It 2 is Monday, January the 22nd, 2024, 9:00 o'clock in the 3 morning, and the Kerr County Commissioners' Court is now 4 in session. We've already had an action packed morning. 5 We'll deal with that later. 6 But if you would, please rise for the prayer 7 and pledge, which I will lead. 8 (Prayer and Pledge) 9 JUDGE KELLY: Please be seated. Okay. As 10 we get started, the first thing I want to do in the 11 excitement this morning I forgot to bring my phone in so 12 I don't have my phone in front of me. But if you would, 13 take your phones and turn them off or to vibrate so they 14 don't interrupt the proceedings. 15 And then the first part of our regular 16 Commissioners' Court meeting is always for public -- and 17 I see Todd back there. But is for public input. And 18 this is an opportunity for the public to talk to the 19 Court. To get your input, for you to tell us what's on 20 your mind. It's not an opportunity where we get to 21 respond. There's no output, if you'll notice, it's just 22 input. So don't be offended if we don't respond to any 23 public comments, but we need to hear from the public on 24 a regular basis and this is how we do it. 25 We ask that you save your comments to us if 8 1 there is an agenda item that addresses that topic. In 2 other words, if you want to talk about an agenda item, 3 wait until that agenda item is called. That's what we 4 request. So this would be for things that are not on 5 the agenda. 6 And I see we've got -- we've got two. Okay. 7 We've got -- oh, Mr. Baroody, you're here. I didn't see 8 you back there. George Baroody. First up. 9 MR. BAROODY: George Baroody speaking. 10 1616 Glen Road. It's always nice to see you too, Judge. 11 So actually I'm coming because I'm going to publicly 12 request something that I've privately requested and been 13 stonewalled in the process. 14 As Judge is well aware and actually the rest 15 of the Commissioners are, minus Miss Overby, I've put in 16 a public information request to receive all the 17 communication between each one of you individually and 18 some specific recipients and staff, DA's Office and 19 actually the local press. 20 The only one that didn't really come -- 21 wasn't forthcoming was the Judge, and I've been told 22 that an Attorney General's opinion has been sought 23 because the claim is attorney-client privileged as 24 regard to the County Attorney. Since -- as I understand 25 it, the Attorney General's opinion is that you can claim 9 1 that, and withhold information as public information; 2 otherwise, as long as that communication was for the 3 purpose of facilitating the rendition of professional 4 legal services to the client governmental body, which in 5 this particular case, unless I'm mistaken, the rest of 6 the body was unaware of the communications, therefore it 7 really shouldn't be privileged information. 8 Rather than wait for an Attorney General's 9 opinion, I'm actually requesting that you dispense with 10 that formality and simply produce the documentation. 11 I'm not really clear what information is there, other 12 than just standard communication. We've come to find 13 out that you not only were not involved -- were not 14 hands-off in the proceedings with Mr. Belew, you were 15 actually orchestrating a decent amount of it by seeking 16 out -- shopping around for a DA or an attorney, County 17 Attorney is also one, to proceed with the case. 18 What I'm looking for is transparency in 19 government. And on the one hand, you've been publicly 20 banning something and we're looking for proof that 21 that's true. And we've already seen bits and pieces of 22 it that it wasn't. 23 So, like I said, I'm asking that you simply 24 release the documents that are communications that are 25 basically public information, so that the community can 10 1 move forward as if -- like it's supposed to. And 2 ultimately in this process, you actually kind of -- 3 you've either had -- been having un-posted meetings as a 4 body with an attorney, which is supposed to be a public 5 meeting, could be closed, or you've been withholding 6 information as public information. Either way, it's 7 coming up real close to a line or crossing it. So 8 please -- okay, I assume that's my time limit thing. So 9 thank you. 10 JUDGE KELLY: Next is -- is it Caudel or 11 Cadell? 12 MR. CADELL: James Cadell. 13 JUDGE KELLY: Yes, sir. 14 MR. CADELL: Thank you. James Curtis 15 Cadell, 416 Alvin Drive. I live and work here in Kerr 16 County. I'd like the Court to consider two items. The 17 first, last year I attended a water availability study 18 workshop here in the Commissioners' Court. At the end 19 of that, I remembered that we would have more of those 20 scheduled. I'd like to see one of those scheduled, 21 specifically to educate the Court with regards to how 22 water availability affects the Model Subdivision Rules. 23 And the second point is those Model 24 Subdivision Rules. I believe that they are stifling 25 development in a community that's hurting for housing, 11 1 and I also believe that they -- that they unduly 2 restrict my rights as a property owner. Thank you. 3 JUDGE KELLY: Okay. Any other public input? 4 With that, we'll move on to the Commissioners' comments. 5 Precinct 1. 6 COMMISSIONER OVERBY: Thank you. Busy last 7 two weeks. I attended the Sharlett(phonetic) for the 8 Kerrville Public Safety facility. They've been tasked 9 with designing something for the entrance there, Layng 10 Guerriero and Autumn Wagamel(phonetic) held that for a 11 couple hours. A great -- I think that's going to be 12 great for the community to have that area in front of 13 the building. 