I want to remind everyone to turn 4 off their cell phones and put them on vibrate. 5 Let me call the first agenda item which is 6 1.1, which is a public hearing to discuss the creation 7 of the Kerr County Emergency Services District #4. 8 Public meeting is now called to order. Is 9 there anyone who would like to address the Court 10 regarding ESD #4? 11 Okay, there being no one then, we're 12 adjourned. Going on to item 1.2, which is to consider, 13 discuss and approve the Resolution of Kerr County 14 Emergency Services District #4. Mr. Reeves. 15 MR. REEVES: Good morning, Gentlemen. On 16 July 8, 2021 a petition was filed by Kirk Griffin and 17 Robert Taylor with Kerr County Clerk Jackie Dowdy to 18 allow for the creation of an emergency services 19 district. 20 This District would be known as Kerr County 21 Emergency Services Direct #4. The petition was deemed 22 by my office to have enough qualified signatures. A 23 public hearing was scheduled for today in accordance 24 with Texas Health and Safety Code Section 775.015(b). 25 And the notice of the meeting was published by Sheriff 4 1 Leitha's Office twice in the local newspaper. 2 This proposed district is not located within 3 the Extra Territorial Jurisdiction of any municipality. 4 The Commissioners' Court must make certain findings in 5 order for the proposed ESD to be placed on the ballot. 6 The proposed Resolution is found in your 7 backup materials, and it outlines the findings that the 8 Court must make. This Resolution has been reviewed and 9 approved by the County Attorney. 10 At this time if the Court so chooses, I ask 11 them to approve and sign the Resolution. We have a 12 separate item on today's agenda, which will formally 13 call to hold an election for the creation of Kerr County 14 Emergency Services Direct #4. 15 COMMISSIONER LETZ: Mr. Reeves, question. 16 You said it is not in the ETJ? 17 MR. REEVES: This one is not. This is ESD 18 #4 in Hunt, Commissioner. 19 COMMISSIONER LETZ: Oh, this is Hunt. Okay. 20 MR. REEVES: We approved 3 last week. 21 COMMISSIONER LETZ: Okay. 22 JUDGE KELLY: I move we approve the 23 Resolution supporting the Emergency Services District 24 #4. 25 COMMISSIONER LETZ: Second. 5 1 JUDGE KELLY: Been moved and seconded by 2 Commissioner Letz to approve the Resolution for the Kerr 3 County Emergency Services District #4. With the 18 approval of the Resolution of the Court, I now ask the 19 Court to order an election to be held on November 20 uniformed election date as outlined in the backup 21 materials. 22 COMMISSIONER LETZ: So move. 23 COMMISSIONER HARRIS: Second. 24 JUDGE KELLY: Motion's been made by 25 Commissioner Letz, second by Commissioner Harris to 6 1 order the election for the creation of Kerr County 2 Emergency Services District #4. Any discussion? Those in favor raise your 9 hand or say aye. 10 COMMISSIONER MOSER: Aye. 11 JUDGE KELLY: Unanimous, four zero. 12 I believe that's all we have on the open 13 meeting agenda. We do have one executive session matter 14 that we're going to convene, which is 2.2(a), which is 15 to consider, discuss and take appropriate action 16 regarding interviews and possible hiring of County 17 Extension Agent. 18 And so we will adjourn from the public 19 session and go into executive session.
