It 2 is Monday, September the 9th, 2024. It's 9 o'clock in 3 the morning and the Kerr County Commissioners' Court is 4 now in session. If you would, pease stand for the 5 prayer and the pledge, which will be led by Commissioner 6 Paces. 7 (Prayer and Pledge) 8 JUDGE KELLY: First item of business. I want 9 to remind everybody to turn your phones off or to 10 silence, Or put it on buzz so you don't interrupt the 11 proceedings. And with that, the first item of business 12 on every regular Commissioners' Court meeting is public 13 input. And this is the opportunity for us to hear what 14 the public wants us to know. We don't have the 15 opportunity to reply, but we can certainly well listen. 16 And we ask that you limit your remarks to three minutes. 17 And with that, I have one request to speak 18 and that's Nikki Caines. 19 MS. CAINES: Thank you. Good morning, Judge 20 and Commissioners. My name is Nikki Caines and I live 21 here in Kerrville. This is my appointment letter from 22 last year as the early voting ballot board judge. And 23 I'm here to say that my term has ended. On that date, 24 which was August 14th, the Court approved and appointed 25 all judges, the polling locations and everything. And 8 1 it was requested by Nadene, who was the Elections 2 Coordinator at the time, and she has the reputation of 3 holding that position for quite some time. 4 Two weeks ago on August 26th, Miss Alford, 5 now the County Clerk, requested approval for early 6 voting locations, election day polling locations, 7 polling judges, and individuals working on election day 8 and central count. What was not included then or on 9 today's agenda are the names of the early voting ballot 10 board judges for your approval. It is no small 11 commitment for the judges and the board members who 12 serve two weeks before and including election day, plus 13 one day after the final canvas. 14 After the runoff election in May, I 15 requested from the deputy of elections a deadline for my 16 submission of names for those willing to serve on the 17 board for this upcoming general election but was never 18 informed. Regardless, I e-mailed on July 20th, 23rd, 19 and August 22nd to try to clarify the names and the 20 status of those I submitted, including myself. To date, 21 I have not received any response. 22 I am not here asking to be appointed. My 23 understanding is that the County chairs may recommend 24 other people who are willing to serve, and I respect 25 this. I am here to encourage the Court to follow 9 1 through, and ensure that that communication is 2 happening, and that those recommendations will follow. 3 Your next court date is September 23rd and election 4 season is fast approaching. The early voting ballot 5 board requires training and begin serving at the start 6 of early voting, which I believe is the 21st. I am also 7 asking that the Court and County employees respond to 8 citizens in a timely manner, answer questions, and 9 communicate the direction of the Court. Thank you. 10 JUDGE KELLY: Is there any other public 11 input? There being none, we'll move on to Commissioners 12 Comments. Precinct 1. 13 COMMISSIONER OVERBY: Precinct 1 got plenty 14 of rain. Super excited. I think everybody else did 15 too, so I don't feel bad. 16 Last Thursday, I had the pleasure of 17 attending -- I got there on the tail end of the benefit 18 -- the Veterans Benefit Fair. 76 tables were set up for 19 vendors. I got to visit with all the folks there and 20 everybody overwhelmingly thought it was well worth their 21 time to be there. And the added bonus was to get to 22 network with some of the other people that were setting 23 up booths. Cudos to Jenna and Chase, they did an 24 awesome job. 25 (Phone ringing.) 10 1 MS. ALFORD: Sorry. 2 COMMISSIONER OVERBY: That's all. 3 COMMISSIONER PACES: I didn't realize we had 4 a time limit. 5 MS. ALFORD: Sorry. Sorry. 6 COMMISSIONER PACES: Well, the burn ban 7 remains lifted in Precinct 2, or all of them for that 8 matter, and we have, as Commissioner Overby stated, been 9 blessed with rain. That's been great. 10 So recently, just working with our County 11 Engineer and our grants coordinator to provide 12 clarifications on the engineering and architectural 13 services RFQs and just so that everybody who might be 14 interested is aware, the submittals are due this -- the 15 13th and we'll be opening them next Monday, on the 16th. 16 And otherwise, I spent the last few days 17 over in Florida. Very momentous occasion for my family. 18 My mother celebrated her centennial birthday. It was a 19 great function. She's doing great. I'll just comment 20 that what a relief it was to arrive in San Antonio late 21 last night. It was cool and there was no humidity. So 22 count our blessings. 23 JUDGE KELLY: Good. Precinct 3. 24 COMMISSIONER LETZ: A couple things. One, I 25 would encourage everyone that if you haven't been down 11 1 Highway 27 by the AG barn, the field is full of American 2 flags, which is very impressive. It's just almost 3 moving just to drive by and see that display. 4 Another thing that's on the agenda today is 5 the 391 agreement. But I have visited with Commissioner 6 Carpenter in Kendall County, they're kind of the same 7 thing. They're kind of evaluating where they are on it. 8 They've talked with Chip Roy. They're not sure, you 9 know, where they're going to go with that. But I said, 10 well, first thing to do is communicate -- keep 11 communication on that. 12 And there was another thing I had but I 13 forgot what it was so it must not have been important. 