Remind 8 everyone to please turn your telephone off, your cell 9 phone, or at least to vibrate so it does not interrupt 10 the proceedings. 11 And the first item we have on the Agenda is 12 our public input. We have one person whose asked to 13 speak to the Court. If anyone would like to speak to 14 the Court, fill out the form, provide it to the County 15 Clerk, she'll pass it up to me, and you'll be called. 16 And we ask that you limit your remarks to three minutes. 17 So the first request I have is from Paul 18 Zohlen. 19 MR. ZOHLEN: Would it be possible to put 20 down that display so I can make eye contact with all of 21 the participants while I'm talking? 22 MR. LEWIS: There you go. 23 MR. ZOHLEN: Thank you. 24 MR. LEWIS: You're welcome. 25 MR. ZOHLEN: Time starts? 7 1 JUDGE KELLY: Yes. 2 MR. ZOHLEN: I'm on the clock. Good 3 morning. My name is Paul Zohlen. I am the County Chair 4 for the Republican Party for Kerr County. I was elected 5 to this position in 2022. Prior to that, I served as 6 the County Vice Chair for four years. Initially, I 7 served as a Precinct Chair and Election Judge for six 8 years. For the last five years, I have recruited, 9 trained and assigned all of the Republican election 10 workers in Kerr County. I know Kerr County elections. 11 I am here to express opposition to hand 12 counting paper ballots. Recently, I heard that the CEC, 13 the County Executive Committee of the Republican Party, 14 may choose the method of counting ballots. I contacted 15 the Secretary of State legal department to confirm who 16 has authority to set election procedures. Here is their 17 response: The authority responsible for adopting a 18 voting system for a given election under Election Code 19 123.001, determines the voting system that will be used 20 in an election and the manner in which the voting 21 equipment will be used. This would include the 22 determination about whether to conduct the election 23 using hand-marked, hand-counted paper ballots with the 24 voting machine being used only as accessibility 25 purposes. 8 1 For a general election held by the County, 2 the County Commissioners Court is the authority 3 responsible for adopting a voting system under Election 4 Code 123.001. For a primary joint election, which we 5 have, the County election officer determines the voting 6 system that will be used for the joint primary under 7 Election Code 172.126(f). Those entities or individuals 8 would be responsible for determining whether a 9 hand-count would be conducted from each respective type 10 of election. 11 If hand-marked, hand-counted paper ballots 12 are adopted as the primary method of voting for a given 13 type of election, then you are still required under 14 State and Federal law to provide at least one accessible 15 voting machine for each early voting location and each 16 election date polling location. 17 In other words, you can have hand-counted, 18 hand-marked paper ballots as your primary method of 19 voting, but you must still have at least one accessible 20 voting machine at each polling location during the early 21 voting and election day. Thank you for your time. 22 JUDGE KELLY: Three minutes exactly. 23 Next is Alicia Bell. 24 MS. BELL: I'm Alicia Bell. I am in 25 Precinct 1. And I see I'm for the paper ballots and 9 1 hand-counting paper ballots. I attended another town 2 hall event in Fredericksburg last night. I listened to 3 Tina Peters, Mark Cook, and Dr. Walter Dougherty. I 4 don't know how to explain it, but anybody who has not 5 heard all the evidence, you have no idea why you're 6 against it. You have to hear the evidence, and if you 7 choose not to hear the evidence, you can't be ignorant 8 of what's going on. You actually shouldn't be -- I'm 9 sorry, you're choosing to be ignorant of what's going 10 on. 11 Anybody who wants good things for this 12 country needs to know that we need to have a true count 13 of what the people wanted. It cannot be controlled by 14 people who pay off the people who threaten them. All 15 around the country people are being threatened and 16 they're being paid off for the new world order. 17 Who wants this country -- do you want this 18 country to stay free? If you want this country to stay 19 free, you can't cooperate with the new world order, 20 because that's what's happening. The people who are 21 cooperating with these electronic voting, the people are 22 cheating. All around the country. And anybody who 23 thinks there's not cheating going on in every single 24 county in this country, they're -- they're not thinking 25 straight. Thank you. 10 1 JUDGE KELLY: Anyone else that would like to 2 offer public input? 