14 Also, I met with Karen Guerriero -- the 15 Guerriero's are popular this week -- over at Kerrville 16 Pets Alive with some of her board members for a couple 17 hours and trying to get a -- my knowledge up on what 18 they're doing for the community and for the Animal 19 Services facility, in particular, and then Commissioner 20 Letz and I met with some of the folks regarding the 21 Animal Services facility as well last week. Busy. 22 JUDGE KELLY: Good. Precinct 2. 23 COMMISSIONER PACES: Okay. Well, the burn 24 ban remains lifted for Precinct 2. But we, again, 25 remain in Drought Stage 3. I attended the Headwaters 12 1 Ground Water Conservation District board meeting on the 2 17th, where it was discussed that we haven't seen any 3 significant recharge of the aquifer as a result of the 4 recent rains. And if we don't see a lot more rain and 5 some recharge, we may find ourselves back in Drought 6 Stage 4. So I always enjoy attending those meetings 7 and thank goodness they let me. 8 In terms of the Center Point sewer project. 9 Hallelujah. D Guerrero has reached substantial 10 completion for their Phase 2 and 3 projects as of 11 January 12th. I attended a part of a walkthrough 12 inspection on the 17th. And look, they have a lot of 13 punch list items to complete in the next 35 days. It 14 looks like they're going to get on with that. But they 15 have satisfied substantial completion requirements. 16 But look, the real issue is they're behind 17 schedule on Phase 2 by 432 days and on Phase 3 by 583, 18 which means that the liquidated damages assessment 19 process will begin in earnest and the potential number 20 is well over a million dollars. So that will be keeping 21 us busy. 22 And again, we're now in the one-year 23 warranty period for that work, so anyone who needs to 24 make a claim for warranty issues should contact 25 GrantWorks, Rosie Daily, at (512) 957-1465 between the 13 1 hours of 8:00 a.m. and 4:00 p.m. on weekdays. 2 Otherwise, the only other thing to report is 3 I traveled to Castroville with Commissioner Harris and 4 our County Engineer, Charlie Hastings, to meet with 5 the -- well, two of the meeting at County 6 Commissioners, Commissioner Sittre and Castiglione, to 7 discuss their experience with public improvement 8 districts. Very much appreciate Commissioner Harris 9 setting that up. It was very valuable discussion and I 10 really appreciate those commissioners. They went out of 11 their way to accommodate us. So good meeting and I'm 12 sure we'll have more discussions about PIDs here amongst 13 this Court. That's it. 14 JUDGE KELLY: Very good. Precinct 3. 15 COMMISSIONER LETZ: A full agenda. No other 16 comments. 17 JUDGE KELLY: Thank you. Precinct 4. 18 COMMISSIONER HARRIS: I'll keep mine short 19 as well. Had the opportunity weekend before last to go 20 to a birthday party at the Dietert Center. Allie Burton 21 turned 100 years old. One of my constituents. Just a 22 great American. And as some of y'all I see out there 23 were there. He was in the Air Force and flew in the 24 World War II as well as Korean war and got shot down in 25 the Korean war and was a POW for about six months, I 14 1 believe. But just -- it was heart -- it was -- the love 2 in that building for Allie Burton was tremendous. And 3 so I just wanted to pass that on. Great American. 4 We've talked about this being stock show 5 season. The grandstand sale was this past week and the 6 week before and had their auction Saturday. And the 7 number they gave me last night was $540,000 at the 8 auction for our kids. That was without add-ons. So 9 it's -- I'm sure it will increase. 10 I want to remind you the Renaissance 11 Festival is going on. This is -- we had it this last 12 weekend and the next two weekends, so you've got a 13 chance to take that in. Hopefully, you have better 14 weather than what it was on Saturday, according to Jody. 15 So that's all I got. 16 JUDGE KELLY: Okay. Then let's move on to 17 the consideration agenda. Item 1.1 consider, discuss 18 and take appropriate action regarding the 2023 Kerr 19 County Historical Commission report, and introduce new 20 members. We're very eager to welcome Ms. Oates. 21 MS. OATES: Good morning. Commissioners, my 22 name is Barbara Oates and I'm the current chair of the 23 Kerr County Historical Commission. And we appreciate 24 the time. We're mandated by the Texas Historical 25 Commission to come and present to the County what we've 15 1 done in the past year and that's the reason I'm here. 2 Currently, KCHC has 64 appointees and we are 3 here to present four new members and appointments and 4 request memberships on your approval, and these people 5 are Carrie Pruitt -- if you'll stand when I say your 6 name. Ted Schulenburg, Noel Putnam, and Mike Oates. 7 All four -- thank you. Thanks for what you're going to 8 do. 9 All four of these individuals have already 10 actively supported KCHC through attending meetings, 11 developing exhibits, working with our website, and 12 cleaning up the KCHC office downstairs here in the 13 Courthouse. They all have a real interest in preserving 14 the history of Kerr County. 