14 Oh, I know what it was. It is important. Kerr County 15 is a recipient of a national award for the sewer project 16 that's been going on for a number of years. To be 17 honest, I'm not sure of what the exact name of the award 18 is, but it's related to the environmental cleaning up of 19 the river and the water state revolving fund. But my 20 understanding is that we're -- it will be announced at a 21 meeting in Nevada. I don't believe anyone from the 22 Court is going. But it is a bit of an honor. 23 And it goes back to Commissioner Bill 24 Williams that had this vision after we had some success 25 in the Kerrville South similar type project, which was 12 1 also very successful. But anyway, that's it. 2 COMMISSIONER HARRIS: All right. I don't 3 have a whole lot other than right here at the courthouse 4 since the last time we met and we've gotten right at six 5 inches of rain. And that's -- kind of goes -- the Judge 6 said he got about the same amount in that time span and 7 I did, too. So even our furthest west people in Kerr 8 County got a pretty good rain awhile back. So we're 9 happy with that. 10 One thing coming up this Saturday, the 11 Ingram Volunteer Fire Department fundraiser. And it'll 12 go virtually all day. You know, they'll have a bunch of 13 chairs that are painted and -- by different schools 14 around the area; not just here in Kerr County. And 15 those chairs are auctioned off and they're kind of neat. 16 It's worth seeing. And I can't remember the exact 17 times. I'm thinking maybe 10:00, 11 o'clock when it 18 kicks off. And there will be a bake sale and all that 19 kind of stuff. So stop in there and, you know, help 20 these volunteers. That's all I've got today. 21 COMMISSIONER PACES: The only thing we might 22 have skipped over is there is the Walk of Honor this 23 Wednesday afternoon. Anybody remember what time that 24 starts? 25 JUDGE KELLY: 5 o'clock. 13 1 COMMISSIONER PACES: 5 o'clock. Yeah, I'm 2 looking forward to that. 3 JUDGE KELLY: We'll have a proclamation here 4 in just a minute. 5 COMMISSIONER PACES: Good. 6 JUDGE KELLY: But one thing I would remind 7 everybody, is that the Field of Honor flags, my wife and 8 I have our father's flags there. And if you haven't 9 done one, I recommend that you seriously consider it. 10 If you haven't gone, if you haven't driven by or walked 11 through it. And they play taps at sunset every night. 12 It is a very appropriate and honorable thing to do. So with that, we'll 18 move on to the Consideration Agenda. And the first item 19 today is 1.1, which is recognition of Brianna Aragon, a 20 Part-time Temporary Engineering Technician, for 21 outstanding work in the Engineering and Road & Bridge 22 Departments. 23 MR. HASTINGS: And I have Brianna here with 24 me. She's standing next to me -- come over here so 25 people can see you. Right there, Brianna. I'd like to 14 1 brag about this gal. She came and worked for us this 2 summer for 16 weeks. She did an excellent job. 3 Brianna Aragon worked in the Engineering and 4 Road & Bridge Departments during the Summer of 2024 as a 5 Temporary Part-time Engineering Technician through an 6 agreement with Schreiner University. During that span, 7 she accomplished much with little to no oversight or 8 instruction. Examples of her work are: Learn to use 9 geographic information system software and accurately 10 measure construction material quantities. Develop -- 11 she developed engineering cost estimates for potential 12 road work projects. She mapped groundwater, monitored 13 water well locations, and looked up the historical water 14 level depths. That was a little special project I 15 needed. 16 Interacted with the public and solved 17 customer problems. Archival and reorganization of 18 department files. She attended development plan review 19 meetings, assisted with construction inspection, 20 assisted with development plan review, and other duties 21 as assigned. That's the catch all. Brianna is a senior 22 civil engineering major at Schreiner University, where 23 she will graduate this fall with a bachelor of science 24 degree and will go on to pursue professional engineering 25 status in the years to come. Please join me in thanking 15 1 Brianna Aragon and Schreiner University for her 2 outstanding service this summer. 3 (Applause) 4 MR. Michael Oates. 16 GENERAL OATES: Good morning, Judge Kelly 17 and Commissioners. Thanks for your service to Kerr 18 County. My wife and I, Barbara, live in Precinct 2 in 19 Kerr County. And I'm here to offer for your 20 consideration a proclamation to commemorate 9-11 as 21 Patriots Day in Kerr County. Judge, I know you've seen 22 the draft proclamation. We can dispense of the reading, 23 or would you like me to read it? 24 JUDGE KELLY: We have not only seen it, 25 we've signed it. 16 1 GENERAL OATES: Okay. 2 JUDGE KELLY: And at this point, let me just 3 take a vote. Those in favor of approving the 4 proclamation for the Patriot Day observance in Kerr 5 County as presented say aye. You may proceed. 6 GENERAL OATES: Okay. So there's going to 7 be like three of our own residents where we're going to 8 recognize at this walk on Wednesday. The walk will be 9 at Schreiner University starting at 5:00. There will be 10 some short remarks and then people are invited to take a 11 1.7 mile walk. Along that walk, they're going to see 12 pictures of representative sample soldiers, sailors, 13 airmen, Marines that were killed every year. 14 Three of our own residents will be 15 recognized there and just to remind our citizens of the 16 sacrifices that were made for the 20 years post 9-11. 17 That event has seemed to, you know, fade into memory, 18 and so we're going to start this as an annual event and 19 we'll see how the turnout goes. ALFORD: We took a vote but -- 3 JUDGE KELLY: We need the motion and a 4 second. 