It's now 10 a.m., and the Kerr County 3 Commissioners' Court is in session. We'll begin today 4 with Commissioner Moser saying the prayer and the Pledge 5 of Allegiance. 6 (Prayer and the Pledge of Allegiance.) 7 JUDGE POLLARD: All right, this is the last 8 Commissioners' Court meeting of the year, and the next 9 part of of the agenda is for visitor input. If there's 10 anybody in the courtroom that wishes to speak on 11 something not on the agenda then please step forward to 12 the podium, identify yourself by name and address, and 13 try to limit your comments to three minutes. Is there 14 anyone wishing to speak on something that is not on the 15 agenda? 16 All right, there being no one, we'll go to 17 the next part of the agenda, which is comments from the 18 Commissioners and/or the County Judge to recognize 19 achievements of persons in their Precinct or to make 20 comments on matters not listed on the regular agenda. 21 We'll start with Commissioner Precinct 1. By the way, 22 let the record reflect that we're unanimous in 23 attendance today, all five of us are here. Please 24 proceed. 25 COMMISSIONER BELEW: Some of us dressed down 4 1 a little bit. 2 JUDGE POLLARD: Pardon? 3 COMMISSIONER BELEW: The short-timer dressed 4 down a little bit today. 5 JUDGE POLLARD: Yeah, you bet. I'm so short 6 you can't see me, man. 7 COMMISSIONER BELEW: He does have on shoes, 8 folks. I checked. 9 They've done a little trenching out by us to 10 allow for a water flow on Upper Turtle Creek Road. 11 Checked on that, that looks really good, and so we're 12 hoping that in the next big rain that we have that will 13 change the water flow for folks that are across the hill 14 and across the Upper Turtle Creek Road. 15 Yesterday being Christmas, I only had eight 16 of the grandchildren there, so it was a quiet day at our 17 house. And so that's all I have to report. Thankful 18 for the rain. 19 COMMISSIONER MOSER: Speaking of water flow 20 Precinct 2 and Precinct 3 has got wastewater flow, okay, 21 always part of the big sewer system. 22 But I would like to take this time to 23 introduce Marty Mistretta. Marty, if you'll stand up, 24 please. Marty is the new County Veterans Service 25 Officer. She'll be taking office, or be here on January 5 1 the 2nd. So Marty, we thank you, we welcome you. And 2 Marty is a member of The Reserve -- Air Force Reserve? 3 MS. MISTRETTA: Yes, Sir. 4 COMMISSIONER MOSER: Air Force Reserve. So 5 we'll be meeting with the advisory committee probably 6 next week, and so welcome, Marty. 7 MS. MISTRETTA: Thank you for having me. 8 COMMISSIONER LETZ: Welcome, Marty. 9 JUDGE POLLARD: Okay, well a few days is the 10 end of my term, and I'm leaving office and retiring. 11 And I want to say that I have -- it's been my pleasure 12 to work with all the members of the Commissioners' 13 Court, it really has. Probably the public doesn't 14 understand or know how dedicated these fellow officials 15 are up here. This is a hard working bunch of 16 Commissioners. And I want to thank them for being so 17 hard working and very cooperative, and it's my honor to 18 work with you. 19 I wanted also to say that this building and 20 the county grounds are occupied by an amazing bunch of 21 dedicated loyal honest employees, hard working 22 employees. I really enjoyed working with all of the 23 people here that work for the County. I was not aware 24 how dedicated they were before getting involved in this 25 job, and I've been very impressed with it. I want to 6 1 thank them for all of the help they've given me in my 2 almost five years on the bench here. 3 You're up. 4 COMMISSIONER LETZ: Well, I'd like to thank 5 Judge Pollard for his service. He and I got to know 6 each other when I first became a Commissioner because at 7 that point in time he served as our civil representation 8 to Commissioners' Court. That was not done by the 9 County Attorney at that time. And in the time when 10 there was an absence I'd see him a whole lot, but really 11 have enjoyed working with you as the County Judge, and 12 thank you. 13 And Christmas, we had a great time out at 14 the ranch. Kids were excited, got way too much stuff 15 like usual. Everyone ate way too much, we had a great 16 holiday. 17 COMMISSIONER HARRIS: I want to say that 18 I've only been here a short time, but Judge Pollard has 19 been very insightful and thoroughly enjoyable to be 20 around, a great man. 21 As far as Christmas goes, man, it's great. 