3 Then let's move on to Commissioners' 4 Comments. Let's start at the other end today. Four. 5 COMMISSIONER HARRIS: Well, we missed what 6 little rain came yesterday. I saw some people got a 7 little bit. We got a few drops and all of them missed 8 my rain gauge, and that's about it. Getting crispy out 9 there, guys. Be careful. Be careful. It's like a 10 powder keg ready to go off. 11 One thing I wanted to -- I don't think we 12 mentioned the official Commissioners' Court, but he 13 hasn't kicked me yet, so I want to acknowledge that 14 Jonathan Letz is leading TWA for the next two years and 15 we have a lot of members in our County and I think it's 16 a feather in his cap. So congratulations. 17 COMMISSIONER LETZ: Thank you. 18 JUDGE KELLY: And to clarify, TWA is the 19 Texas Wildlife Association. 20 COMMISSIONER HARRIS: Exactly. Yeah. They 21 got their start in late '80s. Very small bunch of 22 unified ranchers wanting to work hand in hand with Texas 23 Parks and Wildlife and other things and promote 24 wildlife. And it's grown astronomically, so -- 25 JUDGE KELLY: All right. 11 1 COMMISSIONER LETZ: A couple of comments. 2 One, really these days anyway, comment on articles in 3 the paper. But last evening, Karen was reading the 4 Community Journal, and she goes, this says that you 5 admonished the volunteer fire departments. And I don't 6 know where that came from out of that article or from 7 listening to that tape. 8 And usually, Miss Lavender's very accurate. 9 I did not admonish the volunteer fire departments. 10 Someone on the court back then may have, but it wasn't 11 me. I just want to clarify that. It surprised me. 12 The other thing is, I keep hearing about, 13 you know, comparisons between this year's budget and 14 last year's budget, and how our expenses are up and 15 revenues are down and all this stuff. And I just want 16 the public to understand that comparing this year's 17 budget with last year's or this year's with two years 18 ago, it's not apples to oranges, it's apples to grapes. 19 There is nothing comparison wise, budget wise. 20 We've got -- two years ago we got ten 21 million dollars in Federal Government ARPA. You know. 22 We're not getting that this year. So yes, our revenues 23 are going to be down. We had a bond issue last year 24 that the voters approved. So we're -- all of a sudden 25 this year we're going to show a revenue of $6.5 million. 12 1 Next year we're spending that money. So, I mean, to try 2 to compare this year's budget as a whole with last 3 year's or the year before or probably any year, it just 4 makes zero sense. And I wish people would quit making 5 that comparison. 6 Yes, our -- we have a tough budget this 7 year. We have a tough budget every year. And one of 8 the things that, you know, I even brought it up but I 9 think it's a concern that needs to be brought up at some 10 point, is that bond issues failed last year, and we're 11 doing very little to nothing to fix the problems that 12 those bond issues brought. IT Department. Tax 13 Assessor's Office. We do have a plan for the Ingram 14 Annex, but there's going to be some expenditures out 15 there. Those haven't even been mentioned in the budget 16 process. The Youth Event Center. I mean, we've talked 17 a little bit about some alternative ways to fund maybe 18 some of that but, you know, I think we're being, you 19 know, negligent as a court to not at least address some 20 of those things. That's it. 21 JUDGE KELLY: Okay. Two. 22 COMMISSIONER PACES: Thank you. 23 Attended yet another meeting with D Guerrero 24 and Tetra Tech and, of course, Road & Bridge and 25 Engineering, you know, our Center Point sewer project, 13 1 that they are continuing to work ahead. Making 2 progress. But painfully slow. So we're going to keep 3 the pressure on them and hope to get that done quickly. 4 On a happier note, on roads and 5 reconstruction, Road & Bridge has done an excellent job. 6 They've completed Skyline Drive and I've heard nothing 7 but compliments. Now the only complaint is, that it's 8 kind of a racetrack that we've got. Because it's so 9 much smoother and nicer, we've got too many people who 10 are exceeding the speed limit out there. And I had a 11 word with the Sheriff and he's going to have deputies 12 out there. So beware, if you're one of those that are 13 tempted to go a little faster on Skyline, you might pick 14 up a citation. 15 Okay. Oh, and they're going to start -- 16 well, they've already been progressing the 17 reconstruction of Robertson Road, so they've already got 18 one layer of chip seal down and hopefully we'll get that 19 finished up here in the next week or so. 20 I had my first town hall meeting on the 18th 21 at the Center Point school cafeteria. Pleased to say we 22 had 107 people show up for that town hall. So that was 23 really good. Covered a wide range of topics from the 24 eclipse preparation, planning and status. Talked a 25 little bit about the new Headwaters Groundwater 14 1 Conservation District rules and the impact on 2 development. Gave a summary of the subdivision 3 development projects. 