the 3 Union Church site by adding the fence from the 1886 4 second Kerr County Courthouse. The fence was signed by 5 Julius Neunhoffer surrounding the home behind the garden 6 of memories, and he somehow procured that for us. So a 7 gate also was signed to match the original fence and 8 attached to attractive rock work at the entrance. The 9 Friends also donated material to improve the parking 10 area as a County-owned building. The Friends have a 11 history of preserving our history. Julius Neunhoffer, 12 President of the Friends has prepared a list of items, I 13 think y'all have. And he's been invaluable in 14 collecting, storing and organizing the saving of these 15 items. 16 I hope that you will consider this request. 17 And I feel Julius will be a dedicated steward as he has 18 been for this collection that was a part of the 19 Schreiner family history. 20 And, Julius, you want to -- before Julius 21 speaks, I want to invite all of you to the Kerr County 22 Historical Commission meetings, that's next Monday. Any of the items 18 that were imported, say families moved here from New 19 York, Boston or whatever, and brought something old and 20 dropped it here and said here, have it in the museum. 21 If they're not significant to the area, we feel we 22 oughta liquidate them and use the assets for preserving 23 other things. So in effect, that's what we're looking 24 at futuristically with these items. WILKE: Good morning, Judge, 8 Commissioners. Scott and I are here requesting that the 9 Crime Victim Assistance Coordinator's office remain in 10 the courthouse. First of all, I don't know about Scott, 11 but I know when we, our office, decided to present to 12 the Commissioners the idea of us paying for half of the 13 salary and splitting it with the 198th, we never 14 anticipated that person being in our office. We simply 15 don't have the room. If you go to our office you'll see 16 that we are -- have actually downsized, as you know, and 17 we have absolutely no room. I've been in Scott's 18 office, and he has no room. 19 But in addition when Scott and I were 20 discussing it with Rosa several days ago, we started 21 looking at the pros and cons of having it over at the 22 Sheriff's office, at the Sheriff's Office Annex. And 23 the problem with that is first of all, the space is 24 rather small, and it's in the back of the CID 25 Department. But what we're more concerned about is the 50 1 fact that Defendants who have been indicted for assault 2 family violence, or other violent offenses, are on bond 3 conditions and they have to report to the Probation 4 Department, and we run into probationers constantly over 5 at our office, out in the parking lot, and in the common 6 areas outside of the buildings. So after considering 7 that we also thought that that probably wouldn't be a 8 good idea to have the victims reporting at the same 9 place or the same area as the Defendants who were on 10 bond conditions for assaulting them. And sometimes 11 victims continue to get services from the Crime Victim 12 Assistance Coordinator after the case has been disposed 13 of, so then you have the Defendant on probation for 14 assaultive offenses and the victims who continue to go 15 over to that office. 16 So what we're asking is that that office 17 remain here at the courthouse. It doesn't have to stay 18 in the same area if there's other plans for that area, 19 but if we could keep it in the courthouse that would be 20 very helpful. I think it's also very easy for 21 complainants to find it and get to it here at 22 courthouse. And it's been a great location to have it 23 in a central spot. And another thing about having 24 somebody come to our office, even if we did have the 25 space, is that many times we have officers in there 51 1 discussing cases with us that are very confidential. 2 Anytime we have somebody -- which is rare that we have a 3 member of the public or somebody that's not in law 4 enforcement in our office, we have to shut our doors, 5 and our offices are not completely soundproof, or very 6 soundproof, I should say. But again, any time we have 7 somebody that just drops by, for example a complainant 8 or witness that we're preparing for trial, it's a real 9 problem that we have to talk and whisper and watch what 10 we're saying because we don't want anybody overhearing 11 an officer that's talking to somebody that's willing to 12 work as a confidential informant or an active 13 investigation that they've got going and they're getting 14 our assistance with search warrants. So we're simply 15 asking to be allowed to keep that office here at the 16 courthouse if at all possible. 