22 It's, you know, being a grandfather it's even more 23 rewarding seeing the smiles and the innocence on the 24 children's faces and stuff on Christmas morning. That's 25 all I have to say. 7 1 JUDGE POLLARD: All right, thank you. We'll 2 go to item 1.1 on the agenda. This is a report from the 3 Hill Country District Junior Livestock Show Association 4 regarding an upcoming event. Steve Bauer. 5 MR. BAUER: Good morning, Judge. Good 6 morning, Commissioners. And Judge, wish you luck in 7 that happy retirement. And we appreciate, as the 8 Association on behalf of them, the work that you and 9 support that you've done for us. We greatly appreciate 10 that. 11 Yeah, we do have an event coming January the 12 13th through the 19th. We'll have our 75th, we've hit 13 an anniversary mark. Diamonds, I guess if we were 14 married to it, I guess you'd have to give them diamonds. 15 We had a little fund raiser that was called "Diamonds 16 and Denims" a while back that was successful. But we're 17 on the march, it's coming. I know many of you saw it at 18 your County Christmas party. The barns have been set 19 up, or progress made, so we're excited. 20 Again, 33 counties coming in. All volunteer 21 organization, and I'm proud to say that they are hard 22 working, and it's amazing. They get it done, and they 23 get it there in time, and we put on a great show to 24 support these kids from round the area. 25 This year in our county show we will have 8 1 557 entries that'll be exhibited by 240 exhibitors. In 2 our district show we'll have 3062 entries exhibit by 3 1098 exhibitors. So again, big bunch of kids, parents, 4 folks coming to Kerrville. We look forward to it. We 5 ask for your support. 6 These shows are not just district shows, but 7 we have some statewide shows as we've mentioned before. 8 We have the Ag Mech show, and it continues to grow. The 9 entries are up in that again this year so we're excited 10 about that show as always. The Angora Goat Show is a 11 statewide show as well as the breeding sheep. All of 12 those shows continue to grow. Our gilt show, which 13 starts the show off on Sunday and Monday continues to 14 grow as well. And they get bigger every year. 15 Our vendor area continues to be growing and 16 getting bigger. A place for local businesses and others 17 to showcase their wares during the show as well. And it 18 all culminates on the 19th with our big sale, we ask 19 that you come out and support these kids. It's amazing. 20 This community has always -- for 75 years, I mean the 21 first men and women that organized this, I didn't think 22 had an idea of where it would be today. In one 23 afternoon we generate a million point two to help 24 support the kids of this District. And I think that 25 speaks very highly of this community and surrounding 9 1 communities coming out. Businessmen and individuals 2 alike to support those kids, and we're grateful for what 3 they do. 4 Charlie McIlvain is sitting up here on the 5 front row, and if I can ask permission to call him to 6 the stand to talk about cowboy breakfast. I know that's 7 a big part of what they do. If I may, if Charlie can 8 speak for just a word? 9 MR. MCILVAIN: Thanks, Steve. Good morning, 10 Judge, Commissioners. I am Charlie McIlvain, President 11 and CEO of the Kerrville Convention Visitors Bureau. 12 Before I get on that one main topic I want to discuss 13 this morning, I want to thank each of you for stepping 14 up to the plate and decorating the courthouse for the 15 Christmas activities. I know there was a little bit of 16 a bypass at one point, and I was really proud of the 17 county to step up and decorate and that made a 18 difference for our visitors coming in. 19 Second item as Steve mentioned is the 15th annual cowboy 20 breakfast celebrating the 75th Hill County District 21 Junior Livestock Show. This event recognizes Hill 22 Country students that you rarely hear about. They don't 23 make the police blotter, and they're not on the front 24 page of the newspaper. They're hard working students 25 that they go to school each day and then they come home 10 1 and have responsibilities and chores and are involved in 2 activities which are required to raise show-winning 3 livestock. And so to kick that program off, we will 4 again have our cowboy breakfast at 6 a.m. on Friday, 5 January 11th at the Hill Country Youth Event Center. We 6 have several new activities this year. We'll continue 7 to have our sausage wraps, but we'll also have pancakes 8 for anybody that would like to have pancakes that 9 morning. 