4 And I did talk about election integrity, 5 which I think y'all know that's my favorite topic. And 6 I'm definitely pushing for some change there. What was 7 interesting, out of the 107 people that attended, 50 8 people signed up to volunteer to hand count ballots. So 9 those that say we can't get enough people to hand count 10 ballots, well, you know, this is a systemic thing. A 11 lot of people don't trust our elections. And they are 12 willing to step up. They're waking up. They're willing 13 to step up and volunteer. You know, we're starting to 14 see a bit of civic pride. 15 So I'm hoping that eventually, when it's all 16 said and done before this Court has to make any 17 decisions, you know, we'll have a thousand people sign 18 up and volunteer to hand count. So that's kind of what 19 that's going on. 20 And I also talked about bond propositions, 21 where we're at and what still needs to be done. And 22 what doesn't need to be done at all, and there's a lot 23 of that. 24 Talked about the sewer project. And engaged 25 some updates on county roads and TxDOT projects. So 15 1 because of popular demand, I'm going to do it again on 2 August 1st. And this time it will be at the Hosannah 3 Lutheran Church so that other people might be able to 4 hear the same message. 5 And -- well, obviously working hard on the 6 August 22nd election integrity town hall. We've got an 7 all star cast of knowledgeable people that can talk to 8 us about election integrity. So that's lined up for 9 August 22nd. That's it. 10 Oh, and the burn ban is in place. Actually 11 it's not in place for everybody. So I beat you to that. 12 But be careful out there. It's dry and we've already 13 had a lot of brush fires. 14 JUDGE KELLY: One. 15 COMMISSIONER BELEW: Concerning the press 16 misquoting you or mischaracterizing you, welcome to my 17 world. A number one. The other one is something that 18 Jonathan said and it's the bond issue and having to come 19 up with money for some of the stuff that we need in the 20 County. It's money out of taxpayers' pocket either way. 21 It just looks different when you say it's in the budget. 22 So it affects all of us, our pocketbooks, and we're 23 going to have to, you know, bite the bullet. 24 I did get some of the rain they were talking 25 about. It rained so hard at my house, I started getting 16 1 a little bit excited thinking we could take the burn ban 2 off after just a couple of days. But we do have a burn 3 ban in all four precincts now. And -- and I'm happy to 4 get what little bit of rain we had. Wish the rest of 5 you get some of it. So that's it. 6 JUDGE KELLY: The only thing that I would 7 add is it's been in the newspapers, and some of what you 8 read in the newspapers is true. It really is. Well, we 9 have to laugh about it. 10 But what I was going to say is that it's 11 been in the newspapers that the County has been sued 12 twice in the last month. Once was the D Guerra problem 13 that is in Precinct 2. And our County Attorney's office 14 filed answers on behalf of the Court, each one of us 15 individually. All five of us got sued, even Rich who 16 wasn't a Commissioner at the time. It's true. Sued all 17 of us and the Court. 18 And kudos to our County Attorney's office 19 who represented us, filed a plea to the jurisdiction. 20 We have now been dismissed from that lawsuit. So 21 that's -- that's good news. It was a frivolous lawsuit 22 to begin with, but so what. We're out. 23 And on the other one, we filed our Answer 24 this past week, and we're asking to try to get that case 25 set for trial in March of next year. So we're 17 1 progressing right along. So that's where we are. 2 So with that, we'll move on to the 3 Consideration Agenda. And item 1.1 is an update on the 4 Animal Control facility. Peter Lewis, our architect. 5 MR. LEWIS: Good morning. Commissioners, 6 Judge. I'm going to have -- I'm going to do a 7 presentation in a little bit in reverse order so don't 8 share that with -- 9 So location, for those familiar or 10 unfamiliar, this is the Spur 100 property that the 11 County has acquired, this is Road & Bridge and the Hill 12 Country Youth Event Center over here and the Guadalupe 13 River is a little bit further over there. So this is -- 14 the Animal Services facility sits back up in the 15 property, that's one of the things that we're doing. 16 And our consulting team is doing -- looking 17 at all the rainwater and storm water that comes through 18 this property. It comes from a variety of directions 19 and feeds right through here and goes under the highway 20 and down to the river. Our -- and we have a storm water 21 hydraulic as a consultant on our team who is assessing 22 and trying to capture as much usable property -- 23 COMMISSIONER LETZ: You probably should go 24 to the podium. And maybe start over. 25 MR. LEWIS: Well, should I take this there? 