15 KCHC met eight times last year at the Union 16 Church. And they had -- we had a variety of speakers 17 from the UGRA, the Heart of the Hills Heritage Center, 18 local geologist Susan Longacre came and spoke on 19 fossils, clues to the past, and Gary Noller presented on 20 the hundred years of the VA hospital, just to name a 21 few. 22 We're grateful to the work of the County to 23 renew the lease with Schreiner University which just 24 occurred and we appreciate the use of the Union Church 25 for our meetings. We're also grateful for the financial 16 1 support that the County supplies KCHC. In 2023, we used 2 some of those funds to replace some of the furniture 3 which was deteriorating in the Union Church. We used 4 money to update our tech to help facilitate future 5 presentations and archive our materials and cover usual 6 expenses for printing and materials for our exhibits. 7 Last year, we began to strengthen our 8 partnerships in the community and build new ones through 9 coordination with leadership in the organization. And 10 these partnerships included Heart of the Hills Heritage 11 Center, the Kerr Regional History Center, Schreiner 12 University, Riverside Nature Center, Kerrville Main 13 Street, the Texas Center, the Center Point Historical 14 Preservation Association, and the Kerrville Chamber of 15 Commerce. 16 We participated in the Center Point 17 Historical Preservation Association's 200th Texas Ranger 18 Celebration in May, the Kerrville Chamber of Commerce 19 Business Expo in August, and they filled about 4,000 20 people. We had a lot of people with interest that we 21 could increase our newsletter distribution. And the 22 Jimmy Rogers Celebration at The Arcadia Theater, just to 23 name a few. 24 Our support of the Heritage Center has 25 continued with many of our members serving on that 17 1 board, as well as sending a letter in support of the 2 Historical significance of the AC Schreiner home to the 3 Texas Historical Commission. We continue our rotating 4 exhibits here at the courthouse. Many thanks to Linda 5 Stone for her hard work on those. We also continue our 6 support to the Kerr Regional History Center and their 7 exhibits. They in turn, are supporting us by digitizing 8 all the Tivy annuals. And we also continue our local 9 outreach with our community monthly newsletters and 10 press releases. We believe this is the way forward for 11 us, at the Kerr County Historical Commission, that we 12 build on these partnerships, all these people who have 13 an interest in preserving a history of Kerr County. 14 We have a total of 88 markers in the County. 15 We're awaiting on the State Hospice Cemetery Marker, 16 which has been approved, and we have had repair done on 17 the Apelt Armadillo Farm marker that was hit on Highway 18 27. That's been quite a journey getting that repaired 19 and getting it placed and hopefully that will be soon. 20 We appreciate the County Commissioners' work 21 on the new Animal Control facility construction. Your 22 plans for this new facility have taken into 23 consideration the concerns for the Brown-Goss Cemetery 24 Association. I've met with people on both sides, and 25 it's important -- I've learned with the communication 18 1 but seeing y'all's work and your consideration has meant 2 a great deal to that association. Several individuals 3 of historic significance are buried there, Joshua Brown 4 being one of them, and it is a designated Texas 5 Historical Cemetery. We thank you for the work to come 6 as you move forward in construction considering the 7 impact of that cemetery. 8 In addition, the KCHC has appreciated our 9 communication with the new court liaison, the 10 Commissioner Anne Overby, and we look forward to our 11 work with her in the future. 12 Lastly, a major project for us in 2023 was 13 the clean up and the organization of the KCHC office 14 storage area in the basement of this Courthouse. Items 15 that needed protection in a climate-controlled 16 environment were removed from the basement and stored 17 elsewhere. Debris and extra furniture were removed and 18 we're grateful to the County maintenance for working to 19 replace that ceiling for us and for cleaning the area 20 once the room was better organized. 21 In 2024, we began a more detailed 22 organization of this area and some digitization of the 23 materials held there. Our goal is to create an 24 accessible resource room for KCHC work. Thank you very 25 much for your time. 19 1 JUDGE KELLY: Thank you, Ms. Oates. It's 2 quite obvious to me that the Historical Commission is in 3 good hands. And you have big shoes to fill for Julie, 4 I'll tell you that. 5 One thing I might add is, if you haven't 6 checked with the West Kerr Chamber of Commerce that 7 might be another tip for you to check out. And we truly 8 appreciate what you've done with the storage in the 9 basement of this building. We call that the lower level 10 now, we don't use the basement terminology. But we had 11 stuff stored in this courthouse in every nook and cranny 12 you can imagine. Thank you. 20 Next item is 1.2 consider, discuss and take 21 appropriate action to approve a letter of support for 22 the Hill Country Mental Health & Developmental 23 Disability Center's application to the Texas Health and 24 Human Services Commission for their grant proposal for 25 the mental health grant for Justice-Involved 20 1 Individuals. Mr. Citron. 