5 COMMISSIONER PACES: I'll move we -- 6 COMMISSIONER OVERBY: I make the motion that 7 we accept the proclamation. 8 COMMISSIONER HARRIS: And second. 9 JUDGE KELLY: This is a proclamation for the 10 Patriot Day observance in Kerr County. 11 WHEREAS, the United States of America was 12 attacked on September 11, 2001 by Al-Qaeda terrorists 13 who hijacked three passenger jets and flew them into the 14 Twin Towers in New York City and the Pentagon in 15 Washington, D.C.; and 16 WHEREAS, 2,977 innocent civilians and 343 17 brave firefighters were killed in the attack that day 18 also causing widespread fear and disruption to all 19 facets of American life; and 20 WHEREAS, brave citizens aboard United 21 Flight 93 fought back against the terrorists and crashed 22 the aircraft in Shanksville, Pennsylvania, doubtlessly 23 defeating the hijackers' plan; and 24 WHEREAS, successive Presidents of the United 25 States since 2002 have issued Executive Orders annually 18 1 declaring September 11 to be recognized as Patriots Day 2 in remembrance of those lost on September 11, 2001; and 3 WHEREAS, the United States deployed over 4 800,000 Soldiers, Sailors, Airmen, and Marines to combat 5 in Afghanistan, Iraq, Syria, and the Horn of Africa in 6 20 years following the attacks to defeat Al-Qaeda and 7 their successors in the Islamic State; and 8 WHEREAS, the Armed Forces of the United 9 States have performed with tremendous valor and 10 sacrifice during the Global War on Terror from 2001 to 11 2021 and have suffered over 7,000 warriors killed in 12 defense of the American people; and 13 WHEREAS, thousands of veterans from the 14 Texas Hill Country have served with honor in the 15 multiple combat campaigns in the Middle East and Africa, 16 with three Kerr County Veterans being among those 17 killed: Jacob C. Leicht, Lawrence D. Ezell, and Cody J. 18 Orr; and 19 WHEREAS, Kerr County leaders and the public 20 have faithfully supported its veterans and recognized 21 their service and sacrifice for their country. 22 NOW, THEREFORE, the Kerr County 23 Commissioners' Court, does hereby recognize 24 September 11, 2024 as Patriots Day in Kerr County, 25 Texas, and we call this observance to the attention of 19 1 all citizens and extend our heartfelt gratitude to those 2 veterans who have served in the Global War on Terror. 3 Adopted this 9th day of September, 2024. And it's 4 signed by all of us. 5 And, General, if you'll come down I want to 6 get a photo op on this. But as you're coming down, I 7 want to hold up. The last time that we sat aside each 8 other was at a Memorial Day event and he gave me these 9 cross cannons and missiles. This is the symbol of the 10 United States Army Air Defense artillery, where I 11 served. 12 GENERAL OATES: First fire. 13 JUDGE KELLY: Yes, sir. And I've kept this 14 close. Very meaningful to me. And I have something I 15 want to give you today. We're getting ready to talk 16 about the Daughters of the American Revolution. And 17 they gave out pins at their soiree this last weekend, 18 the convention or whatever it was. There were 700, I 19 know that. 20 VOICE: It's a conference. 21 JUDGE KELLY: And they gave out this pin and 22 I want to give this one to you in honor of renewing the 23 interest and dedication to remembering September 11. 24 And it says, We Remember 9-11-2001. I am not to invite her to the podium. I will 16 read the Proclamation myself. I've been instructed. 17 This is a Constitution Week Proclamation. 18 Whereas, the United States Constitution was 19 signed by 39 men, with 55 delegates in attendance at the 20 Constitutional Convention in Philadelphia's Independence 21 Hall on September 17, 1787, securing the nation's 22 commitment to freedom and democracy; and 23 Whereas, the United State Constitution has 24 guided us through more than two centuries of growth and 25 change and still serves as a model for democratic 21 1 governments around the globe; and 2 Whereas, the 237th anniversary of the 3 signing of the Constitution provides a historic 4 opportunity for the citizens in Kerr County to pay 5 tribute to our Founding Fathers and to reflect on the 6 rights, privileges, and responsibilities of citizenship; 7 and 8 Whereas, today, the United States still 9 stands as a beacon of democracy and tolerance, inviting 10 the world's nations to pursue justice, provide freedom, 11 and protect liberty for their people. 12 Now, therefore, be it resolved that the Kerr 13 County Commissioners' Court hereby proclaims 14 September 17 through 23 as Constitution Week and 15 encourages the citizens of Kerr County, Texas, to work 16 together to foster a greater understanding and 17 appreciation of the Constitution and the rights and 18 duties of citizenship. 19 And I will ask -- I'll make a motion that we 20 approve this. 21 COMMISSIONER HARRIS: Second. 22 JUDGE KELLY: And ask all those in favor to 23 say aye. Sherri Jones. 16 MS. JONES: Good morning, Judge Kelly. 17 Thank you so much, Commissioners, for allowing me to be 18 here. I'd be remiss if I didn't start off by saying 19 thank you for the opportunity to meet with you today and 20 I'll tell you, there's a lot of stress following that 21 kind of amazing stuff this morning. So hopefully I can 22 bring some more good news. It's great to see y'all. 23 And I really just want to take just a moment 24 to say thank you to Jody. Jody has just been such a 25 true professional in all the time that I've worked with 23 1 Kerr County. And I can't thank her enough for her 2 professionalism and kindness and just being amazing to 3 work with. So thank you. 4 Over the past 12 years I've had the 5 privilege of working with Kerr County during my tenure 6 in the waste and recycle industry. In May I resigned my 7 position to build Garbish 365, a waste and recycle 8 vendor consulting firm. Garbish 365 is a waste and 9 recycle vendor consulting company. We work directly for 10 our clients. 