18 1 COMMISSIONER LETZ: Yes. 2 COMMISSIONER BELEW: Yes. 3 MR. LEWIS: All right. Well, good. I got a 4 little practice. 5 MR. MOTHERAL: He can stay there. It's on 6 YouTube. 7 MR. LEWIS: You just get to see my back. 8 You got my back. All right. So I'm going to block the 9 Judge and Commissioners. 10 At any rate, quite a bit of water comes 11 through here in storm water events. And obviously, 12 we're -- that's not a concern in these days but it will 13 be again, we know. 14 So the building sits back on the property, 15 this is the veterans housing over here. And we have one 16 lane coming in and out off of Spur 100 and then we have 17 a pedestrian accessible route out to TxDOT out to 18 Highway 27. 19 Then the building itself, it is -- it has 20 changed in configuration since the bond issue. But it 21 has all the ingredients. We've had a lot of good input 22 from County staff, from Reagan and from Commissioner 23 Letz. And our good friends at Kerrville Pets Alive have 24 a very thoughtful memorandum that helped us understand 25 the County needs. 19 1 What we've done is we've separated this 2 into -- kind of into animals and people. We've got 3 animals -- all the dogs over here and all the people and 4 cats, which think they're people, over here. So the 5 main entry is -- well, the main entry as you come up the 6 roadway on the site, you'll view the entrance to the 7 facility. There's a lobby and a reception area. 8 And on this side we've got Animal Control, a 9 meeting room, community room, and more adoption, and 10 then all the cats back here. A sally port for dropping 11 cats off in vehicles. It's a drive-thru. And then on 12 this side of the equation are all the kennels. We've 13 got -- I don't know, we've got -- basically we've got 14 14 kennels in the adoption area. And the adoption area, it 15 can be expanded during an event that would require more 16 animals, an influx, say if there was a hurricane down on 17 the coast or if there was another kind of event that 18 would cause the County to take on more animals for a 19 period of time. These can be doubled to 28, from 19 to 20 38. We have an isolation area here that has 12, and 21 then a quarantine area, which is separated from the rest 22 of the facility. 23 We have a future vet clinic here. It is 24 unfinished -- well, I say it's unfinished. It will not 25 have all the equipment that it needs, but it will be a 20 1 finished space. And then a sally port for drop off of 2 dogs for euthanasia and a cage storage for all the cages 3 that are in here to either add to or take away from. 4 The -- I guess the final thing here is this 5 is about 13,500 square feet of conditioned space. For 6 what that's worth. And then the image that we've 7 developed, this is going to be for those in the 8 pre-engineered metal building, which is a prefabricated 9 building that's brought onto the site. 10 This back part, we've given it an elevated 11 section down the middle to bring light into -- these are 12 translucent panels all along here to bring light in. 13 The space itself will be heated and conditioned and -- 14 mechanically conditioned. We'll have some large fans in 15 there that will circulate. Some of the spaces in the 16 building will be air conditioned, but that area, the 17 intake evaluation, will be air conditioned. 18 Main entrance to the building here that, as 19 you can see, there's a cat play area in here that you'll 20 see when you come up. See the humans playing with the 21 cats. And then over here is all the Animal Services. 22 In this building we've got the structure inside the 23 building. And it is -- it is represented or reflected 24 in these panels on the outside. This is all metal 25 siding, metal roof. And then on this side of the 21 1 structure on the outside so it doesn't -- it doesn't 2 impede. It allows a flexible space for the offices and 3 meeting rooms inside the building. That's what I got. 4 Any questions? 5 COMMISSIONER LETZ: Question. 6 MR. LEWIS: Yes, sir. 7 COMMISSIONER LETZ: The -- just to go over 8 it again to emphasize it. The hold up on a final budget 9 estimate is the drainage. So when -- do you have any 10 idea when that will come through? 11 MR. LEWIS: I do. And there's been -- 12 there's a couple things that have happened that I didn't 13 mention. But the drainage, we are -- we hope to have 14 all that for an August -- I mean a September -- we'll 15 have all the budget ready to present to Commissioners' 16 Court in September. We will have developed these 17 drawings even further. 18 And we also had an antiquities study, an 19 archeological and antiquities study. We did not -- we 20 have not seen the results of that yet. But that was to 21 determine if there were any archeological things of 22 significance on the site. Any publicly owned property 23 requires that to be developed. 