It's 9 o'clock in 3 the morning and the Kerr County Commissioners' Court is 4 now in session for a special meeting. 5 And we have one item on the agenda today, 6 which is 1.1 canvass the Official Election Results of 7 the 2024 November General Election per the Election 8 Code. Ms. Alford. 9 MS. ALFORD: Good morning, Commissioners. 10 In front of you are the final cumulative report for 11 November the 5th election. Usually what is done, y'all 12 will take turns reading in the race, the candidate, and 13 then the vote and the percentages. 14 COMMISSIONER LETZ: Do we need to read all 15 of them? 16 MS. ALFORD: Yes. 17 COMMISSIONER OVERBY: All the candidates. 18 COMMISSIONER LETZ: Do we read just the 19 total vote? 20 MS. ALFORD: You can read just the total 21 vote and percentage. Just whatever you would like read 22 into the record. 23 COMMISSIONER LETZ: Commissioner Overby, you 24 going to start? 25 COMMISSIONER OVERBY: I can start. 4 1 I will start with the General Election from 2 11/5/2024 for President and Vice President. I'm going to be 8 here for a minute. 9 Candidate Donald J. Trump and JD Vance -- 10 election day -- let's see, where's the total of that? 11 Oh, it's in the very light print, okay. Got it. 21,615 12 votes for a percentage of 76.73 percent. There we go. 13 Kamala D. Harris, Tim Walz, a total of 6,315 14 votes for 22.42 percent. 15 COMMISSIONER PACES: Can we just read the 16 winners, or do we have to read them all? 17 MS. I gotcha. 21 For United States Senator, Ted Cruz received 22 20,840 -- I can barely read this. 23 (Commissioner Harris passing magnifying 24 glass to Commissioner Paces.) 25 COMMISSIONER PACES: That's much better. 6 1 Colin Allred, 6,672 votes. 2 JUDGE KELLY: Percentages. 3 COMMISSIONER PACES: Oh, you want 4 percentages, too. 5 Well back to Ted Cruz, he received 74.11 6 percent. 7 Colin Allred, 6,672 votes for 23.73 percent. 8 Ted Brown received 600 votes for 2.13 9 percent. 10 Analisa Roche received 6 votes for .02 11 percent. 12 And Tracy Andrus received 4 votes for .01 13 percent. 14 The total undervotes was 215, overvotes 10 15 for the total votes cast 28,122 for a hundred percent. 16 JUDGE KELLY: Over and under. 17 COMMISSIONER PACES: I did it kind of 18 backward. 19 COMMISSIONER LETZ: United States 20 Representative, District 21. Chip Roy, 21,386 votes for 21 76.92 percent. 22 Kristin Hook, 5,925 votes for 21.31 percent. 23 And Bob King, 491 votes for 1.77 percent. 24 Voters cast 27,802. Undervotes, 543, and 25 overvotes 2. 7 1 COMMISSIONER HARRIS: For Railroad 2 Commissioner, Christi Craddick, 21,157 for 76.69 3 percent. 4 Katherine Culbert received 5,313 votes for 5 19.26 percent. 6 Hawk Dunlap received 727 votes for 2.64 7 percent. 8 Eddie Espinoza received 378 votes for 1.37 9 percent. 10 Richard McKibbin received 14 votes for .05 11 percent. 12 Total vote cast were 27,589, and the 13 undervotes were 720, overvotes 38. 14 JUDGE KELLY: I'll read Supreme Court 15 Justice. 16 COMMISSIONER HARRIS: I guess you would pick 17 that one. I'm just kidding. 18 JUDGE KELLY: Justice Supreme Court, Place 19 2. Jimmy Blacklock, 21 thousand -- Blacklock. Jimmy 20 Blacklock, 21,774 votes for 79.07 percent. 21 And DaSean Jones, 5,765 votes for 20.93 22 percent. With undervotes at 801, and overvotes of 7. 23 COMMISSIONER PACES: Total votes. 