11 Our effort have achieved significant savings 12 for local Kerrville and Kerr County businesses. We have 13 achieved this by using over a decade of industry 14 experience to best negotiate vendor contract terms and 15 conditions, how to reduce monthly, and one-time service 16 call on behalf of our clients. We offer both one-time 17 negotiation and/or monthly maintenance and contract 18 negotiations. 19 I am here today to request approval from the 20 Court to conduct a no cost vendor waste audit on the 21 eight Kerr County locations and vendor account. Once 22 approved, we will gather needed account information to 23 assess the current service levels, current service 24 rates, and contract terms and conditions. This will 25 give us everything needed to make our recommendations to 24 1 the Court for consideration. 2 Once the information is received, our 3 findings and recommendations will presented to the Court 4 within ten business days. If we find that there is cost 5 savings opportunities and new vendor contract is 6 merited, I will present a proposal for our services for 7 review and consideration. 8 For additional resources to validate my work 9 with the County, I would ask that you reach out to 10 Charlie Hastings and Kelly Hoffer, and Jody, and Shane 11 Evans is my hero. He's such a professional and such an 12 asset to our County. And I can't thank you enough for 13 keeping on board such amazing people to work with. So 14 at this time, I'd like to pass it back to the Court for 15 comments and questions. Thank you. 16 COMMISSIONER LETZ: The general question is 17 to -- can you explain exactly how you make -- how 18 savings are generated? Let me put it that way. 19 MS. JONES: Savings are generated through 20 the assessment of the contract. Is the contract a valid 21 contract? Is it protecting you in the future over rate 22 increases that are coming ahead? If you're not in good 23 contract right now and you're in a rollover, those rate 24 increases right now can be anywhere from 28 to 35 25 percent. So with rate caps we can get those down 25 1 anywhere from the market 10 to 15 percent. So we really 2 want to truly protect the County, and all my clients, 3 now and in the future. 4 Also, looking at vendor rates, rates will go 5 up as we just discussed. And in that time, we need to 6 see if the market value is being sought after. We need 7 to make sure that the rate is competitive. 8 COMMISSIONER LETZ: I guess my question is, 9 is that most of those -- be it whoever does our -- picks 10 it up in the area now, most of it, those contracts are 11 terrible for the most part for the person who has the 12 waste. And I say that from a -- being a small business 13 owner and trying to change one of those contracts. It's 14 almost impossible. How can you -- how do you go in and 15 modify the contracts with the waste industry? 16 MS. JONES: That is done through the 17 negotiation with them to adjust that verbiage to make 18 sure that your best interests are held over the extent 19 of that contract. And that can and would be done. 20 COMMISSIONER PACES: I guess I'm kind of 21 curious. How much do we spend on waste disposal and 22 recycling? I mean, do we have financial leverage to 23 improve commercial terms? 24 MS. JONES: Well, that's what -- and I'm 25 sorry to interrupt you and interrupt the question, but 26 1 that would be a challenge at this moment only because 2 you have a site. So to tell you exactly what that whole 3 picture looks like, that I can do and I would do in my 4 assessment. 5 COMMISSIONER PACES: Yeah. I mean it 6 just -- it doesn't jump out at us. We just went through 7 our budget process and I can't remember any particular 8 budget line item for waste or recycling. 9 COMMISSIONER OVERBY: But you're here today 10 to offer to do this at no cost for us -- 11 MS. JONES: Yes, ma'am. 12 COMMISSIONER OVERBY: -- just to evaluate 13 what we've got going on? 14 MS. JONES: Yes, ma'am. No cost assessment. 15 I go in and take a look at everything and then report 16 back to you the benefits of what, you know, can be 17 offered. Again, at no cost to the County whatsoever. 18 At that point, once that is presented, if I find that a 19 new contract is merited or there is a cost savings, then 20 I'll present you with options and my proposal. And 21 again, you're leaving -- even if you do nothing, you're 22 leaving with nothing more than some great information 23 that may help you in the future. 24 COMMISSIONER LETZ: It's a great proposal, 25 I'm just curious where we can save money. 27 1 COMMISSIONER PACES: I am too. 2 MS. This is a joint project of the Hill 16 Country Master Naturalist and Native Plant Society. 17 Also will provide a report on progress of Bird City 18 Kerrville. Katy, is it Kappel or Kappel? 19 MS. KAPPEL: Yes. Good morning. Katy 20 Kappel. I'm a master naturalist and I live in 21 Kerrville. When I was here last, I was talking about a 22 bird blind and y'all had some concerns about the 23 floodplain and, by golly, we got a flood, didn't we? I 24 was glad we hadn't build the bird blind down here. 25 However, when we built -- y'all built the Veterans 29 1 Pathway, they cleared probably 20 feet of brush. And 2 when the flood came and then some heavy rain, there's 3 been some erosion. And I talked to Mr. Paces' office 4 and he got Charlie Hastings over there. And they're 5 going to have Road & Bridge look at it and see if maybe 6 there needs to be something done that will alleviate 7 some of that. But -- 8 MR. HASTINGS: And it won't be Road & 9 Bridge. Don't give Kelly a heart attack. 