2 And for those of you that don't know, this 3 is Tod Citron, who is the Executive Director for Hill 4 Country MHDD. 5 MR. CITRON: Thank you. Good morning, 6 Judge. Judge Kelly and members of the Kerr County 7 Commissioners' Court. Again, I'm Tod Citron and I'm the 8 Chief Executive Officer of Hill Country Mental Health 9 and Development Disabilities. I've been the CEO for 10 about two and a half years. We are a local mental 11 health authority for a 19-county catchment area that 12 stretches from the I-35 corridor from Comal and Hays 13 Counties and runs west, all the way to the Mexico border 14 to Val Verde County. The total population is about 15 three-quarters of a million people. We have the second 16 largest geographic coverage area of any of the 39 17 centers like us throughout the State. 18 The other day, in regards to why I'm here, 19 we are a safety net provider of mental health services. 20 Mainly for people who tend to be uninsured, who are on 21 Medicaid or disabled. Our office -- our corporate 22 office is located here in Kerrville. We're right over 23 in the Schreiner Building on Water Street. 24 Today, I'm seeking a letter of support for 25 State funding under Senate Billion 292, justice-involved 21 1 individuals who have a mental illness. Commissioners, I 2 have presented to you on April 24th, 2023 seeking a 3 similar letter of support for almost the exact project 4 via Federal Bureau of Justice Assistance funding and we 5 didn't receive the award for that proposal. 6 Specifically, if we are awarded funding we 7 would hire what's called a qualified mental health 8 professional to be housed in the Sheriff's office, or 9 what's called embedded, to provide a resource to the 10 Sheriff. More and more in this day and age our law 11 enforcement agencies are confronted on the front line 12 with individuals who have a mental illness. Sometimes 13 folks offend and they end up incarcerated. This 14 provides tools to the Sheriff's Office where he has 15 mental health expertise. These folks would be my 16 employees, but would be co-located in Sheriff Leitha's 17 jail or where he designates. 18 In addition to the qualified mental health 19 professional, we will hire what's call a certified peer 20 specialist. This is an individual who has a lip 21 experience with mental illness. Their job would be to 22 engage folks who are inmates with a mental illness. 23 Upon release, that they are engaged with service 24 delivery in our clinic. So they go to their 25 appointments. They take their medications. We can help 22 1 secure housing. And with us being able to respond 9 specifically, the 88th Legislature funded millions more 10 dollars for services for folks who are justice-involved 11 who have mental illnesses. It's a very competitive 12 procurement. But anyway, I want to thank you and -- for 13 your consideration and letter of support. 14 JUDGE KELLY: And let me say, as the mental 15 health judge for those 19 counties, there is a huge 16 mental health problem in our area that is being 17 unaddressed. This is a very vital thing that needs to 18 be done and people don't realize how much mental health 19 problems are in our jails. It is astounding. It is 20 truly staggering. So this is something that anything we 21 can do to help Hill Country MHDD, I certainly recommend. 22 MR. I'll just give you a quick rundown on it, which 3 we are currently using a software program called Shelter 4 Pro. Over the past about six months, we've really 5 started to run into a whole lot of issues with employee 6 access and usability for that program. Just about to 7 the point where it's not usable for some. We haven't 8 been able to resolve those issues. Between our IT 9 department looking at it and the actual Shelter Pro 10 company, it's on their end and they can't figure out 11 what's wrong. 12 So we need to move to a different software. 13 We've done a lot of research on this. We've talked with 14 other counties and other cities and what they're using 15 and a lot of them have gone to a program called 16 PetPoint, which is a little bit different but it's very 17 user friendly. More accessible to staff. And one thing 18 that was mentioned was price. It's actually not more 19 expense, it's actually less than what we have budgeted. 20 So basically where we're at is our contract with 21 PetPoint is expiring I believe on the 26th of this 22 month -- 23 JUDGE KELLY: Shelter Pro? 24 MR. GIVENS: Shelter Pro. I'm sorry. 25 Either the 26th or 28th of this month. So we haven't 25 1 actually paid for this next year so we have budgeted 2 funds. Because I think it's $2200 or something per year 3 for Shelter Pro. It's my understanding it's a $1500 fee 4 one time for the use of PetPoint. So we're still 5 working out all those details. 6 I'm probably not totally ready at this point 7 for contract approval because the County Attorney is 8 still looking at that. Item 1.14 consider, discuss and 7 take appropriate action to accept the Sole Source vendor 8 Trinity Innovative Solutions for the purchase of an 9 automatic license plate reader trailer, using funds from 10 Operation Lone Star 2024 grant. Scott Gaige. 11 MR. GAIGE: Yes, sir. Trinity Innovations, 12 we used last year, same vendor as the Sole Source. 13 Basically what makes it a Sole Source is that individual 14 helps. The PR system is built specifically -- that 15 trailer is built specifically for that unit, which makes 16 it a Sole Source vendor, so it's manufactured 17 specifically for that unit. 18 We're looking at Operation Lone Star funds 19 of $62,000.00 to purchase that trailer. So we currently 20 have one we purchased with '23 funds. This will be 21 purchased with '24 funds. 22 COMMISSIONER HARRIS: Scott, can you -- for 23 the public, could you tell them what this trailer is and 24 what it's used for? 25 MR. GAIGE: So what it does, it collects 34 1 data, without getting into too much operational stuff. 