It's a couple minutes after 9 o'clock. I 7 apologize for the delay. We're having technical 8 difficulties here in the courtroom. But the Special 9 Commissioners' Court meeting is now in session. And 10 what we're here today is to discuss adopting our 11 redistricting. So let's start. Do we have Mr. 12 Kimbrough. We have you on the line? 13 MR. KIMBROUGH: Yes, Sir. 14 JUDGE KELLY: We can't understand that. 15 (Off the record.) 16 COMMISSIONER LETZ: Can I make a motion now? 17 And what is the motion if I was to make one? 18 COMMISSIONER BELEW: That we accept the 19 changes -- 20 MR. KIMBROUGH: I haven't memorialized this 21 plan and call it something Commissioner Letz, so why 22 don't we call it Draft Plan D, Delta. D, Delta. 23 COMMISSIONER BELEW: That's it. Draft Plan 24 D? 25 MR. KIMBROUGH: Probably for us. Then this 4 1 would be on the map unless we did Plan II. Arabic II. 2 Arabic number 2. Arabic number 2. We must 3 differentiate draft plans in our system from the ones 4 you're voting on. So we had plan 1 that's been changed 5 now by Draft Plan D. Draft Plan D for approval turns in 6 to -- plan II. Maximum deviation of 4.15 under the 7 configuration. 8 JUDGE KELLY: Okay. I'm going to take a 9 stab at it. Commissioner Letz and I are going to take a 10 stab -- 11 MR. KIMBROUGH: Draft Plan D -- 12 JUDGE KELLY: Right, I got it. 13 MR. KIMBROUGH: Set it up for a vote today 14 by calling it Illustrative Plan Number II with maximum 15 deviation of 4.15 percent with a configuration shown on 16 the screen right now. If somebody can zoom out just a 17 second and somebody can take a screen shot of that. 18 COMMISSIONER BELEW: Yeah. We only see one 19 of the changes right now in the view we have. 20 JUDGE KELLY: Zoom out and get it. Who's 21 going to take the screen shot? 22 MR. KIMBROUGH: There's a screen shot of the 23 whole, but then we're going to go into the zoom business 24 and take a screen shot of the changes. 25 JUDGE KELLY: Okay. Mr. Reeves is taking 5 1 the screen shot. And Miss Stebbins, for the record. 2 MR. KIMBROUGH: Move into the area Precinct 3 1 and 4. 4 JUDGE KELLY: Move into the areas changed. 5 MR. KIMBROUGH: All right. Zoom in. 6 JUDGE KELLY: We got it. You want another 7 one? 8 COMMISSIONER BELEW: Can you page it down 9 just a hair so that we can see the top. There you go. 10 JUDGE KELLY: Okay, we have the screen shot. 11 MR. KIMBROUGH: If I was the presiding 12 officer, I would say is there a motion and a second and 13 call this Draft Plan D, and Illustrative Plan Number II. 14 COMMISSIONER LETZ: So move. 15 COMMISSIONER GIPSON: Second. 16 JUDGE KELLY: We got a motion and a second 17 to approve the redistricting plan, Draft Plan D, 18 Illustrative Plan II with the maximum deviation with 19 4.15 percent with the configuration as presented on the 20 screen. And the screen shots have been taken to 21 memorialize that. 22 Is there any other discussion? Those in 23 favor raise your hand. Unanimous, four zero. A little 24 unorthodox, Chuck, but we got it done. 25 Kim need to talk to you about your vote 6 1 order. 2 JUDGE KELLY: We gotta do it by record vote. 3 Precinct 1? 4 COMMISSIONER BELEW: Yes. 5 JUDGE KELLY: Precinct 2. 6 COMMISSIONER GIPSON: Yes. 7 JUDGE KELLY: Precinct 3. 8 COMMISSIONER LETZ: Yes. 9 JUDGE KELLY: Precinct 4 is absent. 10 County Judge is yes. 11 MR. KIMBROUGH: All right. On your vote 12 order, I'm assuming that you want the effective date for 13 all purposes, for election purposes for primary and 14 general election, and for any business or operational 15 purposes, the effective date January the first of 16 2022 -- 17 JUDGE KELLY: Correct. 18 MR. KIMBROUGH: -- is that correct? 19 JUDGE KELLY: Correct. 20 MR. KIMBROUGH: Okay. I gave you a vote 21 order to that effect. If you could make it effective 22 January the first, 2023 for everything except elections. 23 The elections kick in in '22. 24 COMMISSIONER BELEW: The census information 25 already came in late, right, so we're already a little 7 1 bit behind on all this. There's no reason to put 2 anything off. 3 COMMISSIONER GIPSON: Yeah, I agree. 4 JUDGE KELLY: I'm looking at your orders 5 here. 6 MR. KIMBROUGH: Yeah, I put footers on them. 7 One's to say January the first, 2022 is the one you use. 8 JUDGE KELLY: Yes, I've got it. I see the 9 footer. 10 MR. KIMBROUGH: So those changes that you 11 made because your J.P. and Constable precincts are 12 coterminous with each other and coterminous with the 13 Commissioners. Your vote is technically changed, County 14 Commissioner precincts, County J.P. precincts, and 15 County Constable precincts. Do the configurations show 16 by Illustrative Plan Number II, 4.15 maximum deviation, 17 correct? 18 JUDGE KELLY: Yes, sir. 19 MR. KIMBROUGH: Understand, we will follow 20 up the documents for the attachment. 21 JUDGE KELLY: We understand that. And as of 22 now, we have a signed order. We all signed it. And I'm 23 delivering it to the Boss. 24 MR. KIMBROUGH: Any questions or comments? 25 JUDGE KELLY: No, I think we're good. Is 8 1 there anything else we need to do? 2 MR. KIMBROUGH: I guess we oughta talk about 3 election receipts. We still believe there's a directive 4 out from the Secretary of State Office that put the 5 election precincts deadline mid December, maybe. If 6 it's December. There is rumors going around that 7 Secretary of State said election precinct delivery, 8 analysis delivery, was due November the 10th. We don't 9 believe that. I believe -- I don't believe there's a 10 written decision. So we gotta start working on your 11 election precincts, as directed, okay? 12 JUDGE KELLY: Yes, Sir. 13 Bob. 14 MR. REEVES: Counselor -- 15 MR. KIMBROUGH: Any comments or questions to 16 us? 17 JUDGE KELLY: Hold on just a second. Bob 18 Reeves. Come on up, Bob. 19 MR. REEVES: Counselor, this is Bob Reeves 20 with tax office, we've looked -- we being the Chief 21 Deputy and I, and we have some suggestions which would 22 probably be the most beneficial. Should we just forward 23 them to you? 24 MR. KIMBROUGH: If it's okay with the Court. 25 I just probably need to talk to you on the phone about 9 1 that first -- 2 MR. REEVES: Sure. 3 MR. KIMBROUGH: -- if that would be okay. I 4 have got your telephone number. 5 MR. REEVES: All right. 6 MR.