17 MR. MONROE: Yeah, I agree. 18 COMMISSIONER LETZ: I think the only 19 question I have is one -- you mentioned one of them, I 20 think, we have talked about reorganizing some people and 21 moving some places around so that space may not be 22 available there. I think it's going to be very 23 important though that we now have multiple Victim 24 Service Coordinators, so it needs to be real clear that, 25 you know, that this is only for the DA's. I thought all 52 1 along that it would go into one of y'all's offices or 2 somewhere to a third -- another location. You know at 3 the moment I have no -- I mean it obviously needs to be 4 somewhere and that space is currently available. But 5 long term, I'm not sure it's a great option. This is my 6 personal opinion, because to me we're trying to get this 7 into y'all's area, and it needs to be in y'all's 8 location in my mind. 9 COMMISSIONER REEVES: I tend to agree, 10 though since you want to take it over, you want to fund 11 it out of your budget, I took it that -- and without 12 going in too much, we made an oversight, I think that it 13 should be under where y'all are in your direct offices 14 there,. 15 MR. MONROE: No place for it, Bob. 16 COMMISSIONER REEVES: Well, I'm sorry -- 17 MR. MONROE: I don't know that we ever got 18 into a point where we thought that far down the road 19 about physically where would be the door that opens to 20 go into the Crime Victim Coordinator's office. The 21 problem we're having internally is that it creates 22 conflicts as a matter of law that we don't have any 23 choice, we don't need to discuss them, the courts have 24 already ruled those are conflicts, so we're in an 25 awkward spot. It's one thing to have it under property 53 1 that we somehow control, but our property that we have 2 is y'all's. I mean it doesn't belong to us, it doesn't 3 belong to the 198th; it belongs to the County. So could 4 there be another place to do this? Sure, happy to 5 explore that. We're -- and we recognize that what we'd 6 be asking to do right now is a band-aid really until we 7 can put some thought into how we do this as a practical 8 matter where is a place they could go. 9 We visited with Rusty before. He really 10 doesn't have any area over in, what I would call, the 11 main jail to put any place like that. 12 SHERIFF HIERHOLZER: No. We had actually 13 offered an office over in the annex, but Lucy has the 14 issue she had, and I think the person that's temporarily 15 in there said our offices were too small, so that's all 16 I have to say about the issue. 17 MR. MONROE: So we just didn't want to be on 18 the street corner trying to figure all this stuff out. 19 COMMISSIONER LETZ: How about if we -- stay 20 where it is, obviously there needs to be a location for 21 it, until the end of the year, and come back with a 22 plan, a long-term plan. 23 MR. MONROE: You bet. That's a perfect 24 solution for today is just let's leave everything the 25 way it is, and then let us explore and see what other 54 1 options might be available. I think we're still 2 awaiting to hear officially about the grant which may 3 change things a little bit, depending on how that works, 4 so give us a chance not to do something twice. Okay, so we've added that to all 10 of the agreements we're sending back out now. Commissioner Reeves and I met with the 20 representative, or with the Cailloux Foundation, or part 21 of that with Sandi Cannon and their attorney Mr. David 22 Jackson, and some other staff members. They want to 23 pick up doing courthouse lighting again. They've been 24 the last couple years, there were a few things they were 25 concerned about. We worked and we had a real good 82 1 meeting, I think. Heather has since been in contact 2 with David Jackson working out the agreement a little 3 bit. There were some of the things that we were trying 4 to do. One of the provisions they were concerned about 5 was, you know, we were go to build back maintenance, and 6 they even looked at the generic agreement, and pretty 7 much said no maintenance would be glad to assist as they 8 have in the past. Which I think the only assistance 9 they would be is hanging the wreaths onto this building. 10 They've got the bows that we like to use. They are 11 going to hire or will hire a lighting company that will 12 do all of the installation, to include lights around the 13 perimeter of the building, trees and all that. Some of 14 the items that were in the courthouse square last year 15 they're going to move over to the Plaza across the road. 16 They're trying to make it a little bit of a bigger area, 17 I think. So anyway -- 18 COMMISSIONER BELEW: Across the road? 19 COMMISSIONER LETZ: By the City Hall in the 20 Cailloux Plaza. 