10 And then we have a new event. Of course as 11 tradition has it that we have a little friendly 12 competition between the City Council and yourselves and 13 other elected officials. This year we've got something 14 new rather than the cow chip toss; we're doing a bouncy 15 horse race, so we'll encourage you to come out and 16 participate in the bouncy horse race. Just be prepared 17 to have a good time, and we'll hope to see each one of 18 you at 6 a.m. on Friday, January 11th. 19 Then the third item: -- 20 COMMISSIONER BELEW: Wait, wait, wait, wait. 21 Are those city folks afraid to pick up a cow chip now or 22 what? 23 MR. MCILVAIN: Well, we didn't give them the 24 option. This is something new. We were asked to come 25 up with something new and fresh. 11 1 COMMISSIONER MOSER: Fresh. 2 COMMISSIONER BELEW: Okay, just checking. 3 MR. MCILVAIN: The third item, I wanted to 4 thank the Judge for his dedication to the community, and 5 enjoyed working with you and commend you on everything 6 you've done to make our community a better place to 7 live, work, and visit, so thank you. 8 And then thanks for each of you. We look 9 forward to seeing you on January 11th. 10 MR. BAUER: Commissioners and Judge, thank 11 y'all very much for your support. This Court has always 12 been supportive of the organization and the youth, and 13 we hope that continues for many years forward. We hope 14 to see y'all out there. I encourage you to go to that. 5 All right, the next item on the agenda is 6 1.2 consider, discuss and take appropriate action 7 regarding Resolution for Diane Bolin. 8 COMMISSIONER MOSER: Thank you, Judge. I'm 9 going to lead that, if I may. I'm going to make a 10 motion that we adopt a Resolution, and I'll read the 11 Resolution into the record. 12 Resolution for Diane Bolin to recognize her 13 for her outstanding service as Kerr County Tax 14 Assessor-Collector, and her leadership in voter 15 registration and conducting elections. 16 Whereas, Diane Bolin has been a valued Kerr 17 County employee for 32 years, and served as Kerr County 18 Tax Assessor-Collector for the past 12 years, and 19 Whereas, Diane Bolin was named Tax 20 Assessor-Collector of the year in 2013 by the Tax 21 Assessor-Collector Association TACA, okay, of Texas, and 22 Whereas, Diane Bolin served on the TACA 23 Legislative Committee, Awards Committee, Election 24 Committee, and Board of Directors has served as the TACA 25 San Antonio Regional Coordinator for 12 years. 13 1 Whereas, Diane Bolin served on the Board of 2 Directors of the Kerr County Appraisal District for 12 3 years, and 4 Whereas, Maverick County Commissioners 5 designated December the 5th, 2014 as the "Diane Bolin 6 Day" for dedication, leadership and helping streamline 7 the Maverick County Tax Assessor Tax Office protocols, 8 and 9 Whereas, Diane Bolin received recognition 10 from Secretary of State for voter registration efforts 11 in Kerr County and for the State of Texas in 2007, and 12 Whereas, Diane Bolin was registered with 13 Texas Department of License and Regulations as 14 instructor since 2006, and 15 Whereas, Diane Bolin led the county voter 16 registration and elections for 35,000 voters since 2006 17 during which time there were no voting irregularities. 18 Therefore, be it resolved by Kerr County 19 Commissioners' Court on December the 26th, 2018 that 20 Diane Bolin has contributed greatly to the financial and 21 well-being of the County through effective tax 22 assessment and collection, and has assured every citizen 23 of their right to vote, and their vote counted, and that 24 we congratulate her and wish her the very best in her 25 retirement. I'm going to -- 21 COMMISSIONER BELEW: They worked on the 22 sewer project together by the way. 23 COMMISSIONER MOSER: If I may, I'm going to 24 make another motion to adopt a Resolution, and I'll read 25 it into the record, the Resolution. 16 1 Resolution by Kerr County Commissioners' 2 Court to recognize Judge Tom Pollard for as many decades 3 and leadership, commitment and contributions to Kerr 4 County, 5 Whereas, Judge Tom Pollard, a native of Kerr 6 County, graduate of Tivy High School, graduate of 7 Schreiner College, member of the U.S. Army Reserves, and 8 graduate of South Texas College of Law. Chose to live 9 and work in Kerr County and to serve his community for 10 the past 50 years. 11 Whereas, Judge Tom Pollard provided 12 exemplary service in Kerr County and Kerrville as an 13 attorney, and in many roles as a valued public servant 14 and elected official, most recently as County Judge, and 15 has served effectively, humbly, sacrificially, 16 honorably, and in an artistic -- altruistic, excuse me, 17 role model. Not so artistic; altruistic. 