24 And then there was -- so it's an exploration 25 around the cemetery there to make -- see if there was 22 1 anything that had -- that was on the wrong side of the 2 fence of the cemetery. 3 JUDGE KELLY: Okay. I'm here to discuss a Resolution here 19 that we'd like you to review and approve today about our 20 airport planning study, which we've been working with 21 TxDOT aviation now for a couple years. This is the 22 grant document that is associated with the airport 23 planning study. It is a pretty large investment by 24 TxDOT. They're investing about $225,000 of planning and 25 study work for our airport, and the City and the County 23 1 will jointly share in the ten percent remainder, which 2 is about $12,500.00 each. This is in this year's fiscal 3 2023 budget. It has already been funded from this year 4 so no new money is needed for this. 5 The Resolution is basically what we have 6 within our Interlocal Agreement is that the airport 7 needs to gain written consent from the City and the 8 County for any grants. And then also, because this is 9 for professional services, which is more than $75,000. 10 So looking forward to getting this moved forward. I 11 know we've been talking about it for a couple years so 12 this will help us greatly in our future planning at the 13 airport and look forward to getting that started. 14 I'm happy to answer any questions. 15 COMMISSIONER LETZ: Just a couple of things. 16 This is more for the public, Mary. 17 MS. ROHRER: Sure. 18 COMMISSIONER LETZ: These planning grants 19 are required by TxDOT, correct, or by the feds? 20 MS. ROHRER: Yeah, yes. Last week, Commissioner 16 Harris and I went over there and -- along with 17 Maintenance, to look at the building and figure things 18 out a little bit. And I met previously with John Bull 19 and Miss Tabo(phonetic) over there to look at 20 availability. They can, at present time, vacate half of 21 the first floor and they will maintain the other half 22 and then the second floor. And that is still in flux a 23 little bit. I mean, that part is done. They're still 24 trying to get, and may have found property in Boerne to 25 move additional staff down to Boerne, but that is 26 1 neither here nor there on this agenda item. 2 There's a drawing that everybody has. The 3 outlined area would be the new Environmental Health 4 offices. So it will be to -- there's a couple other 5 agenda items related to cost and doing some things at 6 the building, but I think we need to -- the Court needs 7 to authorize -- this item is just to authorize the move 8 of those two offices to the respective office space, and 9 I'll make such motion to authorized the move. 10 COMMISSIONER PACES: And I'll second it. 11 COMMISSIONER BELEW: Is this the lower 12 level? 13 COMMISSIONER LETZ: Lower level. There are -- two doors are 16 needed to kind of isolate, and these are really things 17 that, in my opinion, are going to be needed whether -- 18 whoever operates that part of the building to kind of 19 separate offices a little bit. So the two new doors 20 need to go in, and chains across the stairway at the 21 bottom to keep people from going upstairs. Hopefully 22 that will deter people. And they'll chain the back 23 hallway past the Environmental Health offices. 24 Maintenance is already working on this. 25 COMMISSIONER PACES: Yeah. We have a policy that the Sheriff is 5 to be paid at least $5,000.00 more than the highest paid 6 employee. The first one is 4 Item 1.12, which is presentation of the 2022 annual 5 report for the Texas Department of State Health Service 6 (DSHS), or what we call "Dishes", Region 8 and Kerr 7 County. This is Nehilot DiPiazza. 8 MS. DiPIAZZA: Good morning. 9 JUDGE KELLY: I don't think we have seen 10 y'all since COVID. 11 MS. DiPIAZZA: Well, yeah, true. And then I 12 think last year we came to do our -- the 2021 report but 13 that was -- yeah, that was the last time I think y'all 14 saw us in person. 15 Good morning, everyone. My name is Nehilot 16 DiPiazza. I am the public health nurse with the 17 Department of State Health Services, our local offices 18 here in Kerrville, and we cover Kerr and Gillespie 19 County. And with me today is Norma Cardona-Price, who 20 is our community health specialist, and Brenda Hulteen 21 who is our LVN and Public Health Dementia Clinic. We 22 have two nurses in our Kerrville office. 23 I apologize. I'm battling a cold the last 24 week so my throat, my voice is kind of in and out. Our 25 office, as you know, handles health and community 45 1 education. We do our immunizations here for eligible 2 children and adults. 3 At least I've seen, of course, COVID-19 4 vaccinations. We do handle routine investigation, 5 tuberculosis treatment and their contact, 6 identification. We do the testing, treatment, and 7 referral and then, of course, our emergency preparedness 8 and response, but that's mostly out of the regional 9 office in San Antonio. 