APPEALS
In Kerr County, Texas, all Appeals from Justice of the Peace courts are to the County Court at Law.
All Appeal trials are De Novo or as if the trial never took place.
A person appeals from a Justice of the Peace civil court when they, in a TIMELY manner:
- Deliver an Appeal Bond that is In the amount ordered by the trial court,
signed by the Appellant, signed by the number of sureties required and approvable by the court
OR
- Make a CASH Deposit
OR
- Execute by an .AFFIDAVIT OF INABILITY TO PAY COSTS.
Appeals from Justice of the Peace Courts (Criminal) are to be made within ten (10) days of the judgment being signed.
Appeals from MOST civil cases, including Small Claims are to be made within TWENTY ONE (21) days of the judgment being signed,
or the Motion to Reinstate, or a Motion to Set Aside or Motion for New Trial is denied.
Appeals from Eviction Cases must be made within five (5) days of the date the judgment is signed.