2 So what it does is, there are camera systems that are 3 deployed out into the roadways and things like that. As 4 vehicles come through, we're able to collect data. 5 We're also able to -- it's built into Texas -- the TCIC 6 and NCIC, which is what we use for -- to run license 7 plates, driver's licenses and things like that. 8 So any kind of stolen vehicle, people that 9 are -- that are on Amber Alerts and things like that, 10 there's vehicles associated, they're entered into that 11 system. So if they were to pass by where we have these 12 units set up, it would trigger an alert for us so that 13 we could react to it. 14 COMMISSIONER HARRIS: Thank you. 15 COMMISSIONER PACES: And Scott, this -- this 16 will be our second unit. Is that correct? 17 MR. GAIGE: Yes. Yes, sir. 18 JUDGE KELLY: And just so the public 19 understands, the Sole Source means we don't have to put 20 out for competitive bids. 21 MR. GAIGE: That's correct. If it's over 22 $50,000 you have to go out for bid for Sole Source. Unanimous. 12 Moving on. 1.15 consider, discuss and take 13 appropriate action to approve justification for 14 adjustment to the Sole Source procurement of products 15 and services for the Lenco Bearcat Armored Rescue 16 Response Vehicle in accordance with Local Government 17 Code, Discretionary Exemptions, Subsection (c) if an 18 item is exempted under Subsection (a)(7) is purchased, 19 the Commissioners' Court, after accepting a signed 20 statement from the county official who makes purchases 21 for the county as to the existence of only one source, 22 must enter in its minutes a statement to that effect. 23 That's the short version of what I was 24 trying to explain a minute ago. 25 MR. GAIGE: Yeah, that's the government 36 1 portion of it. So what we're looking for is the 2 approval to release the funds for the Lenco Bearcat. 3 This was completely -- the Lenco Bearcat, all the 4 funds -- all that -- donations were all from our 5 donations. There was not a public penny that was spent 6 on this project. 7 So, you know, the total project ended up 8 being about almost 320,000. So donations of $150,000 9 from the Cailloux Foundation and the Kerr County 10 Sheriff's Foundation did the matching grant, and they 11 raised the remaining amount. So the Bearcat is done. 12 They're waiting for us to go pick it up. 13 So what happened was the Cailloux Foundation 14 issued the check of $150,000 to the Sheriff's Office so 15 we had to deposit it into our account. So Sole Source 16 since it's over 50,000 so it went into effect, so we 17 covered all that. 18 And also what we've asking for in this 19 portion is we're requesting the Court to pay and approve 20 invoice for today. And we spoke with the Auditor and 21 she's good to go with that as well. 22 JUDGE KELLY: Is that going to be in the 23 bills part? 24 MS. SHELTON: It's the timing of it. We 25 don't have a budget so you're going to be approving a 37 1 budget adjustment. And then the P.O. will be able to be 2 presented to us for payment and we can get it out today. 3 JUDGE KELLY: Now the Sole Source 4 designation on this is because, why? 5 MR. GAIGE: Because the purchase -- because 6 we took that -- the 150,000 donation and we put it 7 into -- basically into our budget. So it falls back to 8 County procurement, so we had to do a sole source 9 procurement for it because it's over the 50,000. So 10 this vendor is sole source because there's -- attached 11 to the Sole Source letter saying that they're a very 12 specific manufacturer for what it is based on patent 13 pending and all that type of information is on there. 14 JUDGE KELLY: Okay. So -- so the public 15 understands, the funds for this Bearcat were all 16 privately raised? 17 MR. GAIGE: Yes, sir. 18 JUDGE KELLY: A portion of what was 19 privately raised was paid directly to the Sheriff's 20 Department, therefore, it has to go through 21 Commissioners' Court. 22 MR. GAIGE: Yes, sir. 23 JUDGE KELLY: And so we've got to designate 24 this as the sole source to be able to spend the money to 25 pay for the Bearcat and bring it back. 38 1 MR. GAIGE: Yes, sir. And that -- we'll 2 come back to the Court for the actual equipment, 3 receiving the equipment, we'll come back to the Court. 4 JUDGE KELLY: Well, I'm looking at -- 5 MRS. The Texas 8 Department of Transportation, TxDOT, has recently 9 revised their policy to allow for installation of 10 mailboxes on state highways only for those addresses 11 that are physically addressed off of said highway, thus 12 necessitating the relocation of dozens of existing 13 mailboxes from State Highway 1340 to other suitable 14 locations. 15 TxDOT approached Kerr County Commissioners' 16 Court about two years ago searching for a solution, the 17 idea was to relocate said mailbox clusters to County 18 right-of-way; however, the Court required that this idea 19 be studied further by TxDOT with the Road & Bridge 20 Administrator, County Engineer, Post Master, and local 21 Homeowners' Associations where applicable, and brought 22 back to the Court to solve issues inherent with the 23 relocation. 