18 JUDGE POLLARD: Never been accused of that. 19 COMMISSIONER MOSER: Altruistic role model 20 for the benefit of Kerr County Community, and 21 Whereas, Judge Tom Pollard was an effective 22 leader and committed to fiscal responsibility and 23 efficiency for Kerr County operations, and 24 Whereas, Judge Tom Pollard has diligently 25 and compassionately protected the rights and dignity of 17 1 all juveniles, mental health patients, and probate and 2 guardian applicants in a fair and just manner, and 3 Whereas, Judge Tom Pollard, character is 4 demonstrated by the love of many, family and friends of 5 Kerr County. 6 Therefore, be it resolved that Kerr County 7 Commissioners' Court does hereby thank, appreciate and 8 congratulate Judge Tom Pollard for ALL, and that's all 9 in capital letters, that he has done helped make Kerr 10 County the best place in the world to live, and wish him 11 the very best as he tries to slow down a bit, but 12 continue to be an important part of this community. Butch Mize has 19 1 been a member of the Mountain Home Volunteer Fire 2 Department for sometime now, and he wants to kind of 3 redirect his volunteer services, and I think he would be 4 an excellent, excellent candidate or person in this 5 position. So Butch, you have anything to say? 6 MR. MIZE: Only that Butch is my nickname 7 and I'd like the record to reflect John Mize. 8 COMMISSIONER HARRIS: Okay, we can do that. 9 So with that, I move to appoint John Mize to the 10 Emergency Service District Number 2 Board for a two-year 11 term. 12 COMMISSIONER BELEW: Second. 13 JUDGE POLLARD: It's been moved by 14 Commissioner Precinct 4, seconded by Commissioner 15 Precinct 1. Is there any further 19 comment or discussion? You sure you want to do this? 20 MR. MIZE: Yes, Sir, I do. I have always 21 served my community ever since I moved here 15 years 22 ago. Due to health reasons, I had to step down and 23 retire from the fire department, and I wasn't ready to 24 quit serving my community. As I'm sure every member of 25 this Board feels the same way, they're not ready to quit 20 1 serving, and I don't think, Judge, you will either. 2 Because it's been my proud -- 3 JUDGE POLLARD: Thank you. 4 MR. MIZE: -- you know, experience to know 5 you, and I appeared before you twice and thankfully 6 neither time in handcuffs. 7 COMMISSIONER HARRIS: And that's an 8 excellent reason why he needs to be appointed. 9 JUDGE POLLARD: All right, if there's no 10 further comment or question those in favor of the motion 11 signify by raising their right hand. 5-0, unanimous. 12 You passed, you're it, Sir. She's going to explain their guidelines and 21 1 stuff with what we're going to do with the contract, so 2 I'll just leave it to her. 3 JUDGE POLLARD: All right. Your name, 4 Ma'am? 5 MS. JONES: Sherri Jones, 2126 Bluff Ridge 6 Drive here in Kerrville. Resident for 19 years now, 7 proud resident. And I would like to go -- if it's okay, 8 may I make a couple of comments? 9 JUDGE POLLARD: Okay, sure. 10 MS. JONES: I'd like to first congratulate 11 you on a job well done, and congratulations on the 12 opportunity to enjoy some life now. I imagine you're 13 looking forward to it, and I hope so. 14 JUDGE POLLARD: Thank you. 15 MS. JONES: And I'd like to thank the 16 Commissioners for allowing me to be here today and speak 17 to you. We are a proud vendor of the County and your 18 offices for services for waste and recycle. And we've 19 provided that over the last -- since December of 2015. 20 And during that time, I'd like to thank Shane for his 21 commitment to making sure the job is well done, and to 22 Jody, too. Jody is my go-to girl for making sure I'm 23 going in the right direction, so I appreciate her very 24 much. 25 We have been utilizing our assets in 22 1 providing services to not only the courthouse, but to 2 the jail, and all of the services that the County 3 handles. And in that prospect over the last year as 4 long as we have a commitment to service with the County, 5 I can control the rates. And with that, we're at that 6 point that we need to go ahead and relook at those. And 7 through an blueprint waste assessment that I did to all 8 of your county offices, we looked at those and assessed 9 at what the best services that were needed at this time. 10 And through that, you'll see on that front page that we 11 have included all of the locations that we had at that 12 time, which is courthouse waste, courthouse recycle, law 13 enforcement, the jail waste, the jail recycle, juvenile 14 detention waste, Road and Bridge at two different 15 locations, and the Maintenance Department. And in all 16 of those through that assessment we found ways that we 17 could not only save the County some dollars throughout 18 the next three years, we also found ways to better 19 utilize what we had on site, which means we either 20 decreased it or increased it. And I can do this either 21 way, Judge and Commissioners, I can go over every line 22 with you if you prefer, or if you have specific 23 questions, I'm more than happy to answer those. 