10 I handed out the booklet with our annual 11 report for our region, for Region 8. So this is for the 12 region, but attached to that booklet is the Kerr County 13 report for Kerr County specifically. And down at the 14 bottom is mostly our initiatives that we work on in our 15 office here in Kerrville. For the most part, of course 16 the immunizations and the STD testing, we do serve on 17 the School Health Advisory Council for Kerrville, Center 18 Point, and Ingram. We educate the community about human 19 trafficking, infant safe sleep, sudden infant death, 20 shaken baby syndrome, breast feeding education, health 21 and adolescent injury prevention, and of course the 22 handwashing and sanitation, hygiene and any prevention 23 of communicable diseases. 24 Part of our initiative for Kerr County -- 25 well, a big one, the big initiative for Kerr County is 46 1 the adolescent child injury prevention. So with that, 2 we have the River Hill Child Fatality review team that 3 we started a couple years ago. I think we're going into 4 year two now. And that is a collaboration of the Kerr 5 County Sheriff's Department, Kerrville PD, the hospital, 6 MHDD, Hill Country Crisis Center, the schools with Kerr 7 County, and we also have Gillespie, Bandera, and Kendall 8 grouped together. So what we work on, we looked at 9 every child death below the age of 18 in Kerr County, 10 and we look at and see was this death preventable. And, 11 if so, was there something different we could have done? 12 Education, resources, anything like that. 13 Sadly, something that we're seeing a little 14 bit more of is teen suicide. That number's on the rise. 15 So we're looking at death safety education for parents, 16 for teen with children and, of course, mental health, 17 what can we do, where can we assist, and then also just 18 overall safety of our kiddos. 19 Something else that we do in our office, 20 both myself and Norma, are child passenger safety 21 technicians, and Norma is an instructor. So we can 22 install, inspect, we distribute car seats and provide 23 education to parents so we know seatbelts save lives. 24 Car seats save children's lives. So we want to make 25 sure we keep our kiddos in Kerr County safe. 47 1 And that's mostly what I've been working on 2 and what we've been working on in our office. And Norma 3 wanted to talk to you a little bit about the child 4 passenger safety and what we're doing with that and the 5 collaborations that we're doing in our community. 6 MS. CARDONA-PRICE: Hi, my name is Norma 7 Cardona-Price. And one of the big community 8 partnerships we have going on right now is with the 9 Kerrville Fire Department. Chief Maloney is on board to 10 working with child safety prevention. And one of the 11 big things was he did get six of his EMTs certified as 12 child passenger safety technicians. So we've continued 13 this partnership with holding a car seat checkup event 14 in the community quarterly. 15 So far we've had -- our first one was at the 16 Kerrville Sports Complex soccer field. The second one 17 we held one at the Louise Hays Park pavilion. Our next 18 one is during National Child Passenger Safety Week. We 19 scheduled it for September the 21st and we're going to 20 be utilizing the City Hall parking lot for that one, and 21 then we'll have another one after that for the fourth 22 quarter. So this is a partnership that we want to keep 23 growing. 24 And not only with the fire department, we do 25 encourage Kerr County Sheriff's Department and also the 48 1 Kerrville Police Department to get more certified 2 technicians on board so that we can work together as a 3 community to bring out child safety and injury 4 prevention utilizing the car seat. 5 As an instructor, I'm able to assist in 6 helping them maintain their certification because it 7 does require an ongoing recertification every two years, 8 and that's doing the child seat checks and attending 9 events and doing the CEU. So that's one of the big 10 things that we have always missed out was having 11 somebody to help us recertify. 12 So that's -- I'm here in the community and I 13 can help with the recertification process. We were able 14 to get Texas AgriLife to come out and do the big 15 teachings to get the fire fighters certified. So we can 16 also help bring other teams to come in and do the actual 17 certification. It -- usually it's either going to be a 18 three-day or a four-day class. So we're always looking 19 for more community partners in that sense. 