24 Several meetings have been held with the 25 above parties in the Guadalupe Ranch subdivision, and 50 1 suitable locations have been identified that would work 2 for all involved. TxDOT will construct edge of road 3 pavement improvements and relocate the mailboxes, and 4 the Guadalupe Ranch Estates HOA, Homeowners Association, 5 will maintain the mailboxes and edge road improvements 6 through a permit issued by the County Engineer and with 7 the consent of the adjacent property owner. These 8 permitting requirements will provide for suitable 9 pavement to be installed by the applicant to protect and 10 preserve the edge of road and drainage ditch, allow for 11 vehicles to safely exit and reenter the road to deliver 12 or receive mail, provide a means for vehicles to turn 13 around, and provide for ongoing maintenance to be 14 performed by the applicant. 15 The County Engineer asks the Court to 16 consider, discuss and take appropriate actions for the 17 Court to authorize the County Engineer to issue a permit 18 for the private installation and maintenance of mailbox 19 clusters for the Guadalupe Ranch Estates subdivision 20 within County right-of-way at suitable locations on 21 Fallow Run and Cherry Springs Road. 22 COMMISSIONER HARRIS: As Charlie said, this 23 has been an ongoing issue for a couple years. Good. 18 COMMISSIONER OVERBY: Good. 19 JUDGE KELLY: So we look forward to your 20 report. 21 Moving on to Item 1.30 consider, discuss and 22 take appropriate action for approval of discretionary 23 items and directions on other construction items at the 24 new Kerr County Animal Services facility. 25 COMMISSIONER LETZ: Commissioner Overby and 69 1 I met for about four hours, literally, going over -- 2 COMMISSIONER OVERBY: Literally. 3 COMMISSIONER LETZ: -- a very long list of 4 things that are everything from what kind of locks will 5 go in doors and what gets locked and things like that. 6 But there's some -- a lot of those were kind of 7 customary that we just gave some direction to Peter 8 Lewis and Reagan was at the meeting for that. But there 9 were some things on the list that we didn't feel 10 comfortable, "we" being Commissioner Overby and I, of 11 giving the direction without coming to the Court first. 12 So some of these items are a generator -- 13 JUDGE KELLY: Backup generator? 14 COMMISSIONER LETZ: Backup generator. 15 COMMISSIONER OVERBY: And propane. 16 COMMISSIONER LETZ: And the propane tank to 17 go with it. That's something that we need to add. And 18 let me preface this. As we're going down some of these 19 items, it's a pretty tight budget out there and this is 20 something that -- it's an expensive item and not 21 included, but we need to kinda do some add alternates 22 and see if we can get them in. And there will also 23 be -- Reagan is looking at -- or is compiling a list of 24 things, of furnishings that are never included in a bond 25 issue and maybe, I'm not sure what the Auditor -- I mean 70 1 visit with the Auditor if there's any additional funds 2 from interest on that. Sometimes we use interest from 3 bond funds until they're spent to -- for furnishings. 4 But anyway, so in the budget there will be a 5 line item that Reagan is working on for a bunch of 6 items. Not a bunch. I mean there's everything from 7 freezers to washing machines and things of that nature. 8 But generator is one. Do we want that as an alternate? 9 Do we want to include it definitely? What is the 10 thought? 11 The heat in the building is electric -- 12 COMMISSIONER PACES: How big is this 13 generator then? 14 COMMISSIONER LETZ: Well, it's going to have 15 to be big enough to -- you know, and then that's the 16 next question, do -- 17 COMMISSIONER PACES: 21 to 24 probably. 18 COMMISSIONER LETZ: Yeah. It will -- that 19 would be -- you know, by the time you do the whole 20 thing, 50,000. 21 COMMISSIONER PACES: Yeah. They're not 22 cheap. 23 COMMISSIONER LETZ: They're not cheap. You 24 know, if the propane tank -- and the next part of the 25 question is, is the generator -- do we only do it for 71 1 the animal portion of the building, which would be a lot 2 less, or for the entire building. And you know, I wasn't real happy being without 25 power for five days in Winter Storm Uri. Having said 73 1 that, I mean, I think it's imperative that we stay 2 within the overall budget. So, you know, we might need 3 to cut back something else somewhere. But I do think we 4 should have a generator out there. 5 COMMISSIONER LETZ: For the whole building? 6 For the building, or for the animals? 7 COMMISSIONER PACES: Well, I would say for 8 the animals. People can wear coats, hats. 9 COMMISSIONER HARRIS: We need to look at 10 both, I think. We did contact 6 KPUB directly and they told us that we need to make a 7 contingency plan anyway. 8 MS. GUERRIERO: Okay. And I also want to 9 say that KCA is very happy about the new shelter 10 facility happening and we would consider -- I don't know 11 how we would handle that as far as donating something 12 to, that was large value that would be helpful. I don't 13 know how to handle that. But I would like you to 14 consider that that is something that we possibly could 15 do. 16 COMMISSIONER HARRIS: That would be nice. 17 Sort of like what the Sheriff has done, you know, he's 18 got a lot of people working from private funds. 19 MS. GUERRIERO: And we're kind of budgeting 20 for that right now and so we would like to know what 21 that could be. 22 COMMISSIONER LETZ: Well, Reagan's working 23 on the list of items that -- you know, the kennels are 24 included in the package, but there's -- there's just a 25 lot of other stuff that's just not included in 78 1 furnishing it. 2 MS. GUERRIERO: Okay. So just consider 3 that. We'd like to have that discussion. 4 COMMISSIONER LETZ: Okay. 5 MS. GUERRIERO: Thanks. 6 JUDGE KELLY: Thank you. 7 COMMISSIONER PACES: I can't recall if the 8 County has ever turned down a donation so I'm sure we'd 9 be happy to accept. 