24 Well, while you think of that, I wrote down 25 a couple notes, and I really don't want to waste the 23 1 opportunity to tell you how much Republic Services is 2 committed to this County. And not only as a resident, 3 your services along with our other customers provide 4 approximately 25 jobs. We all live here, work here, 5 worship here, hopefully stay out of your courts, but we 6 are very committed, and we work very hard and we're very 7 proud of what we do in our community, and we're very 8 involved. I have over 15 years of service to our 9 community through different areas. 10 Also, I wanted to let you know that upcoming 11 at the Hill Country Youth Event Convention Center, we're 12 looking at having a veterans gala in November right 13 before Veterans Day on that Monday in November, and we 14 are going to be raising funds for our local veterans 15 throughout the County, and the City of Kerrville. We're 16 looking to raise approximately $50,000.00 in that one 17 evening, and we're looking forward to doing that, too. 18 Lastly, Republic Services as I said is 19 committed to our community. We've donated services, 20 we've been blessed to donate services, roll offs, to our 21 Ag sale every year at the tune of $35,000.00, if not 22 more. So we are -- remain committed to that, and we are 23 very appreciative of the opportunity. 24 So with that being said, I am open for any 25 questions you may have, or anything we can do to go over 24 1 the details of this. 2 COMMISSIONER MOSER: I've got a comment, if 3 I may. 4 MS. JONES: Yes, Sir. 5 COMMISSIONER MOSER: What Republic does to 6 enable residents of the County that are outside the City 7 to take their recycle materials to the landfill area is 8 very convenient, used extensively, it appears to be. I 9 use it all the time. 10 COMMISSIONER MOSER: So that's a great 11 service. 12 MS. JONES: Thank you. 13 COMMISSIONER MOSER: You roll up there very 14 quickly, don't have to sort the recycle material, put it 15 if the dumpsters, and off you go. So thank you for 16 that. 17 MS. JONES: Thank you. We appreciate your 18 attention to that. 19 COMMISSIONER MOSER: Thank the City for 20 doing that. 21 MS. JONES: We appreciate them, too. 22 COMMISSIONER LETZ: Question. 23 MS. JONES: Yes, Sir. 24 COMMISSIONER LETZ: There's no reason to go 25 through the whole contract. Two things. Shane, has the 25 1 County Attorney reviewed the contract? 2 MR. EVANS: No, they haven't. 3 MS. JONES: Oh, I'm sorry. Jody said yes. 4 COMMISSIONER LETZ: Does the contract allow 5 for us to add or decrease some during the year if we 6 need to? 7 MS. JONES: Yes, Sir. At any time you are 8 allowed to increase or decrease without extending your 9 agreement with Republic Services. And of course that 10 rate would increase or decrease at that time. 11 COMMISSIONER LETZ: And the reason I'm 12 asking and I'm looking at it, my recollection was -- I 13 need to visit with Shane briefly and I need to check on 14 this. That at the Little League Fields, I believe one 15 of those dumpsters is paid by the County, and one by 16 Little League. 17 MS. JONES: Correct. 18 COMMISSIONER LETZ: But I don't see a Little 19 League -- 20 MS. JONES: I understood that the Little 21 League was all under the Little League services, so I 22 would need to check into that, and that's not a problem. 23 And that, I can tell you that once, if this is signed 24 today, the Little League field will be researched for 25 cost savings opportunities, but if not we will guarantee 26 1 not to exceed the rate it currently is at. If that 2 helps at all. 3 COMMISSIONER LETZ: Okay. Okay. 4 COMMISSIONER HARRIS: I have a question, and 5 it's not a complaint, believe me. I see that the 6 courthouse recycle is substantially reduced. What's the 7 reasoning there? 8 MS. JONES: You mean as far as the recycling 9 is concerned? 10 COMMISSIONER HARRIS: Yeah. It went from 11 259 down to 70, I believe. 12 MS. JONES: Actually, the recycle has been 13 in effect over six years, and with that I'm always -- we 14 review and audit our accounts. We're always looking for 15 saving opportunities. That can include an increase of 16 density in an area, and it can mean that in any 17 different area of our business which allows us to 18 provide and extend cost savings, we do that.