10 MS. KAPPEL: Okay. 11 MR. HASTINGS: Shane's going to be able to 12 do it himself. 13 MS. KAPPEL: Okay. 14 MR. HASTINGS: And he has a good plan in 15 place. 16 MS. KAPPEL: All right. But there wasn't 17 anything planned. The City on the other side planted 18 grass. We can't grow grass under there because it's 19 shady. So on November the 2nd, we're having a project 20 community wide of all the garden clubs. We're going to 21 go in and plant native plants at different public 22 buildings and non-profits. So this is, you know, a 23 community wide thing. But we have the Native Plant 24 Society master naturalist wants to go in and do some 25 planting around the Veterans Pathway to keep the erosion 30 1 from happening again. And this is at no cost to the 2 County. They're saving up some plants now. 3 And I notice these folks were already over 4 at the courthouse a week or two ago getting ready to 5 plant some things there. So that's my one point is to 6 ask permission for us to do that project on the 2nd of 7 November and get some things in there to make it look 8 better and hold the soil down. 9 I did want to get back to you about the bird 10 blind thing. We are -- we've given up the idea of 11 putting anything in the floodplain and we're working 12 with the Kerrville parks and rec department right now to 13 build one in Kerrville Schreiner Park. I would still 14 like to put one in Flat Rock, but I think we need to get 15 one up before we think about another one. And I will 16 come back to you with specific plans about that when we 17 get to that point. But having 13 a chance to hear everything that Katy had to say, you 14 know, that area wasn't growing anything because the 15 trees were so thick. The trees had to be cut down to 16 allow sunlight to come through for the first time on 17 that kind of forest floor, if you will. And we are 18 having erosion issues. So I think if they can get some 19 native things established in those areas that are 20 getting the sunlight, it's probably going to help more 21 than anything. 22 MS. KAPPEL: There's a whole area of 23 gardening happening to do with the banks and -- because 24 people -- it comes up and they don't want the banks to 25 wash away. So we want to do that. 32 1 MR. HASTINGS: Sure. But if it -- if it's 2 native then they should be hardy and it should do what I 3 think they're anticipating. And it's a great way to 4 honor the veterans. 5 COMMISSIONER PACES: Okay. And for those of you that 24 don't know, this is a very important service that is 25 provided. They do it at a below market rate fee. And 34 1 the judges frequently refer people to the mediation 2 center so they can get the cases settled that don't need 3 to go to trial. This is something that we've been 4 supporting historically as far back as I think when we 5 opened it, which is, what, 20, 25 years ago? Mr. Givens. 8 MR. GIVENS: Good morning. I just wanted to 9 make some mentions here of some recent donations for 10 your acceptance. Recently we've had Kerrville Pets 11 Alive has donated 75 cat vaccines totaling $228.00. 12 They've supplemented dogs who were reclaimed fees for 13 $250, and that's an ongoing donation during the year. A 14 Portacool Cyclone 160 water cooler for the dog kennel 15 area, which has made a huge difference back there. It 16 gets pretty warm during the summer. So that's -- it's 17 big and it puts out a lot of cool air. 18 COMMISSIONER OVERBY: A swamp cooler. 19 MR. GIVENS: And then also a canopy for the 20 dog yard. Those are a few things I just wanted to 21 mention on here. They weren't -- some of these 22 donations that I'm about to mention are not made 23 directly to Kerr County Animal Services, but they do 24 help the community and are worth noting. 25 KPA also donated a recent $1,000 to the Hill 42 1 Country Animal League for spay and neuter. This just 2 supplements the county voucher to get new adopted pets 3 fixed. And they also keep a fund going at various other 4 vets for when a pet is adopted from KCAS and they pay 5 the difference between the county voucher and what the 6 total cost is to get that pet. GIVENS: Well, so some of this stuff and 7 I'm not sure whenever there's a stray if they -- animals 8 that are actually being strayed out there, you know, the 9 involvement out there is -- some of this pertains to 10 that. You know, I'm not exactly sure, you know, how 11 many -- you know, like the Sheriff's deputies and things 12 like that. Whatever they're required, however many are 13 required to be out there. So I'm not sure exactly how 14 those types are collected. 15 I know that whenever we do some of this 16 stuff -- like we kind of ran into a situation the other 17 day where the constables were needing to sequester some 18 horses. And we didn't actually end up with them because 19 it was just in their best interest to stay where they 20 were at. But that would have been something -- 21 basically, we're just -- we want to get a little bit 22 better of getting some of these fees back. Because we 23 go out and buy feed and stuff like that for the animals 24 and they may be there for ten days, they may be there 25 for one day. We just -- you know, we don't know. 45 1 Depending on the court. So we just want to try to get 2 some more of that back. 3 COMMISSIONER HARRIS: No, I'm mainly talking 4 like dogs and stuff. You know, my dog gets out, you 5 know, unbeknownst to me, and y'all pick him up and then 6 there's a pen fee and initial fee and then hourly fee 7 and so on. 8 MR. GIVENS: Well, so -- so when the dogs -- 9 that's all -- that's all on our other fee schedule. This 10 is actually just the actual livestock. 