21 COMMISSIONER BELEW: In the middle of the 22 art thing, is that what you call the Plaza? 23 COMMISSIONER LETZ: Yeah. 24 COMMISSIONER BELEW: Now, that's County 25 stuff, right? 83 1 COMMISSIONER LETZ: No, no. 2 COMMISSIONER BELEW: What stuff are we 3 talking about? 4 COMMISSIONER REEVES: Some of the stuff that 5 they provided last year -- they, being the Cailloux 6 Foundation, through a private lighting contractor. 7 That's going to be relocated across the street, and 8 they'll be other lighting provided here. 9 COMMISSIONER LETZ: The County does not own 10 any of the lighting stuff. Part of it is owned, but we 11 store -- is owned by the Christmas Lighting Corporation, 12 but they own that. And we talked about that a little 13 bit, because Mr. Eychner was there representing them at 14 this meeting. And a lot of that stuff they think is 15 junk. And they're going to at some point, probably 16 it'll be after the first of the year, they're going to 17 go over and get with Shane and go through what's there. 18 And some of it goes to the dump, some of it may be -- 19 it's up to them to do what they want. 20 JUDGE POLLARD: And this is the stuff that's 21 in the storage over at Maintenance Department? 22 COMMISSIONER LETZ: Yes. And most of 23 that -- I'd say almost none of that, except maybe the 24 Christmas trees, is going to be used this year. And 25 only some of the Christmas trees. 84 1 COMMISSIONER REEVES: And you know junk may 2 be an extreme word. They may can find our uses, other 3 groups that need it. And I don't want it to be 4 misconstrued out there that they aren't appreciative of 5 what they have. But they're going to find additional 6 uses for it. And as you said in a very positive 7 meeting, and I think it'll be very good and it'll be 8 ready for the Christmas lighting parade, which I think 9 is same day as that Household Hazardous Waste. 10 JUDGE POLLARD: Don't want to quote 11 Commissioner Letz. 12 COMMISSIONER LETZ: Some of it is junk, but 13 some of it's very good. 14 (Laughter.) 15 COMMISSIONER BELEW: One person's junk is 16 another person's treasure. Well, I have a concern about 17 that -- 18 JUDGE POLLARD: I can see the headline right 19 now, "Letz says it's junk". 20 COMMISSIONER BELEW: We had a little bit of 21 an issue because the Jewish Community folks wanted to 22 put up a Menorah last year, and they did put it up, but 23 it was an issue. Was that discussed at this meeting? 24 COMMISSIONER LETZ: We did not discuss it, 25 but they do not want to do "control the whole square". 85 1 They really want the front of the courthouse area so 2 it'll be outlined exactly what they do. And other or -- 3 or and/or -- I talked with the County Attorney, certain 4 other things that are used like the Christmas parade, 5 and the lighting, KPUB, to try and get as many of these 6 groups to under the Cailloux thing would be easier from 7 our standpoint, but on some of them we can do them 8 individually as well. But like if they have the front 9 area with the big Christmas tree, which is owned by 10 KPUB -- I think owned by KPUB. KPUB puts it up, I'm not 11 sure who -- maybe the Christmas Lighting Corporation 12 owns that. I'm not sure who owns that tree. 13 But anyway we've asked that those entities 14 kind of work with the Cailloux's to get all that 15 coordinated. The Menorah could either be with that, or 16 it could be right next to it. 17 COMMISSIONER BELEW: I just don't want them 18 to get left out. Hanukkah only falls in the week of the 19 whole Christmas season thing. So they put it up, they 20 take it back down. But they need a place for it. 21 COMMISSIONER LETZ: But Heather can bring 22 that up in her final talks with David Jackson. The 23 agreement will be on our next agenda to approve. I just 24 wanted to give an update to everyone to where we're -- 25 what's going on with the Christmas lighting, but it's 86 1 going to happen. That is part of our discussions. 25 We're going to -- our recommendation will be to rescind 87 1 that previous Court Order, and we've amended the basic 2 control order and come up with some slightly diffeent 3 language. Mark has requested that the City Council 4 approve the agreement first, which is somewhat based 5 after we take action on 1.33. And then go to City 6 Council, and then it'll come back to us, probably two or 7 three weeks, depending on the schedule. Section 2.1.3, which is the Rabies 2 Tag. Delete the words "or cat" from lines 3 and 4. 