24 JUDGE KELLY: Total votes 27,539. 25 COMMISSIONER OVERBY: All right. Justice, 8 1 Supreme Court, Place 4. 2 John Devine, 21,369 votes for 78.35 percent. 3 Christine Vinh Weems received 5,905 votes 4 for 21.65 percent. 5 A total cast vote of 27,274. 1068 6 undervotes, 5 overvotes. 7 COMMISSIONER PACES: All right. Undervotes 17,026, overvotes zero. 11 COMMISSIONER HARRIS: Justice, 4th Court of 12 Appeals District, Place 3. 13 Todd McCray received 21,533 for 79.01 14 percent. 15 Cynthia Marie Chapa received 5,722 for 20.99 16 percent. 17 Total votes cast 27,255. Undervotes were 18 1,085, overvotes 7. 19 JUDGE KELLY: Justice, 4th Court of Appeals 20 District, Place 4. 21 Lori Massey Brissette 21,654 votes for 79.47 22 percent of the vote. 23 And Luz Elena Chapa received 5,596 votes for 24 20.53 percent. 25 Total votes were 27,260. Rodriguez received 5,798 votes for 7 21.31 percent. 8 Total votes cast were 27,210. 1,111 9 undervotes, 26 overvotes. 10 COMMISSIONER PACES: Justice, 4th Court of 11 Appeals District, Place 7. 12 Lori I. Valenzuela received 23,052 votes. 13 That was total votes cast. 23,052 percent -- or 23,052 14 for a hundred percent. Undervotes were 5,295, overvotes 15 zero. 16 COMMISSIONER LETZ: District Judge, 216th 17 Judicial District. 18 Albert "Pat" D. Patillo III, 22,913 votes 19 for a hundred percent. Total votes cast 22,913. 20 Undervotes 5,434. 21 COMMISSIONER HARRIS: District Attorney, 22 198th Judicial District. 23 Stephen Harpold received 22,809, for a 24 hundred percent of the vote. Undervotes were 5,538, 25 overvotes zero. 12 1 JUDGE KELLY: District Attorney, 216th 2 Judicial District. 3 Lucy Wilke 22,842 votes for a hundred 4 percent. Total votes 22,842. Undervotes 5,505, and no 5 undervotes. 6 COMMISSIONER OVERBY: County Attorney. 7 Heather Stebbins received 22,858 votes. 8 That was a hundred percent of the vote. Undervotes were 9 5,489, overvotes were zero. 10 COMMISSIONER PACES: County Clerk, unexpired 11 term. 12 Ian Collum received 8,484(sic) votes. 13 COMMISSIONER LETZ: 18 thousand. 14 COMMISSIONER PACES: What did I say? 15 COMMISSIONER LETZ: 8. 16 COMMISSIONER PACES: 18,484 votes for 81.47. 17 Danny Daniel Holcomb received 4,205 for 18 18.53 percent of the votes. Total votes cast 22,689. 19 There were 5,484 undervotes, and 174 overvotes. 20 COMMISSIONER LETZ: Sheriff, Larry L. 21 Leitha, Jr. 22,859 for a hundred percent of the votes. 22 Total votes, 22,859. Undervotes 5,488, zero undervotes. 23 COMMISSIONER HARRIS: Okay. County Tax 24 Assessor-Collector. 25 Bob Reeves received 23,400 for a hundred 13 1 percent. Undervotes were 4,947, and overvotes were 2 zero. 3 JUDGE KELLY: County Commissioner, Precinct 4 1. 5 Tom Jones. 6,035 votes which is 100 6 percent. 1600 undervotes and zero overvotes. 7 COMMISSIONER OVERBY: County Commissioner, 8 Precinct 3. 9 Jeff Holt received 4,696 votes for a hundred 10 percent of the vote. Undervotes were 1,350, overvotes 11 were zero. 12 COMMISSIONER PACES: Constable, Precinct 1. 13 Tommy Rodriguez received 6,026 for a hundred 14 percent of the vote. That's the total votes cast. 15 Undervotes 1,609, overvotes zero. 16 COMMISSIONER LETZ: Kyle Schneider -- or 17 Constable, Precinct 2. 18 Kyle Schneider, 5,480 votes for a hundred 19 percent. Total votes 5,480. Undervotes 1,405, 20 overvotes zero. 21 COMMISSIONER HARRIS: Constable, Precinct 3. 