11 COMMISSIONER HARRIS: Oh, okay. So 25 I'm just going to give a report on our quarterly report 48 1 from April to June. We have -- we had an increase of 2 tax rate income for 66 veterans and seven surviving 3 spouses. The amount for the retroactive money and the 4 new annual amount is $1,312,800.00. We've completed 38 5 trainings. We have 91 new clients. So we are busy 6 bees. 7 We also had a lot of stuff happen. The 8 Veterans Pathway ribbon cutting ceremony, our annual 9 Memorial Day event, and we also hosted annual training 10 to keep up our accreditation requirement. We had 19 11 counties and four Texas Veterans Commission clinics. It 12 was for three days, it was very good. 13 And then last week we had our benefits fair, 14 which was very successful. I'm so sorry. I'm getting 15 my notes out. We had -- we don't know the exact number 16 of how many people came, but we know there was at least 17 450. We had people come as far as Del Rio and Eagle 18 Pass. A lot of good information came out. We had a lot 19 of people come and approach us, so we had people that 20 didn't know they were eligible for certain healthcare. 21 And then their little packet of education and Texas 22 Veterans Land Board, and Fort Sam Cemetery and get 23 claims submitted, so it was very successful for us. 24 We had someone show up as early as 8:45. 25 They wanted to make sure they weren't lost and knew how 49 1 to get there. Everybody came, spouses, veterans, they 2 all showed up. It was very meaningful and we are very 3 happy for us to be our first one and we do plan on 4 hosting another one. Not next year, but probably the 5 following year. 6 Oh, we also had over 70 vendors that were 7 available to provided these services. This is a 4 great example of -- and we're getting read to talk about 5 tax rate in a minute. This is something that is not 6 required by State Law that we do this. This is 7 something that this County decided to do to help our 8 local veterans. And we all get e-mails that we just 9 need to cut back, cut back, only do what we're supposed 10 to do. 11 And this is an example in my mind of 12 something that we need to keep doing and are continuing 13 to do. It's in our budget again. And just to show the 14 taxpayers, I mean, the amount that we're bringing in, 15 1.3 million additional dollars into this County is 16 amazing on an annual basis. That's a phenomenal number. 17 And the Veterans Service Office, y'all do a great job. 18 MS. SANCHEZ: Thank you. 19 COMMISSIONER PACES: Let me ask, though. 20 And that's just a quarterly number, right? 21 COMMISSIONER LETZ: Yeah. 22 COMMISSIONER PACES: That's just for the 23 quarter? 24 MS. SANCHEZ: Yes, sir. That's from April 25 to June. 51 1 COMMISSIONER PACES: That's incredible. 2 COMMISSIONER LETZ: Yeah. 3 COMMISSIONER PACES: The County definitely 4 benefits, as do the veterans. 5 JUDGE KELLY: At the veterans benefit fair 6 last week, I was confronted by numerous people. Some 7 friends and some people that I didn't know. Reminding 8 me of the way the Veterans Services used to be. In 9 2017, when Judge Pollard asked me to shadow him to do 10 this job, and I was sitting in the blue chairs, we 11 virtually didn't have a veterans services department. 12 For all practical purposes, we didn't have it. 13 And after I got elected in -- and took 14 office in 2019, some of you will remember my first 15 proposed budget. I learned a lot from that. One of the 16 things was I sat down and determined what functions the 17 County performs that we're required to do by statute or 18 Constitution. Our constitutional duties, our statutory 19 duties, the things that -- law enforcement. Roads. The 20 legal system that -- we're required to do this by law. 21 There are some things that the County does 22 that we have chosen to do. And I call those elective. 23 There was the mandatory and elective. Some of y'all may 24 remember my terminology back then. It was a huge fly by 25 the way. It did not work out like we thought it was 52 1 going to work out. And the two things that -- that 2 happened since then has been we turned veterans services 3 around. It is probably the most improved department 4 that we have in the County. And I commend you for it. 5 MS. SANCHEZ: Thank you. 6 JUDGE KELLY: That's not to say that the 7 other departments don't do good work, they do. But they 8 weren't in as bad shape as Veteran Services was. And 9 people would remind me about, remember when you told us 10 that we didn't have to do that? Well, we don't. But we 11 do it because it's the right thing to do. 12 And we learned our lesson with Veteran 13 Services and with Kerrville Pets Alive. Because that 14 was another one that we don't have to do. We manage 15 rabies. That's what we're required to do by law. And 16 you can see our animal control facility and that whole 17 function has been greatly expanded. And we do that 18 because the public has asked us to do it and it is for 19 the public good. 20 And so it's a shout out to not only 21 veterans, but to KPA and what we're doing over there. 22 There are some things that the public needs to know. We 23 spend taxpayer dollars to assist these programs because 24 it is the right thing to do. And this one is actually 25 very profitable so. 53 1 COMMISSIONER HARRIS: Well, I'm going to add 2 to that list you just -- VFDs. That was a huge one. 3 And they're an asset to the County in a lot of ways. 4 And we give them money. A lot of counties, neighboring 5 counties, don't give them a nickel. 6 JUDGE KELLY: Yeah. The rate is broken down as follows: 3 35.47 cents per 100 dollars valuation for maintenance 4 and operations. The interest and syncing fund is 5 4.64 cents per 100 dollars valuation. And the lateral 6 road fund is 2.22 cents per one hundred dollar 7 valuation. Does that agree with your figures? 