10 COMMISSIONER LETZ: Rain water harvesting. 11 There's -- we have already had some preliminary 12 discussions. The UGRA, they have a great program to 13 solve rainwater harvesting, which that water will be 14 used primarily for minimal landscaping that would be 15 there. Not the hose. No irrigation system is planned. 16 And also for washing down the kennels, so that will be 17 the primary source for that. And it would be hooked up 18 to the City water to fill it up when it needs to be. I 19 mean when we don't have rain. But we're working on that 20 and that will be coming back to the Court. There will 21 be a cost share program. 22 COMMISSIONER OVERBY: I don't know the 23 amount. 24 COMMISSIONER LETZ: We're not sure of the 25 amount, but we're looking at probably, oh we're hope -- 79 1 hopefully UGRA would -- somewhere around 80 percent 2 cover the cost and we'd pay 20 percent. Somewhere along 3 that line. 4 JUDGE KELLY: And don't forget to check out 5 the AACOG opportunity because they may have something, 6 too. 7 MS. PUTNAM: There's also some -- when this 8 first started with the bond, I was looking into other -- 9 not, say, funding for some of the interior type of 10 things like kennels and things of that nature, washers 11 and dryers and surgical and all that type of thing -- 12 COMMISSIONER OVERBY: And sinks. 13 MS. PUTNAM: Yes. So there -- there are 14 grant opportunities out there. Haven't looked at it in 15 about a year, but I can refresh. I earmarked those 16 areas. 17 JUDGE KELLY: Even if we're just selectively 18 picking out a few things that we can pay for through 19 grant opportunities, that allows us to have more 20 flexibility with the budget that we have for the bond 21 issue that was approved. 22 COMMISSIONER OVERBY: Correct. 23 MS. PUTNAM: I've earmarked a few things, 24 I'll send it to you guys. 25 COMMISSIONER LETZ: I can get with Reagan on 80 1 kennels. They're -- he and Nicole are honing in on 2 exactly the kennels that they want to be -- have 3 specified. And that would be a big plus if those could 4 be done by a grant so we need to proceed with that. 5 COMMISSIONER OVERBY: I'll follow up on it. 6 COMMISSIONER LETZ: The livestock area, 7 which is the -- will be housed out there. It's not 8 included in the package and was never really intended to 9 be, and it was also felt that, you know, the last -- the 10 current one was built by trustees that are welders. So 11 I don't know if the Sheriff has any people in -- 12 SHERIFF LEITHA: I'll check into that. 13 COMMISSIONER LETZ: But the current ones 14 were constructed, it's not a lot but -- 15 COMMISSIONER OVERBY: It just has to be 16 there in case. 17 COMMISSIONER LETZ: They're pipe pens with a 18 roof over parts of it. But that's something that we 19 need to look at. There's not much signage there, but 20 there is some. We think that Road & Bridge could 21 provide the signage. A couple of stop signs up by the 22 facility and a stop signs down Spur 100. That's it. I 23 mean maybe a few others. 24 COMMISSIONER OVERBY: Maybe a speed limit 25 sign. 81 1 COMMISSIONER LETZ: Yeah, a speed limit 2 maybe. Wouldn't be over probably four or five signs. 3 Not that much. We figured Road & Bridge would be able 4 to take care of that minimal amount. 5 Currently, there is a perimeter fence around 6 the facility with an electronic gate to get in there. 7 There's a chain link fence around by the facility. And 8 the gate to get into it is electronic. Down at Spur 100 9 there isn't one. And not one planned. There is cameras 10 up in the building, but there's no cameras down Spur 11 100. And Commissioner Overby and I thought that, you 12 know, they'll need to add that into the bid package, but 13 a swing pipe gate to me would make sense possibly down 14 there at Spur 100. I don't know. Or we could wait and 15 see if we have a problem with people just driving up to 16 the facility after hours at night. So it's just 17 something I wanted to point out. We don't have to make 18 a decision on that. But there are no gates planned right 19 now at Spur 100. And someone could -- 20 COMMISSIONER OVERBY: To discourage, yeah. 21 COMMISSIONER LETZ: You know, if you put up 22 a gate, well people can drive right around it because 23 it's a field. So we'll have to have -- you know, do 24 some things there as well. 25 On the landscape side, again, and it's 82 1 minimal. I don't think anything's been -- nothing is in 2 the budget for landscaping. Something that we do need 3 to address, though, is down along the cemetery. Brown 4 Cemetery and the VA Cemetery. And we had mentioned 5 several times that we would do some screening. And in 6 my mind I thought, you know, probably maybe a berm of 7 trees or just trees along there would -- would make 8 sense, but just something that we're going to have to 9 look at down the road. And that was mentioned this 10 morning by Miss Oates. 11 And then phone service. Well, I guess mainly 12 that's just for Bruce. They do need a system with some 13 intercom capabilities. 14 MR. MOTHERAL: We got that. 15 COMMISSIONER LETZ: Yeah. 16 COMMISSIONER OVERBY: Okay. 17 COMMISSIONER LETZ: And just -- I'll have 18 Reagan get with you and Peter Lewis to get with you 19 exactly what that is, but that's something that's not in 20 the budget. That's outside generally. 