3 This prevents the cats from having to wear rabies tags. 4 Section 4.1 Restraint, Impoundment, and 5 Disposition of Stray Dogs and Cats. In item 4.1(a) 6 delete the words "or cat". 4.1(b) delete the words "or 7 cat". 4.1(c) delete the words "or cat". And then add 8 the following as 4.1(d) cats shall not be required to be 9 restrained and to not be picked up or be impounded by 10 Kerr County Animal Services personnel. But Kerr County 11 Animal Service personnel may impound cats that may be a 12 danger to the public health, safety or welfare. Cats 13 that are surrendered by owners or trapped by the general 14 public. 15 And then item 4.3, which is Detention and 16 Impoundment Authorized. We're going to replace item 17 4.3(b) with the following language: Each stray or 18 unowned dog or cat shall be impounded for a period of no 19 less than 72 hours, not including days that Facility is 20 not open to the public for business, unless the owner or 21 custodian makes an earlier claim. If there is no room 22 or capacity to impound an animal, as determined by KCAS 23 personnel, then the minimum period of impoundment will 24 be no less than 48 hours, not including days that 25 Facility is not open to the public for business, unless 91 1 the owner or custodian makes an earlier claim. In any 2 case, a reasonable effort shall be made to contact the 3 owner or custodian prior to any disposition of the 4 animal. 5 So it's very -- pretty slight wording 6 changes, but it pretty much gets us in line to what our 7 actual practice is right now. I agree with that. 21 COMMISSIONER LETZ: Judge, I have a couple. 22 One, I've asked both Reagan and Shane to prepare monthly 23 bi-weekly, their preference, reports from their 24 departments. And I think it's just kind of similar to 25 what the airport does. I don't know if y'all have seen 95 1 those. This is the one we got from Reagan. I think 2 it's really helpful, it gives an outline to us as to 3 what each department's doing, and I would encourage all 4 Liaisons to get with their departments and do something 5 pretty simple. It's a -- it doesn't take a lot of time, 6 it shows the whole Court. So this will be distributed 7 to those two departments on a -- probably on, I think, 8 once a month, every two weeks, kind of leave it up to 9 the department. But it's a good idea for us to keep up 10 with what they're doing. 11 And the other thing, I'm not sure exactly 12 who all got it, but we had a fire inspection report of 13 the courthouse, made in August, and we had a number of 14 violations. They were almost all extension cords or 15 exits not working quite right. City/County Joint Projects and Operations 3 Reports. 4 Update on East Kerr County/Center Point 5 Wastewater Project. 6 COMMISSIONER LETZ: A lot of mud. A lot of 7 work. Oh, I will say there is a report on that. The 8 wastewater has started flowing. 9 COMMISSIONER REEVES: Was that intentional? 10 COMMISSIONER LETZ: With that intention. 11 They're actually trying to do the hookups. I'm not sure 12 how much they're getting done in the last couple of 13 days. They're doing connections through Westwood, and 14 there's a certain amount that has to be held in that 15 storage tank on Schladoer Road and Highway 27, and once 16 it goes, the floats will kick off and run into the 17 wastewater plant. 18 JUDGE POLLARD: And everything down in 19 Comfort on the other end is operational? 20 COMMISSIONER LETZ: They're ready, yes. 21 There's still some work being done under the grants that 22 we're doing upgrades, but they have enough capacity to 23 receive. 24 COMMISSIONER REEVES: A long time coming, 25 but I'm sure it's a good feeling, isn't it, 97 1 Commissioner? 2 COMMISSIONER LETZ: Yes, it is. 3 COMMISSIONER REEVES: A lot of hard work 4 like that happen. 5 COMMISSIONER LETZ: And another good thing 6 that's come up, and we've had -- and Charlie was the one 7 who took the lead on this and really got it done, we 8 have agreements, or will have agreements very soon, with 9 both Aqua Texas and Southwest Water Systems, which is a 10 similar to what we have with -- or City of Ingram has 11 with Aqua Texas that if people do not pay their sewer 12 bills they will cut off the water. So it's kind of 13 through an Interlocal Agreement that's to be worked out 14 between us and WCID and both Aqua Texas, and Southwest 15 Water Systems. They've been very cooperative, which has 16 been good to have happen. That's it. 17 JUDGE POLLARD: Okay, all right.