20 We're also working with the fire department 21 with the heatstroke awareness campaign. We do it 22 annually. Usually try to schedule it in June or July. 23 We bring out the temperature display. We schedule it at 24 different locations around the City. This year, we were 25 able to host it at the Broadway Bank. We did one day at 49 1 the Pet Supply Store. Tractor Supply. We did it at the 2 Louise Hays Park and with Chick-fil-a as well. 3 And again, we use fire department vehicles, 4 we use the Kerrville PD vehicle, and we were able to get 5 that message across to the City. So that's something 6 that we plan on every year. 7 JUDGE KELLY: Thank you. 8 MS. DiPIAZZA: Thank y'all very much. 9 JUDGE KELLY: Next item on the agenda is 10 1.13, it's a public hearing for a revision of plat for 11 Lake Ingram Estates Section 2, Lots 66 and 67. Charlie 12 Hastings. 13 MR. HASTINGS: So, Judge, this is a public 14 hearing. 15 JUDGE KELLY: Oh, a public hearing. So we 16 convene the public hearing. Is anyone here that wants 17 to -- yes, sir. If you would go to the podium, identify 18 yourself by name and where you live. 19 MR. EDELSTEIN: Okay. My name is Daniel 20 Edelstein, I live at 204 Oakview Drive in Kerrville. I 21 was the one who -- I was purchasing this property on Jon 22 Bevan and doing the replats. 23 But first of all, I wanted to just thank 24 Charlie and Bobby for just all their help trying to -- 25 or helping us to get this moving forward in an expedient 50 1 process. So I just want to thank them for all they did 2 to help us with this. 3 However, we did have some issues. Really 4 there was right before we closed a month or so ago -- or 5 we were going to close a month or so ago, we had a deed 6 that was filed the day before closing, which the sellers 7 told me it's a fraudulent deed. So we've been trying to 8 rectify that and get that cleared up, but we have not 9 successfully been able to do that. So that's, you know, 10 the main reason why we can't do this is the deadline 11 that Headwaters has on us with the ten acre minimum and 12 all that. 13 So we went ahead and terminated that, our 14 contracts, because we're not going to be able to get 15 this done in time to make that deadline. But do you all 16 have any questions or anything? That's really all I 17 have to say. 18 JUDGE KELLY: Refresh my recollection as to 19 what the situation is. 20 MR. EDELSTEIN: So we had the executor of an 21 estate that we were purchasing from. Day before closing 22 we found out there was a deed filed from somebody who 23 would have been a notary for the -- for the estate. So 24 we're -- been trying to get it cleared up where they -- 25 instead of going to court and getting it all cleared up, 51 1 we've been trying to have them just deed back the 2 property and not go to court and we close it and all 3 that kind of stuff. 4 So we do have paperwork to do all that; 5 however, they have not -- are not signing anything to 6 deed it back to the executor of the estate. 7 JUDGE KELLY: Charlie, give me the ten 8 thousand feet. 9 MR. HASTINGS: The ten thousand foot view is 10 that they've got two lots. They're both about 15 acres 11 and they want to make one of them 25 and the other one 12 five. And that is problematic if it doesn't get 13 approved today because on August the 10th, Headwaters 14 has a new rule that says you have to have ten acres if 15 you want to drill a well. They were rushing to get this 16 done prior to today. They were -- everything was ready 17 to go, they got to closing and they had this title issue 18 crop up. And so they, unfortunately -- we can still 19 have this public hearing, but we won't be able to take 20 action today. 21 JUDGE KELLY: And this is the last day 22 before -- 23 MR. HASTINGS: This is the last day. 24 Unfortunately, the State law says revision of plats have 25 to be taken -- they have to be voted on and considered 52 1 on a regular scheduled meeting. Our next regularly 2 scheduled meeting is August the 14th. So if they can 3 get it cleared between now and August 14th, that's four 4 days after August the 10th, that's what he's trying to 5 let you know. 6 MR. EDELSTEIN: Thank you, Charlie. 7 JUDGE KELLY: Yes, ma'am. 8 MRS. GRINSTEAD: Technically, -- I'll muddy 9 the waters. Technically, every Monday is a regular 10 meeting now. That's what we did at the end of the 11 budget year. Now we -- our schedule is the second and 12 fourth Monday. But as of our -- it was approved at the 13 last budget -- 14 JUDGE KELLY: I don't think the public can 15 hear what you said so let me just kind of recap. You're 16 reminding us that we have adopted every Monday as a 17 regular Commissioners' Court meeting, but we only post 18 the second and the fourth is what we've been doing. 19 That's our practice. Our customary usage here. But if 20 we had to, we could post for any given Monday. 21 MRS. GRINSTEAD: Yes, sir. 22 JUDGE KELLY: So if that helps, that's what 23 we've got. And that information comes from our Court 24 Coordinator so it is authentic. 