21 MR. MOTHERAL: Okay. 22 COMMISSIONER LETZ: But you do need to get 23 on the electrical plans as to what you need in the 24 building, in the offices from a wiring standpoint to 25 make sure that that portion is covered. And more and 83 1 more is wireless now days, but that's something that 2 needs to be looked into. 3 Those are the things that I wrote. You 4 know. Looked at a lot of other -- everything from 5 countertops to on down the line. Anything I left off? 6 COMMISSIONER OVERBY: I think you covered 7 most of that. 8 COMMISSIONER HARRIS: Well, while y'all are 9 talking about this, you know, for the public you know, I 10 know we got an e-mail the other day people think we're 11 dragging our feet on this kind of stuff. What's the 12 prognosis or when we might have something going? 13 COMMISSIONER LETZ: It is still going 14 through the City platting process. They're in the 15 process of or getting very close to submitting it to the 16 City of Kerrville for approval of the building plans. 17 Things of that nature. Going through and making sure. 18 They're just about ready. In fact, I think we were 19 thinking about making some minor change and they said 20 no, no, no, please don't make a change right now. 21 COMMISSIONER OVERBY: We've got it ready to 22 go. 23 COMMISSIONER LETZ: The plans need to get to 24 the City. 25 COMMISSIONER PACES: So when would you 84 1 likely go out for bids? 2 COMMISSIONER LETZ: Sometime midsummer. 3 COMMISSIONER PACES: Midsummer. And then 4 for the public, because I get complaints all the time 5 that I'm holding up, and I assure you I am not. This 6 was approved by the voters. So what's the likely time 7 frame that we would have a completed new facility? 8 COMMISSIONER LETZ: It'll be probably first 9 quarter of next year. I asked if it would be -- I was 10 told at the meeting that it would not be done while I'm 11 still in office. 12 COMMISSIONER PACES: That sounds pretty 13 aggressive actually if the bids go out this summer, I 14 don't know. Anyway -- 15 COMMISSIONER HARRIS: I'm telling everybody 16 you're holding it up. 17 COMMISSIONER PACES: That explains it. I 18 have nothing to do with it. 19 COMMISSIONER LETZ: Essentially it's two 20 metal buildings, pre-engineered type metal buildings. 21 One's the office and the cat area. Then there's a dog 22 area. And then there's kind of a constructed area to 23 connect the two. It's -- 24 COMMISSIONER OVERBY: They're calling it 25 Building A and Building B. 85 1 COMMISSIONER LETZ: Yeah, Building A and 2 Building B and Building C. It's -- you know, it's a -- 3 exactly what -- it's a -- I don't want to say bare 4 bones, but it's not fancy. And it's a -- basically an 5 animal control facility. It's meeting our needs. And a 6 lot of time it's gone into getting the dog area where it 7 is and cat area, and kinda how all that needs to be. 8 There's, you know, air conditioners and 9 things of that nature are -- are expensive, because you 10 have the isolations for the dogs, have to be in separate 11 exhaust system, and the cats the same thing. But the -- 12 spend a lot of time on, you know, learning on things 13 that we have done wrong on the current facility, trying 14 to get the -- for example, the drains. How to get the 15 drains, when you're cleaning out the kennel area to 16 work. 17 So, you know, a lot of time has gone into 18 the details of the facility and really trying to make it 19 through the work flow. It is set up -- we pretty much 20 told them they need to go with a card system instead of 21 a key system for most of the doors. There's a door that 22 goes from the kind of reception area into all the office 23 area. And for kind of -- and then there's a door there 24 that goes all the way to the cat area and dog area. So 25 certain people can have access to certain areas. Just 86 1 like KCAS, they would have a code where they can get in 2 and their access would be into the dog area and cat 3 area, but not into the office area. There's a lot of 4 details. You gotta figure out where you're going to 5 store drugs in a secure area. You have to have three 6 locks for drugs. You have to have three different lock 7 systems before you get to where the drugs are. Same 8 with firearms. They have some firearms out there. 9 You have to have -- I mean, there's a lot 10 more that goes into it than you would even think about 11 once you start getting into the details. So -- but it's 12 progressing. 13 JUDGE KELLY: But to summarize for the 14 public so they know where we stand. The two 15 Commissioners and -- are working diligently trying to 16 get these details worked out. We're expecting hopefully 17 to be able to go to bid by this summer, which would 18 probably mean construction starting probably about time 19 school starts. Somewhere in there. And hopefully 20 complete maybe by next spring or in the summer, 21 depending on delays. Because it always takes longer 22 than you think. But we're talking about probably a year 23 from this summer we should have it up and running. Does 24 that sound about right? 25 COMMISSIONER LETZ: Yeah. 87 1 COMMISSIONER OVERBY: Yeah. 2 JUDGE KELLY: Okay. 3 COMMISSIONER HARRIS: And nobody's dragging 4 their feet on this. I'll make a 25 motion that the Court grant authority to County Engineer 92 1 to negotiate with the owner of -- whatever that lot is. 2 MR. HASTINGS: Lot 8. 3 COMMISSIONER PACES: Lot 8 River Crest 4 Subdivision to provide some level of compensation for 5 the claim that he has made. 6 COMMISSIONER LETZ: Second. 7 JUDGE KELLY: Got a motion and a second to 8 authorize the County Engineer to work towards resolution 9 of the dispute with the owner of lot 8 in River Crest 10 Subdivision.
