It's 9 o'clock, 2 Monday, November the 15th, and the Commissioners' Court 3 is now in session. This is a special session of the 4 Commissioners' Court. And so with that, I call the 5 meeting to order, and remind everybody to turn your cell 6 phones off or to vibrate. 7 And we'll go first to the consideration 8 agenda 1.1, which is to canvass the official election 9 results for the November 2, 2021 Constitutional 10 Amendment Election, and creation of Kerr County 11 Emergency Service District #3 per TEC Section 67. 12 And at the same time we're going to call 13 1.2? 14 MR. REEVES: Yes, Sir. 15 JUDGE KELLY: Which is to canvass the 16 Official Election Results for the Special election for 17 the creation of Kerr County Emergency Service District 18 #4 as per TEC section 67. We'll call items 1 and 2. 19 Mr. Reeves. 20 MR. REEVES: Good morning, gentlemen. You 21 should have have the results in front of you. At this 22 time, I would ask the Court to respectfully read the 23 results into the record. 24 Miss Alford, they only need the totals; they 25 don't need a breakdown, so -- 4 1 MS. ALFORD: That's correct. 2 MR. REEVES: So if the Court would start 3 with Proposition 1. The totals are over in the right 4 hand column in the shade. Please read for and against 5 those. 6 JUDGE KELLY: I'm trying to find them. 7 COMMISSIONER HARRIS: It's on the back page. 8 COMMISSIONER LETZ: I'll go. I'll start. 9 Proposition 1: For, 4,219. REEVES: Yes, Sir. 8 COMMISSIONER LETZ: Make a motion that we 9 accept the vote totals as read into the record. 10 COMMISSIONER BELEW: Second. 11 JUDGE KELLY: We have a motion and second to 12 approve the vote totals as presented. REEVES: Thank you, sir. 16 JUDGE KELLY: I'm going to go ahead -- I've 17 also signed the Resolutions for the creation of 18 Emergency Service Districts three and four. 19 MR. REEVES: Yes, Sir. Those are the next 20 two items on the agenda. 21 JUDGE KELLY: So that's item 1.3, which is 22 to consider, discuss and take appropriate action to 23 approve and sign the Resolution establishing Kerr County 24 Emergency Service District #3. 25 1.4 is to Consider, discuss and take 6 1 appropriate action to approve and sign the Resolution 2 establishing Kerr County Emergency Services District #4. 3 COMMISSIONER REEVES: Yes, Sir. Before the 4 Court today there are two Resolutions. There are -- 5 that have been taken from the Code outlining the results 6 of the election, which you just canvassed. 7 You will notice that for Emergency Service 8 District #3, both totals of those residing within the 9 extraterritorial jurisdiction, or the ETJ, of the said 10 Emergency Services District #3. We had to break the 11 votes out for those residing within the ETJ and those 12 residing outside of it. 13 At this time, I ask the Court to approve 14 both of the Resolutions and place your signatures 15 thereon. 16 COMMISSIONER LETZ: I'll make a motion -- I 17 do want to do them separately for the record. I make a 18 motion that we approve the Resolution establishing Kerr 19 County Emergency Service District #3. 20 COMMISSIONER HARRIS: Second. 21 JUDGE KELLY: Got a motion and a second to 22 approve establishing the Emergency Service District #3. 23 Any discussion? Those in favor raise your hand. 24 Unanimous, four zero. 25 And moving on to number 4. 7 1 COMMISSIONER LETZ: I make a motion that -- 2 do you want to do number 4? 3 COMMISSIONER HARRIS: Yes. I make that 4 motion that we approve and sign the Resolution 5 establishing Kerr County Emergency Services District #4. 6 COMMISSIONER LETZ: Second. 7 JUDGE KELLY: Got a motion and a second to 8 approve establishing the Kerr County Emergency Services 9 District #4. Is there any discussion? Those in favor 10 raise your hand. Unanimous, four zero. 11 MR. REEVES: If I may, Judge, normally we 12 only have to canvass elections in November. I will be 13 coming back before you in May, because there are two 14 constitutional amendments that will be placed on an 15 election in May. Unfortunately, the powers to be in 16 Austin didn't schedule these elections until after the 17 budget was approved. So I will be coming back to you 18 for money to fund such election. 19 COMMISSIONER HARRIS: Bob, have they 20 established it's going to be in May? 21 MR. REEVES: For those two constitutional 22 amendments yes, Sir. 23 COMMISSIONER HARRIS: But nothing else? 24 MR. REEVES: Nothing else. To the best of 25 my knowledge. 8 1 JUDGE KELLY: Very well. Then the last item 2 on the consideration agenda is 1.5 consider, discuss and 3 take appropriate action to rescind Court Order #34021 4 and approve the Enterprise lease for Ag Extension Office 5 passenger van. Miss Shelton. 6 MRS. SHELTON: Yes. This is just an updated 7 lease. And so we're asking that you rescind the prior 8 one and accept this one. It still is within budget. 9 COMMISSIONER LETZ: I move for approval of 10 the agenda item. 11 COMMISSIONER BELEW: Second. 12 JUDGE KELLY: Okay. We got a motion to 13 approve rescinding and resubmitting the lease for the Ag 14 Extension Office passenger van. Any discussion? Those 15 in favor raise your hand.