25 MR. This is from Pamela Slutz, 18 resident at 988 Bear Creek Road in Precinct 1. I should 19 have given this to the radio voice. But I'll -- I got 20 it. 21 "I would like to voice my whole-hearted 22 support for the County's proposal to install "No 23 Parking" signs as outlined by Road Administrator Kelly 24 Hoffer in her presentation to Commissioners' Court on 25 June 12th, 2023, Agenda Item 1.22. As a resident of 59 1 Bear Creek Road, I traverse the bridge at the low water 2 crossing several times a day. Vehicles park along the 3 road where it leaves the bridge and curves sharply to 4 the right over another one lane bridge, it blocks the 5 view of oncoming vehicles and pose a hazard to both 6 drivers and pedestrians. 7 Establishing and enforcing a "No Parking" 8 regime will go a long way to preventing accidents 9 involving both drivers and pedestrians. I thank the 10 Court for its attention to this issue." 11 JUDGE KELLY: Any other -- anyone else want 12 to speak on the public meeting part of this? 13 Okay. Then I'll adjourn the meeting and 14 we'll move on to Item 1.18, which is to consider, 15 discuss and take appropriate action for the 16 Commissioners' Court final approval regarding the 17 installation of "No Parking" signs near Bear Creek 18 Bridge, Precinct 1 and 4. Miss Hoffer. 19 MS. HOFFER: Miss Pamela Slutz made a 20 request on May 11th, 2023 to the Kerr County Road & 21 Bridge office about the installation of "No Parking" 22 signs near the Bear Creek Bridge. And she also made a 23 request to rope off the area to obstruct these vehicles, 24 which we will not be roping that area off. 25 We had a meeting on site on Wednesday, May 60 1 31st, 2023. Representatives were from Kerr County Road 2 & Bridge, Kerr County Engineering, and Kerr County 3 Sheriff's Office, Precinct 4 Commissioner, and the City 4 of Kerrville. 5 We have decided on an area that there will 6 be no parking, and it is inside the curve on the Kerr 7 County side of the bridge. We don't recommend roping 8 off any of the areas. The representative from the City 9 of Kerrville said they already have -- it's about a one 10 to two car place that cars can pull off and not be on 11 the road on the City's side. Kerr County decided on the 12 area marked in the attached data. 13 At this time, I ask the Commissioners' Court 14 for their final approval regarding the installation of 15 two "No Parking" signs within the inside curve near the 16 bridge on the Kerr County side. And this is Precinct 1 17 and 4. It will help with the visibility of what is up 18 there on the bridge before you get into that curve is 19 what that will help. If the cars are parked there, 20 you're coming from the Kerr County side, you can't see 21 the bridge until you're, like, right there. So -- 22 COMMISSIONER HARRIS: I move for approval. 23 COMMISSIONER BELEW: Second. 24 JUDGE KELLY: Got a motion and a second to 25 approve posting the "No Parking" signs on Bear Creek 61 1 Bridge. And as far as the part where we're talking 4 about, and cars coming from either direction, either 5 from the low water crossing or from further up Bear 6 Creek, they can't see one another. They're inching 7 around trying to see if somebody else is coming, and 8 it's a blind spot and this is a no-brainer. 9 JUDGE KELLY: That bridge is problematic, 10 period. 11 COMMISSIONER HARRIS: Sure is. 12 JUDGE KELLY: We can put "No Parking" signs 13 up all day long but it's still going to be a problem. 14 COMMISSIONER BELEW: Right. 15 JUDGE KELLY: But it's a measure. Just for 16 clarification, it's the part that's Kerr County 17 Precinct 1? 18 MS. HOFFER: One side of the road is 19 Precinct 4 and other side of the road is Precinct 1. 20 JUDGE KELLY: Well, I think The Arcadia Loop 21 side is four. 22 COMMISSIONER HARRIS: Yes. 23 MS. HOFFER: Uh-huh. 24 JUDGE KELLY: And the other side of the 25 Guadalupe is one. 62 1 COMMISSIONER BELEW: Right. 2 MS. HOFFER: Right. 3 JUDGE KELLY: So that's really on the -- 4 COMMISSIONER HARRIS: I think the road is in 5 one, and everything on the other side of the road is 6 four. So you get the roadway. 7 JUDGE KELLY: I love our low water 8 crossings, but they are problematic, for sure. 9 COMMISSIONER HARRIS: Yeah. 10 JUDGE KELLY: Any other discussion? There's an increase in the 3 paupers burial, property insurance increased. This last 4 time we didn't have enough in there to cover it. That's 5 about $27,000. 6 You had some major repairs at the jail and 7 they've transferred money around to try to cover that. 8 And that's about $7,100.00. There's also -- oh, you 9 know what? The repairs are at the jail but it's also 10 repairs at other buildings in the County. They 16 even questioned us why we were collecting so much money. 17 So I wanted to stand up here and applaud my staff for 18 what a great job they're doing and I hope they continue 19 to do it. But again, I wanted to applaud them for the 20 hard work that they're doing for this County. 21 JUDGE KELLY: Thank you. And for the 22 record, when you got the audit you came and talked to me 23 and I applauded you. And I pass along some of those 24 compliments to your staff. Doing a good job. 25 Okay.