8 MRS. SHELTON: (Shakes head yes.) 9 MR. REEVES: Just want to verify with the 10 Auditor. The notice of the proposed tax rate was 11 published in a local newspaper in accordance with the 12 Texas Property Tax Code. So 18 wanted to get this moving. 19 One thing that was interesting with the 20 amount, Jody went back and looked at our -- the last 21 time we did this and it came -- we did not go out for 22 qualifications because it was under $50,000.00. At this 23 time, I think we budgeted 50,000. But if we internally 24 cut that back, we don't need to go through that process 25 and we can start negotiating the people who say we'll 69 1 give a maximum of 45,000 and see if we can do it or we 2 can put it out for bid. I don't know. 7 COMMISSIONER LETZ: It depends on -- I 8 don't -- I personally don't think we need to go into as 9 much depth as we have in the past. I don't think we 10 need to -- I think we need to look at salaries and do a 11 comparison across some counties, and then look at the -- 12 a lot of the work was done by the public sector. They 13 did our last thing. They put together ranges. The 14 Court never really finalized and got us into that. 15 So I think it's really -- look at that. And 16 I just don't think it should cost over $50,000.00. 17 JUDGE KELLY: I'm inclined to agree with 18 you, but I'd like to hear from our HR Director. 19 MS. And so, kind of 14 looking to you. You're closer to that market than I am. 15 MS. Item 1.24 quarterly 17 update regarding the current and future grant 18 opportunities for Kerr County Sheriff's Office. 19 Lieutenant Gaige. 20 LIEUTENANT GAIGE: Good morning. Just a 21 quick update on our current grants that we have at the 22 Sheriff's Office and upcoming grants that we are 23 expected to see. Currently, we have two of them active, 24 which is Operation Lone Star and the other one is 25 Operation Stone Garden. Those are currently active 72 1 grants that we're participating in. Upcoming grants 2 that we're waiting for funding that we applied for. So 3 by the 1st of October we should be looking at funding, 4 because that's when the grant period starts or within 5 the next week or two. One is the resistant body armor 6 grant. And the second is the, through AACOG, is the 7 ticket writer grant. So budget on the rifle resistant 8 grant is about $20,400. And the other budget for the 9 ticket writer is about 75,000, is what we're looking at 10 being funded. 11 Just some things to expect with Operation 12 Lone Star. I think it's actually the next slide we're 13 going to talk about extending the period for Operation 14 Lone Star. But Stone Garden, we were contacted about 15 two weeks ago on Operation Stone Garden from the border 16 patrol. So we're looking to fund some more equipment 17 from some funds from fiscal year 2022. That's about 18 $60,000 that they had surplus, which will be towards 19 license plate readers as well. So hopefully we'll see 20 that movement here over the next couple of months or so. 21 And with Operation Lone Star, like I said, I 22 think we'll talk about the extension on that. 23 JUDGE KELLY: Okay. Lieutenant Gaige. 25 LIEUTENANT GAIGE: So the Governor's office, 74 1 basically they extended the period for the Operation 2 Lone Star 2024 basically another year. So it would have 3 ended the 31st of August, so they extended it until '25, 4 August 31st of 2025. This is -- they're shifting the 5 grant application period for Lone Star. 6 Traditionally it was in the -- usually about 7 June, summertime it would come up. So they're actually 8 shifting it to get it online with all the other grant 9 applications which will start in December. So they kind 10 of extended this period without opening another grant 11 application. 12 They mainly want to fund -- make sure that 13 people that are -- personnel that are funded in this 14 grant continue to be able to fund it so they can keep 15 their jobs. So we're expecting maybe about another 16 120,000 to be funded to that program, which will be for 17 recovered personnel. And I think there's some equipment 18 cost that kind of will lapse within that period as well. 19 So -- 20 COMMISSIONER OVERBY: That amount is just 21 for our County? 22 LIEUTENANT GAIGE: Yes, ma'am. 23 COMMISSIONER OVERBY: Okay. 24 LIEUTENANT GAIGE: Yep. So it could be 25 more, but that's what they kind of estimate, $125,000. 75 1 If they want to give us more, we'll take some more for 2 it. 3 JUDGE KELLY: And this is informational, 4 right? 5 LIEUTENANT GAIGE: I'm sorry, sir? 6 JUDGE KELLY: Informational. No action? 7 LIEUTENANT GAIGE: Actually, so -- 8 JUDGE KELLY: You want us to approve this? 9 LIEUTENANT GAIGE: Yeah. I think 18 this is a good opportunity for the public to at least be 19 aware of the various grant opportunity. We've gotten 20 fairly aggressive with our grants. And we've been very 21 successful. It really made a big difference in not only 22 the county government but a big difference in the budget 23 too. 24 But grants are a pain in the rear sometimes. 25 There's a whole lot of reporting, and if you don't 76 1 report you get in trouble. And some of these grants, if 2 don't report within 30 days, a 30 day numbers, on some 3 of the criminal cases we have, you lose the ability to 4 have any state grants. 5 So grant management has become vital to the 6 operation of the County, and vital in terms of 7 compliance because if we don't comply, we could lose the 8 ability to get any grants from the State. And that's 9 something we certainly don't want. And so the -- the 10 entities that file most of those reports are the County 11 Clerk's office, which is not to be underestimated in 12 terms of importance. Without the County Clerk's office 13 providing those reports, we would not be able get these 14 grants. 