22 Paul A. Gonzales received 4,707 votes for a 23 hundred percent. Undervotes where 1,339, overvotes were 24 zero. 25 JUDGE KELLY: Constable, Precinct 4. 14 1 Brad Rider received 6,172 votes, which is a 2 hundred percent of the vote. With undervotes at 1,609, 3 and no overvotes. 4 And that concludes the election results. 5 MS. ALFORD: That is correct. 6 COMMISSIONER HARRIS: Do we make a motion to 7 accept them or -- 8 JUDGE KELLY: We do. Is this a record vote? 9 MS. ALFORD: No. 10 JUDGE KELLY: Okay. Do we have a motion to 11 approve the votes that have been canvassed? 12 COMMISSIONER HARRIS: I so move. 13 COMMISSIONER LETZ: Second. 14 JUDGE KELLY: Got a motion and second to 15 approve the votes as canvassed. Any discussion? 16 COMMISSIONER PACES: I might ask a couple 17 questions. How many people used the DREs? 18 MS. ALFORD: I have not gone through all the 19 tapes to get you that number yet. 20 COMMISSIONER PACES: I'd appreciate getting 21 that. I appreciate what you've done in that regard to 22 where they weren't offered. 23 MS. ALFORD: Yes, Sir. 24 COMMISSIONER PACES: And I'm hopeful the 25 number will be substantially less than what we've seen 15 1 previously. 2 The Court received an e-mail yesterday 3 evening, I believe, bringing to our attention, this is 4 one of my constituents, who is also an election clerk in 5 Precinct 215. And he raised some rather serious 6 concerns about the tabulators indicating that they had 7 the wrong date on election day. They were set up at 8 November 4th, and it wasn't caught until late on the 9 afternoon on the 5th. Apparently corrected, I'm not 10 sure how we corrected it. 11 Can you tell me a little bit about how that 12 happened, and why, or how we make sure that does happen? 13 MS. ALFORD: Yes, Sir. The election staff 14 sets up the scanners, the election equipment for 15 election day. They have to pre-define it so that only 16 Precinct 101 ballots go through 101, 202, and so forth. 17 Because daylight savings was the Sunday 18 before the election, we have to fall back the time on 19 it. And I guess the date somehow when one of my clerks 20 was -- workers were doing that, they failed to notice 21 that it had November the 4th instead of November the 22 5th. And that -- so once -- and nobody noticed it 23 before that. When the zero tape was printed that 24 morning by the judges, they apparently didn't catch it. 25 I'm only aware of it happening in two precincts. And 16 1 one Precinct was basically just a time. And the one 2 you're speaking of was date and time. And I had one of 3 my election clerks go out there and correct the time in 4 that. 5 And I believe the judges and the poll 6 watchers and all that signed off on whatever it takes to 7 print it at that particular time. 8 COMMISSIONER PACES: Do we go back and 9 correct all the ballots that were cast before the 10 correction or -- 11 MS. ALFORD: No. 12 COMMISSIONER PACES: -- we just accept them? 13 MS. ALFORD: Yeah. It just takes -- it's 14 that. 15 COMMISSIONER PACES: Well, it's no secret to 16 anybody that I have a lot of opposition to HART 17 InterCivic and all of the electronic equipment. But 18 once again an example of where it's failed us. That's 19 all I got. 20 MS. ALFORD: Well, this is an error on Kerr 21 County's part; not on HART. 22 JUDGE KELLY: Any other discussion?