15 And I'm appreciative of the Sheriff's Office 16 and the way that y'all have embraced grant writing and 17 grant management. And I know there was -- you know, 18 anything to start something new you always stub your toe 19 a little bit. But it's kind of become a pretty fine 20 tuned machine. And -- 21 LIEUTENANT GAIGE: Yeah, we've -- 22 JUDGE KELLY: -- I like the reports that 23 we're getting. 24 LIEUTENANT GAIGE: Yeah, we've -- myself, 25 Jody and Noel, we -- back in August we went to a new 77 1 grants deal that the Governor's Office had put on, 2 something out at AACOG. And so it was an all day, 3 8-hour class of how to use these grants. And it was 4 super exciting. 5 JUDGE KELLY: This has become a very 6 efficient tool for the County. 7 COMMISSIONER OVERBY: You've gotta do what 8 you've gotta do. 9 COMMISSIONER PACES: I'm glad to hear you 10 were so excited to attend, Scott. Jason, I know 10 this is an annual deal and everything, but just looking 11 at the numbers, you know, it's 1.1 million basically. 12 You know, is this for the money we receive from other 13 counties? Does this make about a break even deal almost 14 for the year? 15 CAPTAIN WALDRIP: It'll be close. You know, 16 we used to do these contracts in multi-year approvals. 17 Now, Wellpath want to do them once a year. Every one of 18 them is going to have a built-in at least a 4.5 percent 19 inflation or increase. So, you know, I guess the 20 overall goal would be hopefully we bring in enough 21 revenue that covers the Wellpath contract. 22 COMMISSIONER HARRIS: Okay. This is something that is not discretionary. 3 We have to provide these services. It's just another opportunity for 25 sheriff's departments to support each other in 80 1 enforcement programs, enforcement actions and task force 2 and stuff from our County or different counties. Just 3 another opportunity for smaller sheriff's departments 4 like ours, especially smaller ones than ours, that we 5 can help each other out for the enforcement duties. 6 COMMISSIONER HARRIS: That's pretty far 7 south. 8 JUDGE KELLY: Well, but they're on the 9 freeway, going down toward the coast. You get a big 10 incident over there, it can be a big deal. 11 COMMISSIONER HARRIS: Sure. 12 CAPTAIN WALDRIP: You know, Bexar County is 13 another County that has an interstate highway and 14 freeway system that it has a lot of boarder related 15 crimes. So it's another opportunity for us to help that 16 out. 17 JUDGE KELLY: A lot of these private groups 18 go through San Antonio. 19 COMMISSIONER PACES: Oh yeah. 20 JUDGE KELLY: So we gotta be prepared on 21 both sides. 22 COMMISSIONER HARRIS: Plus up. 23 JUDGE KELLY: Yep. I was at the -- 22 attended the UGRA board meeting and they approved our 23 application, which is a 90-10 grant with a maximum of 24 $125,000 to go towards the rainwater catchment system. 25 And this is just -- we have a resolution from them that 85 1 I have a copy of that I'll give to -- I don't really 2 know. Nadene probably should have a copy of it. 3 And this goes on. And the contract will be 4 coming up at our next meeting, but I did want to 5 recognize UGRA for really assisting us with this. They helped fund the initial grant to see the 10 feasibility of that study. So they continue, hogs. 11 They work with us on the hog eradication program. And petroleum rack prices, also known as 4 wholesale rack prices, are based on the cost of 5 transporting fuel from a refinery to a distribution rack 6 or racks along a pipeline. 7 Rack prices include the cost of the gas, 8 transportation, overhead and profit, but not taxes or 9 freight charges to transport fuel to retail stations. 10 Rack prices can vary by terminal and depend on several 11 factors, including crude oil cost, refining cost, 12 distance between the terminal and the retailer, and spot 13 market movements. 14 Rack prices are updated daily at 6:00 p.m. 15 and can fluctuate intraday or by region. I forgot to 96 1 raise this during the reporting time. But I did want to 2 make the Court aware that our County Auditor and myself 3 met with the new airport manager, Andrew Munoz, last 4 week. And we actually had some good news that came out 5 of it. At least relative to our budget. 6 Because the developer -- this goes to the -- 7 I think it's roughly 43 acres that the airport would 8 like to purchase. And, of course, the County's share of 9 that would be 50 percent of the 10 percent because TxDOT 10 would pay for 90 percent. But previously, we would have 11 to fund it all and then get reimbursed after two years 12 from TxDOT. Now, it appears that the developer is 13 wanting a price that's substantially greater than the 14 appraised value. The appraised value came in a little 15 over two million or so. And I'm understanding now that 16 they're wanting four and a half million, which now means 17 that it will be in TxDOT's hands and they'll go through 18 a process. 19 They'll get another appraised value, and 20 there will some form of settlement, but it's effectively 21 an eminent domain. And whatever that settlement value 22 finally is will be settled kind of on the spot and we 23 won't be having to wait for two years to get money from 24 TxDOT. 25 So the implication is, you know, while our 97 1 ten percent might be more, it will certainly be well 2 within our budgeted amount because we budgeted for the 3 full amount. So, it's good news from that standpoint. 4 We'll see where it goes. Now it's kind of out of our 5 hands and it will be up to TxDOT to resolve the whole 6 thing and come up with a settlement. 7 COMMISSIONER LETZ: Good. 8 COMMISSIONER PACES: So good news from a 9 budget standpoint anyway. 10 COMMISSIONER LETZ: Yeah. That is good 11 news.
